RE: (Company to be Named) Request for Municipal Support Resolution

We are seeking Municipal Council support for our Solar Garden sites (500 kW and 250 kW). All of the sites are sufficiently treed to allow the solar installations to be naturally screened from roads and neighbours. In a few instances additional trees will be added for additional screening where necessary. All of our sites are on non-prime 4-7 soil classifications in the Canada Land Inventory maps and they are all zoned “rural”.

We believe that the province will have a “carry on” program at the end of the 20 year FIT contracts. The sites should still be producing 80% of their peak capacity. However/ other options are available. The

landowner could purchase the solar assets and participate in net-metering or as a third option, we would decommission the site and return the land to its original state.

Construction will be as unobtrusive as possible with 8:00 am to 4:30 pm working hours. Noise and dust

will be kept at a minimum and we will meet all ministry standards. Local contractors will be employed during construction.

Local contractors will be employed over the life of the 20 year contract (operation and maintenance including electrical, grass cutting/ snow removal, panel washing etc).

A 500 kW project will prevent 175,000 tons of carbon from going into the atmosphere during the life of the contract.

RE: 1933360 Ontario Inc. Request for Municipal Support Resolution

We are seeking Municipal Council support for our Solar Garden sites (500 kW and 250 kW). All of the sites are sufficiently treed to allow the solar installations to be naturally screened from roads and neighbours. In a few instances additional trees will be added for additional screening where necessary. All of our sites are on non-prime 4-7 soil classifications in the Canada Land Inventory maps and they are all zoned “rural”.

We believe that the province will have a “carry on” program at the end of the 20 year FIT contracts. The sites should still be producing 80% of their peak capacity. However, other options are available. The

landowner could purchase the solar assets and participate in net-metering or as a third option, would decommission the site and return the land to its original state.

Construction will be as unobtrusive as possible with 8:00 am to 4:30 pm working hours. Noise and dust

will be kept at a minimum and we will meet all ministry standards. Local contractors will be employed during construction.

Local contractors will be employed over the life of the 20 year contract (operation and maintenance including electrical/ grass cutting/ snow removal, panel washing etc).

A 500 kW project wilt prevent 175/000 tons of carbon from going into the atmosphere during the life of the contract.

RE: (Company to be Named) Request for Municipal Support Resolution

We are seeking Municipal Council support for our Solar Garden sites (500 kW and 250 kW). All of the sites are sufficiently treed to allow the solar installations to be naturally screened from roads and neighbours. In a few instances additional trees will be added for additional screening where necessary. All of our sites are on non-prime 4-7 soil classifications in the Canada Land Inventory maps and they are all zoned “rural”.

We believe that the province will have a “carry on” program at the end of the 20 year FIT contracts. The sites should still be producing 80% of their peak capacity. However, other options are available. The

landowner could purchase the solar assets and participate in net-metering or as a third option/

would decommission the site and return the land to its original state.

Construction will be as unobtrusive as possible with 8:00 am to 4:30 pm working hours. Noise and dust

will be kept at a minimum and we will meet all ministry standards. Local contractors will be employed during construction.

Local contractors will be employed over the life of the 20 year contract (operation and maintenance/ grass cutting, snow removal, panel washing etc).

A 500 kW project will prevent 175,000 tons of carbon from going into the atmosphere during the life of the contract.

SUBJECT: Sydenham Water review RECOMMENDATION: This report is for information only. BACKGROUND: New rates were put into effect in June of 2014. This was the first rate adjustment and review undertaken since its inception. The rates that were put into effect incorporated direction received to: • Limit the shortfall in funding the future replacement of the plant • Phasing increases over 3 years after which a 2% inflation rate would be applied. • Differentiating the consumption rates between classes of users • Apply a non-consumption charge for users not connected or not using the water system within a billing cycle. Attached is Schedule A to By-law 2014-21 which provides for the rate structure as of June 1st, 2014. Also attached is a copy of the power point presentation used at the public meeting held on February 11th, 2014 which provides further background information. From this information, some important points include: • Existing legislation is geared towards the user pay principle in an effort to promote greater awareness of water protection and conservation. • Financial plans covering a minimum of 6 years are a requirement to obtain licensing renewals. The financial plan must show the long term sustainability of the water plant. ANALYSIS: The rate structure that was put in place in June of 2014 was an important step towards the sustainability of the water plant. In 2014, $12,516 was added to the existing reserve. Without the rate increase, a deficit of $24,186 would have needed to be funded from the water reserve. The chart below provides a comparison of the number of accounts and their classification from 2013 and 2014. In 2014, 2 accounts were added from the Morgan subdivision. Of the remaining accounts, 34 were previously classified with no consumption or not connected. Contributing to this increase is the Township`s communication efforts with residents in conjunction to the rate increase, and notifying non-connected accounts and accounts with meters from which a reading could not be received of the pending non-usage charge. This communication not only informed them of the rate change but also offered them an opportunity to schedule an appointment to have their meter looked at by the Township (through Utilities Kingston) to pinpoint why a reading could not be

obtained. 16 meters were returned to working order from this initiative. The remaining accounts could be attributed to the implementation of the non-usage charge. 2013

From June to December 2014, a total of $11,500 was billed through the nonusage charge. Although feedback was received from some residents stating that the non-usage charge was a penalty and that they are not using the system yet contributing more to the plant`s operations, the significant change in the number of accounts with no connection or no meter shows the effectiveness of the charge. The chart below provides consumption data comparing 2013 and 2014. From 2013 to 2014, overall consumption has grown by 6.9%. As well the last column provides the average quarterly consumption per account. Currently 54 m3 per quarter are included within the base rate. 3

Legislation • Originally the Sustainable Water and Sewage Act required municipalities that provide water to the public to implement a full cost accounting and full cost recovery including operating, replacement and improvement costs. • This legislation has since been replaced with Water Opportunities Act 2010 which requires municipalities to develop sustainability plans. • The Safe Drinking Water Act, regulation 453/07 also requires municipalities to provide financial plans covering a minimum of 6 years with the renewal of their license. The Township will be required to do so in the spring of 2014.

• This combined legislation seeks to introduce the principle that having the consumer pay the full cost of providing water will promote greater awareness of water protection and water conservation.

Current Financials • For the majority of the last few years, the Township has had to draw from reserves for the operations of the plant to breakeven. • As a result, funds are not being set aside for the future capital requirements of the plant and the existing reserves are being depleted to cover increasing operational costs. This provides a good indication of the minimum funds that should be set aside for the future capital requirements of the plant. • Fixed operational costs include communication, insurance and contracted services (Utilities Kingston) • Volumetric operational costs consist largely of hydro cost. SunEdison Canada is planning to submit a proposal to the Independent Electricity System Operator

(IESO) to develop three potential solar projects under the IESO’S Large Renewable Procurement (LRP) process within the Township of South Frontenac. The locations of these projects are outlined in the attached notices.

