TOWNSHIP OF SOUTH FRONTENAC BY-LAW NUMBER 2015-09
BEING A BY-LAW TO AMEND BY-LAW NUMBER 2003-75, AS AMENDED, TO REZONE LANDS FROM RURAL (RU) TO SPECIAL LIMITED SERVICE
RESIDENTIAL HOLDING (RLS-5-H), SPECIAL LIMITED SERVICE RESIDENTIAL-WATERFRONT HOLDING (RLSW-96-H); SPECIAL LIMITED
SERVICE RESIDENTIAL-WATERFRONT HOLDING (RLSW-97-H) AND OPEN SPACE PRIVATE (OSP); PART LOT 26, CONCESSION X, DISTRICT OF STORMNGTON: THOMSON.
WHEREAS, the Municipal Council of the Township of South Frontenac deems it expedient to amend By-law Number 2003-75 as amended, as it relates to a parcel of land located m Part of Lot 26, Concession X, in the District of Stomngton,
NOW THEREFORE THE CORPORATION OF THE TOWNSHIP OF SOUTH
FRONTENAC BY ITS COUNCIL, HEREBY ENACTS AS FOLLOWS:
- THAT Schedule <C’ to Zoning By-law Number 2003-75 as amended, is hereby further amended by changing the zoning from Rural (RU) to Special Limited Service Residential Holding (RLS-5-h), Special Limited Service ResidentiaJWaterfront Holding (RLSW-96-h), Special Limited Service ResidentialWaterfront Holding (RLSW-97 -h ) and Open Space Private (OSP) for those lands shown on the attached map designated as Schedule “I”.
- THAT Zoning By-law Number 2003-75 as amended is hereby further amended by adding a new section RLS-5 immediately after section RLS-4(Part Lot 2, Concession XJII, Bedford District), to read as follows: RLS-5-h; (Part Lot 26, Concession X, Storrineton District)
Notwithstanding the provisions of section 9.3.1 or any other provision of this By-law to the contrary, on the lands zoned Special Limited Service Residential Holdmg (RLS-5-h), the following special provision shall apply: Setback from any inland pond (Minimum)……….35 metres (115 ft.) The holding (“h”) symbol is to be removed by by-law to permit development only when a Plan of Condominium Agreement between the property-owner and the Township has been entered into and registered. All other provisions of this by-law shall apply.
- THAT Zoning By-law Number 2003-75 as amended is hereby further amended by adding a new section RLSW-96-h immediately after section RLSW-95 (Part Lot 18, Concession DC, Stomngton District, George), to read as follows: RLSW-96-h; (PartLot26, Concession X. Storrineton District)
Notwithstanding the provisions of section 10.3.1 or any other provision of
this By-law to the contrary, on the lands zoned Special Limited Service Residential Holding (RLSW-96-h), fee following special provision shall apply: Setback from Flood Control Elevation
of 98.65 GSC (highwater mark of lake) (Minimum)………………………………………….35 metres (115 ft.) The holding (“h”) symbol is to be removed by by-law to permit development only when a Plan of Condominium Agreement between the property-owner and the Township has been entered mto and registered. All other provisions of this by-law shall apply.
4. THAT Zoning By-law Number 2003-75 as amended is hereby further amended by adding a new section RLSW-97-h immediately after section RLSW-96-h (Part Lot 26, Concession X, Stomngton District), to read as follows: RLSW-97-h; ffart Lot 26. Concession X, Storrington District)
Notwithstanding the provisions of section 10.3.1 or any other provision of this By-law to the contrary, on the lands zoned Special Limited Service Residential Holding (RLSW-97-h), the following special provision shall apply: Rear Yard Setback (Minimum)………………………..5 metres (16 ft.) Setback from Flood Control Elevation of 98.65 GSC
(highwater mark of lake or inland waterway) Minunum……………………… “..”".""………..30 metres (98.4 ft.) The holdmg (“h”) symbol is to be removed by by-law to permit development only when a Plan of Condominium Agreement between the property-owner and the Township has been entered into and registered and a site plan agreement is entered into with the Township and registered on title specifying the location of all development relative to all required setbacks.
All other provisions of this by-law shall apply. 5.
THIS BY-LAW shall come into force in accordance with section 34 of the
Plannmg Act, 1990, either on the date of passage or as otherwise provided by section 34.
