SUBJECT: 2016 Capital Budget RECOMMENDATION: Council is asked to provide comment and direction on the capital budget. This input will be incorporated into the 2016 preliminary operating budget. BACKGROUND: Council has adopted a budget cycle and provided direction to staff to prepare the preliminary 2016 capital and operating budgets with a target increase in the Township’s levy of 2.0%. The capital budget is a foundational building block of the operating budget. Once the capital budget is set then the numbers are incorporated into the overall operating budget. The capital budget reflects proposed expenditures that are greater than $5,000 and either have a life span greater than one year, add value to an asset or are a one-time expenditure. Each year Council, as part of its operating budget, makes specific contributions to reserves. These savings are put aside for the purpose of paying for future capital expenses. Previous Councils have adopted a “save then pay” strategy as opposed to any consideration of debt financing. Funding for capital expenses comes from three sources, current year taxation, reserves and other funding / grants. This other source includes but is not limited to City of Kingston Funding for Arterial Roads and County Federal Gas Tax dollars. The Township has adopted a multi-year capital and vehicle replacement program with commitments to, gradually increase the level of investment into building and maintaining its tangible capital assets as well as spreading out the cost of updating the municipal fleet. The 2016 Proposed Public Works / Facilities Capital Budget is $10,100,415 with $4,065,339 coming from current year taxation, $5,050,344 from reserves and $980,161 from other sources. Details of each proposed capital expenditure will be reviewed at the meeting. Following presentation of the Capital budget for public works and incorporating all feedback from Council the overall impact on municipal reserves will be presented along with the operating budget on Saturday November 14. I am writing regarding the severance for the property of James Campbell on the James Wilson Road in our Township. It is my hope that, after the severance is approved, it will still be possible to secure continued public access to the small beach that many of us have used for a number of years.

When my children were young, we often stopped at the beach (which one of my children still calls “the magic beach”) en route to our cabin on Canoe Lake Road. While we have water access on our land, Paddy’s Lake is at the far end of the property, and there have been many a time when we swam at the

James Wilson beach rather than hiking all the way back to Paddy’s Lake. Our family has always thought of this beach as a charming public space, and it is my hope that it can remain that way. I understand that this could be possible if, in following the Planning Act provisions regarding public parkland for recreation, the parkland dedication clause was put into effect.

More recently, Wintergreen has been hosting workshops related to the visual arts. While we have many beautiful sites on the land at Canoe Lake, sometimes we hold sessions on the James Wilson Road. For

example, a week-long workshop on pastel painting involved both locations. Participants to that workshop enjoyed the beach at the end of a day of painting, and in this way, the public that has made use of the beach

over the years has included not only local residents, but also visitors to the Township. It would be a shame to lose this lovely swimming location when there is a simple and elegant solution that could be invoked to solve the problem. Yours sincerely, Rena Upitis Executive Director

understand that South Frontenac council will be considering a parkland dedication instead of cash in lieu when the James Campbell severance on Canoe Lake is considered. I would hope that council would opt for the parkland dedication so that this small piece of land would be in the public domain. This would mean that the township would have the ability to formalize and clarify the existing informal arrangement. If this were to happen then people in the neighbourhood would have legal access to Canoe Lake and the tiny beach that is there. Having small amenities for local people helps make communities more livable.

I had the opportunity to view the report and recommendation when it was posted to the township website earlier today. I have also prepared a letter on the topic, below, recognizing that my comments are too late for inclusion in the

Subject: Comment Regarding Possible Parkland Dedication related to Severance Applications at James Wilson Road at Canoe Lake (James Campbell property) To the members of Council of the Township of South Frontenac:

It came to my attention late last week that the Council was contemplating creation of “parklancT near the western end

of the causeway between Canoe Lake and Eel Lake, adjacent to the James Campbell property, and that this topic is on the agenda for the Council meeting to be held Tuesday, October 20, 2015. As I appreciate that my comments are too late for inclusion in the agenda package, I have taken the liberty of preparing a separate letter My points are as follows:

a) I own the cottage and property on James Wilson Road on the eastern end of the causeway/ opposite the James Campbell property. I have received no formal notice of the proposed severances on the James Campbell property/ nor of CounciFs consideration of possible creation of a park; it is only through advice from a cottage neighbour, who saw an article in the local newspaper, that I undertook to investigate and understand what was under consideration. I am disappointed that no formal consultation of neighbours appears to have been undertaken.

b) Regarding public access for swimming: I acknowledge that a number of local people currently use the road allowance to access a small beach area for swimming and appreciate that they wish to continue such use. If you are not personally familiar with the location, I think that you need to be aware that this is a small area (perhaps 20 feet by 10 feet? … Fm not good at judging dimensions) and is hardly a “beach” of the sort that could accommodate a large number of users. I do not believe it would be a sound basis for development of parkland.

c) Concern re development - safety for people: Creation of a park and attempting to attract additional users would

create more traffic on our narrow road (James Wilson Road) and hazards related to parking. Approached from Canoe

