Recommend Reports from the Chief Administrative Officer a) 2024-119 K&P Trail Requirement for all motorized off-road trail users to hold a membership with an authorized partner organization Recommendation: Be It Resolved That staff be directed to amend Bylaw No. 2022-0033 as follows: That Section 7 – Regulations regarding motorized vehicle use on the K&P Trail be amended to add a new 7.3 as follows:

  1. No person shall permit any motorized vehicle noted in Section 5 i and ii, to enter upon or utilize the Trail unless that person is registered with an authorized partner organization as noted in Schedule 2; That Section 7 be re-numbered accordingly; That a new Schedule 2, Authorized Partner Organizations be added, to include the Frontenac ATV Club, the L&A Ridgerunners Snowmobile Club, and the Snow Road Snowmobile Club. And Further That the Warden and Clerk be authorized to complete a revised memorandum of understanding with the Frontenac ATV Club for non-exclusive use of the K&P Trail that outlines the following:
  2. The requirement for all motorized trail users to be licensed and insured.
  3. The 2025 minimum contribution commitment of $15,000 towards trail maintenance.
  4. The requirement for all motorized off-road recreational vehicles using the K&P Trail to have proof of membership, such as a permit or pass, with the Frontenac ATV Club or with another authorized partner organization. And Further That staff present a Memorandum of Understanding to the Eastern Ontario Trails Alliance (EOTA) for non-exclusive use of the K&P Trail that outlines the following:

Page infrastructure and ongoing maintenance of their capital assets including local roads and bridges, clean water, wastewater, waste facilities, and municipally owned buildings including recreational facilities and libraries; and Whereas the Federation of Canadian Municipalities has calculated that Municipal Governments across Canada are responsible for approximately 60 percent of public infrastructure that supports our economy and quality of life, but only receive 10 cents of every tax dollar; and Whereas the Eastern Ontario Wardens’ Caucus (EOWC) region’s capital infrastructure deficit has increased by 58 percent since 2011 and is now at $6 billion, and growing; and Whereas in 2018, the Ontario Government mandated all Ontario municipalities to develop and fully fund capital asset management plans by July 2025; and Whereas the EOWC has released a regional Municipal Infrastructure Policy Papershowing key infrastructure data, opportunities and challenges in small rural municipalities across Eastern Ontario; and Whereas Eastern Ontario is a growing economy that can grow more with sustainable, innovative infrastructure partnership and investment from the Federal and Ontario Governments; and Whereas the infrastructure deficit forsmall rural municipalities cannot be adequately addressed through property tax revenue, restricted municipal borrowing capacity, and municipalities limited ability to generate revenue; and Whereas small rural taxpayers cannot afford dramatic increases to pay for the current and future infrastructure. Now Therefore Be It Resolved That the County of Frontenac joins the Eastern Ontario Wardens’ Caucus, the Association of Municipalities of Ontario, and the Federation of Canadian Municipalities in calling on the Federal and Ontario Governments to immediately and sustainably partner with Municipal Governments by investing in both the new and ongoing maintenance and repairs of municipal infrastructure in Eastern Ontario’s small rural municipalities; and And Further That the Federal and Ontario Governments immediately review data and work together to implement solutions based on the

2024-103 Office of the CAO Marine Services Passenger Code of Conduct Motion #: 159-24 Moved By: Councillor Lichty Seconded By: Warden Smith Be It Resolved That By-law 2022-0032, being a by-law to Regulate the Use of the Frontenac Howe Islander Ferry, be amended as follows:

  1. That Section 2 – Definitions be amended to add the following: i.

Harassment: engaging in a course of vexatious comment or conduct that is known or ought to be reasonably to be known to be unwelcome (Ontario Human Rights Code).

ii.

Vandalism: The deliberate destruction, damage or defacing of the ferry, ferry buildings or property owned or leased by the County.

iii.

Violence: The exercise of physical force, or attempt to exercise physical force, by a person, against another, that causes or could cause physical injury; Examples include verbal threats; threatening notes or emails; shaking a fist in an individual’s face, wielding a weapon, hitting or trying to hit someone, throwing an object at someone, or sexual violence.

  1. That section 4 – Interpretation be amended to add: i.

The Passenger Code of Conduct and conditions of carriage should be considered supplementary, in full or in part, to pre-existing legislation and their future amendments, including: a. The Marine Liability Act (S.C. 2001, c. 6) b. The Canada Shipping Act, 2001 (S.C. 2001, c. 26) c. The Transportation of Dangerous Goods Act, 1992 (S.C. 1992, c. 34) d. Highway Traffic Act, R.S.O. 1990, c. H.8

e. Smoke-Free Ontario Act, 2017 The code of conduct and conditions of carriage apply directly to all persons who board the ferry operated by the County of Frontenac inclusive of staff, contractors, and members of the public.

