Councillor Smith commented that the rules around planning services that were agreed to when the County began providing Central Frontenac with planning services has changed and if Central Frontenac is going to be expected to pay an additional $54,000 per year, it would be better to hire its own planner that only focuses on Central Frontenac. Deputy Warden Higgins agreed with those comments and noted that this will be going to the Township of North Frontenac Council. It was questioned if the Community Planner is required to attend all Committee of Adjustment meetings or site visits. Mr. Gallivan confirmed that it is the responsibility of any professional planner to do a site visit before forming a planning opinion. Deputy Warden Higgins also noted that the delay in North Frontenac’s Zoning by-law is costing the Township money. Mr. Pender noted that much of the development is being driven by the City of Kingston. The Townships can either hire out and allow current planning staff to concentrate on higher priorities or hire on the high end and have current planning staff focus on the day to day planning. The recommendation from the report allows the CAO’s to sit down and come up with the best agreement after looking at the drivers of the costs and bring back options. Deputy Warden Higgins again pointed to the hidden costs which are not reflected in this report. He questioned why the recommendation would not be to hire a planner on the County levy. Mr. Pender expressed concerns that placing the cost on the levy would not be supported by Council so this report represents what all Townships might support. Mr. McIntosh noted that an additional planner is required and recommended that the Committee approve the additional position pending an agreement being reached by the municipalities CAO’s on how the position will be funded. Ms. Rueckwald provided an overview of the extensive number of files that are currently coming forward, with the majority taking place in Central and North Frontenac. It was requested that the CAO’s group consider all planning time when coming up with a cost sharing agreement, noting that there is very little to no development on Frontenac Islands and South Frontenac accounts for much of planning staffs time. b)

Communications a)

Correspondence from Deputy Warden Higgins regarding OMB file in relation to a development in north Kawartha.

It was noted on page 120 of the report that the judge made the decision on good planning principles as opposed to an old planning document. This ruling did not take into account the Official Plan that was in place at the time. Mr. Gallivan clarified that this is not the same developer as the one with the Ardoch Lake development but is the same planner and biologist. Mr. Gallivan noted that he has had discussions with the developer and that the Mississippi Valley Conservation Authority needs to be more involved in this file on a number of issues related to the natural environment. 9.

Background On March 21, 2017 a Plan of Subdivision for Draft Approval was submitted by IBI Group on behalf of Sean Marshall of Pittsburgh Building and Energy Systems Inc., with respect to lands legally described as Part of lots 14-15, Concession 8, Former Municipal Township of Loughborough, Township of South Frontenac and known municipally as 5550 McFadden Road. A Public Meeting was held by the Planning Advisory Committee on June 28, 2017, to allow residents to provide comments on the subdivision proposal. On September 20, 2017, County Council granted draft plan approval to permit the creation of five vacant lots on private services for residential development. The lots each have an area of 2-3 hectares and have frontage and individual entrances on McFadden Road. On December 14, 2017 the Township of South Frontenac provided correspondence to the County of Frontenac requesting revised conditions of draft plan approval. South Frontenac Council passed a resolution at their regular meeting held December 5, 2017 stating the following: “THAT Council approve revisions to the Township’s draft plan conditions for the McFadden Road Subdivision in Part of Lots 14 and 15, Concession VIII, Loughborough District, as follows:

