BY-LAW NO. 2010-65 of
THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC
Being a by-law to delegate authority to the Chief Administrative Officer

subject to the restrictions set out in this Part;
AND WHEREAS The Council of the Township of South Frontenac adopted By-law 2007-81 on th
the 201n day.°.f November 2007, being a by-law to adopt a delegation of authority policy as per Section 270(1) of the Act;
AND WHEREAS Section 5(i) of By-law 2007-81 states that all delegations of Council powers, duties or functions shall be by by-law;
AND WHEREAS the Council of the Township of South Frontenac may be restricted from taking any of the following actions as set^out in the Section 275(3) of the Act, from the day after nomination day being September 10’h, 2010 or the day after election day by October 25th: 2010, until the day after election day being October 25th, 2010 until the date that the new Councii
takes office:
(a) the appointment or removal from office or any officer of the municipality (b) the hiring or dismissal of any employee of the municipality (c) the disposition of any real or personal property of the municipality which had a value exceeding $50,000 when it was acquired by the municipality; and (d) making any expenditures or incurring any other liability which exceeds $50,000.00
AND WHEREAS Section 275(6) of the Act states that nothing prevents any person or body exercising any authority that is delegated to the person or body prior to nomination day;
AND WHEREAS South Frontenac Council is currently involved in a number of capital projects and it is critical that the timely completion of these projects may not be delayed due to the restrictions placed on Council;
NOW THEREFORE the Council of the Corporation of the Township of South Frontenac deems it expedient to enact as follows:
- That the Chief Administrative Officer be delegated the following authority from Council:
Approve change orders related to ongoing projects which exceed the threshold of $50,000.00 .
Execute contracts for projects authorized in the 2010 Budget Determine whether it is in the best interests of the Township to continue current negotiations and the attempt to reach a settlement. This authority does not

To hire or dismiss any employee of the municipality, based on a prudent

include ratification of a new Collective Agreement. assessment of the situation. 2.
That the delegated authority shall be for the duties as detailed in Section 1 of this bylaw only.
That the delegated authority as outlined in this by-law shall be in effect for the period from September 10, 2010 until the date that the new Council takes office in December 2010.
That accountability and the transparency of the delegate’s actions shall be to the Council of the Township of South Frontenac.
- That this by-law shall come into force and take effect on the date of final passing.