  1. That section 5 – General Ferry Use Regulations be amended to add: Passenger Code of Conduct 5.6

No person shall cause a disturbance, act contrary to the public peace, or display other behavior that is deemed to be unsafe or disruptive, including but not limited to: • Harassment • Violence • behaving in an indecent or offensive manner • fighting • behaving in a manner which would interfere with the ordinary enjoyment of persons using the service

5.7 The improper disposal of garbage, litter or waste is prohibited, and no person shall: • discard any item overboard • litter or deposit any household, industrial or commercial waste within or outside of the ferry 5.8

No passenger shall act in an unsafe or uncontrolled manner throughout the voyage, including: • ride, hang or stand on any exterior portion of the ferry • sit, stand, jump, lay, or climb on, over or across any exterior or interior railings or other protective barriers • tamper with Fire Fighting or Life Saving Equipment

5.9

No person shall, without authorization, handle, interfere with or operate any part of the mechanical, electrical, electronic or safety equipment of the ferry or dock facility

No Person shall smoke or hold lighted tobacco, lighted cannabis, use an electronic cigarette or any other lighted smoking equipment or material while in or on the ferry Carried

Call to Order Deputy Warden Vandewal called the meeting to order at 9:00 a.m. We begin this gathering by acknowledging and celebrating these traditional lands as a gathering place of the first peoples and their ancestors who are entrusted to care for mother earth since time immemorial. Mr. Lemieux provided an overview of County services and their funding allocations and sources and, the 2025 Draft Budget, Budget Challenges, and the 2025 Budget Context containing the draft tax rate increases and responded to questions on same. Legislative Services Ms. Amini provided an overview of the Legislative Services 2025-2029 Business Plan and the Electronic Documents Records Management System project proposal and responded to questions on same. The Committee of the Whole recessed at 10:17 a.m. The Committee of the Whole reconvened at 10:29 a.m. Frontenac Paramedics Chief Goudie provided an overview of the Frontenac Paramedics 2025-2029 Business Plan and responded to questions on same, specifically around the change in dispatch systems as currently Township Fire Departments are having to attend all calls. To reduce those lower acuity calls will help with this. Chief Goudie provided an overview of the Frontenac Paramedics Enhanced Paramedic Resource project proposal and responded to questions on same. In terms of questions raised regarding services for Wolfe Island, Chief Goudie advised that it was the direction of Council to relocate that resource to the City of Kingston. He also pointed to the ORH study which shows the low call volume for Wolfe Island. In terms of Howe Island, residents there are serviced by 2 ferries and responses can also come from Leeds Grenville. Chief Goudie noted that this enhanced resource would begin in the New Year. Mr. Lemieux confirmed the correct numbers for this project proposal which only covers the cost of the positions, and not the cost of the vehicle. He noted that in year 1, any new position is fully funded by the municipal levy. In future years, the provincial grant covers 50% of the cost. Chief Goudie provided an overview of the Frontenac Paramedics Superintendent of Performance Standards – Training project proposal and responded to questions on same. It was asked if this program is approved, would this position also assist in joint training with Township fire departments. Mr. Farrell confirmed that these conversations have already begun with Township CAO’s. It was asked if there is any future potential to get a standing order that would allow fire departments to move patients in the absence of an ambulance, to which Chief Goudie noted that this is beyond the County’s decision-making authority. He is not aware if central dispatch has the authority to authorize this. The Coast Guard and Air Ornge are bound by different legislation. He also noted that there are certain circumstances that are termed “rescue” which adhere to different criteria in terms of ability to transport.

GIS Ms. Elderhorst provided an overview of the GIS 2025-2029 Business Plan and responded to questions on same. Finance Mr. Piasetzki provided an overview of the Financial Services 2025-2029 Business Plan and responded to questions on same. In terms of insurance costs, it was asked if there is potential for self insurance and pooling with other municipalities to which Mr. Lemieux responded that the County itself is a very small player in this and if you are in a pool and there is a larger claim from a larger municipality, we are then paying for this. Information Services Mr. Millard provided an overview of the Information Services 2025-2029 Business Plan and responded to questions on same. The Committee of the Whole recessed at 11:52 a.m. The Committee of the Whole reconvened at 12:30 p.m. Fairmount Home Ms. Brant provided an overview of Fairmount Homes 2025-2029 Business Plan and responded to questions on same. In terms of the 68% funded by the Province, this is dependent on what costs are submitted. If they are eligible costs, the Province covers it, regardless of your cost per bed. In terms of comments made regarding City Transit coming to Fairmount Home, staff are currently in conversations with City staff regarding this matter. In terms of water and sewer, the City’s focus on growth is on the west end, and not focused on north of the 401. Ms. Hunt provided an overview of Fairmount Homes Occupational Therapist – Full Time project proposal and answered questions on same. In terms of what has been done in the past, Ms. Hunt noted that additional costs were incurred to contract this out. Mr. Allen provided an overview of the Economic Development 2025-2029 Business Plan and project proposals and responded to questions on same. Mr. Allen provided an overview of the Economic Development Project Proposals for a Community Development Officer and responded to questions on same. In terms of questions regarding how much staff time is allocated to maintaining the trail, Mr. Allen advised that 50% of his time is allocated to the trail; however, this includes procurement and monitoring of the trail. He noted that there are systems for oversite and reporting and staff continue to find efficiencies, including partnerships with ATV clubs that have allowed him to reduce his time on the trail compared to passed years. In terms of questions regarding if this position would also support the Townships, Mr. Allen confirmed that this new position would work with the Townships where goals align and would support projects in this respect, but the position would not provide direct support to the Townships. To questions regarding why the Community Futures Development Corporation would not have the resources for this and why are they pushing the County to pay for this, Mr. Allen noted that the Frontenac CFDC is the smallest in Ontario and is based on population and businesses it services. Their funding is based on how much lending they provide to the business community. As such, they are not able to grow to add that additional staff. In addition, their mandate is directly providing advise and funding to businesses to help them grow. They are an incredible resource to our community but their ability to expand or grow is limited. Ms. Bolton provided an overview of the Planning Units 2025-2029 Business Plan and responded to questions on same. In terms of questions around communal services, staff are currently working with the Ministry of the Environment to streamline the process that recognizes this MSC will be overseeing these systems. Currently, it is a 3year red tape process for each system that goes into the ground. Ms. Bolton provided an overview of the Planning Project Proposal for Population, Housing, and Employment Projections and responded to questions on same.

