Page WHEREAS the County of Frontenac is a member of the Municipal Advisory Committee on the Algonquin Land Claim;

AND WHEREAS there has been a the long-standing absence of information and consultation with stakeholders and the public around this critical issue;

AND WHEREAS the lack of information provided, and the absence of any meaningful consultation since the last meeting, has resulted in a complete vacuum of stakeholder awareness, and no evidence that stakeholder input was adequately considered;

THEREFORE BE IT RESOLVED THAT the County of Frontenac request that the Co-Chairs of the Committee convene a joint emergency meeting of the Committee of External Advisors (CEA) and Municipal Advisory Committee (MAC) before June 30, 2015, including the chief negotiators for both levels of government, to provide clarity on the following:

  1. the current state of the negotiations;
  2. the changes to the Agreement in Principle (AIP) that have occurred since the last CEA/MAC meeting and the last public information sessions held in March 2013;
  3. the current position of both levels of government regarding the AIP; and

Mr. Orland French appeared before County Council and presented a proposal to publish a new book on Frontenac County’s history and requested the County’s assistance. As part of the presentation, Mr. French provided a YouTube video on the geographical area of Frontenac County, which may be viewed at http://youtu.be/XQbE2L3LuSQ. As part of his presentation, Mr. French confirmed that the book would include events in celebration of the County’s 150th Anniversary and is looking for Council support of $80,000 which would print between 2500 and 3000 books. He suggested this cost could be split 5 ways between the County and the 4 Townships and that this cost would be recuperated in the sale of the books which run around $45 each.

Donation to the Canadian Plowing Championships WHEREAS the Wolfe Island Plowmen’s Association’s bid to host the 2015 Canadian Plowing Championships was accepted by the parent organization, C.P.O., AND WHEREAS and the event is expected to bring to Wolfe Island for a week approximately 30 competitors and their partners from across Canada, which is anticipated to positively impact the economy of Frontenac Islands Township and potentially drive increased attendance to the 150th Anniversary August Showcase, AND WHEREAS the hosting budget is projected to be in the range of $20,000; AND WHEREAS the Canadian Plowing Championships organizing committee sent correspondence to the County of Frontenac dated February 4, 2015 asking for its consideration of a $3,000 donation towards the event: THEREFORE BE IT RESOLVED THAT the Council of the County of Frontenac supports the 2015 Canadian Plowing Championships with a donation of $3,000. Recommendation RESOLVED THAT Council of the County of Frontenac accept the Corporate Services – 2015 Temporary Borrowing By-law report; AND FURTHER direct the Clerk to introduce a by-law later in the meeting to authorize current borrowings from time to time during 2015.

Background On an annual basis, the Municipal Act, Chapter 25 of the Statutes of Ontario 2001, permits a council to pass a by-law authorizing the head and treasurer to borrow, from time to time by way of promissory note or banker’s acceptance, such sums as the council considers necessary to meet current expenditures during the year. These provisions read as: 407(2) Except with the approval of the Ontario Municipal Board, the total amount borrowed at any one time plus any outstanding amounts of principal borrowed and accrued interest shall not exceed, (a) from January 1 to September 30 in the year, 50 per cent of the total estimated revenues of the municipality as set out in the budget adopted for the year; and

(b) from October 1 to December 31 in the year, 25 per cent of the total estimated revenues of the municipality as set out in the budget adopted for the year. 407(3) Until the budget is adopted in a year, the limits upon borrowing under subsection (2) shall temporarily be calculated using the estimated revenues of the municipality set out in the budget adopted for the previous year.

Comment Based on our 2015 estimates, unpaid temporary borrowings should not exceed $18,219,621 for the first three-quarters of the year and $9,109,811 for the final quarter of 2015.

Sustainability Implications Governance – appropriate stewardship of County resources.

Financial Implications The County rarely requires borrowing to cover ongoing operating expenses, but the provision should be available if required to provide for short term cash flow requirements.

Recommendation THAT Council of the County of Frontenac receive the Corporate Services – 2015 Vendor of Record List report; AND FURTHER Council approve the 2015 Vendor of Record List as presented.