Lake Road, James Wilson Road requires careful navigation over hills and around two 90-degree turns - two cars can pass safely, but only if drivers going both ways stay at the edge of the road. Approached from the west, there is an even narrower section of James Wilson Road that would create accident risks for users. The subject proposed parkland is at a

sharp corner of the road with a driveway entering from the south - this would pose a safety hazard for both pedestrian

and vehicular traffic.

d) Concern redevelopment-impact on natural environment: the area in question is right beside a shallow bay that is

used by wildlife - we have loans. Great Blue Herons and turkey vultures in the area. Should development be contemplated, I would expect some sort of environmental impact study to be undertaken. At a minimum, I would expect that acceptance from the Cataraqui Regional Conservation Authority would need to be secured.

e) Concern re development - impact on surrounding neighbours: I understand that locals have long enjoyed swimming in Canoe Lake from the road allowance near the James Campbell property and believe they should continue to have access to swim; however/1 do not think this is the right location for a park and beach. As noted above, it is a small area. Creation of a park and attempting to attract additional users would not only create more traffic and hazards

related to parking, but also noise from park users. While I appreciate that noise carries over water and that people swimming do make some noise, I would not have bought this cottage property if it had been across from a park. To

date/ we have endured loud noise, at times late into the night, from the beach area (including a young man apparently

trying to find out how loud he could scream in the middle of the night). I do not think it is practical to expect the township to be able to monitor and control such behaviour; accordingly, I do not think it wise for the township to create

a more appealing venue for such late-night parties. I am happy to pay taxes for the privilege of owning a cottage property/ but believe that we have a right to peaceful enjoyment of our property.

f) Concern re development-impact on property value: We have spent considerable funds on both acquisition and

maintenance of our property, and we have added a screened-in porch/ which has resulted in increased taxes payable to

the township. I believe that creation of a park here would result in decreased property value for our cottage and/ should the township proceed with a park, then I would seek to explore a corresponding decrease in tax payable. In conclusion, I would urge you to decide against parkland in this area.

I had a brief exchange of voice message with Lindsay Mills of the Planning department last week, and will endeavour to speak with him in person when he is back in the office tomorrow.

TO SOUTH FRONTENAC COUNCIL:

OCT 15, 2015

This letter concerns the proposed granting of severances for the Campbell property on Canoe Lake, which I strongly oppose until a professional survey has been conducted to determine the exact boundary of the property, the Township road allowance limits, and the relation to the Canoe Lake high-water mark.

Granting any severance before this survey is completed will expose the Township and taxpayers to the risk of mistakenly allocating the small beach area in question. Furthermore, since Mr. Campbell is applying for the severances and contends the beach area in question is on his land, he has an obligation to prove this and pay for an impartial, independent surveyor selected and supervised by the Township.

This process will protect Township taxpayers from any potential future liability, and establish clear property boundaries at no additional cost to them. If Mr. Campbell refuses to pay in advance the cost of this survey (by means of an escrow payment made to the Township), the severance application should be rejected by the Township.

This is particularly required as Mr. Campbell has in the past allowed the unauthorized construction of a permanent building (without a building permit or proper setback) on the land in question, and the placement of unauthorized trailers. This indicates a lack of respect for Township bylaws. Furthermore, his existing building on Canoe Lake is for sale, which demonstrates his intention to sell all his properties and leave the area.

I should add that I built a home 5 km from the Canoe Lake beach area 15 years ago, and it is my prime swimming location. In the summer, I routinely swim there twice per day, and often bring visiting friends and family as well. It is particularly apt for very small children, as it has a shallow, sandy entry with no deep drop offs. I have seen many local families bring their children there, in part because it is not used for motorized boat launching.

If a survey establishes that the beach access/high-water point is within the Township road allowance, then I recommend it be incorporated into a public parkette available to all Township residents. I would be pleased to donate a permanent picnic table and benches, and I know several neighbours (permanent residents and cottagers) would contribute a day of labour to make this parkette an asset to the area.

In conclusion, although this beach access point is small in size, the decision facing Council is large because it will determine whether access to one of the Townships’ finest recreational lakes is private, or public, for future generations to come.

I have two young boys who have enjoyed playing in the sand and splashing in the shallows at this little beach. It is the closest beach to our home on Canoe Lake Road, and as we do not have waterfront

property/ it is nice that we can also enjoy Canoe Lake via the only public access point on the lake. Fve been told by my neighbours that this sweet little spot could endure if the parkland dedication clause in the Planning Act provisions was enacted. good public access. Establishing this pubic access would altow all residents of the township access to one of our takes. It wouki help reduce any conflict between lake residents and other residents of the township by permitting access on township property.. As you know there are very few natural beaches on any of the Township lakes and this is an opportunity that comes

along very rarely. At little cost, can secure access to a small beach far all township residents. This is a once in a lifetime opportunity and once it is gone, it will be gone forever. TTianks you for your consideratron off this^issue and support fcr all the residents in the Township. ».
