Township of orth Fron ten ac Minutes of a Regular Meeting of Council for The Corporation of the Township of North Frontenac Held November 19, 2021 in Council Chambers, 6648 Road 506, Plevna, Ontario (via Electronic Participation) Present: Mayor Ron Higgins; Councillor Wayne Good — Ward 1; Deputy Mayor Gerry Martin and Councillor Vernon Hermer (Electronic Participation) — Ward 2; Councillor John Inglis and Councillor Fred Fowler — Ward 3 Absent with Councillor Fred Perry — Ward 1 Regret: Also Present: Cheryl Robson, Chief Administrative Officer (CAO); Tara Mieske, Clerk/ Planning Manager (CPM); Corey Klatt, Manager of Community; Development/CAO Back-up (MCD); Darwyn Sproule, Public Works Manager (PWM); Eric Korhonen, Director of Emergency Services/Fire Chief (DESFC); and Kelly Watkins, Treasurer 1. Call to Order The Mayor called the meeting to order at 9:02 a.m. 2. Approval of Agenda a. November 19, 2021 Resolution #: 486-21 Moved By: Deputy Mayor Martin Seconded By: Councillor Inglis Be It Resolved That Council approves the Agenda for the Regular Meeting of Council dated November 19, 2021, as circulated. Carried 3. Disclosure of Pecuniary Interest and General Nature Thereof None declared. 4. Business Introductions a. Tumblehome Lodge Resolution #: 487-21 Moved By: Councillor Inglis Seconded By: Deputy Mayor Martin Regular Meeting of Council Minutes November 19, 2021 Page 1 of 12 Be It Resolved That Council receives for information the Business Profile of Tumblehome Lodge provided by Councillor Inglis, Chair, and Paul Thiel, Member, of the Economic Development Task Force (EDTF). Carried 5. Presentations None. 6. Delegations a. Richard Morey - Portion of Arcol Road Resolution #: 488-21 Moved By: Deputy Mayor Martin Seconded By: Councillor Inglis Be It Resolved That Council receives for information the Delegation from Richard and Debbie Morey regarding Council Resolution #478-19, which required Part 1 to be transferred to the Township at the time the Arcol Road was transferred due to the size of Part 1; And That they are requesting to purchase part of the Township Road Allowance which would connect Parts 1 and 4, as this Road Allowance leads to water they are proposing to provide the Township with an access over Gordie Lane, owned by the Moreys, to the Road Allowance closer to the water; And That Council instructs the Clerk/Planning Manager and Public Works Manager to review the proposal and report back to Council with recommendations at the next regular Council meeting. Carried 7. Adoption of Minutes a. Minutes of Meeting(s) to be Adopted by Council Resolution #: 489-21 Moved By: Councillor Inglis Seconded By: Deputy Mayor Martin Be It Resolved That Council adopts the Minutes as circulated, of: a. A Special Meeting of Council re: Municipal Modernization Intake 3 dated October 18, 2021; b. A Regular Meeting of Council dated October 22, 2021; and c. A Special Meeting of Council re: Succession Planning dated October 28, 2021. Carried 8. Business Arising from the Minutes a. Resolution #391-21 - Waste Electrical and Electronic Equipment Transition Update Resolution #: 490-21 Moved By: Deputy Mayor Martin Seconded By: Councillor Inglis Whereas Council passed Resolution #327-21 at their meeting on July 16, 2021 receiving for information the Public Works Manager’s (PWM) Administrative Report entitled “Waste Electrical and Electronic Equipment Transition Update”; and Council Regular Meeting of Council Minutes November 19, 2021 Page 2 of 12 instructed the Public Works Manager to notify the Association of Municipalities of Ontario (AMO) and Resource Productivity & Recovery Authority (RPRA) that the WEEE program offered by the PRO is considered a reduction in service, and the Municipality objects to any such reduction in the level of service during the pending transition of the Blue Box Program; and Council requested the Mayor send a letter to the Minister regarding the changes to the program and the additional costs due to the changes in the program; And Whereas Council passed Resolution #391-21 at their meeting on September 10, 2021 receiving for information an update from the PWM, that after negotiating a second pickup location at the 506 Waste Site, in addition to the Plevna Waste Site, the Public Works Manager (PWM) executed an Agreement with EPRA on August 17, 2021; Therefore Be It Resolved That the refusal by EPRA to place a bin at the 506 Waste Site, and the heavy duty Sacs provided in lieu of a bin, and the requirement for the Township to load the Sacs for pickup, are all considered reductions in the level of service; And That Council objects to this reduction in the level of service; And That Council requests the Mayor send a letter to the Minister regarding the changes resulting from the program, the associated reduction in the level of service, and