Present: Mayor Ron Higgins; Councillor Wayne Good – Ward 1 (electronic participation); Deputy Mayor Gerry Martin and Councillor Vernon Hermer – Ward 2; Councillor John Inglis and Councillor Fred Fowler – Ward 3 Absent with Regret: Councillor Fred Perry – Ward 1 Also Present: Cheryl Robson, Chief Administrative Officer (CAO); Tara Mieske, Clerk/ Planning Manager (CPM); Corey Klatt, Manager of Community Development/CAO Back-up (MCD); Eric Korhonen, Director of Emergency Services/Fire Chief (DESFC); and Kelly Watkins, Treasurer 1. Call to Order The Mayor called the meeting to order at 9:12 a.m. 2. Approval of Amended Agenda a) Approval of Amended Agenda for June 18, 2021 Resolution #: 277-21 Moved By: Seconded By: Councillor Inglis Councillor Fowler Be It Resolved That Council approves the Agenda for the Regular Meeting of Council dated June 18, 2021, as amended. Carried 3. Disclosure of Pecuniary Interest and General Nature Thereof None declared. 4. Delegations a) Sarah and Nicholas Sproule - Building Permit for Cabin Minutes of a Regular Meeting of Council June 18, 2021 Page 2 of 15 Resolution #: 278-21 Moved By: Councillor Fowler Seconded By: Councillor Inglis Be It Resolved That Council receives a Delegation from Nicholas and Sarah Sproule regarding the issuance of a building permit for their property; and thanks them for their time spent today. Carried Note: The Public Works Manager (PWM) arrived at the meeting at this time. 5. Presentations a) Sally McIntyre, General Manager, Mississippi Valley Conservation Authority (MVCA) Resolution #: 279-21 Moved By: Councillor Inglis Seconded By: Councillor Fowler Be It Resolved That Council receives for information the presentation from Sally McIntyre, General Manager, Mississippi Valley Conservation Authority (MVCA) regarding: i. Mississippi River Watershed Plan – Draft Plan; ii. Invasive Species – Eurasion Milfoil and Phragmites; iii. Septic Re-inspection Program; iv. Kashwakamak Lake Dam Plans Update; v. Water Controls/Levels. and thanks her for her time spent today. Carried 6. Business Introductions a) Councillor Inglis (Chair) and Paul Thiel (Member), Economic Development Task Force: Steve Skinner – Maple Syrup. Resolution #: 280-21 Moved By: Seconded By: Councillor Fowler Councillor Inglis Be It Resolved That Council receives for information the Business Profile for Steve Skinner - Maple Syrup prepared by Councillor Inglis, Chair, and Paul Thiel, Member, of the Economic Development Task Force (EDTF). Carried 7. Adoption of Minutes Resolution #: 281-21 Moved By: Seconded By: Councillor Inglis Councillor Fowler Be It Resolved That Council adopts the Minutes of: Minutes of a Regular Meeting of Council June 18, 2021 Page 3 of 15 a. Minutes of a Public Meeting of Council regarding amendments to the Fees and Charges By-law (Building Department and Sale of Masks) dated May 28, 2021, as amended to add Opening Remarks; b. Minutes of a Meeting of a Regular Meeting of Council dated May 28, 2021. Carried 8. Business Arising from the Minutes a) Resolution #58-21 – Mitigation System to Reduce the Radon Levels at the Cloyne Library/Barrie Hall Resolution #: 282-21 Moved By: Seconded By: Councillor Fowler Councillor Good Whereas Council passed Resolution #58-21 at their meeting on February 5, 2021, instructing the Manager of Community Development (MCD) to install radon testers at the Community Halls, Municipal Complex and Fire Halls; and to report back to Council; Therefore Be It Resolved That Council receives for information an email dated June 8, 2021 from the MCD advising radon testing by a C-NRPP Certified Radon Professional had been performed at the Cloyne Library/Barrie Hall, with the levels higher than the daily recommended limits of 200 Bq/M3; and that the recommendation from the company who performed the testing is to proceed with diagnostic testing and the design of a proper mitigation system to reduce the levels of radon, at an approximate cost of $3,200; And That Council instructs the MCD to proceed with the diagnostic testing and design of the mitigation system, with the $3,200 coming from the Community Halls budget for urgent repairs and general maintenance; And That Council instructs the MCD to report back to Council with the details and potential costs to mitigate the issue for Council’s consideration. Carried b) Resolution #140-21 -Easement Acquisition Agreement - Shabomeka Lake Dam Resolution #: 283-21 Moved By: Seconded By: Councillor Good Councillor Fowler Whereas Council passed Resolution #140-21 at their meeting on March 19, 2021, receiving a presentation from Sally McIntyre, Mississippi Valley Conservation Authority (MVCA); and approving the proposed location for the easement at the Shabomeka Lake Dam; Therefore Be It Resolved That Council receives for information the proposed Permanent Easement Acquisition Agreement from MVCA for the Shabomeka Dam Property; And That Council will consider a By-law later in the meeting to sign the Amended Agreement. Carried b) B1 - Louri Snider, Baseball for Dad re: Mark’s Buddy Bench Request for Placement at Sand Lake Beach Resolution #: 285-21 Moved By: Seconded By: Councillor Inglis Councillor Fowler Be It Resolved That Council receives an email dated June 1, 2021 from Louri Snider, founder of Baseball for Dad requesting approval for the placement of a Mark’s Buddy Bench at the Sand Lake Public Beach; And That Council supports this initiative to encourage awareness of mental health and promote kindness, friendships and inclusivity; and approves the placement of a Buddy Bench at the Sand Lake Public Beach; And That Council instructs the