We would like to invite you to an upcoming community meeting to discuss the proposed projects. The meeting will be held at the Harrowsmith Public School, 4121 Colebrook Road, Harrowsmith, on Wednesday June 17, 2015 from 7:00 pm to 9:00 pm. An open house session is planned for the first hour, from 7:00 pm to 8:00 pm and a presentation followed by a question and answer period is planned for the last hour, from 8:00 pm to 9:00 pm.

This informational meeting will provide an opportunity to learn more about the proposed solar projects and meet team members from SunEdison Canada. Information, including each proposed projects boundary, proposed connection lines and environmental features will be on display throughout the

This public community meeting is being held as part of the early community engagement requirements of the LRP. Community Engagement Plan - Freeman Road Solar Project

Introduction The Large Renewable Procurement (LRP) is a competitive process for procuring large renewable energy projects (greater than 500 kW). The Independent Electricity System Operator (IESO; formerly the Ontario Power Authority) has designated SunEdison Canadian Construction LP as a Qualified Applicant under the LRP process based on the ability to meet a set of mandatory requirements focused on past development experience and financial capability. SunEdison Canadian Construction LP is now eligible to submit a proposal under the Request for Proposals (LRP I RFP) stage. SunEdison Canadian Construction LP is proposing to develop an up to 100 MW (AC) groundmount solar project, known as the Freeman Road Solar Project (hereinafter referred to as the “Project”). The Project will be located on part lots 16, 17 and 18, Concession 4, Portland, in the Township of South Frontenac, and part lots 47 top 49, Concessions 1 and 2 in the Township of Stone Mills. A map showing the Project Location is provided in Figure 1. An important part of the Project proposal will be meaningful community engagement. Accordingly, SunEdison Canadian Construction LP has commissioned Hatch to prepare this Community Engagement Plan for the Project. This Community Engagement Plan also addresses some of SunEdison Canadian Construction LP’s community engagement commitments beyond the LRP process should SunEdison Canadian Construction LP be awarded a contract from the IESO. 1.1

Community Engagement Plan - Freeman Road Solar Project

The Proponent: SunEdison Canadian Construction LP The Qualified Applicant of the Project is SunEdison Canadian Construction LP, a wholly owned subsidiary of SunEdison. The Registered Proponent for the Project will be SunEdison Canadian Construction LP, or an affiliate thereof (hereinafter jointly referred to as SunEdison Canadian Construction LP). SunEdison is a global provider of renewable energy services that is dedicated to transforming the way energy is generated, distributed, and owned around the globe. They manufacture solar technology and develop, finance, install, own and operate solar and wind energy power plants. 1.2

Community Engagement Plan - Freeman Road Solar Project

Project Overview SunEdison Canadian Construction LP is proposing to develop the Freeman Road Solar Project, a ground-mount solar project anticipated to have a capacity of up to 100 MW (AC). The Project will be located on part lots 16, 17 and 18, Concession 4, Portland, in the Township of South Frontenac, and part lots 47 top 49, Concessions 1 and 2 in the Township of Stone Mills. SunEdison Canadian Construction LP will be leasing the properties associated with the Project site from its current landowners. The Connection Line for this Project will run north along the Camden Portland Boundary Road, then east along Colebrook Road into Harrowsmith, then north to the intersection with Alton Road, at which point it will travel east to the Wallace Solar Project connecting via lines from Alton Road or Jamieson Road. The Project location is presented in Figure 1.

1.3

Large Renewable Procurement Process The LRP is a competitive process for procuring large renewable energy (solar, wind, waterpower, and bioenergy) projects. In the current process, the IESO may award contracts for up to 140 MW of solar power. The LRP Process requires that proposals be prepared and submitted to the IESO. These proposals must contain detailed information on the proposed Project as well as the company submitting the proposal (SunEdison Canadian Construction LP). The LRP Process also requires that community engagement activities be undertaken, and provides credit to projects that are able to obtain community support. However, as a competitive process, not all projects submitted to the IESO will be awarded contracts. The deadline for the submission of application under the LRP I RFP Process is September 1, 2015. The IESO currently anticipates awarding contracts by the end of 2015. Should this Project be successful in the LRP process, the Project would then move to obtain the requisite environmental permit, a Renewable Energy Approval (REA), from the Ontario Ministry of the Environment and Climate Change (MOECC) (see below). Should the Project not be successful in the LRP process, no further action would be taken at this time; however the Project may be resubmitted to the IESO under future procurement programs (such as the proposed LRP II RFP Process). Community Engagement Requirements

2.1

Large Renewable Procurement Process There are several mandatory community engagement requirements stipulated within the LRP Process. These include: 

Preparing and distributing this Community Engagement Plan

Hosting a community meeting, and providing notification of the community meeting via direct mail to landowners within 120 m of the Project, and via publication in local newspapers

Preparation of a meeting summary report upon the conclusion of the community meeting.

Renewable Energy Approval Process Should the Project be successful in the LRP Process, there will be additional community engagement requirements associated with the REA Process, including: 

Further meetings with officials from the local municipality, and provision of a prescribed municipal consultation form

Maintaining the Project website, on which additional REA documents will be made available

Preparing and making available for review, various requisite Project reports

Hosting of two community meetings, and providing notice of the community meetings via direct mail to landowners within 120 m of the Project site, and publication in local newspapers

Preparation of a consultation report upon conclusion of the above activities

Community Engagement Plan

3.1

Objectives of Community Engagement The objectives of community engagement as proposed within this Community Engagement Plan are consistent with those identified in the MOECC Environmental Assessment and Approvals Branch’s (EAAB’s) Code of Practice: Consultation in Ontario’s Environmental Assessment Process1, and include: 

Provision of Project information to the community

Identification of potential stakeholders who may have an interest in or be affected by the Project

Ensuring that municipalities and members of the public are notified and consulted early in the development process

Obtaining local input regarding the Project in the form of questions and comments

Identification of and responding to concerns which may arise as a result of the Project.

To ensure this occurs, SunEdison Canadian Construction LP is committed to maintaining open and honest communications with stakeholders throughout the development, and ultimately construction and operation of this Project should it occur.

