TOWNSHIP OF SOUTH FRONTENAC BY-LAW 2014-0052

BEING a by-law respecting the licensing of lotteries

WHEREAS Section 23.1 of the Municipal Act, 2001, S.O. 2001, c.25 as amended (the Act) provides that without limiting sections 9, 10 and 11 of the Act, those sections authorize a

municipality to delegate its powers and duties under this or any other Act to a person or body

subject to the restrictions set out in this Part;

AND WHEREAS The Council of the Township of South Frontenac adopted By-law 2007-81 on the th 20m day of November 2007, being a by-law to adopt a delegation of authority policy as per Section 270(1) of the Act;

AND WHEREAS Section 5(i) of By-law 2007-81 states that all delegations of Council powers, duties or functions shall be by by-law;

NOW THEREFORE the Council of the Township of South Frontenac, enacts as follows: DEFINITIONS 1.

In this by-law:

a) Tottery Licensing Officer” means the Clerk Administrator, Treasurer or Deputy Treasurer of the Township of South Frontenac

b) “Charitable Organization” means a registered charitable organization which performs services to" .

iv. other purposes beneficial to the community not falling under i, ii, iii, and benefits the public at large, not a private group. GENERAL 2.

The Lottery Licensing Officer may issue licenses to conduct the following lottery schemes:

a) bingo events where the total cash prize value to be awarded on any one occasion does not exceed $5,500

b) media bingo events where the total cash prize value to be awarded on any one occasion does not exceed $5,500

c) raffle lotteries where the total value of the prizes to be awarded does not exceed $50,000 d) break open ticket lotteries bazaars e) 3.

That all charitable and religious organizations wishing to conduct and manage a lottery scheme, shall first procure a license from the Lottery Licensing Officer.

ThaUhe said licenses shall be issued in the form set out. and subject to all terms and conditions set from time to time by the Alcohol and Gaming Commission of Ontario.

FEES 5.

That the fees for such lotteries shall be as follows: Bingos, Raffles & Bazaars

1.5% of prizes

Break Open Tickets

1.5% of prizes

ENACTMENT

  1. That this by-law shall come into force on the day of its passing. READ A FIRST AND SECOND TIME this 2nd day of September 2014. READ A THIRD TIME, SIGNED, SEALED AND FINALLY PASSED this 2nd day of September 2014.
