The common practice is a contractor will invoice us within 30 days of the work being done. In this case we did not appreciate the fact that we had not been invoiced when we engaged the same contractor for additional work. The vast majority of the itemized descriptions of work performed involved a vendor of record. Going forward most of this work will be tendered. As a lot of this work is Winter Control, we will use this opportunity to reassess what routes should be outsourced and what routes should be undertaken inhouse for more effective service delivery. FINANCIAL/STAFFING IMPLICATIONS: As these invoices were not received until after the previous years financial were closed off, these expenses cannot be back charged. The Public Services Committee at its meeting of May 19, 2016, recommended that 50% of total owing be charged against the 2016 Budget and the remaining 50% be paid from the 2017 Budget in January 2017.

SUBJECT: Organizational Review – CAO recommendations RECOMMENDATION: THAT Council adopts the recommendations of the CAO as presented. BACKGROUND: Recognizing the challenges being faced, Council supported the CAO’s recommendation for an organizational review by; approving $45,000 for a consulting contract, approving the terms of reference for the RFP and fully participating in the interview process. Subsequent to the consultants presenting their findings and recommendations, Council set a working COW meeting with the management team on May 4. Council approved the format for the May 4 meeting and committed to focusing on solutions. The complete organizational review report has been shared as well as the extensive minutes of the May 4 meeting. From the May 4 meeting it is clear that there is no clear direction from Council on how to proceed. Furthermore Council chose not to include implementation funds in the 2016 budget nor did they wish to pursue a last minute opportunity to adjust the tax rate to take advantage of lower than anticipated rates for the County and Education portions. The CAO has been tasked with summarizing the issues, evaluating the merits of the consultant’s recommendations and presenting recommendations that reflect the various voices of Council in an effort to address the challenges faced. The following is an executive level summary of the identified challenges: •

While the strategic plan remains valid, little has been done towards developing an implementation plan and there remains a lack of focus on the big picture. Council will need to define some concepts and narrow the focus. Once clarified there needs to be strong linkages between the Plan and the actions of management. Council needs to be decisive and clearly define its role and set expectations for staff with regard to the relationship with the County. The current Township/County relationship is ineffective and a hurdle to reducing roadblocks. Council has expressed support for changes to the frequency and structure of meetings but has not defined what they want. Staff reports could have greater depth and more options to support Council decision making Current management team has little time to focus on the broader expectations being set by this Council and the general increased expectations from the public. The consultants and staff believe there is insufficient staffing to address current expectations and there is little if any capacity to delegate to other staff. Additional channels of communication are needed to meet the demands of staff and the public.

To date economic development has not been a priority of Council and thus has minimal resources assigned. The Township has chosen not to seek access to potential resources at the County. The combined CAO/Clerk role limits the amount of time available to focus the organization on strategic priorities. Council has not demonstrated a commitment to growth despite the development pressures faced and staff’s ability to respond in a timely manner both pre and post approval has been less than optimal. Despite having only one full time staff member in the Fire service, there remains a lack of understanding to support additional full time staffing. With the consensus that there is a commitment to building and maintaining a strong road network the Public Works Department has not been able to focus resources towards policy, planning and analytical requirements. Solid Waste is undergoing significant changes at the provincial level and changes are anticipated. There is lack of resources to effectively pursue long term recreational planning, grants and sponsorships. There is a need to establish the optimal mix of reserves and debt necessary to best meet demands and expectations

The Consultant offered 16 detailed recommendations (see attached) but summarized below. In the chart there is an indication of Council’s level of support for the recommendations from the May 4 meeting.

STAFF REPORT CLERKS DEPARTMENT The Development process is the biggest issue before Council. The growth pressures show no signs of stopping and yet we have continued to do business as usual. The options for delivering planning services are on a continuum. At the far end South Frontenac has delegated authority for approval of subdivisions and plans of condominium. At the other end South Frontenac operates like the other Frontenac municipalities and provides a local planning contact, but all planning services are handled by County staff. Currently we are somewhere in the middle and the process and clarity with the County is less than optimal. Currently we have a planner and planning assistant to handle the volume of activity from the Committee of Adjustment and our current role in subdivisions / condominiums. Recognizing that the current process is less than optimal and that there is need to better coordinate the entire development process and the need to coordinate economic development activity additional resources are required. While the Province is still yet to proclaim the requirement for a Planning Advisory Committee at the County level, and the scope for this Committee is still being debated, it does not reduce the need for additional local resources. The biggest barrier to implementing any recommendation appears to be adequate funding. However it is also clear that without enhanced resources and a plan to move forward there can be no reasonable expectation that progress can be made to address the challenges identified. Keeping in mind the reluctance so far to commit resources, the limitations of existing staffing levels, the constant pressure of development and the need to prepare this organization for the future my recommendations attempt to address the critical issues, on a priority basis, thus minimizing the budgetary impact. 2016 Plan:

