Delegations (i)

Jamie Curragh re: Seniors Housing

Jamie Curragh spoke to CouncU about a proposed seniors housing complex in Verona that he is planning.

The proposed ten unit complex would be built within the Verona hamlet on

an existing 2 acre building lot on Fine Ridge Road, which is east off of Road 38. The ten units consist of sh. one bedroom and four two bedroom

apartments with a 24 foot by 24 foot common area on each floor, with access to each apartment off the common rooms.

The proposed units, based on ten units would have a lot coverage per unit of .20 acres with a building foot print of approximately 7%. Both complexes

would be serviced by private well and septic services on site.

Mr. Curragh cited the 2011 municipal housing strategy for the City of Kingston and County ofFrontenac, which found that of the current

applications for housing on the social housing waiting list, almost 65% were in need of a one bedroom unit whUe another 21% needed a two bedroom unit.

Mr. Curragh added that the demographics ot South Frontenac Township, now and in the future, suggests there is a compelling argument for the need of senior’s complexes in the hamlets and surrounding areas. In addition, Mr. Curragh said that a recent study published by the County ofFrontenac, entitled, “Seniors Community Housing Pilot Project,” identified the need for seniors housing in Frontenac County.

Councillor Vandewal clarified if the complex would be 10 units and if it

a suitable lot for septic.

Deputy Mayor McDougaU said Mr. Curragh has developed a creative

would be in walking distance to most things in Verona. He feels this is a

terrific opportunity and supports Mr. Curragh. Mayor Davison echoed Deputy Mayor McDougalPs comments and is supportive of this proposed development. Councillor Tinlin asked if the complex would be one level or two levels.

Councillor McPhail asked what commitment Mr. Curragh is looking for from the Township in the future. Mr. Curragh said he would be requesting concessions on the development fees and requesting a building permit from

the Township of South Frontenac.

CounciUor York asked about the size of the lot and its suitability for parking.

Mr. Curragh responded that there would be lots of room for parking as it is a 2 acre lot.

Councillor Vandewal stated that he felt the Township should not state they would make concessions when in the past, concessions have not been made for sumlar projects.

Councillor Stowe said that the City and the County have undertaken studies that demonstrate a need for this type of service.

Deputy Mayor McDougaU suggested that partnerships with the County and City, and a combination of activities could be garnered in order to support this type of activity.

Mayor Davison thanked Mr. Curragh for his presentation and said this is an exciting project for the Township of South Frontenac. (")

Peter Radley, re: Closing ofUnopened Street

Peter Radley, Solicitor, Cunningham, Swan, addressed CouncU on behalf of

Mrs. Hole who has retained him in the sale of her property at 3947 Church Street, Harrowsmith. Mr. Radley advised he was surprised when he received

a letter from the solicitor acting for the purchaser of the property indicating

that a search of the title showed that the house was sitting on a road allowance. He is requesting that the Township of South Frontenac close that portion of the street designated as Part 1 on the draft Plan and to close that

part of John Street designated as Part 3, and following the closing of the street, which records show has never been opened since the Plan was deposited in 1886, and following the closing of the road, that it be deeded to Mrs. Shirley Hole.

Mr. Radley further advised, that it was his client’s hoped that in conveying the property to her, the Township will expect for her to pay tfae costs of the preparation of the required documentation as she will be paying for the RPlan, but that the property occupied for many years by she and her family be conveyed to her for the sum of $1.00.

^Lslr!^a^?^^.^!,tw?s estabushed over 125 years ag°- Assessment information indicates that the dwelling was constructed in 1880, which would have meant that the house was in that location prior to the estabUshment of Plan 77 which created John Street.

Mr. Radley searched the title and found that Plan No. 77 identified Church

Street_and Johu Street on a Plan of Subdivision dated 18S6. By-law No. 11 if passed terminates this particular subdivision and it becomes one parcel of land.

Council has a policy regarding the sale price of closed road allowances which

wollld establish the price of part 1 on the draft plan at approximately $10,000. However, CouncU may waive or reduce the fee in such cases, such

as cases where construction has taken place on a road allowance where it can be demonstrated that the relevant portion of road allowance has not been

correctly identified by surveyors or the Township. Mr. Everett Kerr spoke regarding his concern about losing access to Ms field if the road is closed. Mr. Kerr would have no entry to his field if the road is closed. In addition, it was suggested that the Township of South Frontenac be deeded the triangle shaped portion on the corner (part of Lot 2), for a snow plow turn around or to accommodate future access. Mr. Kerr

suggested that he would be open to dedicating a portion of land to the Township to allow future access to his property. 6.