Human Resources Ms. McCulloch provided an overview of the Human Resources 2025-2029 Business Plan and responded to questions raised. The Committee of the Whole recessed at 10:42 a.m. The Committee of the Whole reconvened at 10:52 a.m. K&P Trail Mr. Allen provided an overview of the K&P Trail 2025-2029 Business Plan and responded to questions on same. In terms of whether the County has made use of grant matching, Mr. Allen advised that the County has not yet pursued this. It was noted that partnerships with the EOTA can offset some of these costs. In terms of whether other organizations could help pick up some of the operating costs, Mr. Allen noted that there are discussions with Townships that may have the equipment to do this; however, they are already working to capacity to keep their own roads kept up. With the Frontenac ATV Club, they are looking to increase maintenance funding. Snowmobile clubs have their own equipment, so we do not get involved in winter maintenance. There are number of different models of trail governance, and strengthening signage revenue without making it a stretch for businesses is also being considered. It was asked if old rail cars could be used for bridges on the trail, to which Mr. Allen advised that staff are looking at this. Deliberations The Committee of the Whole considered each project proposal. Mr. Lemieux provided the Committee of the Whole with an overview of the budget costs and the effects on the budget which each project proposal. Our mission is to build and maintain positive relationships between all users of the K&P Trail as well as the broader community. Our Contributions to the K&P Trail We continuously work year-round to maintain the condition and safety of the trail for the enjoyment of all users. Our contributions include both financial support and in-kind service hours for the following:

atv’rs or horseback riders, providing a friendly and welcoming presence. They educate users on local bylaws and trail etiquette while also acting as a deterrent to those who may abuse the trails. Our Wardens have been invaluable in assisting lost, injured or stranded trail users. In addition to patrol duties, our Wardens perform many hours of trail maintenance. We are currently in the process of training all 12 Wardens in First Aid, which is always a welcomed skill to have on the Trail. When the Frontenac ATV Club organizes rides, our Wardens ensure the safety and compliance of all participants and while patrolling we document and report irresponsible behavior to local authorities for further action. We assist the County, at times, by helping with the Trail Counter maintenance and providing transportation for various County events, when we are asked. We have most recently been asked by Mike Gorman of the Gravel Cup Canada Event to provide four Trail Wardens to assist with this 108 kilometer event. Proposal to amemd our Memorandum of Understanding As part of our proposal, the Frontenac ATV Club commits to the following:

a further contribution of $5,000.00 annually, payable in four equal installments, to assist with dust suppression

the Frontenac ATV Club will continue to supply and maintain the comfort stations at Bellrock Trailhead and Fish Creek Road

ongoing funding for garbage and recycling receptacles

expansion of our Trail Warden Program at our own expense with potential collaboration with County Bylaw to assist with enforcement of permit use with any funds of a result of Administrative Monetary Penalties (AMP) going directly to the County. We have a plan we would like to bring forward, another time, regarding enforcement.

Finally, should our club continue to grow, in part due to the requirement of club membership, through the purchase of permits, the Frontenac ATV Club proposes a further contribution of $32.50 for every permit sold over the 300-permit mark each year.

Altogether, these commitments represent a total financial contribution of at least $21,160.00, and an in-kind contribution of at least $14,160.00, resulting in a minimum

Why Club Membership and Trail Permits We believe that the future of utilizing a trail in the outdoors is directly related to how clubs and its members use it today. Our guidelines will promote safe and responsible riding on trails and protect our environment at the same time. Purchasing a Trail Permit will give the rider membership in the Frontenac ATV Club and all of the benefits of our association with the OFATV and will, most importantly, allow us to continue our valuable work throughout the County of Frontenac. Re: Request for Proposal 2024-014 Fairmount Home Management of Dietary and Support Services – Contract Award Recommendation Resolved That Council pass a by-law authorizing the Warden and Clerk to execute an agreement with Sodexo Canada for the management of dietary and support services at Fairmount Home for a six-year term with an option to renew for up to three-years. Background Fairmount Home (“Fairmount”) currently has an agreement with Sodexo Canada (“Sodexo”) to provide the management of dietary and support services. Amending agreements were made January 1, 2022, to extend the services for a further three-year term to December 31, 2024. On August 26, 2024, Fairmount issued a Request for Proposal (RFP) for the management of dietary and support services. The RFP closed on October 11, 2024. Comment Fairmount and County staff conducted the RFP process for the management of dietary and support services, which included a mandatory tour of Fairmount, review of the submissions, interviews and reference checks. There were two (2) submissions for the RFP.