3.2

Publication and Distribution of this Community Engagement Plan In accordance with Section 3.2.5(a) of the LRP I RFP2 this Community Engagement Plan will be continuously posted on the Project website 15 days prior to the date of the community meeting until the IESO announcement of the Selected Proponents for LRP I RFP. In accordance with Section (iv), a copy of this Community Engagement Plan will also be delivered to the Clerk of the local municipality. Should the Project receive a contract from the IESO, this Community Engagement Plan will remain on the Project website for the life of the Project, and will be updated periodically as necessary.

3.3

Engagement Strategies and Activities

3.3.1

Project Website Project information, including this Community Engagement Plan (as discussed in Section 3.2 above), will be posted to the Project website: www.sunedison.ca/freeman and updated, as necessary, throughout the LRP I RFP process. Should the Project receive a contract from the IESO, the Project website will remain active for the life of the Project, and will be used to post regular information updates, as well as required documentation during the REA process.

3.3.2

Meetings with Township of South Frontenac Officials SunEdison Canadian Construction LP has already engaged various officials of the Township of South Frontenac with respect to this Project, including a presentation before Council. This engagement with officials from the Township of South Frontenac is intended to continue throughout the development of the Project. SunEdison Canadian Construction LP will be appearing before the Committee of the Whole on June 18, 2015, and requesting a Council support resolution in support of this Project during the July 7, 2015 Council meeting. Those wishing to appear before Council regarding this Project at either of the meetings identified can contact the Township’s Chief Administrative Officer Wayne Orr at 613-376-3027 x2225 or worr@southfrontenac.net to discuss any requirements. A formal submission will be required at least 7 days prior to the date of the meeting.

The community meeting will take place within the Township of South Frontenac from 6:00 to 8:00 pm on June 17, 2015. The community meeting will be held at the Harrowsmith Public School, 4121 Colebrook Road, Harrowsmith, ON. The first hour of the community meeting will be an open house format with poster board displays available for review, while during the second hour a town hall meeting will be held with a presentation from SunEdison Canadian Construction LP, followed by a question and answer period. Copies of the poster boards will be made available in hard copy format to be kept for future reference. Copies can also be obtained for those unable to attend the meeting by contacting one of the individuals listed in Section 3.3.6. Notification of the community meeting will be undertaken as detailed in Section 3.3.3.1 above. 3.3.3.3

Meeting Summary Report A meeting summary report will be prepared following the community meeting described in Section 3.3.3.2. It is anticipated that the report will include: 

Copies of all materials presented during the community meeting

Summaries of all comments and questions submitted, and SunEdison Canadian Construction LP. response.

A copy of the meeting summary report will be posted to the Project website and distributed to the Clerk of the local municipality. 3.3.4

Renewable Energy Approval Community Meetings Should the Project receive a contract from IESO, the Project would then be required to obtain a REA from the MOECC prior to construction. As part of this process, two public meetings will be held. Locations, dates and times of the public meetings would be determined at a later date; however, further information is provided below with respect to Notifications and timelines.

3.3.4.1

Community Engagement Plan - Freeman Road Solar Project

Renewable Energy Approval First Community Meeting The first community meeting in the REA process is held after the Project Description Report has been prepared. The Project Description Report provides general information on the proposed project, along with a preliminary assessment of potential impacts and mitigation measures to be employed to minimized environmental impacts. Notices for the public meeting will be distributed to all individuals on the stakeholder mailing list identified in Section 3.3.3.1, along with any additional stakeholders who have indicated an interest in being on the Project mailing list. The Notice will also be posted in local newspapers on two separate occasions, one of which is at least 30 days prior to the community meeting date.

3.3.4.2

Renewable Energy Approval Second Community Meeting The second community meeting in the REA process is held after all of the various reports, required as part of an REA application (with the exception of the Consultation Report) are prepared. The reports will be made available for public review (both on the Project website and at the local municipal office) 60 days prior to the public meeting date. Notices for the public meeting will again be distributed to all individuals on the stakeholder mailing list, and will be posted in local newspapers on two separate occasions, one of which is at least 60 days prior to the date of the community meeting.

3.3.4.3

Consultation Report At the conclusion of the REA process, a Consultation Report will be prepared summarizing the results of all consultation activities, and questions and comments received from the public and other interested parties, will be assembled and submitted with the REA Application to the MOECC.

3.3.5

Ongoing Engagement during Project Construction and Facility Operations Once all permits and approvals have been obtained, the facility will proceed into construction, and then operations. Throughout this period, a sign will be maintained at the Project site to provide contact information for representatives of SunEdison Canadian Construction LP. Based on feedback from the public and municipal representatives during earlier engagement activities, additional engagement activities that will be considered during this time may include issuance of Project newsletters, formation of a Community Liaison Committee, educational outreach to local schools, or additional public meetings

Community Engagement Plan - Groenewegen Solar Project

Introduction The Large Renewable Procurement (LRP) is a competitive process for procuring large renewable energy projects (greater than 500 kW). The Independent Electricity System Operator (IESO; formerly the Ontario Power Authority) has designated SunEdison Canadian Construction LP as a Qualified Applicant under the LRP process based on the ability to meet a set of mandatory requirements focused on past development experience and financial capability. SunEdison Canadian Construction LP is now eligible to submit a proposal under the Request for Proposals (LRP I RFP) stage. SunEdison Canadian Construction LP is proposing to develop an up to 50 MW (AC) groundmount solar project, known as the Groenewegen Solar Project (hereinafter referred to as the “Project”). The Groenewegen Solar Project is located on part lots 7, 8 and 9, Concession 1 Portland, and on part of lots 7 and 8, Concession 3, Portland, in the Township of South Frontenac. A map showing the Project Location is provided in Figure 1. An important part of the Project proposal will be meaningful community engagement. Accordingly, SunEdison Canadian Construction LP has commissioned Hatch to prepare this Community Engagement Plan for the Project. This Community Engagement Plan also addresses some of SunEdison Canadian Construction LP’s community engagement commitments beyond the LRP process should SunEdison Canadian Construction LP be awarded a contract from the IESO. Community Engagement Plan - Groenewegen Solar Project

The Proponent: SunEdison Canadian Construction LP The Qualified Applicant of the Project is SunEdison Canadian Construction LP, a wholly owned subsidiary of SunEdison. The Registered Proponent for the Project will be SunEdison Canadian Construction LP, or an affiliate thereof (hereinafter jointly referred to as SunEdison Canadian Construction LP). SunEdison is a global provider of renewable energy services that is dedicated to transforming the way energy is generated, distributed, and owned around the globe. They manufacture solar technology and develop, finance, install, own and operate solar and wind energy power plants. Community Engagement Plan - Groenewegen Solar Project

Project Overview SunEdison Canadian Construction LP is proposing to develop the Groenewegen Solar Project, a ground-mount solar project anticipated to have a capacity of up to 50 MW (AC). The Groenewegen Solar Project is located on part lots 7, 8 and 9, Concession 1 Portland, and on part of lots 7 and 8, Concession 3, Portland, in the Township of South Frontenac. SunEdison Canadian Construction LP will be leasing the properties associated with the Project site from its current landowners. The Connection Line for this Project will run north from the Project along Florida Road, to the intersection with Henderson Road, where it will travel east to the intersection with Yarker Road, and then east to the Intersection with Highway 38. From here, the Connection line will either (i) travel north through Harrowsmith to the Wallace Solar Project, connecting via lines from Alton Road or Jamieson Road or (ii) travel south along Highway 38 to one of two possible Connection Points in the City of Kingston. The Project location is presented in Figure 1.