  1. Add a condition to require that the Owner dedicate to the Township a road widening of McFadden Road so that the road allowance along the whole frontage of the subject land has a width of 10 metres (33 ft.) measured from the centre line of the travelled portion of the road to the subject property.
  2. Delete Condition #13 requiring direct access to the Cataraqui Trail.
  3. Change Condition #14 to state that no development is permitted within 15 metres of the two westernmost wetlands identified in Figure 1 of the Environmental Impact Study dated March 2017, prepared by Niblett Environmental Associated Inc. and that no development is permitted within 30 metres of any other waterbody on the subject land. And direct staff to forward the Township’s revised conditions of draft plan approval to the County of Frontenac with a request that the requirement for a road widening of McFadden Road be incorporated into the County’s draft plan conditions. Carried.” Draft Plan Approved Development The subject lands are 12.99 hectares in size with approximately 445 m of frontage along McFadden Road and are located three kilometers west of Perth Road Village. The subject site is located in a predominately rural area within the Township. There are clusters of existing rural residential development directly north and northeast of the site on Norway Road. Existing uses to the east, south, and west include a mixture of agricultural, rural residential and undeveloped wooded lots. property abuts the Cataraqui Trail, which is maintained by the Cataraqui Region Conservation Authority. The site was formerly an active sand pit. The sand pit licence has been surrendered and the lands have been rehabilitated. The subject lands have been re-designated in the Townships Official Plan from Mineral AggregatetoRural` to reflect the rehabilitation of the land. The lands are vacant and are described in the Hydrogeological Study as “hummocky from borrow pits and soil working”. Two artificial ponds are located on the site; one is located near the eastern central portion of the subject property and the other in the southern central portion of the site. No easements dissect the property. The five new residential lots and units will be accessed through five individual lot entrances off McFadden Road. The lots will range in size from 2.1 – 3.3 hectares, with road frontages from 76.2 m to 121.7 m (Table 1). Each lot will be privately serviced with individual private septic and water services. Comments and Discussion If the approval authority identifies the need to amend conditions of draft approval, the Planning Act, ss. 51(44)-(47) enables them to do so. This process involves consulting with any affected persons and/or agencies as necessary, determining if the changes are appropriate and then determining if the changes are minor. If the changes are deemed to be minor, no formal circulation is required under the Planning Act. If the changes are not minor, a notice containing the changes is required to be circulated as per the regulation in the Planning Act. Planning staff have reviewed the Township’s revised conditions of draft plan approval and generally support the revisions. The condition to require that the Owner dedicate to the Township a road widening of McFadden Road is a standard condition the Township requires. This condition was not included in the Township’s draft plan conditions when the Township was previously circulated. Planning staff are of the opinion that this is an appropriate change. Township staff have spoken with the applicant regarding this change and the applicant has no objection. Planning staff have amended the conditions of Draft Plan Approval to reflect this change as 14. General conditions E. (attached). access to the Cataraqui Trail. The County of Frontenac’s Official Plan supports pedestrian travel with a focus on trail connectivity and use. Section 4.1.4 Trail Development states that County Council recognizes that trails (for both walking and cycling) can provide significant health, transportation, environmental, and economic benefits. The County’s goal is to establish a well-connected system of trails throughout Frontenac that will provide residents the opportunity to engage in active healthy lifestyles, to travel to key destinations, and experience the vistas provided by the County’s natural features and cultural resources. Through conversations with the Cataraqui Region Conservation Authority, it is apparent at this time that the CRCA does not support direct connection of municipal properties to the trail. Previously, planning staff had recommended the inclusion of a right-of-way to provide access to the trail with a 0.3 metre reserve held in Trust by the Township to allow pedestrian access to the Cataraqui Trail once permitted. Planning staff are not recommending a change to this condition. The resolution passed by Township Council approved a revision to Condition #14 of the Township’s draft plan condition. This revision reflects the current condition 9. Environment B. and C. in the approved draft plan conditions by County Council. Therefore, no change is required. Planning staff consider revisions to the conditions of draft plan approval as minor. As such, there is no requirement to circulate a notice of the changes. As a best practice, however, planning staff will notify the applicant and any interested local agencies and public bodies of the changes. Based on the foregoing comments and discussion, County staff are of the opinion that the Draft Plan Approval conditions should be revised to include Condition 14. General conditions E. to recognize the road widening requirement. Sustainability Implications As stated in Directions for Our Future, Government decision-making processes are clear, transparent, forward thinking and focused on the longer term. The public is interested, informed, and meaningfully involved in local governance. Financial Implications There are no direct financial implications associated with this report. CONDITIONS TO APPROVAL The conditions of approval for the draft plan of subdivision are as follows:

  1. Approved Draft Plan: A. That this draft plan approval applies to the Draft Plan of Subdivision located on Part of Lots 14 and 15, Concession 8, Township of South Frontenac, Former Municipal Township of Loughborough, County of Frontenac dated by the owner March 20, 2017 prepared and certified by Josselyn Engineering Inc. and Hopkins Chitty Land Surveyors Inc., comprising a total of five residential lots.
  2. Subdivision Agreement: A. That the owner of the subject land enter into a subdivision agreement with the Township of South Frontenac, prepared to the satisfaction of the municipality, to be registered on title of the subject land. A copy of the subdivision agreement shall be provided to the County of Frontenac by the Township of South Frontenac.
  3. Financial Requirements: A. That the owner agree in writing to satisfy all the requirements, financial and otherwise of the Township of South Frontenac concerning the installation of services and drainage and other works, in accordance with the Township’s Design Criteria and Guidelines, and that this shall be reflected in the Subdivision Agreement. B. That the Owner shall reimburse the Township of South Frontenac and County of Frontenac for all legal, engineering, planning, administrative expenses and permit fees, including the cost of any peer review that the Township of South Frontenac or County of Frontenac may require in relation to the Plan of Subdivision. C. That the Owner agrees to deposit with the Township, securities in the form of a letter of credit representing 100% of the estimated cost of the works to be provided with respect to the subdivision. The letter of credit shall be reduced, in accordance with the terms and conditions of the Subdivision Agreement. D. That the Owner agrees for the Subdivision Agreement to contain a provision requiring the Owner to pay development charges, in place at the time of the

