TOWNSHIP OF SOUTH FRONTENAC BY—LAW2022-31 BEING A BY-LAW TO DELEGATE AUTHORITYTO THE CHIEF ADMINISTRATIVE OFFICER.
WHEREAS Section 23.1 of the Municipal Act, 2001, S.O. 2001, c.25 as amended (the Act) provides that without limiting sections 9, 10 and 11 of the Act, those sections authorize a municipality to delegate its powers and duties underthis or any other Act to a person or body subjectto the restrictions set out in this Part; AND WHEREAS The Council of the Township of South Frontenac adopted By—law 2007-81 on the 20th day of November 2007, being a by-law to adopt a delegation of authority policy as per Section 270(1) of the Act; AND WHEREAS Section 5(i) of By—law2007-81 states that all delegations of Council powers, duties or functions shall be by by—law; AND WHEREAS the Council of the Township of South Frontenac may be restricted from taking any of the following actions as set out inthe Section 275(3) of the Act, from the day after nomination day, being August 19”‘,2022 orthe day after election day, being October 24”‘,2022, until the date thatthe new Council takes office: the appointment or removal from office or any officer of the municipality (a) the hiring or dismissal of any employee ofthe municipality (b) the disposition of any real or personal property of the municipality which had (c) a value exceeding $50,000 when itwas acquired bythe municipality; and making any expenditures or incurring any other liability which exceeds (d) $50,000.00
AND WHEREAS Section 275(6) of the Act states that nothing prevents any person or body exercising any authority that is delegated to the person or body priorto nomination day;
AND WHEREAS South Frontenac Council does not wish the operations of the municipality to be limited by these restrictions; NOW THEREFORE the Council ofthe Corporation of the Township of South Frontenac deems it expedientto enact as follows:
That the Chief Administrative Officer be delegated the following authority from Council: To expend or incur liability, in the best interests of the Municipality, which may exceed the threshold of $50,000 Execute contracts in the best interests of the municipality including the sale of property To hire or dismiss any employee of the municipality based on a prudent assessment of the situation.
That this by—lawshall come into force on either August 19, 2022 or October 24, 2022 following a determination under Section 275(i) that Council’s actions are restricted.
That accountability and the transparency of the delegate’s the Council of the Township of South Frontenac.
That the delegated authority as outlined in this by—lawonce enacted shall be in effect for the period from August 19, 2022, until the date that the new Council takes office in November 2022.
