a) Appointment of Deputy Mayor as Chair of Meeting

Zoning By-law Amendment Application

a) #Z06/22 - 1251 Heron Way (Wilston) Jennie Kapusta, Community Planner, County of Frontenac, presented the report regarding the Zoning By-law Amendment Application.

Public Comments and Questions Scott Wilston, applicant, was present for the meeting and explained the intent of the Application (i.e. separate quarters for family sleeping, etc.).

Council Comments and Questions Kapusta advised the Zoning By-law Amendment Application is to permit an oversized sleep cabin on a property zoned Limited Service Waterfront Exception Zone 5. She advised the current zoning of the property permits a Temporary Garden Suite which the Applicants would like make a permanent structure.

Councillor Inglis asked Kapusta to clarify the difference between a Garden Suite and a Sleep Cabin. Kapusta advised a Garden Suite is permitted full kitchen and washroom facilities, while a Sleep Cabin has no kitchen facilities and is only permitted limited washroom facilities. She noted a Garden Suite is permitted as a temporary use through the adoption of a By-law.

Deputy Mayor Martin asked if a change of use could be obtained to prevent the removal of the structure. Kapusta advised a Garden Suite is intended as a temporary living space; and that the Temporary Use By-law sets out the permitted time frame for the structure.

Councillor Inglis asked if the original intent of the Applicant was to keep the Garden Suite as a Secondary Dwelling Unit. Kapusta advised the Applicant initially applied to allow a Secondary Dwelling Unit; however this use is not supported based on the Township’s Official Plan policies. She advised the Applicant amended the Application to request an oversized sleep cabin.

Mayor Higgins advised he understands the policies regarding Garden Suites; however he noted there is a shortage of dwelling units. He asked if Planning Staff had any recommendations for future policies to permit additional dwellings in the Waterfront Page 2 of 5

Kapusta advised the Garden Suite was meant to be a Temporary Use only. She noted policies regarding additional dwelling units within the Waterfront Area would have to be supported by Lake Capacity Assessments.

Councillor Hermer asked if the permanent structure exists today due to a remiss of the Council at the time. Kapusta advised the Temporary Use By-law and building permit indicated the use was to be temporary. She noted the Applicants originally intended to remove the structure as per the provisions set out in the Temporary Use By-law, but would like to keep it as a compliant structure.

Mr. Wilston advised the full site plans were submitted to Council and the Chief Building Official at the time the Temporary Use By-law was approved. He noted there were no changes to the site plans when the building permit was issued. Mr. Wilston advised he engaged a Land Use Planner to work with Township staff in developing an appropriate plan.

Deputy Mayor Martin advised he had concerns about the future use of the property if there is a change in ownership.

Note: Councillor Good joined the meeting at this time.

Councillor Good noted the sleep cabin could be used as a Short Term Accommodation in the future, if the property is sold.

Resolution #: 238-22 Moved By: Seconded By: Councillor Fowler Councillor Hermer Be It Resolved That Council receives for information the Zoning By-Law Amendment Application #Z06/22 1251 Heron Way (Wilston) including: a. Notice of Public Meeting; and b. Planning Report;
And That County Planning staff will review any public comments received regarding the proposed Zoning By-Law Amendment; and provided a recommendation in a final report to Council at a future meeting. Carried

Page 4 of 5 Procedure for Public Meetings under the Planning Act Respecting Proposed Amendments to the Township of North Frontenac’s Zoning By-law Opening Remarks

  1. The Council of the Township of North Frontenac is conducting a Public Meeting, today June 17, 2022, under the Planning Act with respect to Proposed Amendment to the Township of North Frontenac’s Zoning By-law related to a Zoning By-law Amendment Application for the property located at 1251 Heron Way.
  2. Any persons who wish to receive a copy of the minutes of the public meeting, a copy of the report on the proposed Amendments to the Township of North Frontenac’s Zoning By-law or notice of the passing of the proposed Amendment to the Township of North Frontenac’s Zoning By-law, should provide their full name, address, postal code, email address and contact numbers to the Clerk following the meeting. If a person or public body does not make oral submissions at the public meeting or make written submissions to the Township of North Frontenac before the proposed Amendments to the Township of North Frontenac’s Zoning By-law being approved the person or public body:  is not entitled to appeal the decision of the Township of North Frontenac to the Ontario Land Tribunal; and  may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the tribunal, there are reasonable grounds to do so.