  1. Reassign the Arena Recreation Supervisor to report to the Public Works Manager
  2. Reassign the HR/Legislative Compliance Coordinator to report to the Treasurer.
  3. Create and hire a Development Services Manager with the Planner/Deputy Clerk and CBO reporting to this new role. Focus on streamlining the development process and enhancing customer service. In addition take on the role of coordinating current and future economic development resources as well as contracted bylaw enforcement services.
  4. Establish a Senior Management team comprised of the CAO, Public Works Manager, Treasurer and Development Services Manager assisted by the Executive Assistant to develop an implementation plan for the strategic plan

Given the opportunity with a pending retirement update and redefine the role of Accounting Clerk 6. Relocate staff to accommodate the new positon and to facilitate the formation of a cohesive senior team focused and resourced for success. • Public Works Manager moves to George St. (current HR office) • Fire Chief moves to Sunbury hall until Perth Road Station is built • Arena/Recreation Supervisor moves to Keeley (PW Mgr. office) • HR position moves to Recreation office • New Development Services Manager to Fire Chief’s office 2017 Plan:

  1. Separate the CAO/Clerk role into two and hire a Clerk to support Council and Committees, carryout statutory responsibilities and fulfill communications role. Located in Mayor’s office. CAO to be named as additional Deputy Clerk.
  2. Adjust Council / Committee Structure, reflecting focus on Strategic Plan. Establish the creation of a Development Services Committee. Council and all three committees to be supported by the Clerk
  3. Create a community driven Economic Development Committee to assist with formulating an economic development strategy and allocate budget dollars for initiatives
  4. With an improved structure focused on implementing Council’s objectives time will be available to consider operational processes and needs. 2018 Plan:
  5. Establish and hire full time Fire Prevention/Education Officer. Allowing for enhanced policy and administration services as well as emergency preparedness services by the Fire Chief. To be located at Perth Road station with Fire Chief
  6. Allocate additional budget dollars to support Economic Develop initiatives The above 2.5 year plan responds to the challenges identified, aligns with the consultant’s recommendations, fits within a reasonable cost, and will enhance the organization’s efforts to move forward. SUBJECT: Vendor sole sourcing RECOMMENDATION: This report is for information only. BACKGROUND: From time to time, circumstances will create situations where goods and services need to be sole sourced. As per the procurement policy, the purchase of goods and services must be provided for in the budget or approved by Council. ANALYSIS: The Township has circumstances where Council approval would be required: • a vendor will be used for goods or services across various budget lines where their overall total would exceed the procurement thresholds but individually would not exceed the budget lines where the work or goods would apply to. This can also include low cost work done through a vendor of record, initially meeting the procurement policy but cumulatively for the year exceeding thresholds. • Certain goods are sole source based on the fabrication or quality of goods. An example of this would be culverts. Although there is more than one supplier, our existing inventory is from a specific supplier which makes the inventory compatible or interchangeable in its use. • Geography affects where and how goods can be obtained. An example of this is rental equipment and construction materials. On a yearly basis, the Public Works manager brings forward the results of the request for quotes for Council approval. This year’s results will be brought forward at the June 7th meeting. Through discussion with the Public Works manager, it is anticipated that other areas of work will also be issued through request for quotes and then brought forward to Council for approval. One example is local road plowing. Further, an analysis will be done on a yearly basis to identify any area for which this process may need to be undertaken.