The term of the agreement will be six (6) years with an option to renew for up to three (3) years and will include a termination clause. Based on Fairmount’s 2024 budget for the management of dietary and support services, Sodexo’s budget included in the RFP proposal is reasonable. See the Financial Implications section for details. Financial Implications Fairmount’s 2024 budget includes $323,793 for the management of dietary and support services. In addition, Sodexo’s proposal includes a $348,803 investment for a six-year term, which can be used towards strategic projects including renovations to resident home areas, interior painting, resident engagement fund and the implementation of new food services information technology. Recommendation Be It Resolved That staff be directed to amend Bylaw No. 2022-0033 as follows: That Section 7 – Regulations regarding motorized vehicle use on the K&P Trail be amended to add a new 7.3 as follows: 7.3

No person shall permit any motorized vehicle noted in Section 5 i and ii, to enter upon or utilize the Trail unless that person is registered with an authorized partner organization as noted in Schedule 2;

That Section 7 be re-numbered accordingly; That a new Schedule 2, Authorized Partner Organizations be added, to include the Frontenac ATV Club, the L&A Ridgerunners Snowmobile Club, and the Snow Road Snowmobile Club. And Further That the Warden and Clerk be authorized to complete a revised memorandum of understanding with the Frontenac ATV Club for non-exclusive use of the K&P Trail that outlines the following:

  1. The requirement for all motorized trail users to be licensed and insured.
  2. The 2025 minimum contribution commitment of $15,000 towards trail maintenance.
  3. The requirement for all motorized off-road recreational vehicles using the K&P Trail to have proof of membership, such as a permit or pass, with the Frontenac ATV Club or with another authorized partner organization. Background At its regular meeting on January 19, 2022, following a presentation from Mr. Wayne Robinson, County Council considered Report 2022-005 and directed staff to enter into negotiations between the Ontario Federation of Snowmobile Clubs, the Eastern Ontario Trails Alliance and the Ontario Federation of ATV Clubs on the development of a Joint Usage Agreement for the K&P Trail. Subsequently, staff presented Council with Report 2022-087 - Planning and Economic Development – Operational Update and requirement for trail passes on the Frontenac K&P Trail which contained the recommendation to implement the requirement for a “Trail pass” or club membership for motorized off-road use. The recommendation from staff was postponed through the following motion: Motion #: 132-22

ongoing management of the garbage and recycling receptacles in Verona and Godfrey;

expansion of the Trail Warden Program to monitor the activity on the K&P Trail and to assist with the reporting and management of maintenance concerns;

should the club membership grow, in part due to the requirement of club membership on the K&P Trail, the Frontenac ATV Club proposes a further contribution of $32.50 for every membership sold over the 300-permit mark each year.

The Frontenac ATV Club estimates that these commitments represent a total financial contribution of at least $21,160, and an in-kind contribution of at least $14,160, resulting in a minimum contribution of over $35,320 of value provided each year to the K&P Trail and the County of Frontenac through this partnership. It is the recommendation of this report that the requirement for membership be implemented for summer motorized use on the K&P Trail between KM 39 (Bellrock Road) and KM 98 (Mississippi River). Comment Since the inception of the Frontenac K&P Trail, County Council has sought to balance the need for operational recoveries with the desire to make the trail a free amenity, especially for users with lower impacts on the trail infrastructure. In Eastern Ontario, almost all multi use trails require permits or passes for summer motorized use, either through a local club affiliated with the Ontario Federation of ATV Clubs (OFATV) or through the Eastern Ontario Trails Alliance (EOTA). The Counties of Renfrew and Lanark require summer motorized users such as ATV and Side-by-Sides to hold a membership or permit with the OFATV. This is significant with respect to the K&P Trail, as a permit is required for any motorized trail users leaving Frontenac County along the K&P Trail to visit Calabogie, Renfrew or other communities located on connecting rail trails operated by other municipalities. Existing Agreement The Frontenac ATV Club (formerly the Verona District ATV Club) is an OFATV affiliated Club in good standing and has had a partnership agreement with Frontenac County to permit trail access for club members on the K&P Trail since 2019. This agreement allows for the club to advertise the K&P Trail on the OFATV provincial network, provides access to members, and host events along the trail, such as group rides. Since 2019, staff have seen increasing benefits from this partnership:

The Frontenac ATV Club provides two portable washroom facilities on the trail each year.

It has purchased and installed two bicycle repair stations, one in Verona and one in Sharbot Lake.

It has provided financial contributions towards bridge replacements, trail development and dust suppression.

In 2024, the Frontenac ATV club began to coordinate the presence of trained “Trail Wardens” to monitor the activity on and condition of the trail each weekend. These wardens serve as “eyes on the trail” and report any deficiencies or issues observed on the trail. They also serve as community ambassadors, helping trail users find useful information, amenities, or support.

