TOWNSHIP OF SOUTH FRONTENAC BY-LAW 2014-30
A BY-LAW TO AUTHORIZE THE EXECUTION OF AN OWNERSHIP
TRANSFER AGREEMENT BETWEEN THE TOWNSHIP OF SOUT FRONTENAC AND THE COUNTY OF LENNOX AND ADDINGTON FOR THE PETWORTH BRIDGE.
WHEREAS, pursuant to Section 8 of the Municipal Act, 2001, as amended, a mumcipality is empowered to pass by-laws for the operation of the municipality and to enter into agreements:
AND WHEREAS, pursuant to Sections 11 and 27 of the Municipal Act, 2001, as amended, a Council of a municipality may pass by-laws in respect of a highway under its jurisdiction:
AND WHEREAS the Council of the Corporation of the Township of South Frontenac deems it necessary and expedient to authorize the Township to enter into an agreement with the County of Lcnnox and Addington for the transfer of
ownership and complete responsibility of the Petworth Bridge from the County to
the Township;
AND WHEREAS the Council of the Corporation of the Township of South Frontenac deems it necessary and expedient to designate the Township’s signing officers for the agreement:
NOW THEREFORE, the Council of the Corporation of the Township of South Frontenac enacts as follows:
- That the Corporation of the Township of South Frontenac is authorized to enter into a transfer of ownership agreement with the Corporation of the County ofLennox and Addington hereto attached as Schedule “A”;
That the Mayor and CMef Administrative Officer be confirmed as the signing officers for the Corporation of the Township of South Frontenac; and
- That Schedule “A” is hereby deemed to be an integral portion of this by-law;
That this by-law shall come into force and take effect on the date of its passing

BETWEEN:
THE CORPORATION OF THE COUNTY OF LENNOX & ADMNGTON (referred to herem as “L&A”) and
THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC (referred to herein as “SF”)
WHEREAS there is a bridge which crosses ti-ie Napanee River located entirely wifhin the
geographicboundanesofSF.hich is kno^ locally as the “Petworth Bridge-.-and is located shown on the attached map;
as
AND^WHEREAS historically because of its position in proximity to the boundary of the L&A
with the County ofFrontenac, the Petworth Bridge has been jomtly maintained by L&A and originally the County ofFrontenac but most recently SF;
AND WHEREAS Councils ofL&A and SF have by resolutions CC-13-233 and 2014-03-07 respectively approved proceeding with entering into this agreement under which SF shall
assume
owne-ship and complete responsibility for the Petworth Bridge; y
NOW THEREFORE Ae parties agree as follows:
L&A hereby transfers to SF all its right, title and interest in fhe Petworth Bridge.
SF hereby agrees to assume ownership and all responsibility for maintenance and repaire to the Petwortfa Bridge commencing from the date of this Agreement.
SF shall indemnify and hold L&A harmless fi-om any and all claims, costs, liabilities
whatsoever related to the Petworth Bridge arising on or after the date of this Agreement. 4. This Agreement is binding on the parties hereto and fheir successors. IN WITNESS WHEREOF fhe parties have executed fhis Agreement. THE CORPORATION OF THE COUNTY THE CORPORATION OP THE OF LENNOX & ADDINGTON