1.3

Large Renewable Procurement Process The LRP is a competitive process for procuring large renewable energy (solar, wind, waterpower, and bioenergy) projects. In the current process, the IESO may award contracts for up to 140 MW of solar power. The LRP Process requires that proposals be prepared and submitted to the IESO. These proposals must contain detailed information on the proposed Project as well as the company submitting the proposal (SunEdison Canadian Construction LP). The LRP Process also requires that community engagement activities be undertaken, and provides credit to projects that are able to obtain community support. However, as a competitive process, not all projects submitted to the IESO will be awarded contracts. The deadline for the submission of application under the LRP I RFP Process is September 1, 2015. The IESO currently anticipates awarding contracts by the end of 2015. Should this Project be successful in the LRP process, the Project would then move to obtain the requisite environmental permit, a Renewable Energy Approval (REA), from the Ontario Ministry of the Environment and Climate Change (MOECC) (see below). Should the Project not be successful in the LRP process, no further action would be taken at this time; however the Project may be resubmitted to the IESO under future procurement programs (such as the proposed LRP II RFP Process). Community Engagement Requirements

Large Renewable Procurement Process There are several mandatory community engagement requirements stipulated within the LRP Process. These include:

Creating and maintaining a Project website, on which various documents must be made available

Preparing and distributing this Community Engagement Plan

Hosting a community meeting, and providing notification of the community meeting via direct mail to landowners within 120 m of the Project, and via publication in local newspapers

Preparation of a meeting summary report upon the conclusion of the community meeting.

Renewable Energy Approval Process Should the Project be successful in the LRP Process, there will be additional community engagement requirements associated with the REA Process, including: 

Further meetings with officials from the local municipality, and provision of a prescribed municipal consultation form

Maintaining the Project website, on which additional REA documents will be made available

Preparing and making available for review, various requisite Project reports

Hosting of two community meetings, and providing notice of the community meetings via direct mail to landowners within 120 m of the Project site, and publication in local newspapers

Preparation of a consultation report upon conclusion of the above activities

Community Engagement Plan

3.1

Objectives of Community Engagement The objectives of community engagement as proposed within this Community Engagement Plan are consistent with those identified in the MOECC Environmental Assessment and

Approvals Branch’s (EAAB’s) Code of Practice: Consultation in Ontario’s Environmental Assessment Process1, and include: 

Provision of Project information to the community

Identification of potential stakeholders who may have an interest in or be affected by the Project

Ensuring that municipalities and members of the public are notified and consulted early in the development process

Obtaining local input regarding the Project in the form of questions and comments

Identification of and responding to concerns which may arise as a result of the Project.

To ensure this occurs, SunEdison Canadian Construction LP is committed to maintaining open and honest communications with stakeholders throughout the development, and ultimately construction and operation of this Project should it occur.

3.2

Publication and Distribution of this Community Engagement Plan In accordance with Section 3.2.5(a) of the LRP I RFP2 this Community Engagement Plan will be continuously posted on the Project website 15 days prior to the date of the community meeting until the IESO announcement of the Selected Proponents for LRP I RFP. In accordance with Section (iv), a copy of this Community Engagement Plan will also be delivered to the Clerk of the local Municipality. Should the Project receive a contract from the IESO, this Community Engagement Plan will remain on the Project website for the life of the Project, and will be updated periodically as necessary.

3.3

Engagement Strategies and Activities

3.3.1

Project Website Project information, including this Community Engagement Plan (as discussed in Section 3.2 above), will be posted to the Project website: www.sunedison.ca/groenewegen and updated, as necessary, throughout the LRP I RFP process. Should the Project receive a contract from the IESO, the Project website will remain active for the life of the Project, and will be used to post regular information updates, as well as required documentation during the REA process.

3.3.2

Community Engagement Plan - Groenewegen Solar Project

Meetings with Township of South Frontenac Officials SunEdison Canadian Construction LP has already engaged various officials of the Township of South Frontenac with respect to this Project, including a presentation before Council. This engagement with officials from the Township of South Frontenac is intended to continue throughout the development of the Project. SunEdison Canadian Construction LP will be appearing before the Committee of the Whole on June 18, 2015, and requesting a Council support resolution in support of this Project during the July 7, 2015 Council meeting. Those wishing to appear before Council regarding this Project at either of the meetings identified can contact the Township’s Chief Administrative Officer Wayne Orr at 613-376-3027 x2225 or worr@southfrontenac.net to discuss any requirements. A formal submission will be required at least 7 days prior to the date of the meeting.

3.3.3

Large Renewable Procurement Community Meeting A community meeting will be held in the Township of South Frontenac during summer 2015. Further information on this meeting is provided below

distributed to neighbouring landowners abutting and within 300 m of the boundary of the Project site

distributed to every First Nation and Métis community that may be affected by or otherwise interested in the Project

distributed to the Clerk of the local Municipality

distributed to the Director, Environmental Approvals Access and Service Integration Branch, MOECC

distributed to the secretary of every company operating an oil or natural gas pipeline if a pipeline right-of-way is located within 200 m of the Project

distributed to the secretary-treasurer of the Cataraqui Region Conservation Authority.