The Frontenac ATV Club has 365 members in 2024, up from 120 members in 2020. To see more growth, and to provide education and leadership to more of the local motorized trail community, the Frontenac ATV club would like to see the County require membership or a permit for summer motorized use, consistent with other trails in Eastern Ontario. The club would benefit from the collection of additional fees, which would in turn result in additional recoveries for the County. Trail Maintenance & Management Frontenac County now operates 78 kilometres of the K&P Trail, with an additional 12 kilometres expected to be added in the coming years. 59 kilometres or 76% of this trail is available for use by ATV’s and Side-by-Sides, which creates a more significant annual maintenance need when compared to the 19 kilometres of non-motorized trail, specifically with respect to grading and dust suppression. Regular maintenance costs for the operation of just 70 kilometres of trail infrastructure during 2024 include:

  1. Brushing & Mowing (70 km): $23,782
  2. Dust Suppression (30 km): $24,786
  3. Grading & Aggregate Replacement (59 km): $33,563 As the Frontenac K&P Trail grows in length and popularity these costs will continue to increase. A consistent and predictable annual contribution from the Frontenac ATV Club will assist staff in budgeting and planning for future maintenance. By entering into a formal agreement with the Frontenac ATV Club, the County can expect to recover a minimum of $15,000 towards these costs in 2025. Additional Benefits The Frontenac ATV Club provides invaluable “in-kind” contributions which support the oversight and administration of the trail, and the club also creates significant economic activities on the trail. Trained Club “Wardens” patrol the K&P Trail every weekend from May until November. These wardens provide a presence and safety service on the trail when use is typically highest. This presence has also been observed to improve overall etiquette and reduce dangerous behaviours in trail users.

The wardens and other club members keep the trail clear of trees and other debris after storms. One of the club members is a certified arborist and has assisted in the removal of some difficult and dangerous tree limbs.

The hosting of trail ride events, attracting visitors to Frontenac County from across the province. In 2024, the Frontenac ATV Club has hosted 6 formal group ride events, with 25 -155 individuals travelling from across Eastern Ontario to participate in each event.

Washrooms are highly sought after amenities by all trail users, and the two currently provided by the club are amenities that are frequently used.

The volunteer “eyes” on the trail are of immense value to County staff, saving countless hours of patrols and investigations for the Manager of Economic Development. The same can be said of the minor repairs and culvert clearing. This work, if not completed by volunteers, would require additional seasonal staff or contractors to support trail operations. In the case of contractors, the jobs are often too small and the process of obtaining quotes too long, for the work to be completed in a timely manner. Examples of Similar Agreements In 2024, and for several year prior, the Township of North Frontenac has entered into separate agreements with the Ottawa Valley ATV Club (an OFATV affiliate), the Eastern Ontario Trails Alliance, and the Bytown Motorcycle Association to provide their members with access to 58 kilometres of Crown Roads managed by the Township during the summer months. In 2024, both the Eastern Ontario Trails Alliance and the Ottawa Valley ATV Club provided contributions of $20,000 to support the maintenance of these roads. Winter Motorized Use The entire Frontenac K&P Trail (78 kilometres) is made available for winter motorized use by Snowmobiles from December 1st until March 31st each season. As per the Motorized Snowmobiles Act RSO, all motorized trail users must hold a pass issued by the Ontario Federation of Snowmobile Clubs to use the K&P Trail and other connected snowmobile trails. Implementing the same requirement for summer motorized use will improve consistency between seasons and motorized uses on the same shared use trail. Summary County staff recommend that Frontenac County Bylaw No. 2022-0033 be updated to include the requirement for all motorized users to hold a club membership and that the

Memorandum of Understanding with the Frontenac ATV Club for 2025 be amended to include the following clauses:

  1. The requirement for all motorized trail users to be licensed and insured.
  2. The 2025 minimum contribution commitment of $15,000 towards trail maintenance.
  3. The requirement for all motorized off-road recreational vehicles using the K&P Trail to have proof of membership, such as a permit or pass, with the Frontenac ATV Club or with another authorized partner organization. As directed by County Council in resolution #132-22, the same offer will be made to the Eastern Ontario Trails Alliance to recognize the pass provided by that organization on the K&P Trail as well and to establish a similar Memorandum of Understanding for access and partnership. Financial Implications The recommendation, if approved, will result in a minimum cost recovery of $15,000 towards trail maintenance from the Frontenac ATV Club in 2025, and for each year the agreement remains in place. If the Eastern Ontario Trails Alliance wishes to sign a similar agreement, it should be expected to provide an additional $15,000 recovery towards trail maintenance, and for each year the agreement remains in place. Dear Warden and Council The Frontenac ATV Club is an OFATV chapter club and a not for profit organization dedicated to fostering responsible, safe, legal, and environmentally-friendly use of trails for all-terrain vehicle riding in Frontenac County. Our mission is to build and maintain positive relationships between all users of the K&P Trail as well as the broader community. Our Contributions to the K&P Trail We continuously work year-round to maintain the condition and safety of the trail for the enjoyment of all users. Our contributions include both financial support and in-kind service hours for the following:

