Present: Mayor Ron Higgins; Councillor Wayne Good – Ward 1 (electronic participation); Deputy Mayor Gerry Martin and Councillor Vernon Hermer – Ward 2; Councillor John Inglis and Councillor Fred Fowler – Ward 3 Absent with Regrets: Councillor Fred Perry – Ward 1 Also Present: Cheryl Robson, Chief Administrative Officer (CAO); Corey Klatt, Manager of Community Development/CAO Back-up (MCD); Tara Mieske, Clerk/ Planning Manager (CPM); Eric Korhonen, Director of Emergency Services/Fire Chief (DESFC); Kelly Watkins, Treasurer; and Jennie Kapusta, Community Planner, County of Frontenac (electronic participation). 1. 2. 3. Resolution #: 274-21 Moved By: Councillor Fowler Seconded By: Councillor Inglis Be It Resolved That Council approves the Agenda for the Public Meeting regarding the Zoning By-law Amendment – File #Z02/21 – Tal and Julie Peer dated June 18, 2021, as circulated. (12059 Road 509) Resolution #: 275-21 Moved By: Seconded By: Councillor Inglis Councillor Fowler Be It Resolved That Council receives for information the Zoning By-law Amendment - File #Z02/21 – Tal and Julie Peer including: a. Zoning By-law Amendment Application – Tal and Julie Peer (12059 Road 509); b. Report from County Planner; And That Council will consider the Zoning By-law Amendment for Application File #Z02/21 – Tal and Julie Peer at the Regular Council Meeting. Carried 6. Council Comments and Questions Councillor Inglis asked if the property owners would like more than the one main dwelling and will the two accessory dwelling require a rezoning. Kapusta advised they have a specific list of permitted uses, including one main dwelling and two secondary dwelling. Therefore they would require a Zoning By-law Amendment if they wanted additional dwellings on the property or uses not permitted in the Rural zone. The Mayor advised Section 9 in the application was left blank and he assumed it was not applicable. He requested this be added to the application in the future. He noted the applicants had included both Township Maintained Road and Right-of-Way as access to the property on the application and he felt this was an error. Kapusta advised there is a deeded access on the subject property (private lane) used to access a property located behind the subject property; therefore this is why the Right-of-Way was included. 7. The Council of the Township of North Frontenac is conducting a Public Meeting, today June 18, 2021, under the Planning Act with respect to Proposed Amendment to the Township of North Frontenac’s Zoning By-law related to a Zoning By-law Amendment Application from Tal and Julie Peer for their property at 12059 Road 509 requesting a change from recreational/commercial zoning to residential zoning. Any persons who wish to receive a copy of the minutes of the public meeting, a copy of the report on the proposed Amendments to the Township of North Frontenac’s Zoning By-law or notice of the passing of the proposed Amendment to the Township of North Frontenac’s Zoning By-law, should provide their full name, address, postal code, email address and contact numbers to the Clerk following the meeting. If a person or public body does not make oral submissions at the public meeting or make written submissions to the Township of North Frontenac before the proposed Amendments to the Township of North Frontenac’s Zoning By-law being approved the person or public body: • is not entitled to appeal the decision of the Township of North Frontenac to the Ontario Land Tribunal ( formerly the Local Planning Appeal Tribunal); and • may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the tribunal, there are reasonable grounds to do so.”