Community Meeting A community meeting will be held to discuss the Project with members of the local community. As per Section 3.2.5(c) the following information will be made available on display during the meeting:

The community meeting will take place within the Township of South Frontenac from 6:00 to 8:00 pm on June 17, 2015. The community meeting will be held at the Harrowsmith Public School, 4121 Colebrook Road, Harrowsmith, ON. The first hour of the community meeting will be an open house format with poster board displays available for review, while during the second hour a town hall meeting will be held with a presentation from SunEdison Canadian Construction LP, followed by a question and answer period. Copies of the poster boards will be made available in hard copy format to be kept for future reference. Copies can also be obtained for those unable to attend the meeting by contacting one of the individuals listed in Section 3.3.6. Notification of the community meeting will be undertaken as detailed in Section 3.3.3.1 above. 3.3.3.3

Meeting Summary Report A meeting summary report will be prepared following the community meeting described in Section 3.3.3.2. It is anticipated that the report will include: 

A copy of the meeting summary report will be posted to the Project website and distributed to the Clerk of the local municipality. 3.3.4

Renewable Energy Approval Community Meetings Should the Project receive a contract from IESO, the Project would then be required to obtain a REA from the MOECC prior to construction. As part of this process, two public meetings will be held. Locations, dates and times of the public meetings would be determined at a later date; however, further information is provided below with respect to Notifications and timelines.

3.3.4.1

Renewable Energy Approval First Community Meeting The first community meeting in the REA process is held after the Project Description Report has been prepared. The Project Description Report provides general information on the proposed project, along with a preliminary assessment of potential impacts and mitigation measures to be employed to minimized environmental impacts. Notices for the public meeting will be distributed to all individuals on the stakeholder mailing list identified in Section 3.3.3.1, along with any additional stakeholders who have indicated an interest in being on the Project mailing list. The Notice will also be posted in local newspapers on two separate occasions, one of which is at least 30 days prior to the community meeting date.

3.3.4.2

Renewable Energy Approval Second Community Meeting The second community meeting in the REA process is held after all of the various reports, required as part of an REA application (with the exception of the Consultation Report) are prepared. The reports will be made available for public review (both on the Project website and at the local municipal office) 60 days prior to the public meeting date. Notices for the public meeting will again be distributed to all individuals on the stakeholder mailing list, and will be posted in local newspapers on two separate occasions, one of which is at least 60 days prior to the date of the community meeting.

3.3.4.3

Consultation Report At the conclusion of the REA process, a Consultation Report will be prepared summarizing the results of all consultation activities, and questions and comments received from the public and other interested parties, will be assembled and submitted with the REA Application to the MOECC.

3.3.5

Ongoing Engagement during Project Construction and Facility Operations Once all permits and approvals have been obtained, the facility will proceed into construction, and then operations.

Community Engagement Plan - Wallace Solar Project

Introduction The Large Renewable Procurement (LRP) is a competitive process for procuring large renewable energy projects (greater than 500 kW). The Independent Electricity System Operator (IESO; formerly the Ontario Power Authority) has designated SunEdison Canadian Construction LP as a Qualified Applicant under the LRP process based on the ability to meet a set of mandatory requirements focused on past development experience and financial capability. SunEdison Canadian Construction LP is now eligible to submit a proposal under the Request for Proposals (LRP I RFP) stage. SunEdison Canadian Construction LP is proposing to develop an up to 50 MW (AC) groundmount solar project, known as the Wallace Solar Project (hereinafter referred to as the “Project”). The Project will be located on private property on Part Lots 5 and 6, Concession 6, in the Township of South Frontenac. A map showing the Project Location is provided in Figure 1. An important part of the Project proposal will be meaningful community engagement. Accordingly, SunEdison Canadian Construction LP has commissioned Hatch to prepare this Community Engagement Plan for the Project. This Community Engagement Plan also addresses some of SunEdison Canadian Construction LP’s community engagement commitments beyond the LRP process should SunEdison Canadian Construction LP be awarded a contract from the IESO. 1.1

Community Engagement Plan - Wallace Solar Project

The Proponent: SunEdison Canadian Construction LP The Qualified Applicant of the Project is SunEdison Canadian Construction LP, a wholly owned subsidiary of SunEdison. The Registered Proponent for the Project will be SunEdison Canadian Construction LP, or an affiliate thereof (hereinafter jointly referred to as SunEdison Canadian Construction LP). 1.2

Community Engagement Plan - Wallace Solar Project

Project Overview SunEdison Canadian Construction LP is proposing to develop the Wallace Solar Project, a ground-mount solar project anticipated to have a capacity of up to 50 MW (AC). Located on Part Lots 5 and 6, Concession 6, in the Township of South Frontenac, the nearest intersection to the Project site is Alton Road and Highway 38, north of the community of Harrowsmith. SunEdison Canadian Construction LP will be leasing the properties associated with the Project site from its current landowners. The Project will be connected to the transmission network via transmission lines which currently cross the properties associated with the Project site. As a result, no off-site connection line is required for this Project. The Project location is presented in Figure 1.

1.3

Large Renewable Procurement Process The LRP is a competitive process for procuring large renewable energy (solar, wind, waterpower, and bioenergy) projects. In the current process, the IESO may award contracts for up to 140 MW of solar power. The LRP Process requires that proposals be prepared and submitted to the IESO. These proposals must contain detailed information on the proposed Project as well as the company submitting the proposal (SunEdison Canadian Construction LP). The LRP Process also requires that community engagement activities be undertaken, and provides credit to projects that are able to obtain community support. However, as a competitive process, not all projects submitted to the IESO will be awarded contracts. The deadline for the submission of application under the LRP I RFP Process is September 1, 2015. The IESO currently anticipates awarding contracts by the end of 2015. Should this Project be successful in the LRP process, the Project would then move to obtain the requisite environmental permit, a Renewable Energy Approval (REA), from the Ontario Ministry of the Environment and Climate Change (MOECC) (see below). Should the Project not be successful in the LRP process, no further action would be taken at this time; however the Project may be resubmitted to the IESO under future procurement programs (such as the proposed LRP II RFP Process). Community Engagement Requirements

2.1

Preparation of a meeting summary report upon the conclusion of the community meeting.

Renewable Energy Approval Process Should the Project be successful in the LRP Process, there will be additional community engagement requirements associated with the REA Process, including: 

Further meetings with officials from the local municipality, and provision of a prescribed municipal consultation form

Maintaining the Project website, on which additional REA documents will be made available

Preparing and making available for review, various requisite Project reports

Hosting of two community meetings, and providing notice of the community meetings via direct mail to landowners within 120 m of the Project site, and publication in local newspapers

Preparation of a consultation report upon conclusion of the above activities

Community Engagement Plan

3.1

Objectives of Community Engagement The objectives of community engagement as proposed within this Community Engagement Plan are consistent with those identified in the MOECC Environmental Assessment and Approvals Branch’s (EAAB’s) Code of Practice: Consultation in Ontario’s Environmental Assessment Process1, and include: 

Provision of Project information to the community

Identification of potential stakeholders who may have an interest in or be affected by the Project

Ensuring that municipalities and members of the public are notified and consulted early in the development process

Obtaining local input regarding the Project in the form of questions and comments

Identification of and responding to concerns which may arise as a result of the Project.

