TOWNSHIP OF SOUTH FRONTENAC BY-LAW 2010-30
BEING A BY-LAW TO EXEMPT LAND WITHIN A REGISTERED PLAN OF
SUBDIVISION FROM PART LOT CONTROL, PURSUANT TO SECTION 50(7) OF THE PLANNING ACT, R.S.O. 1990, as amended
WHEREAS certain lands within the Registered Plan of Subdivision 13M-79 as approved
by Township of South Frontenac By-law 2008-54 are subject to part lot control under section 50(5) of The Planning Act; and
WHEREAS section 50(7) of The Planning Act gives Council the authority to pass a bylaw to provide that subsection (5) does not apply to land that is within part of such
registered plan of subdivision; and
WHEREAS the Council of the Corporation of the Township of South Frontenac wishes
to exempt a portion of lot 16 ofRP13M-79 from part lot control for the purpose of conveying parts 1,2 and 3 on Plan 13R-19818 to portions of lots within Registered Plan 13M-27;
NOW THEREFORE THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC BY ITS COUNCIL HEREBY ENACTS AS FOLLOWS:
Land within lot 16 of Registered Plan 13M-79, District of Storrington, identified as parts 1,2 & 3 of Registered Plan 13R-19818, is hereby exempted from part lot control for the purposes only of conveying:
A) Part 1 of Registered Plan 13R-19818 to be added to lot 4 within Registered Plan 13M-27 and Block 23 within Registered Plan 13M-79;
B) Part 2 of Registered Plan 13R-19818 to be added to lot 13 within Registered Plan 13M-27;
C) Part 3 of Registered Plan 13R-19818 to be added to lot 19 within Registered Plan 13M-27.
This by-law shall come into force and take effect on the date of registration of this by-law. This by-law shall be without further force and effect upon three months of the date of passing of this by-law if all transfers to lots 4,13 and 19 in plan 13M-27 have not been finalized. th
