TOWNSHIP OF SOUTH FRONTENAC BY-LAW 2010-63

BEING A BY-LAW TO ESTABLISH HIDEAWAY LANE AS A PUBLIC HIGHWAY

WHEREAS Section 31(2) of the Municipal Act, 2001, authorizes the municipality to establish a highway by by-law; and WHEREAS the municipality is the registered owner of those lands being part of Lot 14, Concession 8, and Part of the 0.305 metre reserve within Neddow Park Lane on

Plan 1588, being Parts 1,2 and 4,13R-12700, in the former geographic Township of Storrington; and

WHEREAS Council wishes to establish all of the foregoing lands as public highway known as Hideaway Lane; and WHEREAS it is not Council’s intention that the municipality shall assume or

otherwise be responsible for the maintenance and repair of the aforesaid highway; NOW THEREFORE BE IT RESOLVES THAT: 1.

Those lands being part of Lot 14, Concession 8, and Part of the 0.305 metre reserve within Neddow Park Lane on Plan 1588, being Parts 1,2

and 4,13R-12700, in the former geographic Township of Storrington, now in the Township of South Frontenac, in the County ofFrontenac be and are hereby established as a public highway to be known as Hideaway Lane.

Despite the foregoing, the municipality shall not assume or otherwise maintain or be responsible for the maintenance and repair ofHideaway Lane unless and until Council passes a by-law expressly assuming

responsibility for the maintenance and repair ofHideaway Lane. 3.

The Clerk shall cause a certified copy of this by-law to be registered against the title of the aforesaid lands.

This by-law shall come into force and take effect on passing. By-law 2005-28 is hereby repealed. th