Reports Requiring Action (i)

Lindsay Mffls, Planner, re: Private Lanes Aligned to Cross Over Unopened Road Allowances; Township of South Frontenac

Lindsay Mills addressed a report prepared by Anne Levac, Planning

Assistant, regarding cases where proposed new lanes are routed to cross over

an existing unopencd road allowance anywhere in the Township and why we are not requiring them to enter into a licence agreement to do so. The Township solicitor has said he does not see the need for a licence agreement when the only purpose is to cross the road allowance. He said

that the only merit to such an agreement might if the work required to upgrade a section to private lane standards could in some way cause a safety issue to other members of the public travelling along the allowance. The Committee of Adjustment did not require a licence agreement on a newly created lane from Canoe Lake Road as a result of severances created

on Desert Lake Road in 2011. However, at the request of the purchaser of

one of the severed lots, Township Council did pass a by-law at their meeting of November 6,2012 permittmg the use and maintenance of this portion of the road allowance as part of the access to the new lots. Mr. Mills said that

this is the only time tMs has been done in recent memory. Comments from Council included there should be a fair application of the rules and that such matters should come to Council first prior to going through the Committee of Adjustment. This will ensure Council understands the details of the application in advance. (ii) Lindsay Mms, Planner, re: OueUette Draft Plan of Subdivision 10T-

2011/002, Sands Road, Part Lots 9 & 10, Concession K, District of Storrington

Lindsay Mills reviewed a proposed plan of subdivision on Sands Road in the Hamlet ofBattersea that was originally presented to the Committee of the

Whole on February 9,2010. Sixteen estate residential lots are proposed with frontage on a new road into the 24 hectares lot.

The proposed lots generally met the minimum standards for development set forth in the Official Plan and the property is within the settlement area of

Battersea where the Official Plan directs development and prefers it to occur. The development is supported by four technical studies.

The Plan came before the Committee of the Whole in the past, but has since been revised and a formal application has been submitted. Although sixteen

lots are still proposed, their frontages on the new road are reduced to approximately 50 metres while each lot maintains a size of at least 0.8

hectares. Also, some of the new lots would gain their access from a proposed new lane located along the top of the ridge on the property.

From a Planning perspective, there are no objections to the layout as submitted. Public Works expressed concern that two stormwater ponds, that the Township would own, would require twice the periodic maintenance compared to one stormwater pond. The Fire Department’s only concern is

that the development is near the end of Sands Road where there is only one way in and one way out where delays may occur for emergency access The lots would be serviced by private septic systems and individual wells. KFL&A Public Health offers no objections to the development.

This proposal has been advertised for a public meeting at the December 4th, 2012 Council Meeting. The applicants are requesting that a zoning by-law amendment be approved at the meeting to permit the residential use as proposed.

A letter of objection to the subdivision has been received and signed by many residents in the area. Their main concern appears to be that drainage will altered which would negatively affect their land; that wildlife habitat on the escarpment would be destroyed; and that there wiU be increased traffic on Sands Road.

Council discussed many aspects of the proposed development such as

terrain is heavy clay Dan Camming of the Sand Lake Association added that there is an area that

floods every spring and that there is a spring in the escarpment area that is wet year round. There is a steep escarpment which is why the lots have to be built at the back of the property. Further remarks from Council included: »

a lot of work has been put into this subdivision plan with environmental input and it is positive that applicant is trying to meet

all of the requirements of subdivision development substantial change in the revised version, and it will be tough to turn down since all of the studies have been allowed; should have been cleared up much earlier

if approved, there should be an agreement to have a study done on each lot to ensure there is no highwater table in order to avoid future problems through permits being issued

principle by Council, but now the applicant wants to make substantial changes and this is a problem

Is it unusual to come back with this amount of change after Couucil approves in principle

radical change and a lot of money has been spent .

Public meeting will occur next week.

(iii) Anne Levac, Planning Assistant, re: Closing of Unopened Street Lindsay MUls presented a report prepared by Anne Levac re Closing of

Unopened Street.

Ts item was discussed at length under 5. (ii) Delegations: Peter Radley, re: Closing ofUnopened Street.

Lindsay IVKUs advised if we close the road, the Township would lose access to the lot in the back. Therefore, the Township would ask Mrs. Hole to deed to

the Township the triangular portion (Part 5). Mr. Kerr would be giveu access to Ms property through this arrangement.

After much discussion it was agreed that the property that Mrs. Hole and her

family have been living on for many years would be conveyed to her for $1.00 on thecoudition that she convey to the Township the triangle portion described as Part 5 of Plan 13R-19606. Council directed Lindsay MUs to

prepare the necessary documentation to bring back to Council for review and approval.

Everett Kerr proposed that he would dedicate land to the Township for a future road. Councillor Vandewal said that none of these transactions should cost the Township anything.

(iv) Anne Levac, Planning Assistant, re: Closing of Unopened Road Allowance

Lindsay IVUUs presented a report by Anne Levac regarding closing of an

unopened road allowance. Lanes in part of Ormsbee Subdivision were

dedicated to the Township as part of the original subdivision agreement, but were not assumed by the Township. These lanes are privately maintained.

Peter Scott owns property at 4572 Wildlife Lane and is developed with a seasonal dwelling constructed over 50 years ago. Mr. Scott wishes to construct a new dwelling further from the water, while at the same time not

building too close to the road. If he could acquire part of this road allowance, it would aUow him to build further back. If Council agrees to close and sell this portion of Wildlife Lane, the amount payable to the Township according to our road closing policy would $5,899.68 plus HST

plus advertising, survey and administrative costs.

Council discussed the request and it was generally felt that there is enough property for the applicant to build upon without necessity of closing and selling the road allowance. Council is not in favour of this. 7.

Councillor Robinson advised that they are currently workmg on their budget.

The draft budget reflects a 1.97% increase. .

Portland Historical Society

Deputy Mayor McDougaU reported that the work being done on the old school is

turning out very well with the floors havmg been sanded, etc. He said everything

is moving forward and the work should be completed in time for the 150th anniversary celebrations.
