By-Law 2023-61 Being a By-law to authorize the execution of an Encroachment Agreement between and Adam Rayner relating to the existing the Township of South Frontenac structure located on the Township owned road allowance, District of Portland.
WHEREAS PURSUANT TO Section 9 of the ll/Iunicipa/Act, 2001, S.O. 2001, as amended, a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act;
AND WHEREAS pursuant to Section 5.3 of the Municipa/Act, 2001, 0.25, the powers of every Council shall be exercised by by—law; AND WHEREAS it is deemed expedient that the Township of South Frontenac enter into an agreement with Adam Rayner respecting the encroachment of the structure, being a residential building on the road allowance municipally known as Colebrook Road, District of Portland. AND WHEREAS such agreement is required to set out the terms and conditions of the provision of such encroachment; NOW THEREFORE the Council of the Township of South Frontenac enacts as follows: 1.
That the Mayor and the Clerk are hereby authorized, on behalf of the Township of South Frontenac, to enter into and execute under its corporate seal, an Encroachment Agreement with Adam Rayner.
That a copy of the said agreement shall remain attached to and form part of this by—lawmarked as Schedule A.
That the Owner(s) of the lands as of the date of by—lawpassage shall pay all costs associated with the development, passage and registration of this by—law.
That this By-law shall be registered in the Land Registry Office and the Municipality shall be provided with the appropriate documentation that the registration has been completed within ten (10) business days of the date of registration.
That passage of this By-law shall be deemed to include authorization to legal counsel to register the same in the Land Registry Office without further written
authorization. 6.
That this By-law shall come into force and effect on the final date of passing.