To ensure this occurs, SunEdison Canadian Construction LP is committed to maintaining open and honest communications with stakeholders throughout the development, and ultimately construction and operation of this Project should it occur.

3.2

Publication and Distribution of this Community Engagement Plan In accordance with Section 3.2.5(a) of the LRP I RFP2 this Community Engagement Plan will be continuously posted on the Project website 15 days prior to the date of the community meeting until the IESO announcement of the Selected Proponents for LRP I RFP. In accordance with Section (iv), a copy of this Community Engagement Plan will also be delivered to the Chief Administrative Officer of the Township of South Frontenac. Should the Project receive a contract from the IESO, this Community Engagement Plan will remain on the Project website for the life of the Project, and will be updated periodically as necessary.

3.3

Engagement Strategies and Activities

3.3.1

Project Website Project information, including this Community Engagement Plan (as discussed in Section 3.2 above), will be posted to the Project website: www.sunedison.ca/wallace and updated, as necessary throughout the LRP I RFP process. Should the Project receive a contract from the IESO, the Project website will remain active for the life of the Project, and will be used to post regular information updates, as well as required documentation during the REA process.

3.3.2

Meetings with Township of South Frontenac Officials SunEdison Canadian Construction LP has already engaged various officials of the Township of South Frontenac with respect to this Project, including a presentation before Council. This engagement with officials from the Township of South Frontenac is intended to continue throughout the development of the Project. SunEdison Canadian Construction LP will be appearing before the Committee of the Whole on June 18, 2015, and requesting a Council support resolution in support of this Project during the July 7, 2015 Council meeting. A formal submission will be required at least 7 days prior to the date of the meeting.

distributed to the secretary of every company operating an oil or natural gas pipeline if a pipeline right-of-way is located within 200 m of the Project

The community meeting will take place within the Township of South Frontenac from 6:00 to 8:00 pm on June 17, 2015. The community meeting will be held at the Harrowsmith Public School, 4121 Colebrook Road, Harrowsmith, ON. The first hour of the community meeting will be an open house format with poster board displays available for review, while during the second hour a town hall meeting will be held with a presentation from SunEdison Canadian Construction LP, followed by a question and answer period. Copies of the poster boards will be made available in hard copy format to be kept for future reference. Copies can also be obtained for those unable to attend the meeting by contacting one of the individuals listed in Section 3.3.6. Notification of the community meeting will be undertaken as detailed in Section 3.3.3.1 above. 3.3.3.3

Meeting Summary Report A meeting summary report will be prepared following the community meeting described in Section 3.3.3.2. It is anticipated that the report will include: 

Copies of all materials presented during the community meeting

Summaries of all comments and questions submitted, and SunEdison Canadian Construction LP. response.

A copy of the meeting summary report will be posted to the Project website and distributed to the Township of South Frontenac’s Chief Administrative Officer. 3.3.4

Renewable Energy Approval Community Meetings Should the Project receive a contract from IESO, the Project would then be required to obtain a REA from the MOECC prior to construction. As part of this process, two public meetings will be held. Locations, dates and times of the public meetings would be determined at a later date, however further information is provided below with respect to Notifications and timelines.

3.3.4.1

Community Engagement Plan - Wallace Solar Project

Renewable Energy Approval First Community Meeting The first community meeting in the REA process is held after the Project Description Report has been prepared. The Project Description Report provides general information on the proposed project, along with a preliminary assessment of potential impacts and mitigation measures to be employed to minimized environmental impacts. Notices for the public meeting will be distributed to all individuals on the stakeholder mailing list identified in Section 3.3.3.1, along with any additional stakeholders who have indicated an interest in being on the Project mailing list. The Notice will also be posted in local newspapers on two separate occasions, one of which is at least 30 days prior to the community meeting date.

3.3.4.2

Renewable Energy Approval Second Community Meeting The second community meeting in the REA process is held after all of the various reports, required as part of an REA application (with the exception of the Consultation Report) are prepared. The reports will be made available for public review (both on the Project website and at the Township of South Frontenac municipal office) 60 days prior to the public meeting date. Notices for the public meeting will again be distributed to all individuals on the stakeholder mailing list, and will be posted in local newspapers on two separate occasions, one of which is at least 60 days prior to the date of the community meeting.

3.3.4.3

Consultation Report At the conclusion of the REA process, a Consultation Report will be prepared summarizing the results of all consultation activities, and questions and comments received from the public and other interested parties, will be assembled and submitted with the REA Application to the MOECC.

3.3.5

Ongoing Engagement during Project Construction and Facility Operations Once all permits and approvals have been obtained, the facility will proceed into construction, and then operations. Throughout this period, a sign will be maintained at the Project site to provide contact information for representatives of SunEdison Canadian Construction LP. Based on feedback from the public and municipal representatives during earlier engagement activities, additional engagement activities that will be considered during this time may include issuance of Project newsletters, formation of a Community Liaison Committee, educational outreach to local schools, or additional public meetings

