TOWNSHIP OF SOUTH FRONTENAC BY-LAW2020-27 A BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC TO DELEGATETHE AUTHORITYTO GRANT CONSENTSAND VALIDATION CERTIFICATESTO STAFF.

WHEREASSection 54(2) of the Planning Act, RSO 1990, as amended, empowers the Council of a municipalityto delegate the authorityto grant consents and validation certificates to a Committee of Council or to an appointed officer by name or position occupied; AND WHEREAS the Council of the Corporation of the Township of South Frontenac deems it advisable to delegate the authority to grant consents and validation certificates for undisputed applicationsto an appointed officer;

NOWTHEREFORETHE COUNCILOF THE CORPORATIONOF THE TOWNSHIPOF SOUTH FRONTENAC ENACTSAS FOLLOWS: 1.

THAT the authority to grant undisputed consents and undisputed validation certificates,

as defined in this by-law, under Sections 53 and 57 of the Planning Act, RSO 1990, as amended, including the authority to change conditions of a provisional undisputed consent and validation certificates, is hereby delegated to the Director of Development Services, and in the Director’s absence, to the Senior Planner in the Development Services Department. 3.

An “undisputed consent” and “undisputed validation certificate” is a consent/certificate

application that satisfies all of the following chteria: .

Is consistent with the Provincial Policy Statement (s. 3(5) Planning Act); Does not require a plan of subdivision for the proper and orderly development of the municipality (s. 53(1) Planning Act);

Conforms with section 51(24) of the Planning Act,

.

Conforms with the Frontenac County Official Plan; Conforms with the South Frontenac Official Plan;

.

Complies with the South FrontenacZoning By-law(or will comply subject to a

.

standard condition of rezoning or minor variance); and Has no unresolved objections/concems raised from agencies or the public.

THAT the authority to change the conditions of undisputed consents and undisputed validation certificates as per subsection 53(23) ofthe Planning Act at anytime before a consent is given, and to determine if a change to conditions is minor or not as per

subsection 53(26) of the Planning Act for the purpose of giving notice, is hereby delegated to the Directorof Development Services, and in the Director’s absence, to the Senior Planner in the Development Services Department.

This By-law shall come into force and take effect on May 19th, 2020.