Background The County of Frontenac’s Procurement Policy, dated March 20, 2013, section 5.14 states: Authorized Person(s) may select the VOR process of procurement if the Vendors are included on a Vendor of Record list. Generally, there shall be a documented detailed working relationship with the Vendor who will be providing the Goods or Services needed by the County without the County absorbing the administrative costs of seeking several quotes. The VOR process may be used either directly to Procure Goods and or Services (i.e. without further competition) or it may be used as the basis for a Bid Request. Every three years vendors will be provided with the opportunity to be included on the Vendor of Record list through an open solicitation of expressions of interest. Current Vendors and new submissions will be reviewed using the standard Recommend Report to Council Corporate Services – 2015 Vendor of Record List March 18, 2015

evaluation process available for the specific good or service to which the vendor relates. A vendor who is the successful bidder in a competitive process for the County and who provides the contracted service consistent with the requirements of the contract in a manner satisfactory to the Authorized Person will be added to the Vendor of Record list. The VOR list shall be reviewed at least once per fiscal year by County Council during budget deliberations to ensure the County continues to receive Goods and Services at the best possible value. However, any VOR vendor can be removed from the list at any time on recommendation to Council by the Authorized person.

Comment Staff have reviewed the list and made amendments as required. The current Vendor of Record list is attached to this report for Council’s review.

Background For the past several years the Chief, Deputy Chiefs, Supervisors and Paramedics have attended various annual general meetings and conferences. With Council’s direction, at its January 16, 2013 meeting, only Directors/Managers are now able to attend a conference and authorization is required from Council for any other staff member to attend conferences.

Comment The following conferences have been identified for attendance to by different FPS staff: Paramedic Chiefs of Canada (PCC) Annual General Meeting and Conference: PCC initiates include leadership development, research studies and sponsors educational and training opportunities for its members to carry out their statutory and leadership responsibilities. One of the strategic goals of the PCC is to support mentoring and education to facilitate succession planning in Canadian land ambulance services. The 2015 location is Niagara Falls, Ontario from June 4th to 5th, 2015. Attendees:

Recommendation RESOLVED THAT Council of the County of Frontenac accept the Corporate Services – 2015 Federal Gas Tax Distribution By-law report; AND FURTHER direct the Clerk to introduce a By-law later in the meeting to authorize the distribution of Federal Gas Tax in 2015.

Background The County is bound by the terms and conditions of the Federal Gas Tax Agreement with the Association of Municipalities of Ontario (AMO). In 2013 Council identified that all Federal Gas Tax funds received in a year should be distributed to the Townships. These funds are distributed annually by weighted assessment by bylaw. In addition, other Federal Gas Tax funds are forwarded to the Townships for Community Improvement Plans, Eco-tourism projects and Smaller Scale sustainability projects. In 2014 the County of Frontenac was selected for an audit of compliance with the agreement, undertaken by the firm Grant Thornton. Comment This report reviews two issues

  1. The AMO Federal Gas Tax audit findings.
  2. Federal Gas Tax distribution for 2015 Federal Gas Tax Audit Findings. Of the 29 areas reviewed, two were identified as “exceptions noted”. Exception 1. Section 3.1 (e) Ensure any of its contracts for the supply of services or materials to implement its responsibilities under this Agreement shall be awarded in a way that is transparent, competitive, consistent with value for money principles and pursuant to its adopted procurement policy. In one smaller scale sustainability project, Arden Revitalization, the proponent did not obtain the required number of quotes as such $ 10,135 was provided as part of a total project cost of $16,553. Response: The County will highlight in its contract for all Federal Gas Tax recipients, other than eligible municipalities, the requirement to be in compliance with the County’s Procurement Policy and to provide proof thereof. Exception 2 Section 6.2. Where a Recipient decides to allocate Funds to another Eligible Recipient it must be done by by-law. The by-law must be passed and submitted annually to AMO on or before March 31st. The by-law will identify the Eligible Recipient and the amount of funds the Eligible Recipient is receiving for the Municipal Fiscal Year. Eco-Tourism projects: North Frontenac and Frontenac Islands are provided a share of Federal Gas Tax funds equal to the amount of Federal Gas Tax funds allocated to the K&P Trail through the budget. In 2015 the approved budget includes $270,000 for the K&P Trail, therefore 26% of that amount, $70,200 will be provided to North Frontenac and Frontenac Islands for Eco-Tourism projects. In 2014 Council approved an additional $360,000 of Federal Gas Tax funding to be allocated to the trail to support an application for National Trails Coalition funding through the Eastern Ontario Trails Alliance. The eco-tourism share to be allocated to North Frontenac and Frontenac Islands is $93,600. This additional amount was not provided in the 2015 budget documentation shared with Council. Community Improvement Plan (CIP) and Smaller Scale sustainability projects: The amounts to be allocated to the Townships for these projects are not known until year end. The By-law will identify these projects as “other funds based on eligible projects”. Sustainability Implications Governance – appropriate stewardship of County resources.