The contractor shall be responsible for collecting and/or disposing of all such water, ensuring that all erosion and sediment control and dechlorination requirements of the MOE, CRCA, and various other authorities having jurisdiction are met. After flushing/swabbing is completed, water from the existing distribution system shall be allowed to flow at a controlled rate into the new pipeline. Liquid chlorine solution shall be introduced so that the chlorine is distributed throughout the section being disinfected. The chlorine shall be applied so that the chlorine concentration is 50mg/L minimum and 200mg/L maximum throughout the section. The system shall be left charged with the chlorine solution for 24 hours. Sampling and testing for chlorine residual will be carried out by the Engineer’s Inspector. The chlorine residual will be tested in the section after 24 hours. If tests indicate a chlorine residual of 25mg/L minimum, the section shall be flushed completely and recharged with water normal to the operation of the system. If the test does not meet the requirements, the chlorination procedure shall be repeated until satisfactory results are obtained. Immediately after the system has been recharged and then following an additionally 24 hours, samples shall be taken for micro bacteriological testing. Two consecutive acceptable samples taken a minimum of 24 hours apart must be obtained. The system shall not be put into operation until clearance has been given by Utilities Kingston. Page 35 of 42 Page 172 of 260 Township of South Frontenac Design Criteria and Standards March 2015 A professional engineer shall certify that testing and the disinfecting of mains was undertaken as per OPSS. All newly constructed watermains shall be isolated from the existing distribution system by physical separation or through the use of an appropriate backflow prevention device approved by the Township. This isolation shall remain in place until approval of the Township is granted for permanent interconnection. 10.0 STREET LIGHTING The following illumination levels will be continually applied to new roadway construction and upgrades to existing roadways that have been designated for other rehabilitation work where application of the new lighting criteria would be justified and warranted. Street lighting design in the Township shall be based on ANSI/IESNA RP-8-00. Modifications to RP-8-00 have been made in certain areas to conform to the Township’s requirements. Lighting standards for other applications such as public pathways shall be considered on a case-by-case basis. The design and supporting documentation shall be included in the design submission for subdivision approval. Page 36 of 42 Page 173 of 260 Township of South Frontenac Design Criteria and Standards March 2015 10.2 Material Specifications All street lighting equipment used in the Township must meet these street lighting standards and specifications and the appropriate CSA standards and specifications. 10.2.1 Street Light Poles Streetlight poles shall be located in accordance with Township standards or as otherwise approved by the Township. On existing rights-of-way in developed areas, poles shall be located having regard for existing utilities and adjacent land use and topographical features. Streetlights shall be located at all urban intersections and all major rural intersections. 10.2.2 Luminaires The following luminaires are approved for use in the Township. Cobra Head Luminaires  Cree: XSP series, or equivalent - XSP1-29W, XSP1-38W XSP2-64W, XSP2-82W, XSP2-90W, XSP2-101W XSP2L-168W Decorative Luminaires  Lumca: CP6114 and CP6113 series, or equivalent - Configuration: 36N/54N/72N Source: LED Wattage: 48W/72W/96W Distribution Type: L3 Lens: AC Voltage: 120 – 277 Colour: Black Page 37 of 42 Page 174 of 260 Township of South Frontenac Design Criteria and Standards March 2015 10.3 Energization Process The developer/contractor shall provide the following documentation to the Township when they wish to have their street lights energized:  Letter requesting energization  As-built drawings clearly showing street light wiring  As-built one-line-diagram  List of lights to be energized along with location, ESA certificate number, transformer number, and wattage of light information  Up-to-date ESA certificates of inspection (ESA certificates are valid for 6 months) When the Township has received and accepted all required documents and materials, the Township will perform an inspection of the installation. If required, a deficiency list will be provided back to the developer/contractor indicating the deficiencies. When the installation passes the inspection, the Township will send a request to energize the lights to the Supply Authority. 11.0 PARKLAND AND OPEN SPACE Under the Planning Act Section 51, the Township is entitled to a conveyance of land or a payment of money for parkland purposes that is equal to a percentage of the appraised value of the development lands as of the day before draft approval. The Township may require a monetary payment ('cash-in-lieu') or a payment in combination with land cash. This may require an appraisal by a qualified appraiser to be completed at the applicant's expense. Should the Township require parkland, the Township will accept only those lands that meet its requirements regarding location and suitability for parkland purposes. The Township will establish whether it will accept the lands in a 'clean' state or whether there will be additional requirements regarding improvements of the lands. The value of such improvements shall be factored into the value of the lands being dedicated. Appropriate information may be required to alert future home owners of specific parkland or open space types, and where applicable, the potential facilities or path system within it, and the expectations of the Township in terms of maintenance. Page 38 of 42 Page 175 of 260 Township of South Frontenac Design Criteria and Standards March 2015 11.1 Types and Maintenance Levels Any required park development plan shall be prepared in accordance with the following criteria as applicable. 11.1.1 Natural Area This type of area is defined as a parcel of land which because of its proximity to sensitive environmental protection areas, water courses, known ANSI’s (Areas of Natural and Scientific Interest), or unique physical characteristics will be retained in its existing natural state. The rationale for these types of areas is to preserve natural resources and their aesthetic quality, and to provide in some instances buffering between active recreation areas, roadways, or developments. Where land has been deeded to the Township as a natural area, the Township will only attend to risk management issues and will not perform any regular maintenance on these parcels. 11.1.2 Woodlots A woodlot is a parcel of land that contains a mix of trees species, and because of the quality and/or numbers of the trees is considered an asset to the community and will be retained for the provision of shade, the quiet enjoyment of nature and the retention of habitat for bird and animals. The woodlot will be managed by the Township and governed by good forestry practices and risk management procedures. 11.1.3 Tot Lots This type of area is defined as a small park designed to serve a 2-3 block area and generally a population of up to 2,500. Tot lots are 0.5 to 1.0 acres in size and generally contain the following types of recreation facilities: equipped play areas, benches, open space landscaping, and picnic tables. Tot lots may be used in areas where it is difficult to acquire sufficient land for a neighbourhood park. The Township will do regular maintenance of these types of parks. 11.1.4 Neighbourhood Park This type of area is defined as a park that provides for both passive and active recreational uses that may include play equipment, playing fields for both organized and impromptu games, court games, skateboard ramps, water play features, pathways, lighting, seating and picnic areas, natural and maintained landscaping, gardens plots, or senior citizen areas. Neighbourhood parks are generally 1.0 to 5.0 acres in size and are accessible by foot or bicycle and a service population of up to 5,000 persons. The Township will do regular maintenance of in these types of parks. Page 39 of 42 Page 176 of 260 Township of South Frontenac Design Criteria and Standards March 2015 11.1.5 Community Park This type of area is defined as a park that provides a diverse range of recreational, passive, and leisure activities; and may contain areas of environmental or aesthetic quality (natural areas or woodlots). Facilities and activities may include, but are not limited to: athletic fields, community centers, public event spaces and buildings, access roads and parking areas, lighting, and any facilities associated with neighbourhood parks. A community park is typically a "drive-to" facility from five to 25 acres in size that services the needs of up to 25,000 people. Community parks are ideally located near collector or arterial roads to accommodate adequate access and should be well-buffered from adjacent residential areas. The Township will do regular maintenance in these types of parks and will do additional or specialized work based on programming and events held in the park. Note: A community park can also have a dual function as a neighbourhood park or tot lot when it provides facilities similar to these park types and its proximity to residential areas allows residents to walk or ride bicycles to the park. 11.1.6 Special Facilities This type of area is generally identified as buildings and supporting lands that can accommodate the needs of the public for activities and events that are unique in function and purpose. Examples of special facilities include public golf courses, areas for field sports, nature trails, boat ramps, beach access points, community sports complexes, and other single-purpose or unique facilities. Special facilities standards are based on the desires or unique characteristics of a community and will be subject to policies and studies undertaken by the Township. The Township will develop specialized maintenance and operational plans for these facilities. 