TOWNSHIP OF SOUTH FRCNTENAC BY-LAW 2010-62
BEING A BY-LAW TO AUTHORIZE ENCROACHMENT ON THE ROAD ALLOWANCE BETWEEN CONCESSION 11 AND
CONCESSION 12, IN LOT 21, DISTRICT OF LOUGHBOROUGH WHEREAS Section 11 (2) of the Municipal Act, 2003, c. 25 authorizes a municipality to pass by-laws respecting highways; and
AND WHEREAS such jurisdiction includes allowing any person owning or occupying a structure that is wholly or partially erected or constructed on any highway to maintain and use
such structure thereon and to fix such annual charges that the Council considers reasonable for such an owner or occupant to pay for such a privilege;
AND WHEREAS tiie well, and a portion of the dwelling and septic bed of property at 6724 Perth Road (1029 050 040 78800), are located on the unopened road allowance’between concession 11 and concession 12, in lot 21, District ofLoughborough; NOW THEREFORE THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC, BY ITS COUNCIL, HEREBY ENACTS AS FOLLOWS:
The well, and portions of the dwelling and septic bed which are occupied and/or used by the owner of 6724 Perth Road, lot 21, concession 12 and part of the road allowance between concession 11 and concession 12, District ofLoughborough, are allowed to encroach into the road allowance between concessions according to the attached surveyed sketch (Schedule “B”);
The annual fee for this privUege is Sl.OO;
A permit agreement shall be entered into between the property owner and the Township and attached to this by-law as Schedule “A”;
This by-law shall come into force and take effect on the date of its passage.
