Minutes of a Regular Meeting of Council for The Corporation of the Township of North Frontenac Held October 14, 2022 in the Council Chambers, 6648 Road 506, Plevna, Ontario

Present: Mayor, Ron Higgins; Councillor Wayne Good - Ward 1; Deputy Mayor Gerry Martin and Councillor Vernon Hermer - Ward 2; Councillor John Inglis and Councillor Fred Fowler - Ward 3 Also Present: Corey Klatt, Chief Administrative Officer (CAO); Tara Mieske, Clerk/ Planning Manager (CPM); Brooke Hawley, Manager of Community Development (MCD); Darwyn Sproule, Public Works Manager (PWM); Eric Korhonen, Director of Emergency Services/Fire Chief (DESFC); Kelly Watkins, Treasurer; and Sonya Bolton, Manager of Community Development, County of Frontenac (Electronic Participation)

Call to Order The Chair called the meeting to order at 9:02 a.m.

b. Mississippi Valley Conservation Authority (MVCA) re: Resolution #339-22 - Phosphorus Levels in Mazinaw Lake

Resolution #: 398-22 Moved By: Seconded By: Councillor Fowler Councillor Hermer Whereas at their meeting on September 2, 2022Council received for information an email dated August 15, 2022 from the Mazinaw Property Owners Association (MPOA) regarding unfavourable phosphorous results in the lower part of Mazinaw Lake for past 6 years (4 sampling periods);
And Whereas Council received an email from Kelly Stiles dated August 16, 2022 receiving the email from the MPOA and advising she will review the data provided and respond to the MPOA in September; And Whereas Council requested MVCA provide an update to the Clerk once they have reviewed the data and this information be provided to Council at that time; Page 2 of 10

Township of North Frontenac Regular Council Agenda Minutes October 14, 2022 And Whereas Council requested MVCA explain how data is collected and analyzed; and explain the fluctuations; Therefore Be It Resolved That Council receives for information an email dated September 12, 2022 from Kelly Stiles, Aquatic Biologist, MVCA, advising they have recently consulted with the Ministry of Environment, Conservation and Parks (MECP) in regard to the data for Mazinaw Lake; and MECP recommended MVCA use standard methods for statistical data trends analysis currently used by the province. MECP are providing examples of the methodology and are available to review the results once MVCA has completed the analysis. This combined review will assist in having a comprehensive understanding of the results; And That Councillor Inglis will contact MVCA regarding analysis of data. Carried

B1. Request for Maintenance of Quakenbush Road

Resolution #: 400-22 Moved By: Seconded By: Councillor Fowler Councillor Hermer Be It Resolved That Council receives for information an email dated September 20, 2022 from Brad Runtz, Real Estate Agent on behalf of Brett Mask, property owner, advising the property Mr. Mask owns is accessed by Quakenbush Road; and that the road leading to the property is in horrendous condition; and that Mr. Mask, and other landowners on Quakenbush Road, would like Council to provide maintenance of the road for the 2.5 kilometres that it is currently maintained under the Township’s Level of Service By-law #89-13 Schedule “C”; And That the Public Works Manager will review the condition of the Quackenbush Road and report to Council with proposed options and associated costs for consideration during the 2023 budget process. Township of North Frontenac Regular Council Agenda Minutes October 14, 2022 of North Frontenac, being Part 2 on Registered Plan 13R-4192 and a portion of a Shore Road Allowance, lying between Part 2 on Registered Plan 13R-4192 and Sand Lake, be approved; And That Zoning By-Law Number 55-19 of the Township of North Frontenac, as amended, be further amended, as per Attachment 1 (Draft By-Law to Amend Zoning By-Law Number 55-19); And That Council determines that in accordance with Section 34(17) of the Planning Act, no further notice is required prior to the passage of the By-Law; And That the amending by-law be presented to Council for all three readings. Carried

b. Sonya Bolton, Manager of Community Planning, County of Frontenac: Implementation of Provincial Bill 109, the “More Homes for Everyone” Act

c. Clerk/Planning Manager: To Dedicate and Assume Part 2 on Registered Plan 13R- 22722 as a Road

Resolution #: 403-22 Moved By: Seconded By: Councillor Hermer Councillor Fowler Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “To Dedicate and Assume Part 2 on Registered Plan 13R- 22722 as a Road”; And That Council will consider a By-law later in the meeting to dedicate and assume Part of Lots 24 and 25, Concession 8, Township of Clarendon, Part 2, 13R-22722 as a road; And That Council instructs the Clerk to have the Municipal Solicitor register the By-law. Carried

d. Clerk/Planning Manager: Two (2) Shore Road Allowance Applications for Approval in Principle – Jennekens and Freel

e. Clerk/Planning Manager: Shore Road Allowance Closure and Sale By- law – Skerkowski

