Minutes of a Public Meeting of Council for The Corporation of the Township of North Frontenac regarding Amendments to the Recreational Vehicle By-law and Zoning By-law #55-19 Held February 25, 2022 in the Council Chambers, 6648 Road 506, Plevna, Ontario

Call to Order and Purpose of Meeting The Deputy Mayor called the meeting to order at 9:11 a.m. The Meeting was to hear comments from the Public regarding a proposed Zoning By-law Amendment with respect to provisions regarding Recreational Vehicles and the draft Recreational Vehicle By-law.

Administrative Reports

a) Dmitry Kurylovich, Land Use Planner, County of Frontenac - Public Information Meeting for Proposed Amendment to Zoning By-Law Number 55-19, to Update Sections Regarding Recreational Vehicles.

Resolution #: 71-21 Moved By: Seconded By: Councillor Inglis Councillor Fowler Be It Resolved That Council receives for information the Planning Report from Dmitry Kurylovich, Community Planner, regarding proposed updates to the Zoning By-law #55- 19, to update sections regarding Recreational Vehicles;
And That County Planning staff will review any public comments received regarding the proposed updates and provide a detailed analysis and recommendation in a final report to Council at a future meeting. Carried

b) Clerk/Planning Manager: Recreational Vehicle By-law Amendment

Resolution #: 72-21 Moved By: Seconded By: Councillor Inglis Councillor Fowler Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Recreational Vehicle By-law Amendment”; And That Council receives comments from the public regarding the draft By-law and will consider the new Recreational Vehicle By-law at the March 25, 2022 Council meeting; And That Council instructs the Clerk to make the following Amendments:

  1. Amend Section 1 c) to add “…and no Licence shall be renewed after January 1, 2024 unless the Recreational Vehicle complies with this By-law”. Carried

Public Comments and Questions Brad Schmidt advised he obtained a Recreational Vehicle (RV) placement in 2017. He noted the proposed changes simplified the RV By-law. He advised the existing accessory structures on his property met the requirements under the previous Zoning By-law and RV By-law but may not meet the proposed new provisions in the RV By-law (i.e. larger accessory structures than what is proposed to be permitted). He asked if existing uses or structures would be permitted in the future. He noted Zoning By-law Section 1.2.3 provided for the continuation of an existing use. The CPM advised the new provisions will be under the Municipal Act (not Planning Act); therefore has no provisions regarding legal non-conforming/non-complying (grandfathering) use; Page 2 of 6

Township of North Frontenac Public Council Meeting Minutes February 25, 2022 however it would be Council’s decision to have provisions included recognizing existing structures if they had a building permit, met setbacks, etc.

Hal Rivington noted there are many small lots within the Township, 1 acre or less. He advised many people brought RVs for visits with family and friends during the pandemic. He asked if smaller lots would be permitted to have multiple RVs on their property for a short stay (2-4 days). The CPM advised the provisions in the proposed RV By-law set out the permitted number of RVs on an individual lot for a temporary stay; and that Council could include provisions regarding personal gatherings for weekend use if they so wish. The CPM also noted it is proposed that an RV is permitted on a lot with a dwelling for up to 28 days without a licence. Mr. Rivington noted this only permits one RV per lot. The CPM advised the purpose of the Public Meetings are to gather information for Council’s consideration.

Ms. D. Smith advised the temporary use of RVs for a special event could be regulated by the Township, with property owners obtaining permission from the Township (similar to a burn permit). She advised it is difficult to create provisions for every anticipated use. She advised the frequency of use of stored RVs will be challenging to monitor. Ms. Smith further noted an RV could be “stored” in the spring and removed in the fall, while being used during this period with no oversight. She advised this allows the RV to be used in place of a sleep cabin (bunkie) with no regulation.

Council Comments and Questions Councillor Inglis asked if the policies in the proposed RV By-law were consistent with the policies of Central Frontenac and South Frontenac. The CPM advised she was not familiar with those policies.

Councillor Good asked if the storage of RVs would be permitted on a property with a dwelling. The CPM advised there are provisions to address RV storage. Good stated this will be complaint driven and complaints and enforcement may increase (i.e. Noise, etc.).

Councillor Inglis noted there should be a consistent unit of measurement (imperial or metric) used throughout the By-law.

Councillor Fowler asked if there would be a restriction on the number of RVs permitted per group. The CPM advised the number of permitted RVs for a group is determined by the size of the property. For example, a 3 acre property would be permitted 3 RVs (1 per acre to a maximum of 25 RVs).

Councillor Inglis advised Council could leave the proposed By-law as drafted and a resident could approach Council in 2024 to request an exemption from provisions in the RV By-law if they cannot meet the requirements (i.e. request for reduced setback).

Deputy Mayor Martin noted each request to Council could be considered on a case by case basis. He further noted, with respect to large gatherings, it benefits the Township if they are aware of the gathering (i.e. Fire Department re: safety concerns). Page 3 of 6

Councillor Fowler noted some of the concerns with large gatherings can be addressed through other By-laws (i.e. Noise By-law exemptions).

Councillor Inglis noted there may be negative impact on neighbouring properties if a small lot (i.e. 1/2 acre) and/or waterfront lots are permitted a large number of RVs, which may remain on the property for an extended period of time.

Councillor Fowler noted the provisions could clearly state the RVs must be removed after the event. He asked if there is a limit to the number of stays. The CPM advised there is no limit to the number of times an RV can be on a property for up to 28 days; nor is there a stipulation the RV must belong to the property owner. Fowler asked what the licence fee is and the Treasurer advised it is $300 per year if a trailer placement is approved.

Sonya Bolton explained the different By-laws and advised today’s Public Meeting is for both the proposed revised Zoning By-law and RV By-law.

Inglis advised Council could adopt the RV By-law as written and review in the future, as it is complex with changing conditions.

Page 4 of 6 Procedure for Public Meetings under the Planning Act Respecting Proposed Amendments to the Township of North Frontenac’s Zoning By-law Opening Remarks

  1. The Council of the Township of North Frontenac is conducting a Public Meeting, today February 25, 2022, under the Planning Act with respect to Proposed Amendment to the Township of North Frontenac’s Zoning By-law to remove General Provisions regarding Recreational Vehicles which will be incorporated into the Recreational Vehicle By-law and incorporate the applicable provisions into the Recreational Commercial Zone as the Recreational Vehicle By-law does not regulate these.
  2. Any persons who wish to receive a copy of the minutes of the public meeting, a copy of the report on the proposed Amendments to the Township of North Frontenac’s Zoning By-law or notice of the passing of the proposed Amendment to the Township of North Frontenac’s Zoning By-law, should provide their full name, address, postal code, email address and contact numbers to the Clerk following the meeting. If a person or public body does not make oral submissions at the public meeting or make written submissions to the Township of North Frontenac before the proposed Amendments to the Township of North Frontenac’s Zoning By-law being approved the person or public body:  is not entitled to appeal the decision of the Township of North Frontenac to the Ontario Land Tribunal; and  may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the tribunal, there are reasonable grounds to do so.