Insurance We carry 15 million liability insurance at all times Trail Warden Program Through our OFATV Certified Trail Warden Program, we train and certify Trail Wardens who regularly patrol the Trail, often working hand –in –hand with the O.P.P SAVE Team. Our trained Wardens help to keep the trails enjoyable and safe for all of our members. Our Wardens interact with all Trail users, whether they are hikers, cyclists, atv’rs or horseback riders, providing a friendly and welcoming presence. They educate users on local bylaws

and trail etiquette while also acting as a deterrent to those who may abuse the trails. Our Wardens have been invaluable in assisting lost, injured or stranded trail users. In addition to patrol duties, our Wardens perform many hours of trail maintenance. We are currently in the process of training all 12 Wardens in First Aid, which is always a welcomed skill to have on the Trail. When the Frontenac ATV Club organizes rides, our Wardens ensure the safety and compliance of all participants and while patrolling we document and report irresponsible behavior to local authorities for further action. We assist the County, at times, by helping with the Trail Counter maintenance and providing transportation for various County events, when we are asked. We have most recently been asked by Mike Gorman of the Gravel Cup Canada Event to provide four Trail Wardens to assist with this 108 kilometer event. Proposal to amend our Memorandum of Understanding As part of our proposal, the Frontenac ATV Club commits to the following:

a further contribution of $5,000.00 annually, payable in four equal installments, to assist with dust suppression.

the Frontenac ATV Club will continue to supply and maintain the comfort stations at Bellrock Trailhead and Fish Creek Road.

ongoing, year round funding for garbage and recycling receptacles at Verona and Godfrey.

Finally, should our club continue to grow, in part due to the requirement of club membership, through the purchase of permits, the Frontenac ATV Club proposes a further contribution of $32.50 for every permit sold over the 300-permit mark each year.

Altogether, these commitments represent a total financial contribution of at least $21,160.00, and an in-kind contribution of at least $14,160.00, resulting in a minimum contribution of over $35,320.00 of value provided each year to the K&P Trail and the County of Frontenac.

Why Club Membership and Trail Permits We believe that the future of utilizing a trail in the outdoors is directly related to how clubs and its members use it today. Our guidelines will promote safe and responsible riding on trails and protect our environment at the same time. Recommendation Resolved That a by-law be introduced later in the meeting to adopt the 2025 FrontenacHowe Islander Ferry Fees and Fares Schedule. Background The County of Frontenac establishes its fees and fares schedule for the FrontenacHowe Islander Ferry operation annually. The ferry links the west end of Howe Island with the mainland at Kingston. The County has in past discussions indicated that the operation of the ferry should not be a financial burden to the County. The current agreement has the Ministry of Transportation covering 80% of eligible costs to operate the ferry, with the remaining 20% municipal share coming from Howe Island. Within this framework, there are a number of ways to realize the municipal funding required to operate the ferry through different fee and fare scenarios. The agreement between the County of Frontenac and the Ministry of Transportation allows for a ferry revenue reserve to be maintained up to 5% of the current operating expenditures. A structure for fees and fares was instated beginning in 2005 which standardized the rates charged for both the Township Ferry and the Frontenac-Howe Islander Ferry and created a common revenue account.

Comment Consistent with previous years, the 2025 pass is proposed to provide access to both the County and the Township ferries. The common fee structure for the Township and the County ferries is proposed to continue. 2025 Fees and Fares Staff propose that fees should only be collected when vehicles are coming on to Howe Island from either ferry. The County and the Township will continue to make available temporary passes to provide for short term requirements, which can be arranged at the Frontenac-Howe Islander Ferry office or the Township of Frontenac Islands’ municipal office on Howe Island. It is proposed that the following changes to the prices of the annual passes or tickets occur in 2025. The fee structure in place is projected to satisfy Howe Island’s revenue requirements to offset their share of operating expenses. The 2025 fees below were presented to the Council of the Township of Frontenac Islands on November 12th and will be considered at their November 25th meeting. No passes will be sold until the Township of Frontenac Islands adopts the schedule of fees and fares. Should any changes occur, a revised by-law will be brought forward to County Council in December. A memorandum of understanding addressing the details of this arrangement has been executed to address the sharing of revenues between the County and the Township. Financial Implications Under its agreement with the Ministry of Transportation, the County can reserve up to 5% of operating expense in a reserve to mitigate ferry revenue fluctuations. As of the end of 2023, the County held a reserve balance of $0. The proposed fee structure in this report is projected to be sufficient to meet Howe Island’s revenue needs to cover its portion of operating expenses for 2025. Recommendation Be It Resolved That Council of the County of Frontenac accepts the resignation of Mr. Kurt Halliday from the Frontenac Joint Accessibility Advisory Committee and thanks him for his nine years of dedicated service to the County of Frontenac; And Further That Policy A09-ADM-001, Citizen Appointments to Committees – Procedures for Vacancy, public notice and advertisement of vacancies, be waived; And Further That Council appoints Mr. David Yerxa to the Frontenac Joint Accessibility Advisory Committee as the Representative for the Township of Central Frontenac, whose term expires November 15, 2026. Background By-law No. 2022-0026, being a bylaw to provide for governing the proceedings of the Council and its committees, the conduct of members and the calling of meetings (short titled Procedural By-law), was adopted by County Council on July 20, 2022. The by-law sets out the County of Frontenac Advisory Committees to Council, including the appointments of its members.

