TOWNSHIP OF SOUTH FRONTENAC BY-LAW NUMBER 2011-18

BEING A BY-LAW TO AMEND BY-LAW NUMBER 2003-75, AS AMENDED, TO JUEZONE LANDS FROM SPECIAL RURAL (RU-37) ZONE TO COMMUNITY FACILITY (CF) ZONE; SPECIAL URBAN MULTIPLE

RESIDENTIAL (UMR-2)^ ZONE; ENVIRONMENTAL PROTSCTION (EP) ZONE; SPECIAL RESIDENTIAL (R-25) ZONE; AND SPECIAL RESIDENTIAL (R-26) ZONE: PART LOT 3, CONCESSION IV, DISTRICT OF LOUGHBOROUGH: VALLEYVIEW ESTATES

WHEREAS, the Municipal Council of the Township of South Frontenac deems it

expedient to amend By-law Number 2003-75 as amended, as it relates to a parcel of land located in Part of Lot 3, Concession IV of the District ofLoughborough.

NOW THEREFORE TH2 CORPORATION OF THE TOWNSHIP OF SOU FRONTENAC BY ITS COUNCIL, HEREBY ENACTS AS FOLLOWS:

  1. THAT Schedule ‘B’ to Zoning By-law Number 2003-75 as amended, is hereby further amended by changing the zoning from Special Rural (RU-37) Zone to Community Facility (CF) Zone; Special Urban Multiple Residential (UMR-2) Zone; Environmental Protection (EP) Zone; Special Residential (R-25) Zone; and Special Residential (R-26) Zone for those lands shown on the attached map designated as Schedule “I”.

  2. THAT Zoning By-law number 2003-75 as amended is hereby further amended by adding a new section UMR-2 (Lot 3, Concession IV, Loughborough - Valleyview Estates), immediately after section UMR-1 (Lot 19, Concession XI, Portland District - R. Ball), to read as follows:

UMR-2 (Part Lot 3, Concession IV, Louehboroush District - Vallewiew Estates)

Notwithstanding the provisions of sections 5.8.2, 16.3.1, 32.3 or any other provision of this By-law to the contrary, on the lands zoned Special Urban Multiple Residential (UMR-2) Zone, the following provisions shall apply. Zone Regulations

no building or structure shall be located within the 30 metre setback from the wetland .

The permitted uses may be contained in more than one building on the lot.

All other provisions of this by-law shall apply. 3.

THAT the uses permitted in the UMR-2 zone be subject to a site plan agreement to be entered into between the owner and the municipality and registered on the

title of the property specifying, among other things, locations of all buildings and structures; septic system; stormwater treatment; lighting; garbage areas; landscaped buffers; parking and manoeuvring areas and aisles and entrance locations and design.

  1. THAT Zoning By-law number 2003-75 as amended is hereby further amended by addmg a new section R-26 (Lot 3, Concession IV, Loughborough - Valleyview Estates) immediately after section R-25 (Lot 3, Concession W, Loughborough Valleyview Estates), to read as follows:

R-26 (Part Lot 3, Concession TV, Louehboroueh District - Vallewiew Estates)

Notwithstanding the provisions of section 12.3 or any other provision of this Bylaw to the contrary, on the lands zoned Special Residential (R-26) Zone, the following provisions shall apply. Zone Regulations .

4,000 sq. m (1 ac.) 25 metres (82 ft.)

6 metres (20 ft.) for principal building 3 metres (9.8 ft.) for accessory buildings .

Interior Side Yard (Minimum)

1.5 metres (5 ft.) on one side and 3 metres (10 ft.) on the other

All other provisions of this by-law shall apply. 6.

THAT THIS BY-LAW shall come into force in accordance with sections 34 and

41 of the Planning Act, 1990, either on the date of passage or as otherwise provided by sections 34 and 41. Dated at the Township of South Frontenac this fifteenth day of March, 2011.
