By-Law Number 2026-10 A By-Law to Delegate Authority to the Chief Administrative Of?cer for certain Acts During the Restricted Authority “Lame Duck” Period Whereas Section 275 of the Municipal Act, 2001, 8.0. 2001, 0.25, as amended, restricts acts that a Council can take after Nomination Day (August 21 2026) until the new Term of Office commences) where three quarters of the members of the outgoing Council of the Municipality may not be returning, (the “Lame Duck Period”); Whereas Section 275 (3) of the Municipal Act, 2001, SO. 2001, c.25 restricts Council from taking action on the following during the Lame Duck Period:
.. . .
The appointment or removal from of?ce of any officer of the municipality; The hiring or dismissal of any employee of the municipality;
The disposition of any real or personal property of the municipality which has a value exceeding $50,000 at the time of disposal; and Making any expenditure or incurring any other liability which exceeds $50,000; unless the matter is included in the 2026 budget.
Whereas Section 275 (6) of the Municipal Act, 2001, SO. 2001, c. 25 states that nothing in this section prevents any person or body exercising authority of a municipality that is delegated to the person or body prior to nomination day for the election of the new council; Whereas Section 23.1 of the Municipal Act, 2001, SO. 2001, c. 25, authorizes a municipality to delegate its powers and duties under this or any other Act; and
And Whereas Council does not wish operations of the municipality to be limited during the Lame Duck Period; Whereas Council deems it expedient to delegate authority to the Chief Administrative Officer to take action, where necessary, on certain acts during the “Lame Duck” Period, if it applies, between August 21, 2026 and November 17, 2026. Therefore Be It Resolved hereby enacts as follows:
That the Council of the Corporation of the Township of South Frontenac
- That the Council of the Corporation of the Township of South Frontenac hereby delegates authority under Section 275 (3) of the Municipal Act 8.0. 2001 for the duration of the Lame Duck Period as follows: a) The Chief Administrative Officer be delegated authority to appoint or remove from office any officer of the municipality; b) The Chief Administrative Officer be delegated authority to hire or dismiss any employee of the municipality;
c) The Chief Administrative Officer be delegated authority to dispose of any real or personal property of the municipality which has a value exceeding $50,000 at the time of disposal; and d) The Chief Administrative Officer be delegated authority to make any expenditures or incurring any other liabilitywhich exceeds $50,000; and

Page 2 of 2 2. That the Chief Administrative Officer will report to Council on any actions undertaken pursuant to the delegated authority under section 1 of this By-Law. 3. This By-law shall come into force and take effect on the date of its passage, only in the event Council becomes “Lame Duck”.