Comments Appointments to all County Advisory Committees, including the Joint Accessibility Advisory Committee, for this Council term were made at the January 18, 2023, Council meeting through By-law 2023-002. Mr. Kurt Halliday was appointed as the Township of Central Frontenac representative. Due to personal reasons, Mr. Halliday has submitted his resignation on the Committee. Policy A09-ADM-001, Citizen Appointments to Committees, sets out the procedures for when a vacancy occurs, and states: Vacancies: Where a vacancy occurs as a result of resignation or other reasons, the Clerk shall notify the previous unsuccessful candidates to determine whether they wish to let their name be reconsidered for appointment and arranges for a public notice and advertisement of vacancies and descriptions of roles and responsibilities of Committee members appointed. The Appointment process noted above is then followed. During the 2023 appointment process, 6 applications were received to fill the 5 appointments positions to the Committee. Staff have reached out to Mr. David Yerxa who was the unsuccessful applicant, who has confirmed his willingness to be considered for appointment. Mr. Yerxa was a member of the Joint Accessibility Advisory Committee for the previous 2 terms of Council (2017-2022) and was involved and active with the committee. Mr. Yerxa is a resident of the Township of Central Frontenac, though his past appointments were as a Member from the Community at large. Staff are recommending that Council waive the requirements to arrange for public advertisements and appoint Mr. Yerxa to the Joint Accessibility Advisory Committee for the remainder of the term of Council (November 2026).

Recommendation Be it Resolved That the Council of the County of Frontenac receive the Corporate Services - 2025 Draft Budget Revision Report, And Further That Council amend the budget to reflect the adjustments outlined in the report. And Finally That the Council of the County of Frontenac pass a by-law later in the meeting approving the 2025 Budget. Background The Committee of the Whole considered the budget during meetings on October 29th and October 30th, 2024. The adjustments below reflect the changes in direction provided by the Committee of the Whole following the meeting. Comment This report brings to Council’s attention, the directed budget amendments and information received after budget deliberations and the budget implications. Financial Implications After adjusting for the proposed phase-ins and updated expense figures provided by our service delivery providers, the proposed levy increase for the County for 2025 has been reduced from the 6.07% presented in the 2025 draft budget to 5.48%. These proposed adjustments would bring the total County Levy for 2025 to $13,530,849. To maintain the service delivery as recommended by the Committee of the Whole at the budget deliberations, the following adjustments are proposed:

Remove Project Proposal for added Frontenac Paramedics Superintendent, Performance Standards & Training – Committee of the Whole did not vote in the project proposal to add an additional Superintendent in 2025. This results in a $197,196 reduction in operating costs and $40,015 for the levy in 2025 compared to the draft budget presented to the Committee of the Whole.

Changes in costs for shared services with the City – Updated guidance on the costs for Social Services, Social Housing, and Provincial Offenses was provided by the City of Kingston following the budget meeting. The City of Kingston will be bringing its budget to its Council in January 2025, so the figures presented are still draft figures. As a reminder, these services are governed under the Local Services Realignment agreement with the City of Kingston, and the County will pay its share of the actual costs to manage those services based on the terms of the agreement. Recommendation This report is for information purposes only. Background In 2010, the County of Frontenac provided $80,000 to Frontenac Transportation Services (FTS) to support drives totaling over 500,000 kms. In 2011, FTS sought County of Frontenac support in the amount of $86,000. In 2014, this was increased by an additional $10,000 to $96,000 to support senior transportation services in the County. The grant was in support of the prior Council’s strategic priority namely: “Addressing the existing gap in Seniors Affordable Housing stock by leveraging and/or funding the construction of a project in each of the four Frontenac Townships – to be accomplished by the end of the 2015-18 term of Council.” In prior years, the entire grant was provided to Frontenac Transportation Services (FTS) who in turn supported transportation services provided by Southern Frontenac Community Services (SFCS); however, in 2019, the grant was split between the two organizations, with both services now reporting to Council. It was identified that given this grant was and continues to be supported annually by County Council, there was a need to standardize reporting for Council to be able to evaluate performance against stated objectives. As a result, at its regular meeting held October 16, 2019, Council passed the following resolution, being Recommend Reports from the Chief Administrative Officer, clause f):

By-Law No. 2024-036 Of The Corporation of the County of Frontenac being a by-law to appoint the Warden and the Deputy Warden for the County of Frontenac

Whereas Section 5 of the Municipal Act provides that a municipal power, including a municipality’s capacity, rights, powers and privileges, shall be exercised by its council and by by-law, unless the municipality is specifically authorized to do otherwise; And Whereas Section 11 of the Municipal Act provides that an upper-tier municipality may pass by-laws respecting its governance structure of the municipality; And Whereas Section 233 of the Municipal Act provides that if the term of office of an appointed head of council of an upper-tier municipality is one year, the council of the upper-tier municipality shall, in each year of its term, appoint the head of council at its first meeting; And Whereas Procedural By-law 2022-0026 states that the term of office for the Warden and Deputy Warden are for a one-year term during the term of Council; Now Therefore Be It Resolved That the Council of the Corporation of the County of Frontenac hereby enacts as follows: 1.

