Minutes of a Regular Meeting of Council for The Corporation of the Township of North Frontenac, held February 7, 2020 in the Council Chambers, 6648 Road 506, Plevna, Ontario.

Present: Mayor Ron Higgins; Councillor Fred Perry – Ward 2; Councillor Vernon Hermer and Deputy Mayor Gerry Martin – Ward 2; and Councillor John Inglis – Ward 3.

Absent: Councillor Wayne Good - Ward 1 and Councillor Fred Fowler – Ward 3.

Also Present: Cheryl Robson, Chief Administrative Officer (CAO); Tara Mieske, Clerk/ Planning Manager (CPM); Corey Klatt, Manager of Community Development/CAO Back-up (MCD); and Eric Korhonen, Director of Emergency Services/Fire Chief (DESFC); and Kelly Watkins, Treasurer.

  1. Call To Order The Mayor called the meeting to order at 9:00 a.m.

#39-20 Be It Resolved That Council adopts the Minutes of a Regular Meeting of Council dated January 17, 2020, as circulated. Carried 8. Business Arising from Minutes a) Resolution #20-20 – Mayor’s Administrative Report “MNRF Meeting December 11, 2019” – Letter from Steve Dunham regarding Request to Frontenac County to Amend the County Official Plan to Remove Regional Area of Natural and Scientific Interest (ANSI) Provisions Moved by Councillor Hermer, Seconded by Councillor Inglis

#40-20 Whereas Council passed Resolution #20-20 at their meeting on January 17, 2020
requesting County Council amend the County Official Plan to remove the policies for Regular Council Minutes February 7, 2020 Page 2 of 8

Regional Areas of Natural and Scientific Interest (ANSI) and the protection of same be determined by the lower tiers and included in the Townships’ Official Plans, during the County’s Official Plan Review; Therefore Be It Resolved That Council receives for information a letter dated January 28, 2020, from Steve Dunham, Resident, advising he had attended the Council meeting on January 17, 2020 where there was discussion about the problems associated with the County Official Plan (OP) protecting Regional ANSIs to the same degree as Provincial ANSIs; and that there was general agreement on Council regarding the need for the County to change this unreasonable OP provision; and that the reason for not proceeding with the request to amend the OP at the next meeting appeared to be the cost and the alternative was to wait 1-1/2 years until the next scheduled OP review at the County; and that Mr. Dunham represents a large number of private property owners impacted by the current County ANSI provisions and find the provisions for that period of time unreasonable and unacceptable; and in order to assist the Township to move forward on this OP request promptly, the group of property owners is offering to compensate the Township the $750 fee associated with the OP amendment request; And That Council thanks the residents for the offer and that the Deputy Mayor will ask County Council about the timeline for the County Official Plan and their opinion on moving the protection of Regional ANSI’s from the County OP to the Township OP for protection level. Carried

#42-20 Be It Resolved That Council receives for information an email dated January 23, 2020 from the Ministry of Environment, Conservation and Parks (MECP) inviting North Frontenac to participate in a multi-stakeholder engagement consultation to gather input on how to improve efficiencies, consistency, transparency and oversight of Conservation Authorities. Carried B2. Sylvia Jones, Solicitor General re: Invitation to the Ontario Provincial Police (OPP) Regional Roundtable Sessions Moved by Councillor Hermer, Seconded by Councillor Inglis

#43-20 Be It Resolved That Council receives for information a letter dated January 15, 2020 from the Solicitor General advising the Province is engaging stakeholders with respect to the Community Safety and Policing Act (CPSA), which will come into force in 2021; and inviting North Frontenac to participate in a Regional Roundtable for the Provincial Government to provide an overview of the upcoming regulatory changes related to OPP services and for communities to identify pertinent local issues and provide feedback on OPP-related policy proposals; And That Fred Fowler will attend the consultation session held on February 20, 2020 in Brockville as a Representative for North Frontenac; And That Council instructs the Clerk to complete the registration. Linda Murray, Director of Corporate Services, Kingston Frontenac Lennox and Addington (KFL&A) Public Health re: Sewage System Inspection Agreement to be Terminated, Effective January 1, 2021 as Outlined in Part 8 of the Building Code Act Moved by Councillor Inglis, Seconded by Councillor Hermer

#44-20 Be It Resolved That Council receives for information a letter dated January 30, 2020 from Kingston, Frontenac, Lennox & Addington (KFL&A) Public Health, advising that, as legislative oversight for sewage systems is found in Part 8 of the Ontario Building Code (OBC), not the Ontario Public Health Programs (OPHS), Part 8 would be best aligned Regular Council Minutes February 7, 2020 Page 4 of 8

with the other sections of the OBC which are currently delivered by municipalities; and that KFL&A is providing notification of their intent to terminate their agreement to carry out the municipality’s responsibilities for sewage systems under the OBC Act and attendant regulations effective January 1, 2021; And That Council instructs the CAO to prepare a report outlining options for the Township to fulfill their duties under Part 8 of the OBC. Carried