Resolution #: 405-22 Moved By: Seconded By: Councillor Hermer Deputy Mayor Martin Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Shore Road Allowance Closure and Sale By-law – Skerkowski”;
And That, as required by By-law #22-15,
• All That Part of the Shore Road Allowance adjacent to Lots 4 and 5, Concession 11, geographic Township of Miller, being Part 3 on Registered Plan 13R-18349 (Grindstone Lake);
be declared as surplus and sold to the adjoining owners. Appraisals of these properties are not necessary as this is a Shore Road Allowance;
And That Council will consider a By-law later in the meeting to Stop-up, Close and Sell a Portion of the Shore Road Allowance.

f. Clerk/Planning Manager: Unregistered Shore Road Allowance By-law

Resolution #: 406-22 Moved By: Seconded By: Deputy Mayor Martin Councillor Hermer Be It Resolved That Council receives for information the Clerk/Planning Managers Administrative Report entitled “Unregistered Shore Road Allowance By-law – Barrie By- law No. 64”; And That Council approves the recommendation provided by the Township Solicitor and will consider a By-law to confirm Barrie By-law No. 64 dated October 19, 1889 later in the meeting; And That Council advises if any additional surveying or legal work is required to correct the property owner’s title it shall be at the cost of the property owner. Carried

g. Clerk/Planning Manager and Public Works Manager - Request for Reconsideration of Transfer of a portion of Arcol Road being part 3 on Registered Plan 13R-22538

Resolution #: 407-22 Moved By: Seconded By: Councillor Hermer Deputy Mayor Martin Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Morey – Request for Reconsideration of Transfer of a portion of Arcol Road being Part 3 on Registered Plan 13R-22538”; Page 5 of 10

Township of North Frontenac Regular Council Agenda Minutes October 14, 2022 And That Council amends Resolution #520-21, and approves accepting the transfer of a portion of the Arcol Road more specifically described as Part 3 on 13R-22538 prior to the Road Allowance through Lot 22, Concession 3, being Part 1 on Registered Plan 13R-22589 being transferred; And That once the transfer is completed, Council instructs the Clerk to prepare a By- law to assume this portion of Arcol Road for Council’s consideration. Carried

h. Economic Development Officer: EDO Attendance at the 2022 OEMC Conference (Sept. 14-16, 2022)

i. Director of Emergency Services: Carbon Monoxide Awareness Week
November 1-7 2022

Resolution #: 409-22 Moved By: Seconded By: Councillor Hermer Deputy Mayor Martin Be It Resolved That Council receives the Director of Emergency Services/Fire Chief’s Administrative Report entitled “Carbon Monoxide Awareness Week, November 1 – 7, 2022” for information purposes; And Thatthe North Frontenac Fire Department wishes to remind and educate local residents about the importance of having working carbon monoxide detectors in their home, if the home has a fuel burning appliance, a fireplace or an attached garage; And That Council instructs the Director of Emergency Services/Fire Chief to place a copy of the Mayoral Declaration in the Frontenac News. Carried

j. Public Works Manager: Proposal to Advance Engineering Services for the 2023 Capital (Bridge) Plan

Resolution #: 410-22 Moved By: Seconded By: Deputy Mayor Martin Councillor Hermer Be It Resolved That Council receives for information the Public Works Manager’s Administrative Report entitled “Proposal to Advance Engineering Services for the 2023 Capital (Bridge) Plan”; And That Council approves advancing the engineering services for the 2023 bridge projects identified in the approved 2022 10 year Capital Plan;
And That Council instructs the Treasurer to transfer the costs for the detailed design work from the Roads Sustainability TCA Reserve Fund. Carried

Resolution #: 411-22 Moved By: Seconded By: Councillor Hermer Deputy Mayor Martin Be It Resolved That Council receives for information the Public Works Manager’s Administrative Report entitled “Application to Name a Lane – off Buckshot Lake Road”; And That Council approves in principle, subject to the Public Notice, the name “Beech Corners Lane”;
And That Council instructs the Clerk to prepare a draft By-law amending the Corporation’s Naming of Roads By-law #07-03 with the private lane name, and provide the required Public Notice of the Township’s intention to pass this By-law. Carried Note: The PWM left the meeting at this time.