That Councillor , be and is hereby appointed as the Warden for the County of Frontenac whose term will expire November 15, 2025.

That Councillor , be and is hereby appointed as the Deputy Warden for the County of Frontenac whose term will expire November 15, 2025.

That all previous by-laws or parts of by-laws that conflict with this by-law are hereby rescinded.

By-Law No. 2024-038 of The Corporation of the County of Frontenac being a by-law to establish a fees and fares schedule for the Frontenac-Howe Islander Ferry operation for the year 2025 Whereas Section 391 of the Municipal Act, 2001, S.O. 2001, c.25, as amended authorizes a municipality to impose fees or charges on persons: (a)

for services or activities provided or done by or on behalf of it;

(b)

for costs payable by it for services or activities provided or done by or on behalf of any other municipality or any local board; and

(c)

for the use of its property including property under its control.

And Whereas the Corporation of the County of Frontenac operates a ferry to and from Howe Island known as the Frontenac-Howe Islander Ferry; And Whereas the Council of the County of Frontenac deems it expedient to adopt the following fees and fares in relation to the Frontenac-Howe Islander Ferry operation for the year 2025; Now Therefore Be It Resolved That the Council of the County of Frontenac hereby adopts the following fees and fares structure in relation to the Frontenac-Howe Islander Ferry operation for the year 2025:

  1. The 2025 pass shall provide access to both the County and Township operated ferries.
  2. A common fee structure shall apply for both the County and Township operated ferries.
  3. Fees shall only be collected when vehicles are coming onto Howe Island from either the County or Township operated ferry.
  4. The County and the Township will continue to make available temporary passes to provide for short term requirements, which can be arranged at the Frontenac-Howe Islander Ferry office or the Township of Frontenac Islands’ municipal office on Howe Island.

Definitions Single Vehicle Single vehicle will include a car, motorcycle, van, SUV, or pickup truck. Heavy Vehicle Any vehicle greater than 6,000 kgs and/or 7 metres (23 feet).

The same individual who purchased the first full-price 2025 annual pass;

An individual who is married to or is in a common-law relationship with the full-price 2025 annual pass purchaser;

The dependent child of a full-price 2025 annual pass purchaser or the fullprice pass purchaser’s married or common-law spouse who is under the age of 18;

The dependent child of a full-price 2025 annual pass purchaser or the fullprice pass purchaser’s married or common-law spouse who is over the age of 18, only if the dependent child has both the same permanent address as the full-price 2025 annual pass purchaser and is attending school full-time.

Documentation must be provided that satisfies the staff person issuing the passes. A third pass at a reduced rate is not available.

Whereas pursuant to Section 289 of the Municipal Act, S.O. 2001, and amendments thereto (‘the Municipal Act’), the County of Frontenac shall in each year prepare and adopt a budget including estimates of all sums required during the year for the purposes of the County of Frontenac; And Whereas it is necessary for the County of Frontenac to raise for the year 2025 certain sums; Now Therefore Be It Resolved That the Council of the Corporation of the County of Frontenac enacts as follows: 1.

BY-LAW NO. 2024-042 OF The Corporation of the County Of Frontenac being a by-law to amend Bylaw No. 2022-0033 to require that all motorized off-road vehicles using the K&P Trail be registered with an authorized partner organization. Whereas, section 9 of the municipal Act, 2001, S.O. 2001, c. 25 as amended, provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority; Whereas. Section 8 of the Municipal Act, 2001, S.O. 2001, c. 25 as amended, provides that sections 9 and 11 shall be interpreted broadly so as to confer broad authority on municipalities to enable municipalities to govern their affairs as they consider appropriate and to enhance their ability to respond to municipal issues; and, And Whereas the Council of the Corporation of County of Frontenac passed By-law 2022-0033 on September 21, 2022, being a By-Law to Regulate and Govern the Use of the Frontenac K&P Trail; And Whereas the Council of the Corporation of County of Frontenac deems it expedient to amend By-law No. 2022-0033; Now Therefore Be It Resolved That the Council for The Corporation of the County of Frontenac hereby enacts as follows: That Trails By-law 2022-0033, be amended as follows: That Section 7 – Regulations regarding motorized vehicle use on the K&P Trail be amended to add a new 7.3 as follows: 7.3

No person shall permit any motorized vehicle noted in Section 5 i and ii, to enter upon or utilize the Trail without proof of membership, such as a permit or pass, with an authorized partner organization as noted in Schedule 2;

That Section 7 be re-numbered accordingly. That a new Schedule 2, Authorized Partner Organizations, be added, to include the Frontenac ATV Club, the L&A Ridgerunners Snowmobile Club, and the Snow Road Snowmobile Club, attached to the By-law as Appendix A. 2.

That this amending by-law shall come into force and take effect on the date of final passing.