BACKGROUND: A vendor of record is a vendor with which the Township already has an acceptable business relationship which pre-qualifies the vendor to provide goods/services to the Township. A vendor of record listing provides the full listing of pre-qualified vendors. Our procurement policy provides for the use of a vendor of record when a purchase is between $150 and $25,000 and the services requested are within budget. Further, our procurement policy provides that a vendor of record listing shall be compiled by staff and recommended to Council for approval on a bi-annual basis. ANALYSIS: There is currently no Council approved vendor of record listing. Attached is a draft Vendor of Record listing. This listing represents any vendor with which the Township has done business within the last three years. The Resolution being sought involves the submission to the MNR of Council’s concern that work being performed at Johnston Point under instructions from our client, Gary Beach, “may harm species at risk” and the submission to its own staff of a question regarding whether that work may be performed now. I cannot properly express how disappointing and objectionable these actions, if approved, would be. If Council has concerns, why not address them first to our client and its consultants? Why is there a continuing attitude of aggression? Our client’s environmental consultant has taken yet another trip to Johnston Point; that marked his 28th site inspection. Let it also be known that our client and his consultant have very recently communicated with Ministry officials; the Ministry apparently knows what work is being performed now on site. Our client settled its Appeal with the Township and appeared, hand in hand, with the Township (and the County) before the OMB only five or so weeks ago. There were objectors who provided evidence. They brought with them a person they wanted to have qualified as an expert in ecology; that person was cross-examined, after which the Board pronounced that his evidence would not be helpful in the Hearing process. Following the conclusion of the evidentiary portion of the Hearing and following submissions from counsel, the Board accepted the Settlement. My question is this: is Council now relying on expressions of concern from those same people who appeared at the Board Hearing in advancing the proposed Notice of Motion? Council, it is understood, has certain responsibilities and rights. With those rights, however, come duties: Council has a duty to act fairly toward my client. It cannot harass my client. In sending these “concerns” to the Ministry, Council is impugning the reputation of my client. It must not do so. My client will continue to protect species at risk through reliance on his experts and through constant contact and communication with Ministry staff and your own staff. I urge your municipality not to adopt the two-part Motion, but rather to contact my clientthrough its staff-if it has questions or concerns. I trust my concerns and those of my client will be made known to your Council Members and I trust that Council will adopt a more friendly and less combative course of action. Are there any signs up in the area warning of the snakes? It may be an option to work with the municipality (if it is a municipal road) to install some. I have recently contacted and reminded the Johnston Point developer about their responsibilities under the Endangered Species Act. Regarding a temporary halt to construction at Johnston Point, the developer does have authorization to move forward from the municipality but they must ensure they do not contravene theEndangered Species Act. The Johnston Point property is private land and the Endangered Species Act does not authorize MNRF employees to freely access those lands. Our recent communication with the Johnston Point proponent included an offer to provide advice or answer particular questions. Thank you for your previous email with video and pictures of the Gray Ratsnakes. As we discussed I have passed on the sightings to our GIS technician to add them to our database. However there is considerable concern within the lake association’s Board of Directors regarding the tone of Mr. Cohen’s memo and his apparent disagreement of having a species at risk study made prior to further development. Thank you for your letter regarding our discussion about the Sunbury Road Emergency Detour Route (EDR). I have been in touch with the Ministry ofTransportation and am pleased to provide you with the information that they have shared with me. I was pleased to hear that the Ministry of regional staff has been working with your township on this issue. They have assured me that they will continue to assist the Township of South Frontenac in any way that they can.

Transportation’s

As you are likely aware, EDRsare designated routes that are selected through a collaborative

process involving the Ministry, the Ontario Provincial Police, municipalities and emergency services. While our province is interested in establishing EDRs for our 400—series highways, the municipal roads that are used for designated EDRs are not under provincial jurisdiction or under provincial obligation to assume or care for the EDR roadway.

Although municipal roads are used as EDRs, there is a mutual benefit to the province, the municipality, the motoring public and police and emergency services to have a signed and designated route when 400—series highways are closed for an emergency situation. These signed and designated EDRs help guide motorists back to the highway when traffic is diverted, keep heavy truck traffic off of roadways and bridges that are not built for these vehicles, and; it creates a safer environment for police and emergency services to respond to the emergency situation on the highway,

The Ministry encourages your Township to apply to the Ontario Community Infrastructure Fund (OCIF),administered through the Ministry of Economic Development, Employment and Infrastructure, in an effort to secure funding for infrastructure projects. I understand that the Township of South Frontenac is currently receiving funding from this program through the formula—basedallocation. I was pleased to hear as well that the funding for the OCIF program is ramping up to $300 Million by 2018-19, with $200 Millionavailable in predictable formula—basedfunding and $100 Million in applications—based funding.

Thursday, May 19th, 2016 OGRA Calls Upon Province to Review Funding Allocation Formula In response to numerous complaints from members, the Ontario Good Roads Association has called upon Hon. Jeff Leal, Minister of Agriculture, Food and Rural Affairs, to establish a task force to review the current funding formula and establish a more transparent and equitable distribution of infrastructure funding. Members have specifically complained that the ranking system has not been transparent enough and that the formula used actually appears to penalize those municipalities which have attempted to plan for major infrastructure improvements. It would appear that municipalities who have done a better job of managing their infrastructure are scoring lower than those that have not been as proactive. Joe Tiernay, OGRA Executive Director, stated, “The Province must bring together stakeholders and form a taskforce to investigate the issue. Municipalities are getting tired of filling in application forms only to have them rejected without any clear idea as to why” he added. OGRA would like to hear your comments about this.
