TOWNSHIP OF SOUTH FRONTENAC BY-LAW 2011-20
A_BY~_LAW TO APPROVE FOR THE CHARGING OF SERVICES WITH
REGARD To SOUTH FRONTENAC FIRE AND RESCUE RESPONDING TO MOTOR VEHICLE ACCIDENTS
WHEREAS the Municipal Act, S.O. 2001, c. 25, Section 390 authorizes a municipality to establish fees and charges for various services provided by the municipality; AND WHEREAS South Frontenac Fire and Rescue are a department within the Township of South Frontenac;
^^^^J^^^J^^^^O^?u^.^l?UJ:T_ac.iwis!les to establish common billing practices for the provision of services provided by the Fire and Rescue with regard to motor vehicles accidents throughout the Township.
AND WHEREAS the Township of South Frontenac deems it necessary to recover the costs associated with providing this service to residents and non-residents:
NOW THEREFORE THE CORPORATION OF THE TOWNSHIP OF SOUTH
FRONTENAC, BY ITS COUNCIL, HEREBY ENACTS AS FOLLOWS:
Insurance companies will be billed quarterly for all motor vehicle accidents for residents and non-residents.
Billing rates shall be consistent with the cmrent Ministry of Transportation rate per vehicle.
The amount collected shall be deemed offset revenue.
- The municipality shall absorb all or partial amounts under the following circumstances:
(i) The vehicle owner does not submit a claim to their msurance company (ii) The insurance company covers only partial payment (iii) The Fire Department is cancelled enroute to the accident.
(iv) The insurance company provides a letter advismg that no claim has been made or that only partial payment will be made.
