We spoke a couple weeks ago about putting a dog park in Harrowsmith/South Frontenac area.

When we last spoke you said you would relay it to the council. I am looking for an update on what the council had thought. I have spent the last 2-3 weeks collecting signatures from fellow south Frontenac residents. I have collected roughly 4-500 signatures of support.

I very strongly believe this will benefit the community, if I could address the council in person that would be ideal. Presenting my support, and discussing this idea further more.

REPORT TO COMMITTEE OF THE WHOLE PLANNING DEPARTMENT AGENDA DATE: September 12, 2017 REPORT DATE: September 5, 2017 SUBJECT: Proposed Road Assumption and Naming: Chris Kerr


RECOMMENDATION: The recommendation is that the Committee receive the Planning report dated September 5, 2017 and consider a request by a property-owner for the municipality to assume a newly-constructed road and name it as “Bus Line Road” in Part of Lot 19, Concession VI, Portland District.

BACKGROUND: A property-owner has requested to know whether Council would agree to accept dedication of a newly-constructed private lane and assume full maintenance of it as a public road. The property is located in the Hamlet of Petworth in Portland District and the lane was constructed as a condition of consent applications S68-15-P and S-69-15-P in 2015. Two waterfront lots were created fronting on the Napanee River and the new lane was required to access the northern lot through the south lot from Petworth Road. Attachment #1 shows the location of the subject land and Attachment #2 shows the new lot layout and the new lane. Note that the old Petworth Mill was dedicated to the Township as a condition of approval of the consent applications. The lane was constructed and inspected by public works prior to final approval of the consents and, at this point in time new owners of the lots wish to construct homes on these waterfront parcels. Thus, for civic addressing purposes, the lane must be named. However, the original applicant, who still owns the retained portion of land, wishes to dedicate the lane to the Township so that it can be fully maintained as a public road. This would allow him to apply to create an additional residential lot which would front on the new road. Attachment #3 shows where the new lot would be located. Public Works has no objection to the road assumption but both Public Works and Planning will require that the road be paved with asphalt given that the road is located within the hamlet where a higher standard of development should be expected as opposed to more rural areas. The owner is aware of this requirement. However, at a length of only 152 metres including the cul-de-sac, Public Works standards would not require a sidewalk to be built. In addition to the above, the owner wishes to name the new road “Bus Line Road” which has special significance to him. Normally, new road and lane names are chosen from the pre-approved list of names that was endorsed by Council three years ago. However, there is nothing to preclude anyone from coming forward with a new name proposal. In this case, the proposed name is acceptable according to the Fire Chief in that it is not similar in any way to other road names in the Township or elsewhere which would cause confusion to emergency responders. However it should be noted that an administration fee must be charged for such requests covering staff time and advertising fees. The Committee is asked to consider both the request for the road assumption and the request for the new road name.

RECOMMENDATION: The recommendation is that the Committee receive the Planning report dated September 6, 2017 and consider a request by a property-owner for the municipality to close and transfer ownership of a portion of unopened road allowance between Lots 5 & 6, Concession III, Bedford District.

BACKGROUND: As part of the sale of a property in the District of Bedford the real estate lawyer for the buyer discovered that a portion of unopened road allowance that was thought to form part of the subject property may not have been formally closed and transferred to the property. Township staff were not able to find any by-law that effected this closure and transfer. Attachment #1 shows the location of the subject property. The parcel is 0.9 hectares (2.3 ac.) in size (including the former road allowance) with 179 metres (587 ft.) of waterfrontage on Thirty Island Lake. It is accessed by McGowan Lane which is routed around the north portion of the lot. As illustrated on the attachment, the unopened road allowance that forms the boundary between Lot 5 and Lot 6 in Concession III appears to have been stopped up and closed and ownership transferred to the property through which it passed. Survey Plan #13R-6339 from 1985 defines the property boundary and describes it as Parts 1, 2 and 3, thus, identifying the lot as one lot comprised of all three parts - Part 2 being the former portion of road allowance. Attachment #2 shows these three parts forming the subject lot. Township records include the deed for the subject property which describes the lot as being made up of Part of the Road Allowance between Lot 5 and 6, and Part of Lot 5 and 6, Concession 3, Township of South Frontenac, Bedford, County of Frontenac, designated as Parts 1, 2 and 3 on Reference Plan 13R-6339. Part 2 refers to the former road allowance as noted above. Additional Township records on the parcel include information related to a consent application in 1983 and a minor variance application in 2000 all of which refer to the property as being one lot with the former road allowance included. Attachment #3 is excerpts from the property file indicating this. However, there is no record of any by-law which formally closed and transferred ownership of the road allowance. Therefore, the Committee is asked to consider the formal closure and transfer of this portion of road allowance by by-law. For the Committee’s information, the portion of road allowance is 0.4 acres in size and is wholly located within 300 feet of the lake. Under the Road Closure By-law, the land is sold at $2.41 per square foot within 300 feet of a lake and, accordingly, the cost calculation for this sale works out to $41,972.00. By way of procedure, the road closure would need to be advertised for four consecutive

Page 24 of 45 weeks in the local newspapers and on the Township’s website. A deposit of $3,000.00 is required for staff to proceed with this advertising. As an alternative to the above process, the Committee may wish to acknowledge that the subject road allowance has been part of the property for all intents and purposes for over thirty years and forego the normal process of advertising and charging a fee. Perhaps an administration fee would be appropriate to cover staff’s time to prepare the road closure by-law and bring it forward to Council.