issuance of the building permit, prior to the issuance of the building permit until the development charges have been paid in full. 4. Permits A. The Owner shall agree in writing to obtain permits or approvals as may be required from Federal, Provincial, Municipal, or local authorities and to file copies thereof with the Township. 5. Access A. That the owner shall agree in writing that all entrances to the lots, including entrance culverts, be located and constructed to the satisfaction to the Township. B. That the subdivision agreement shall provide that 0.3 metre reserves be identified by survey at the following locations: (i) along Lot 4 where the lot abuts the Catarqui trail; and (ii) along Lot 5 where the lot abuts the Cataraqui Trail to be held in trust by the Township to allow pedestrian access to the Cataraqui Trail once permitted. C. That the subdivision agreement shall provide that an easement is created to allow pedestrian access from Lots 1, 2, and 3 to the Cataraqui Trail where the Trail abuts the property at Lots 4 and 5. 6. On-Site Sewage Disposal and Water Systems: A. That the Subdivision Agreement include a requirement that any abandoned wells must be decommissioned according to MOECC guidelines. B. That the Subdivision Agreement include a requirement that any septic systems that may be present on the site and which are not planned to be used as part of the development be decommissioned as per applicable regulations. C. That the recommendations outlined in the letter dated June 16, 2017 from KFL&A Public Health be addressed to the satisfaction of the Township for the five lot development. D. Recommendation Whereas the Council of the County of Frontenac considered all written and oral submissions received on this application, the effect of which helped Council to make an informed decision; Be It Resolved That the Council of the County of Frontenac approve Frontenac Islands Official Plan Amendment No. 4 to the Township of Frontenac Islands Official Plan, as contained in Bylaw No. 2017A attached to this report as Appendix A. Background An Official Plan Amendment (OPA) has been initiated by the Township of Frontenac Islands to include new private road (lane) policies and update existing transportation policies. Currently, the Official Plan includes policies for private road development under Section 3.3. Transportation and Utilities. Section 3. Private Roads details the function and extent of private roads within the municipality with subsections for private road standards, condominium roads and development on existing private lanes. New private lanes or extensions to private lanes are not permitted in the Township. Under the Private Road Standards Section 3.4.2.1.3(a), the policy reads as follows: “The Township shall establish standards for new condominium roads and for lot creation on existing private lands where infill lot creation is being considered.”