request that the future transition of other programs maintain the existing levels of service. Carried b. Resolution #459-21 - Property access on Shabomeka Lake adjacent to Bon Echo Provincial Park Resolution #: 491-21 Moved By: Councillor Inglis Seconded By: Deputy Mayor Martin Whereas Council passed Resolution #459-21 at their meeting on October 22, 2021, receiving a verbal report from Mayor Higgins regarding his letter to the Ministry regarding access for residents on Shabomeka Lake Road; and Council requested the Mayor write the letter to the Ministry, including historical use; Therefore Be It Resolved That Council receives for information an email dated November 11, 2021 from Mayor Higgins responding to Minister Imbogno’s email which stated “I understand that a few private cottage property owners within the municipality have asked for a new road to be constructed through Bon Echo Provincial Park as an alternative to their water access only private properties. While the ministry understands the desire for private property owners to have alternative access to their properties, the ministry is currently not considering authorizing new uses in provincial parks and conservation reserves such as private access roads.”; And That the Mayor clarified there are approximately 40-50 private cottage property owners along the Shabomeka Lake shoreline; and there is no request for a new road or any type of construction activity, based on the current land use, environmental impact or the disruption of the guests at the park; And That, based on the historical use of the trail by the shoreline property owners to access the properties and bring in supplies; and the clarification that there is no request for new construction, the Township respectfully requests the Minister reconsiders the decision to only permit existing pedestrian access and restrict motorized vehicle access on the northside of the Shabomeka Lake control structure within the regulated park Regular Meeting of Council Minutes November 19, 2021 Page 3 of 12 boundary and allow North Frontenac residents to access their properties using the existing trail; And That the Township is open to discussion with the Ministry to ensure complete understanding of the request; And That the DESFC will talk to Chief Cuddy regarding access for emergency Services if the dam is not wide enough. Clerk’s Administrative Report - Communications ‘A’ Section Resolution #: 492-21 Moved By: Councillor Fowler Seconded By: Deputy Mayor Martin Be It Resolved That Council receives for information Section ‘A’ Items of the Clerk’s Administrative Report entitled “Communications of Interest.” Carried b. Communications ‘B’ Section - Action Items None. 10. Council, CAO, and Managers’ Administrative Reports a. CAO (On Behalf of the Emergency Control Group): COVID-19 Draft Vaccination Policy Resolution #: 493-21 Moved By: Deputy Mayor Martin Seconded By: Councillor Fowler Be It Resolved That Council receives for information the Chief Administrative Officer’s Administrative Report, on behalf of the Emergency Control Group (ECG) entitled “COVID-19 Draft Vaccination Policy”; And ThatCouncil instructs the CAO to include the new COVID-19 Vaccination Policy as amended re: boosters to the Personnel & Employment Policy and Procedure Manual effective November 19, 2021; And That the ECG continue to work with the Kingston, Frontenac, Lennox, and Addington (KFL&A) Public Health and Municipal Partners to ensure all reasonable workplace control measures are in place and the ECG will re-assess the Vaccination Policy on an on-going basis as required based on Public Health and Provincial guidelines; And That the Clerk amend the Procedural Policies for Council, Committees and Task Forces with the same requirements as approved by Council for Employees regarding Vaccinations for the December 10, 2021 Council Meeting. Carried b. Clerk/Planning Manager: Amendment to Administrative Reports to Ensure Council Agendas are Accessible Resolution #: 494-21 Moved By: Councillor Fowler Seconded By: Deputy Mayor Martin Regular Meeting of Council Minutes November 19, 2021 Page 4 of 12 Be It Resolved That Council receives for information the Clerk/Planning Managers Administrative Report entitled “Amendment to Administrative Reports to Ensure Council Agendas are Accessible”; And That, in accordance with the Accessibility for Ontarians with Disabilities Act (AODA), Applications and Inspection Reports will not be provided in Council Agendas; and the information will be summarized in the Administrative Reports. Carried c. Clerk/Planning Manager: Two (2) Shore Road Allowance Applications for Approval in Principle - Jefferson and Prior Resolution #: 495-21 Moved By: Deputy Mayor Martin Seconded By: Councillor Fowler Be It Resolved ThatCouncil receives for information the Clerk/Planning