Financial Implications

The distribution of Federal Gas Tax estimated for 2015 is included in Appendix A to this report.

CARRIED At the time of purchase the County’s legal fees for this lengthy negotiation were not known. However in anticipation of such expenditures, $20,000 was budgeted to a Land Acquisition Reserve for the years 2010-2013 and $30,000 in 2014. The amount of $15,000 for the land purchase plus the County’s associated legal fees of $12,067.22 equals a total of $27,067.22.

Sustainability Implications The importance of trail development has been expressed year after year in the County’s Sustainable Actions, a guide to sustainability. As a community, we benefit from the connections and access to nature that is provided by a trails network. As more and more of the trail is completed, regional branding and marketing will aid in developing the economic benefits of this asset.

Financial Implications The Land Acquisition Reserve balance at the end of 2014 is $107,653.93.

Recommendation This report is for information only. Background The County of Frontenac is responsible for granting subdivision and condominium approvals. This report will provide Council with a summary of the current planning application activity in process. Comment The County requires mandatory pre-consultation prior to applications being submitted. The pre-consultation process follows two steps: (i) Pre-consultation meeting with the proponent, the Township and County to review the proposal, the County application process and the requirements for a complete application. (ii) On-site pre-consultation meeting between the County’s hydrogeologist/engineer and the proponent’s hydrogeologist/engineer to review the requirements of the hydrogeological study. Once a formal application is made and the application is deemed “complete” (i.e. all of the studies identified in pre-consultation have been submitted), it is circulated to the Township, Conservation Authority, and other agencies such as Bell Canada and Hydro One for comment. These agencies give advice to the County on technical issues and provide conditions of draft approval should the development be approved by County Council. A public meeting is held on behalf of the County by Township Council where the applicant and interested members of the public have an opportunity to present their comments. A member of the public may also make a written submission at any time prior to the decision by County Council. Throughout the process an applicant will typically revise their plans and supporting studies in response to agency and public comments. Planning staff at the County prepare a report to County Council recommending approval or refusal of the draft plan of subdivision or condominium. The decision on whether to approve or refuse a proposed development is made by County Council, and this decision can be appealed to the Ontario Municipal Board. A recommendation for draft approval includes a list of conditions provided by the County, Township, and other agencies that the applicant must fulfill in order to receive final approval. Once the applicant fulfills the conditions and the development receives Final Approval from County Council, the lots may be registered and sold. The chart attached as Appendix A lists plans of subdivisions and plans of condominiums that are currently part of the County’s approvals process. This includes a general location of applications with ongoing formal pre-consultation. A location map of the applications is attached in Appendix B. Financial Implications The County’s Fees for Services By-law No. 2010-0019 includes the list of fees for condominium and subdivision approval. A proposal to update the fees by-law for planning will be brought forward in 2015. Sustainability Implications The existing subdivision application process in place at the County promotes timely and thorough review of development applications. As a result, it is expected that many applications dealt with by County Council – once determined to be ‘good planning’ – can be approved promptly and new construction can take place. Issues may arise through the process that introduce delays but result in improvements to the application. The application process promotes both good land use planning and the economic development pillar of Directions for Our Future. Crane, Stewart and Lemke: As members of the Committee of External Advisors (CEA) on the Algonquin Land Claim, we are writing to express our profound concern over the long-standing absence of information and consultation with stakeholders and the public around this critical issue. You are aware that the last meeting of these committees occurred several years ago. In the interim, we have continued to hear claims from government sources that stakeholders, most of whom sit on these committees, have been kept apprised of developments in the negotiations; this is factually incorrect. The lack of information provided, and the absence of any meaningful consultation since the last meeting, has resulted in a complete vacuum of stakeholder awareness, and no evidence that our input was adequately considered. We are left to deal with a number of rumours about the current status of the negotiations, rumours about the number of changes that have been made to the Agreement-in-Principle (AIP) without any knowledge of what they might be, and rumours as to the current position of both levels of government regarding the claim. Accordingly, we are requesting that you convene a joint emergency meeting of the CEA and Municipal Advisory Committee (MAC) in the next two to three weeks, including the chief negotiators for both levels of government, to provide clarity on the following: 1) the current state of the negotiations; 2) the changes to the AIP that have occurred since the last CEA/MAC meeting and the last public information sessions held in March 2013; 3) the current position of both levels of government regarding the AIP; and 4) details of how public and stakeholder input was taken to the negotiating table and the specific outcomes of those discussions. In the absence of such a meeting, the contention that stakeholders and the public are being kept informed and consulted rings hollow. ESTABLISHMENT OF THE COMMITTEE (1)