The proposed amendment contains private road construction standards agreed upon by the Public Works Managers in the four Townships. Sections 3.4.2.1.3(b) and (c) provide policy direction for the creation of condominium roads and development on existing private lanes. The intent of the policy is to ensure that private roads are built and maintained to an acceptable standard, such as allowing the safe passage of emergency vehicles, for all future development. It is important to note that the Official Plan Amendment No. 3 to include the above noted policies in the Township Official Plan is under appeal OMB Case PL130683 June 14, 2013. Previously, the Ministry of Municipal Affairs would not support policies that allowed new development on private roads, citing health and safety reasons in the review of the County Official Plan. In response, the County undertook the County of Frontenac Private Roads (Lanes) Study: Final Report and Recommendations. The Study was completed in 2016 and subsequently adopted by County Council. The Study provides an inventory of existing private lane development in the County and contains planning policy for future private lane development. The Study created planning policy to allow for development on some of the County’s private roads based on a number of factors such as: length of the road; topography, road quality; and maintenance. The study also investigated and recommended legal and planning tools to ensure new private roads are maintained to a consistent standard. This work created a measurable and enforceable mechanism aimed at creating reasonable and safe development of private roads. Upon review of the Study, the Ministry of Municipal Affairs changed their approach and supported the private roads policy in the County Official Plan, framing this for inclusion at the Township level. The purpose of the amendment is to implement the recommendations of the Private Roads (Lanes) Study: Final Report and Recommendations (2016). The OPA will include amendments to the Transportation policies of the Plan and the addition of new Private Lane policies to the Rural policies of the Plan in order to guide development on new and existing private lanes in the Township. The amendment includes polices for private lane construction standards, infilling and extension of new lots on existing lanes, new private lanes, assumption of private lanes, and private lane monitoring. As such, the policy addresses healthy and safety concerns while promoting development. 2014 Provincial Policy Statement The 2014 Provincial Policy statement (PPS) provides direction on matters of Provincial interest related to land use planning and development. The PPS promotes efficient land use and development patterns that support strong, liveable and healthy communities, protect the environment and public health and safety, and facilitate economic growth. The PPS also requires Official Plans to set out appropriate land use designations and provide policies directing development to suitable areas (Section 4.7). The intent of the PPS is that Official Plans should provide general policy direction for land uses which are implemented through Zoning Bylaws. The Ministry of Municipal Affairs supports the Private Roads (Lanes) Study as a measureable and enforceable mechanism aimed at creating reasonable and safe development of private roads in the County Official Plan. The proposed amendment is consistent with the Provincial Policy Statement (2014). County of Frontenac Official Plan, 2016 The County of Frontenac Official Plan is a framework for guiding development in the County through the management and protection of the natural environment and by providing direction and influence on growth patterns. It is focused on the six themes of economic sustainability, growth management, community building, housing and social services, heritage and culture and environmental sustainability. Section 4.1 Transportation of the Plan contains policies concerning the extensive road network across the County the importance of roads in maintaining and improving the economy of Frontenac County. Section 4.1.1.6 Private Roads reads as follows: “The County is undertaking a private roads study in 2016. The results of this work will assist the County and its lower-tiers in developing a measurable and enforceable mechanism aimed at creating reasonable and safe development of private roads.” The County of Frontenac Private Roads (Lanes) Study: Final Report and Recommendations was adopted by County Council following completion of the Study in 2016. As part of the Study, Draft Township Official Plan Amendments were prepared for the Township Official Plans. The Township of Frontenac Islands is now implementing the recommendations of the Study through the Draft Township of Frontenac Islands Official Plan Amendment included in the report. The proposed amendment is consistent with the County of Frontenac Official Plan, 2016. It should be noted that the private lane policies were included in the new Official Plan for North Frontenac Township that was approved in 2016. The Central Frontenac Official Plan is currently being updated and will also include these policies. Township of Frontenac Islands Official Plan, July 2013 Consolidated Version The Township of Frontenac Islands Official Plan, July 2013 Consolidated Version contains direction for current private lane development. Section 3. Transportation and Utilities speaks to the existing infrastructure. The existing road network contains roads and ferry services under the jurisdiction of the Province of Ontario, Frontenac Management Board, the Township and private landowners. All roads in the Township are grouped into three classifications including major roads, local roads, and private roads. Private roads have the primary function of providing direct access to cottages, cottage and camp establishments, resorts and private clubs and condominium developments. New private lanes or extensions to private lanes are currently not permitted in the Township. However, condominium roads and lot creation on existing private lanes may be permitted. Policies are provided for private road standards, condominium roads, and development on existing roads. These policies are under appeal OMB Case PL130683.

Official Plan Amendment No. 4 will implement the recommendations of the County of Frontenac Private Roads (Lanes) Study, 2016 and provide construction standards and policy for reasonable and safe development on private roads. The study guides infilling and extension of new lots on existing lanes, new private lanes, assumption of private lands and private lane monitoring. The proposed amendment includes new private lane policies and updates the existing Transportation policies in the Township of Frontenac Islands Official Plan, Consolidated Version July 2013. The amendment conforms to the intent of the current policies regarding reasonable and safe development along private roads in the Township. Comment The current Township of Frontenac Islands Official Plan policy does not contain private road construction standards nor provide a measurable and enforceable mechanism for creating reasonable and safe development of private roads. The Official Plan Amendment adopts the recommendations of the County of Frontenac Private Roads Study: Final Report and Recommendations, replacing the current text with morecomprehensive private road policy, which has been adopted by Frontenac Islands Council (see attached Bylaw 2017A). The Township of Frontenac Islands held two public meetings to engage members of the public on the proposed change. Meetings were held on September 11, 2017 at the Wolfe Island Council Chambers and on October 10, 2017 at the Howe Island Council Chambers. Comments received from the public concerned conditions of existing private roads and the level of responsibility the Township had for maintenance. Questions arose over the costs to upgrade and what type of development would trigger an upgrade to the road. Staff addressed all concerns, stressing the importance of upgrading roads to make sure they are safe and accessible (e.g. emergency vehicles) before additional development. Copies of the Official Plan Amendment were distributed as well as the decision tree summarizing policy changes. Overall, the public was receptive to the amendment and saw value in the new policies. Staff recommend that County Council approve Amendment 4 to the Township of Frontenac Islands Official Plan. Sustainability Implications One of the key focus areas of Directions for Our Future, the County’s Sustainability Plan, is Land Use Planning and Management. From a sustainability perspective, this involves an approach that ensures a clean and healthy environment, a strong economy, and long term viability. The County of Frontenac Private Roads (Lanes) Study: Final Report and Recommendations provides that development on private roads is an important regional issue for economic, cultural and social reasons. Approval of this amendment will continue to permit development along private roads in the Township, improving cultural, social and economic vitality within the County in a safe and consistent manner.