Manager’s Administrative Report entitled ‘Two (2) Shore Road Allowance Applications for Approval in Principle — Jefferson and Prior"; And That Council approves in principle the Application(s) to close, stop up and sell the Shore Road Allowance(s) as describes below: • Part of the Shore Road Allowance lying adjacent to Lot 9, Plan 1037, geographic Township of Barrie (Mazinaw Lake); • Part of the Shore Road Allowance lying adjacent to Lot 5, Plan 1419, geographic Township of Barrie (Big Gull Lake). Carried d. Clerk/Planning Manager: Resignation of Alternate Member of Committee of Adjustment Resolution #: 496-21 Moved By: Councillor Fowler Seconded By: Deputy Mayor Martin Be It Resolved That Council receives for information the Clerk/Planning Managers Administrative Report entitled “Resignation of Committee of Adjustment Alternate Member”; And That a Selection Committee will interview potential candidates and provide a recommendation to Council to fill the Alternate Member position; And That the Clerk shall advertise for the Alternate Member position and provide a copy of all confidential responses, including resumes, to the Selection Committee being comprised of the Chair of the Committee of Adjustments/Planning Advisory Committee; Councillor Fred Fowler, Council Liaison; and the Clerk/Planning Manager; And That Council instructs the Clerk to prepare a letter of thanks on behalf of the Township to Janice Arthur, for her many years of service to the Township in her role as Member and Alternate Member of the Committee of Adjustment/Planning Advisory Committee. Carried e. Clerk/Planning Manager: Noise By-law #27-21 Exemption Requests Resolution #: 497-21 Moved By: Deputy Mayor Martin Seconded By: Councillor Fowler Regular Meeting of Council Minutes November 19, 2021 Page 5 of 12 Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Noise By-law #27-21Exemption Requests”; And That Council chooses Option #2,that Council instructs the Clerk to amend Section 3.3 g) to the hour of 12:00 a.m. from 11:00 p.m. Carried f. Clerk/Planning Manager: Shore Road Allowance - 1123 Don Anna Road (Burns) Resolution #: 498-21 Moved By: Councillor Fowler Seconded By: Councillor Good Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Shore Road Allowance — 1123 Don Anna Road (Burns)” And That Council approves of the transfer of PIN 36178-0926 (Part 2 and the parcel of land between the Fedderson property and the Shore Road Allowance) from the Estate of Donald Perry to the Township; And That Part 2 will be sold to the Applicant (Burns) in accordance with By-law #22-15 being the Township Road Closing Policy; And That Council instructs the Clerk to provide the draft Transfer to the Township’s Solicitor for review prior to the Township accepting the Transfer; And That the sale of the remaining portion of PIN 36178-0926 to the neighbouring property owners if they apply to purchase the Shore Road Allowance shall follow the same process. Carried g. Director of Emergency Services/Fire Chief - Fire Department Charge Backs and Fees for Service, Motor Vehicle Accidents (MVA) Resolution #: 499-21 Moved By: Councillor Good Seconded By: Councillor Fowler Be It Resolved That Council receives for information the Director of Emergency Services, Fire Chief’s Administrative Report entitled “Fire Department Charge Backs and Fees for Service, Motor Vehicle Accidents (MVA)”; And That Council instructs the Clerk to draft a By-law for Council’s consideration at a later meeting for the charging of fees for services with regards to Responding to Motor Vehicle Accidents for non-residents and/or residents; And That Council instructs the Clerk to draft a By-law for Council’s consideration at a later meeting to enter into an Agreement with the Ministry of Transportation for the purpose of accessing the Authorized Requester Information System (ARIS); And That Council instructs the Clerk to amend the Fees and Charges By-Law #31-21, Schedule H, Section K, “Services Provided” to “Motor Vehicle Accident — for emergency response, collision, or motor vehicle fire on any property owned by or within the Municipality of North Frontenac, including Secondary Roads and Private Lanes, and provides firefighting, emergency service or other essential equipment”; And That Council instructs the Clerk to amend the Fees and Charges By-Law #31-21, Schedule H, Section K, “Fees for Service” to “based on the Ministry of Transportation, Fire Response criteria, for non-resident and/or residents of the Municipality’; Regular Meeting of Council Minutes November 19, 2021 Page 6 of 12 And That, as per the Township’s Notice By-law #101-19, Council instructs the Clerk to provide Notice of a Public Meeting and intent to pass a By-law to amend the Fees and Charges By-law at a later date; And That Council defers this until it has be