  1. Council, CAO and Managers’ Administrative Reports a) Clerk/Planning Manager – To Regulate the Location, Installation and Operation of Outdoor Solid-Fuel Combustions Appliances Moved by Councillor Perry, Seconded by Deputy Mayor Martin
    #45-20 Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “To Regulate the Location, Installation and Operation of Outdoor Solid Fuel Combustions Appliances”; And That Council instructs the Clerk not to make any amendments; And That Council will consider a new By-law to Regulate Outdoor Solid-Fuel Combustion Appliances at a future meeting. Carried b) Clerk/Planning Manager – Road Allowance between Lots Closure and Sale By-law – Stanton and Pierce

    #46-20 Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Road Allowance between Lots Closure and Sale By-law – Stanton and Pierce”; And That, as required by By-law #22-15,
    • All Those Parts of the Road Allowance between Lots 25 & 26, Concession 2, geographic Township of South Canonto, Township of North Frontenac, County of Frontenac being Parts 1-6 on Registered Plan 13R-22148. be declared as surplus and sold to the adjoining owners. Appraisals of these properties are not necessary as these are Road Allowances; And That Council instructs the Clerk to have the Township’s Solicitor register an easement over Parts 2 and 5 on Registered Plan 13R-22148 in favour of the neighbouring property owners who use this portion of Paynes Lane for access; and an easement over Part 2 on Registered Plan 13R-22148 in favour of the Stanton property; And That Council instructs the Clerk to forward the Registered By-law and PIN to Hydro One to complete the easement over Parts 1 through 6 in favour of Hydro One; And That Council will consider a By-law later in the meeting to Stop-up, Close and Sell a Portion of these Road Allowances.

#47-20 Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Two Road Allowance Closures and Sale By-law – Webster and Dreifelds”; And That, as required by By-law #22-15,

• All That Part of the Shoreline Road Allowance around Mississagagon Lake, lying in front of Lot 11, Concession 9, geographic Township of Barrie, Township of North Frontenac, County of Frontenac being Part 1 on Registered Plan 13R- 19573; • All That Part of the Original Shoreline Road Allowance around Big Gull Lake, adjacent to Lot 1, Registered Plan 1570, geographic Township of Clarendon, Township of North Frontenac, County of Frontenac being Part 1 on Registered Plan 13R-10136. •
Be declared as surplus and sold to the adjoining owners. Appraisals of these properties are not necessary as these are Road Allowances; And That Council will consider a By-law later in the meeting to Stop-up, Close and Sell a Portion of these Road Allowances.

#48-20 Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “To Delegate Authority to the Mayor and the Clerk to sign Indemnity Agreements and Development Agreements”; And That Council will consider a By-law at a future meeting to Delegate Authority to the Mayor or Deputy Mayor and the Clerk or Deputy Clerk to sign Indemnity Agreements and Development Agreements. Carried e) Clerk/Planning Manager – Request to Waive Planning Fees – Hamilton – Minor Variance Moved by Deputy Mayor Martin, Seconded by Councillor Perry
#49-20 Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Request to Waive Planning Fees – Hamilton – Minor Variance”; And That as there are costs incurred by the Township to process the Application, Council does not waive the Township’s Planning Fee of $750. Carried f) Public Works Manager – Risk Management Regional Seminar Moved by Deputy Mayor Martin, Seconded by Councillor Perry

And That the Public Works Manager will review recent revisions to the Minimum Maintenance Standards O. Regulation 239/02, as amended by O. Reg. 366/18, and recommend revisions to By-law #89-13 (A Level of Service Policy for Township Roads) and By-law #123-13 (Assumption of Unmaintained Municipal Roads and Private Lanes Policy and Minimum Construction Standards) for consideration by Council at a future meeting. Carried

g) Mayor – Norcan Lake Winter Maintenance Moved by Deputy Mayor Martin, Seconded by Councillor Perry
#51-20 Be It Resolved That Council receives for information the Mayor’s Administrative Report entitled “Norcan Lake Lane Winter Maintenance”; And That our Public Works Manager (PWM) continue to work with Greater Madawaska PWM on a draft Service Contract Agreement for Greater Madawaska Township to provide winter maintenance to Norcan Lake Lane on behalf of North Frontenac Township for both Councils’ consideration.