11.1.7 Linear Recreation Spaces This type of area is defined as continuous aligned open spaces that provide travel routes for one or more types of recreational or non-motorized vehicles such as bicycling, roller blading, strolling, hiking, or jogging. In rural areas such activities as horseback riding would be permitted. Pathways and trails may be developed in association with natural areas or stormwater ponds. The Township will do regular maintenance in linear park systems. Mowing or turf maintenance may be restricted to grassed areas immediately adjacent to the path itself depending on the adjacent land categories. Page 40 of 42 Page 177 of 260 Township of South Frontenac Design Criteria and Standards March 2015 11.1.8 Open Space Associated with Stormwater Ponds The Township has acquired through the subdivision process parcels of lands that are used for stormwater purposes and form integral parts of stormwater management systems for the Township. These stormwater parcels are not accepted as dedicated parkland but because of their location adjacent or within township parks or open spaces may contain ancillary amenities for recreational uses. The Township will complete risk management assessment and follow-up maintenance to stormwater ponds lands (above the high water levels) that are within or adjacent to township parks. These parcels of land may include linear recreation trails/paths. Mowing or turf maintenance may be restricted to grassed areas immediately adjacent to the path itself depending on the adjacent type of pond. 11.2 Fencing Adjacent to Parkland and Open Space Fencing may be required to be installed adjacent to parks where active recreational or sports fields require such an element. Additional protective fencing or higher fencing may be installed where needed. All fencing shall conform to OPSD for ‘Fence, Chain Link, Installation – Roadway’. Gates within the fencing will be permitted, subject to approval by the Township and the owners signing a waiver that absolves the Township for repairs required as a result of the gate being installed or damages to it. The cost of the gate will be the owner’s responsibility. Fencing abutting residential lots shall conform, at minimum, to the requirements defined in the Township`s Swimming Pool Regulations By-Law. 11.3 Services Required to Parkland Boundary The developer will be responsible for connections of a water service and electrical services from the street right-of-way to the park property line. The water service sizes shall be based on the functions and size of the proposed park, with a minimum of 50mm. Page 41 of 42 Page 178 of 260 Township of South Frontenac Design Criteria and Standards March 2015 11.4 Drainage and Easements through Parklands All residential lot drainage shall occur on private lands and no drainage ditches or swales will be permitted on the Township parkland unless approved by the Township. No underground services, hydro transformers, or telecommunication boxes will be permitted on the park land unless approved by the Township. 11.5 Parkland Development Plans A parkland development plan submission shall include the following:  A tree inventory and preservation study of the proposed parkland which is acceptable to the Township and which shall will identify and provide a surveyed location for all existing trees including their type, height, caliper, and condition; those trees proposed to be removed and retained; and methods to be used to maximize tree preservation  A site plan showing details of recreational elements, play features/equipment, pathways, lighting, amenities, fencing, signage, and/or buildings or structures  A grading plan including any catch-basins, swales, ditches, or drainage control features and servicing details including any existing or proposed infrastructure in the park with minimum service laterals to the property line 12.0 ACCESSIBILITY All public spaces shall be barrier-free for persons of all ages and abilities. This includes sidewalks, walkways, parks, and semi-private open spaces. Placement of trees, landscaping, seating, public art, and signage should not obstruct paths of travel. Integration of access structures to provide barrier-free connections between streets, pedestrian walkways, and parking areas, should include curb ramps, entry ramps, and handrails. In high activity areas, the use of multi-sensory indicators (tactile, visual, and/or audible) should be implemented as directed by the Township. Barrier-free areas are to be design to standards established by the Accessibility for Ontarians with Disabilities Act and in consultation with the Township. 13.0 STANDARDS It is the responsibility of applicant to acquire the most up-to-date OPSS and OPSD documents. Page 182 of 260 securities t f / Page 183 of 260 PLANNING REPORT Township of South Frontenac Prepared for Committee of the Whole Planning Department Agenda Date: June 9, 2015 Date of Report: June 5, 2015 File: RC-15/01 Subject: Closing of Road Allowance in Between Concessions IX and X, and Between Lots 30 and 31, Bedford District, Township of South Frontenac: Mahmud _______________________________________________________________________ Summary of Recommendation: The recommendation is that the Committee receive the Planning Report dated June 5, 2015 and consider the closing and transferring ownership of portions of unopened road allowances, between Concessions IX and X and between Lots 30 and 31 District of Bedford. Purpose of Report: The purpose of this report is to provide the background information necessary to enable Council to provide direction to staff regarding the closing of unopened and untravelled Township road allowances. Background & Discussion: By letter dated March 26, 2015, the property-owner at 306 Campground Lane is requesting to know whether Council would agree to the closure and sale of two portions of unopened road allowance that run through his properties. Attachment #1 shows the location of the owner’s properties and Attachment #2 is a copy of the letter requesting Council’s consideration of the closures (his hand-drawn map is included). As explained in the letter from the owner, the proposal is to stop up and close two portions of road allowance and sell them to him to add to his abutting lands. Recognizing that the closure of the portion on the north of his 2 acre lot would effectively close off the road allowance that leads north towards Bob’s Lake, the applicant proposes to transfer ownership of an equal portion of land to the Township to preserve this access from Burridge Road. The proposed land transfers are shown on Attachment #3. The final lot configuration, after the closures and ownership transfers, is shown on Attachment #4. Burridge Road is a forced road which was constructed to the east of the road allowance, presumably through more acceptable topography. The effect of this is alignment is that many sections of the road allowance are redundant- meaning that they will probably never be used by the Township for roads. Because of this, portions of both of these unopened road allowances have already been closed and sold as seen on the attachments. Thus, it appears that the closing and sale of the portions of road allowances is an acceptable land use decision. The property-owner will acquire more usable land and the Township would benefit from the funds received from land that would never be used for municipal purposes. It should also be noted that, as part of this transaction, the Township would ask for a road widening to the Burridge Road allowance as shown on Attachment #4. Process: If the Committee agrees in principle to the closing of the road allowances a public meeting on the matter must be held. This meeting is advertised in a local newspaper for at least four weeks prior to the meeting and signs would be posted on the property advising of the meeting. Any abutting property-owner would also be contacted as to whether they would be interested in purchasing the road allowance and, if so, they would be entitled to Page 184 of 260 purchase half of the width of the road where it abuts their land. However, in this case the applicant owns both sides of the road allowance. If the request moves forward, the Planning Department would require that the applicant deposit $3,000.00 to cover costs of advertising and administration – much of this may be returned at the end of the process. All surveying and registration costs would be borne by the applicant and there would be no cost to the Township. Council policy related to the sale price of closed Township roads would result in a price of approximately $11,450.00.