The County of Frontenac Seniors Housing Task Force shall be comprised of four (4) members as follows: (a) Three members of County Council, specifically:  One (1) member of County Council which sits on the City of Kingston Housing and Homelessness Advisory Committee  One (1) additional member of County Council  The Mayor of the Township in which the housing matter is being considered; and (b) One Township Council representative in which the housing matter is being considered

BY-LAW NO. 2015-0013 OF THE CORPORATION OF THE COUNTY OF FRONTENAC A By-law to authorize the Corporation of the County of Frontenac to distribute the Federal Gas Tax amongst its four lower-tiered municipalities;

WHEREAS Ontario municipalities recognize that all governments must work together collaboratively and in harmony to ensure that investments in communities are strategic, purposeful and forward-looking; AND WHEREAS the Corporation of the County of Frontenac (the Recipient) adopted By-law 2010-0015 which authorized the Warden and Clerk to execute an agreement with AMO regarding the Federal Gas Tax since the execution of that agreement is mandatory if the County of Frontenac wanted to participate in the transfer of federal gas tax revenue; AND WHEREAS Section 6.2 of the Agreement permits the Recipient to allocate funds to another Eligible Recipient; THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the County of Frontenac hereby orders and enacts: I.

THAT the Treasurer be authorized to distribute the Federal Gas Tax to the four lower-tiered municipalities as per the attached Schedule for the year 2015 and that other funds be distributed to eligible municipalities based on eligible projects.

THAT this By-law shall come into force and have effect upon the final passing thereof.

BY-LAW NO. 2015-0014 OF THE CORPORATION OF THE COUNTY OF FRONTENAC being a by-law to authorize temporary borrowing for current expenditures for the year 2015

WHEREAS per Section 407(1) of the Municipal Act, 2001, S.O. 2001, c. 25 as amended (“the Act”), at any time during a fiscal year, a municipality may authorize temporary borrowing, until the taxes are collected and other revenues are received, of the amounts that the municipality considers necessary to meet the current expenditures of the municipality for the year; AND WHEREAS the Corporation of the County of Frontenac (“the County”) deems it necessary to borrow from time to time until other revenues are collected; AND WHEREAS per Section 407(2) of the Act, except with the approval of the Ontario Municipal Board, the total amount borrowed at any one time plus any outstanding amounts of principal borrowed and accrued interest shall not exceed: (a)

from January 1 to September 30 in the year, 50 per cent of the total estimated revenues of the municipality as set out in the budget adopted for the year; and,

(b)

from October 1 to December 31 in the year, 25 per cent of the total estimated revenues of the municipality as set out in the budget adopted for the year.

AND WHEREAS per Section 407(4) of the Act estimated revenues of the County as set forth in the estimates adopted for the year 2015 is $36,439,243, which does not include revenues derivable or derived from: (a)

arrears of taxes, fees or charges; or

(b)

a payment from a reserve fund of the municipality, whether or not the payment is for a capital purpose.

