TOWNSHIP OF SOUTH FRONTENAC BY-LAW NUMBER 2010-44

BEING A BY-LAW JTO AMEND BY-LAW NUMBER 2003-75, AS AMENDED,

TO CHANGE THE PROVISIONS OF SPECIAL LIMITED SERVICE RESIDENTIAL-WATERFRONT (RLSW-74) ZONE TO PERMIT A SECONDARY DWELLING TO CONTINUE FOR AN ADDITIONAL THREE

YEAR PERIOD, PART LOT 8, CONCESSION X, DISTRICT OF PORTLAND; FINK.

WHEREAS, the Municipal Council of the Township of South Frontenac deems it expedient to amend By-law Number 2003-75 as amended, as it relates to a parcel of land located in Part of

Lot 8, Concession X of the District of Portland;

NOW THEREFORE THE CORPORATION OF THE TOWNSfflP OF SOUTH FRONTENAC BY FTS COUNCIL, HEREBY ENACTS AS FOLLOWS:

I. THAT z?ning BY~}aw. nilm!:)e5 2003-75 as amended is hereby further amended by deleting the Special Limited Service Residential-Waterfront (RLSW-74) Zone in its entirety and replacing it with a new RLSW-74 Zone to read as follows: RLSW-74 (Lot 8, Concession X, Portland District - Fink)

Notwithstanding any provision of this By-law to the contrary, on the lands zoned Special Limited Service Residential-Waterfront (RLSW-74) Zone, the following provisions shall apply:

In addition to the uses permitted in section 10.2 of this By-law the following uses are permitted: i)

A secondary temporary dwelling unit.

In addition to the zone regulations section 10.3 of this By-law the following regulations apply:

i) street access to both dwellings (principal and secondary) is limited to one driveway only;

ii) the maximum permitted floor area of the temporary secondary dwelling is 59 2 2 metres2 (638 ft/);

iii) the maximum height of the structure housing the temporary secondary dwelling is one storey or 4.5 metres, whichever is the lower number;

iv) the temporary second dwelling use shall be permitted for a maximum period of three (3) years from the date of the approval of this Zoning By-law Amendment namefy June 15,2013. All other provisions of this by-law shall apply. 2.

THIS BY-LAW shall come into force in accordance with sections 34 and 39 of the

Planning Act, 1990, as amended, either upon the date of passage or as otherwise provided by said sections 34 and 39.
