Corporate Services – Permission to Enter into Agreement with the Province of Ontario for the Ontario Community Infrastructure Fund (OCIF)
Recommendation Resolved That the Council of the Corporation of the County of Frontenac receive the Corporate Services – Permission to Enter into Agreement with the Province of Ontario for the Ontario Community Infrastructure Fund (OCIF); And Further That a by-law be passed later in the meeting authorizing the Warden and the Clerk to enter into an agreement with the Province of Ontario Ontario Community Infrastructure Fund (OCIF). Background The Ontario Community Infrastructure Fund (OCIF) provides a steady source of predictable, long-term funding and supports the repair and revitalization of infrastructure in small, rural and northern communities. The fund supports the government’s municipal infrastructure strategy which began by requiring municipalities that request provincial infrastructure funding to show how their proposed projects fit within a comprehensive asset management plan. On July 4, 2016 Ontario launched the expanded Ontario Community Infrastructure Fund (OCIF). The fund was increased to provide more stable, predictable, formula-based funding and also includes a new top-up component for those eligible to submit applications.

Comment The County was advised in July of the Allocation Notice showing the OCIF funding available to the County over the next three years as well as additional details on the County’s eligibility for the OCIF top-up component. New formula allocations are contingent upon the execution of a Contribution Agreement with the province and are subject to the terms and conditions outlined in the allocation notice. To fully execute the agreement, the province requires a by-law authorizing municipal representatives to enter into this agreement with the Province, with the said by-law referencing the Ontario Community Infrastructure Fund Formula Component and include the names of the designated signatories for the Contribution Agreement. Under the expanded OCIF funding eligible expenditures for the development, updating and improvement of asset management plans for any asset type(s), include: • • • •
asset management software training for asset management planning third-party condition assessments, and third-party consultants whose responsibilities are limited to asset management planning.
Council, during the detailed project proposal presentations on October 12, 2016, moved forward to the 2017 budget the Work Order System which involves the implementation of an integrated work order system to service the County of Frontenac. The work order system will be the primary source for fixed asset management. It will be utilized for asset tracking, maintenance management (both reactive & preventative maintenance) and capital planning to provide more comprehensive data to make better business decisions with respect to asset management. Work Order software will require an initial investment of $60,000 with $50,000 coming from the OCIF grant and the remaining $10,000 from the Federal Gas Tax reserve. Sustainability Implications Governance – appropriate stewardship of County resources. Financial Implications It is anticipated that by entering into an agreement with the province for the Ontario Community Infrastructure Fund (OCIF), County will received $50,000 per year for a three year period. By-Law Number 2016-0044 of The Corporation of the County of Frontenac being a by-law to authorize the Warden and Clerk to enter into an agreement with the Province of Ontario for the Ontario Community Infrastructure Fund
Whereas the Province of Ontario provides grants through the Ontario Community Infrastructure Fund; and, Whereas the County of Frontenac received an Allocation Notice showing the Ontario Community Infrastructure funding available for it over the next three years; and, Whereas a requirement of receiving the Ontario Community Infrastructure Funding requires a by-law authorizing municipal representatives to enter into an agreement with the Province. Now Therefore Be It Resolved That the Council of the Corporation of the County of Frontenac enacts as follows: 1.
That the Warden and Clerk be authorized to enter into an agreement with the Province of Ontario for the Ontario Community Infrastructure Fund Formula Component.
That this By-law shall come into force and take effect upon the date of final passing.

By-Law No. 2016-0045 of The Corporation of the County OF Frontenac being a by-law to confirm all actions and proceedings of County Council on November 23, 2016
Whereas Section 8 of the Municipal Act, S.O. 2001, c.25 and amendments thereto provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act; and; Whereas Subsection 2 of Section 11 of the Municipal Act, S.O. 2001, c.25 and amendments thereto provides that a lower-tier municipality and an upper-tier municipality July pass by-laws respecting matters within the spheres of jurisdiction described in the Table to Subsection 2 subject to certain provisions, and; Whereas Section 5 of the Municipal Act, S.O. 2001, c. 25 and amendments thereto provides that a municipal power, including a municipality’s capacity, rights, powers and privileges under Section 8 shall be exercised by its council and by by-law unless the municipality is specifically authorized to do otherwise; and; Whereas the Council of the County of Frontenac deems it expedient to confirm its actions and proceedings; Now Therefore Be It Resolved That the Council of the Corporation of the County of Frontenac hereby enacts as follows:
- That all actions and proceedings of the Council of the County of Frontenac taken at its special meeting held on November 23rd, 2016 be confirmed as actions for which the municipality has the capacity, rights, powers and privileges of a natural person.
- That all actions and proceedings of the Council of the County of Frontenac taken at its special meeting held on November 23rd, 2016 be confirmed as being matters within the spheres of jurisdiction described in Subsection 2 of Section 11 of the Municipal Act, S.O. 2001, c.25 and amendments thereto.
- That all actions and proceedings of the Council of the Corporation of the County of Frontenac taken at its special meeting held on November 23rd, 2016 except those taken by by-law and those required by by-law to be done by resolution are hereby sanctioned, ratified and confirmed as though set out within and forming part of this by-law.