NOW THEREFORE the Corporation of the County of Frontenac enacts as follows:

  1. THAT the Warden and Treasurer are hereby authorized, on behalf of the County, to borrow from time to time, by way of promissory note or banker’s

acceptance, from the TD Canada Trust (the “Bank”), any municipality or school board, a sum or sums not to exceed the aggregate of $18,219,621 from January 1, 2015 to September 30, 2015 and $9,109,811 from October 1, 2015 to December 31, 2015 less the amount of similar borrowings which are still unpaid to meet, until the taxes are collected, the current expenditures of the County for the year 2015, including the amounts required for the purposes mentioned in Sub-section (1) of the said Section 407 and to give, on behalf of the County, to the said Bank, a promissory note(s) or banker’s acceptance(s), sealed with the corporate seal and signed by the Warden and Treasurer for the monies so borrowed with interest, in the case of borrowing from the Bank at the Bank’s prime interest rate less one-quarter per cent which shall be as notified by the Bank to the Treasurer from time to time, or in the case of borrowing from a municipality or school board at a rate to be negotiated with the municipality or school board but not to exceed the Bank’s prime lending rate at the time of borrowing. 2. THAT all sums borrowed pursuant to the authority of this by-law as well as all other sums borrowed in this year and in previous years from the said Bank, municipality or school board for any or all of the purposes mentioned in the said Section 407 of the Act shall, with interest thereon, be a charge upon the whole of the revenues of the County for the current year and for all preceding years, as and when such revenues are received. 3. THAT the Treasurer is hereby authorized and directed to apply in payment of all sums borrowed as aforesaid, together with interest thereon, all of the monies hereafter collected or received either on account or realized in respect of the taxes levied for the current year and preceding years, or from any other source, which may lawfully be applied for such purposes. 4. THAT this by-law shall come into force and effect on the final passing thereof. Read a First and Second Time this 18th day of March, 2015. OF THE CORPORATION OF THE COUNTY OF FRONTENAC Being a By-law to Authorize Fees for Planning Services for the Townships

WHEREAS Section 5 (3) of the Municipal Act, 2001, as amended (hereinafter the Act) provides that a municipal power, including a municipality’s capacity, rights, powers and privileges, shall be exercised by its council by by-law, unless the municipality is specifically authorized to do otherwise; AND WHEREAS Section 8 (1) of the Act confers broad authority on municipalities to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality’s ability to respond to municipal issues; AND WHEREAS the Corporation of County of Frontenac currently has agreements in place with the Township of Frontenac Islands, the Township of North Frontenac and the Township of Central Frontenac to provide certain Planning Services to the Townships; AND WHEREAS Council considered seven (7) options for fees for Planning Services through Report 2015-010 at its regular meeting held February 18, 2015; NOW THEREFORE the Council of the Corporation of the County of Frontenac deems it expedient to authorize the following:

  1. THAT the fees for Planning Services for the Townships reflect the current program as follows:     

Hourly billing for costs associated with the preparation of all planning reports associated with a private application; No cost for pre-consultation, inquiries by citizens or Township staff; No cost for municipal initiated planning work, including Official Plan and Zoning By-law updates; No charge for GIS services; No overhead costs attributed.

  1. THAT each Township approve a 2 year Planning work plan to ensure priorities are addressed.

WHEREAS Section 8 of the Municipal Act, S.O. 2001, c.25 and amendments thereto provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act; and; WHEREAS Subsection 2 of Section 11 of the Municipal Act, S.O. 2001, c.25 and amendments thereto provides that a lower-tier municipality and an upper-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction described in the Table to Subsection 2 subject to certain provisions, and; WHEREAS Section 5 of the Municipal Act, S.O. 2001, c. 25 and amendments thereto provides that a municipal power, including a municipality’s capacity, rights, powers and privileges under Section 8 shall be exercised by its council and by by-law unless the municipality is specifically authorized to do otherwise; and; WHEREAS the Council of the County of Frontenac deems it expedient to confirm its actions and proceedings; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the County of Frontenac hereby enacts as follows:

  1. THAT all actions and proceedings of the Council of the County of Frontenac taken at its regular meeting held on March 18, 2015 be confirmed as actions for which the municipality has the capacity, rights, powers and privileges of a natural person.
  2. THAT all actions and proceedings of the Council of the County of Frontenac taken at its regular meeting held on March 18, 2015 be confirmed as being matters within the spheres of jurisdiction described in Subsection 2 of Section 11 of the Municipal Act, S.O. 2001, c.25 and amendments thereto.
  3. THAT all actions and proceedings of the Council of the Corporation of the County of Frontenac taken at its regular meeting held on March 18, 2015 except those taken by by-law and those required by by-law to be done by resolution are hereby sanctioned, ratified and confirmed as though set out within and forming part of this by-law.