RECOMMENDATION: The recommendation is that the Committee receive the Planning report, dated September 7, 2017, for information regarding a proposal by the Frontenac Provincial Park to acquire abutting unopened road allowances from the Township.

BACKGROUND: As part of a new Frontenac Provincial Park Management Plan the Park staff is proposing to acquire a number of Township-owned unopened road allowances that abut the Park boundaries. These road allowances are located at the west, south and east boundaries of the Park. Attachment #1 is a letter dated July 5, 2017 from the Park Superintendent advising of the Park’s interest in acquiring the lands and citing the Provincial Parks and Conservation Reserves Act of 2006 as the basis for the acquisition. The attachment includes a map indicating the road allowances of interest. The matter was brought to the Township’s Development Review Team on August 30, 2017 where each road allowance was discussed. It was determined that more examination of each road allowance is required before moving forward with an agreement on these road allowance transfers. It should be noted that, ultimately, the Township’s position on this matter should be that:

  1. The Township should only agree to transfer ownership of road allowances that would not serve the Township in the future;
  2. If Frontenac Park still want the road allowances that the Township wants to retain they would need to expropriate the land;
  3. In either of the above cases the Township should receive fair market value of the lands.

The new Frontenac Provincial Park Management Plan was released last year and identifies the regulation of unopened road allowances as a priority. The next step is to proceed with the Environmental Assessment and Land Use Amendment components of the project. Ontario Parks is interested in regulating these unopened road allowances as soon as possible. As such, we are providing you with advanced notice of our plans.

In previous communications (e.g., e-mail sent April s, 2013), we have identified our interest in regulating the road allowances as part of the regulated boundary of the park and have provided

the sections of the Provincial Parks and Conservation Reserves Act, 2006 that refer to road allowances.

I have included a map highlighting the properties involved in this initiative. Red lines are road allowances proposed for removal from the regulated park boundary, blue lines are allowances proposed to be added to the regulated park boundary and blue polygons are MNRF properties to be added to the regulated park boundary.

RECOMMENDATION For direction.

BACKGROUND Council meets to conduct business in accordance with the Procedural Bylaw. Currently the schedule includes two Council and two Committee of the Whole (COW) meetings per month September through June and one combined Council/COW meeting for each of July and August. Special meetings are at the call of the Mayor (i.e. Saturday Budget session). In addition the three standing committees (Public Services, Corporate Services and Development Services) meet monthly. At the outset of this term of Council there was discussion about reducing the number of meetings. The decision to make any changes was deferred to half way through the term of office. Subsequent changes to the Procedural Bylaw have been deferred awaiting proclamation of Bill 68 which will require further changes. The Mayor has asked staff to present an alternative meeting schedule for consideration by Council. Senior staff have discussed the options and present the following for consideration. •

Meetings would take place on the First and Third Tuesday of each month except for July and August where there would only be one meeting on the first Tuesday. Statutory public meetings under the Planning Act would only be held on the First Tuesday with corresponding Bylaws brought forward for adoption to the Third Tuesday meeting as appropriate. Public delegations would be heard only on the Third Tuesday. Corporate Delegations (i.e. Annual Audit, consultants) would be heard at either Meeting, as scheduled. In July and August the meeting agenda is fully combined. Issues previously discussed at COW, excluding overall budget and strategic planning matters, would be addressed through one of the three standing committees of Council (Public Services, Corporate Services or Development Services) PSC, CSC and DSC would become more formalized with reports and recommendations issued as part of the agenda package. Committee recommendations would come forward to Council for adoption by Council. Councillors who are not members of the standing committee can attend as a member of the public to listen, but not participate in the discussions. These meetings would not be compensated. To be successful, without rehashing the entire issue at Council, members of Council will have to have greater faith that the standing committee members have carefully considered and questioned the matter prior to making the recommendation. Closed Session would still be scheduled at the start of the agenda with an appropriate amount of time allocated; generally one hour Meeting times would be moved forward starting at 6:00pm (with Closed Session starting at 5:00 if needed) Our strength is our community.

To facilitate this operation, it is recommended that a full road closure be implemented on Friday, September 29th, 2017 from Alton Road to Portland Avenue. It should be noted that this is a PA Day which should minimize the impact of a road closure. The public will be advised of this closure on our website and in our Banner ads. SUBJECT: Roads and Bridges 5 year Capital Plan BACKGROUND: Attached is the proposed 5 Year Plan for Roads and Bridges which originated from the Asset Management Plan. Historically, we have always incorporated an amount for upgrading gravel roads to surface treated. In revisiting our original plan (2018-2022) with staff, we collectively feel that some of our Arterial roads require more attention and that we should forego our Local Upgrades for the next five years. This recommendation is based on the understanding that we need to increase our drainage efforts as part of our maintenance activities over this 5 year period. As a result of our internal discussions, Public Works staff have recommended, by consensus, the revised 5 Year plan to the Public Services Committee. Both the original and revised plan is presented to the Committee of the Whole for further discussion, clarification and revision where necessary.