Manager of Community Development to contact Ms. Snider to arrange for the delivery and installation of the cement pad (if required) and bench at the Sand Lake Beach. Carried c) B2 - Frontenac County re: Draft Community Safety and Well Being Plan (CSWBP) Resolution #: 286-21 Moved By: Seconded By: Councillor Fowler Councillor Inglis Be It Resolved That Council receives for information a letter dated May 28, 2021 from Mayor Frances Smith, Chair of the Advisory Committee for the Community Safety and Well -Being Plan (CSWBP), advising the provincial deadline for each lower tier municipality to approve a CSWBP is July 1, 2021; and that the plan has been completed as prescribed by legislation by Big Thinking Consulting; And That the draft Plan was presented to Council at a Joint Councils Meeting hosted by Central Frontenac Township on May 20, 2021; And That the Council of North Frontenac adopts the Community Safety and Well- Being Plan for the Townships of Central Frontenac, North Frontenac, South Frontenac and Frontenac Islands; And That Council instructs the Clerk to post a copy on the Township’s website and have a copy available in the Township office within 30 days. Carried d) B3 - Mr. Benoit, Resident re: Exemption from Noise By-law Resolution #: 287-21 Moved By: Seconded By: Councillor Hermer Deputy Mayor Martin Minutes of a Regular Meeting of Council June 18, 2021 Page 6 of 15 Be It Resolved That Council receives for information an email dated June 4, 2021 from Roch Benoit, Resident, advising he will be hosting a wedding reception on July 17, 2021 at 1088 Pine Path Lane; and requesting an exemption from the Township’s Noise By- law 27-21, Section 3.3 (g) which provides that no loud parties are permitted between the hours of 11:00 p.m. and 7:00 a.m. that is clearly audible at neighbouring premises or residential properties; And That Council approves the exemption to the Noise By-law to permit the wedding reception to continue until 12:00 am on July 18, 2021; And That Council instructs the Clerk to provide a copy of this Resolution to the Township’s By-Law Enforcement Officer and to Mr. Benoit. Carried e) B4 - Town of Fort Erie - Request for Support re: Gains Tax on Residence Resolution #: 288-21 Moved By: Seconded By: Councillor Hermer Deputy Mayor Martin Whereas primary residences are currently exempt from a capital gains tax; And Whereas currently secondary and additional non-primary properties are subject to capital gains; And Whereas the Federal Government is currently looking into a primary residence capital gains tax as they have recognized that affordable housing has become a serious issue in Canada; And Whereas smaller communities including the Town of Fort Erie are seeing unprecedented higher selling prices that are outpacing prices in larger cities; And Whereas many hard-working Canadians who have only a primary residence with no additional non-primary homes count on their home equity as financial aid to apply to upsizing or downsizing their home depending on their personal situation; And Whereas a change in taxation to primary residences would be a significant financial blow to Canadians and would create an unfair, two-tiered taxation which could lead to depleted savings, inter-generational disparities, disparities among diverse groups such as seniors who may have a significant portion of their savings vested in their primary residence, as well as, reducing the ability of home ownership thereby a further, higher need for rentals; And Whereas the Federal government could look at other means to slow down the rapidly escalating housing costs to improve housing affordability; Therefore Be It Resolved That the Council of the Township of North Frontenac receives the Resolution of the Town of Fort Erie requesting the Federal Government not consider capital gains tax on primary residences and Council supports this request; And That a copy of this resolution be circulated to The Right Honourable Justin Trudeau; The Honourable Doug Ford, Premier of Ontario; Scott Reid, MP; Randy Hiller, MPP; and the Town of Fort Erie. Carried Minutes of a Regular Meeting of Council June 18, 2021 Page 7 of 15 f) B5 - Township of The Archipelago - Request for Support re: Bill 228 - Banning Unencapsulated Polystyrene Foam Resolution #: 289-21 Moved By: Deputy Mayor Martin Seconded By: Councillor Hermer And Whereas the environmental impacts associated with the breakdown of unencapsulated PS foam are significant, as it is one of the top items of debris found on shorelines, beaches, and surface water around the world and causes adverse effects to wildlife when ingested; And Whereas on May 13, 2021, the Province of Ontario passed Bill 228: Keeping Polystyrene Out of Ontario’s Lakes and Rivers Act, to regulate and control its use for floats; And Whereas on May 13, 2021, the Province of Ontario passed Bill 228: Keeping Polystyrene Out of Ontario’s Lakes and Rivers Act, to regulate and control its use for floats; And Whereas that the Great Lakes and St. Lawrence Cities Initiative (Cities Initiative) recognizes the need for PS foam to be encapsulated when used for floatation; and that the Cities Initiative and its members call on the Federal Government of Canada (Ministries of Fisheries and the Environment) the Province of Ontario (Ministry of Natural Resources & Forestry, Ministry of Environment, Conservation & Parks), the Province of Quebec, The United States (U.S.) Federal Government, and the U.S. States of New York, Pennsylvania, Ohio, Indiana, Michigan, Illinois, Wisconsin and Minnesota to work in collaboration with each other to enact laws which:
