Public Meeting Statement • The purpose of this public meeting is to hear comments on Zoning By-Law Amendment Application PL-ZBA-2024-0009. • If you wish to be notified of the decision of Council in respect to the application, you must submit a written request to the Clerk by email care of planning@southfrontenac.net. This will also entitle you to be advised of an Ontario Land Tribunal appeal. • Only a specified person or public body as defined in the Planning Act, or the registered owner of any land to which the by-law would apply, may appeal the decision to the Ontario Land Tribunal. They must have made an oral submission at the public meeting or a written submission to Council. • The appeal must be filed with the Clerk within 20 days of the notice of decision. Summary This report provides Council with information about Zoning By-law Amendment Application PL-ZBA-2024-0090 for a property civically addressed as 848 Burnt Hills Road. If approved, a holding symbol (H) would be placed on the Rural (RU) zone on a portion of the subject lands. Council will review the proposal and invite public input at the statutory public meeting. Staff are recommending that Council pass a by-law during the Council meeting in which the public meeting is held, per Procedural By-law as Amended by By-law 2023-44, as the planning matter is technical in nature (i.e. it fulfills a condition of consent approval) Recommendation That By-law 2024-63 being a By-law to amend By-law 2003-75, as amended, to amend the zoning on lands known as 848 Burnt Hills Road, be given first and second reading; and That By-law 2024-63 be given third reading, signed and sealed. Background The subject application is related to consent applications PL-BDJ-2024-0011 and PL-BDJ2024-0012 for the creation of two new rural residential lots. The severed parcels are approximately 12Ac and 8Ac in area. These consent applications were provisionally approved by the Committee of Adjustment on May 9, 2024. The purpose of the rezoning application is to implement a condition that requires a holding symbol to be placed on the RU zone on the portion of the severed parcels within 120 metres of Beacon Point Wetland Complex, to be removed only after an environmental impact assessment is completed to the satisfaction of the Township. Under the Planning Act, a public meeting is required to be held to receive comments from the public on the proposed rezoning.

Property Description The subject property is approximately 160.9 acres with frontage on Burnt Hills Road. Development is isolated to the eastern portion of the property and consists of a dwelling and detached storage structure. The subject property consists of woodlands, cleared areas, and low lying wetlands. The area immediately adjacent to Burnt Hills Road is mostly cleared of trees and features an unevaluated wetland and a small pond with hydrologic connections to the Beacon Point Wetland Complex. The remainder of the property is mostly characterized by mixed forest and some scattered low-lying wetland areas. One of these wetlands is the Beacon Point Wetland Complex. This Provincially Significant Wetland (PSW) is located approximately 400m from Burnt Hills Road. The severed parcels extend to the boundary of this PSW. Topography varies significantly across the extent of the subject property. The area adjacent to Burnt Hills Road are predominantly flat. However, the area of the proposed retained lot (excluding proposed Lot 2) adjacent to Burnt Hills Road features steeply sloping topography, rendering a majority of this frontage unusable. The surrounding area consists primarily of rural residential and agricultural uses. Department and Agency Comments Public Services, Building Services and Cataraqui Conservation were not circulated the rezoning applications as their staff had no objection to approval of the related consent applications. Public Comments No comments were received from the public at the time of writing this report. Discussion/Analysis The proposed zoning by-law amendment was assessed against the applicable policies of the Provincial Policy Statement 2020, County of Frontenac Official Plan, and Township of South Frontenac Official Plan, as well as the provisions of Zoning By-law No. 2003-75. The Committee of Adjustment had consideration for these planning documents in the decision to grant provisional approval to the consent applications. The Provincial Policy Statement (Section 1.1.5) and the County of Frontenac Official Plan (Section 3.3) permit residential development, including lot additions, which are locally appropriate, in rural lands. The County Official Plan and the Township Official Plan also permit residential development in the Rural Designation. The severed parcels met all applicable requirements for new lot creation. Both severed parcels are intended to be used for rural residential purposes. The northern lot line of both severed parcels aligns with the boundary of the Beacon Hill Provincially Significant Wetland (PSW) complex. There is high probability that the land surrounding this feature contain significant wildlife habitat and habitat for endangered and threatened species. The Provincial Policy Statement prohibits development within 120m of a PSW unless it has been demonstrated that there will be no negative impacts. to development within 120m of a PSW. For this reason, one of the conditions of approval of the consent applications was that a holding symbol be placed on lands within 120m of the PSW in order to restrict their development until such time as an environmental impact assessment (EIA) is completed which demonstrates no negative impacts on any identified natural features and their ecological function. This would ensure that a building permit could not be issued for development within 120m of the PSW unless the appropriate study has been submitted. The holding symbol would not impact the owner’s ability to obtain a building permit for buildings and structures that might be proposed more than 120m from the PSW. A holding symbol was a recommended condition of approval instead of requiring an EIA upfront in support of the consent applications due to the size of the severed parcels and the existence of potential building envelopes more than 120m from the PSW. It is anticipated that development on both severed parcels would occur within these identified building envelopes. Should development be proposed within 120m of the PSW, the holding symbol will allow for the scale and scope of the required environmental study to match the proposal. Conclusion It is the opinion of Township Planning Staff that the proposed zoning by-law amendment is consistent with the Provincial Policy Statement 2020, in conformity with the Frontenac County Official Plan and Township of South Frontenac Official Plan and represents good planning for the subject lands. Staff recommend that Council pass a by-law during the Council meeting in which the public meeting is held, per procedural By-law as Amended by By-law 2023-44, as the planning matter is technical in nature. Specifically, the Committee of Adjustment had consideration for all applicable policy in the decision to grant provisional approval to the consent application, and the by-law will fulfill one of their conditions. Page 20 of 47 Township of South Frontenac By-Law Number 2024-63 Page 1 of 2 By-Law Number 2024-63 BEING A BY-LAW TO AMEND BY-LAW 2003-75, AS AMENDED, TO PLACE A HOLDING SYMBOL ON THE RURAL (RU) ZONE ON A PORTION OF LANDS DESCRIBED AS 848 BURNT HILLS ROAD, PART LOT 29, CONCESSION 11 DISTRICT OF STORRINGTON: WILEY Whereas pursuant to the provisions of Section 34 of the Planning Act, RSO 1990 as amended, the council of a Municipality may enact by-laws regulating the use of land and the erection, location and used of buildings and structures thereon; Whereas By-law 2003-75 being the Zoning By-law regulates the use of land and the erection, location and use of buildings and structures within the Township of South Frontenac; Whereas the Council of the Corporation of the Township of South Frontenac considered all written and oral submissions received on this application, the effect of which helped Council make an informed decision; And that there be no further notice pursuant to Section 34 (17) of the Planning Act; Therefore be it resolved that the Council of the Corporation of the Township of South Frontenac hereby enacts as follows:
- That Schedule “C” to Zoning By-law Number 2003-75 as amended, is hereby further amended by adding a holding symbol (-H3) to the RU zone on the lands shown on Schedule “1”.
- That the following holding symbol provision be added to Section 33: Holding Symbol H3 The holding symbol (-H3) applying to lands zoned Rural (RU) may be removed to permit development only after an Environmental Impact Assessment is prepared to the satisfaction of the Township.
- This By-law shall come into force in accordance with Sections 34 and 36 of the Planning Act, 1990, as amended, and take effect either upon the date of passage or as otherwise provided by said Sections 34 and 36. Council approved these fees in principle pending the required public meeting. A copy of the original report is provided under Exhibit A. Council will review the proposal and invite public input at the public meeting. Staff are recommending that Council pass a by-law during the Council meeting in which the public meeting is held, if there are no comments from the public. Financial Implications Adding new fees to cover activities undertaken by planning staff in response to public/developer demands means a greater proportion of the cost of staff time can be recovered from the user of these services. Summary This report provides Council with information about proposed amendments to the Planning Fees Schedule. Recommendation That Council approve the updated Planning Fees for 2024, attached as “Exhibit A” in principle; and That Council direct staff to provide notice in order for Council to hold a public meeting on Tuesday, August 13, 2024, in accordance with By-law 2016-73, regarding the proposed amendments to the Planning Fees Schedule. Discussion/Analysis The proposed amendments to the Planning Fee Schedule will address matters that arose over the past year as well as changes in provincial legislation. The proposed amendments include the following matters:
- Multi-residential and Residential site plan fee for waterfront properties
- Subdivision legal deposit increase
- Validation of title fee
- Source Water Protection – Risk Assessment Review
- Red line revisions to plans of subdivision/condominium
- Request for Municipal Support Resolution for energy grid programs (FIT) or similar programs
- Multi-residential and Residential site plan fee for waterfront properties Provincial legislation removed the ability for municipalities to utilize site plan control for waterfront properties. The Township completed a Planning Fees update in 2023 to reflect this change. The province then reversed this legislative change, and the Township can now re-apply site plan control for waterfront development. residential development were also previously removed to reflect provincial changes but are being re-instated for residential development of greater than 10 units. 2. Subdivision legal deposit increase Staff recommend an increase in legal deposits for small subdivision applicants due to the number of billable hours from the Township’s solicitor for these types of development applications. 3. Validation of title fee The Township has received several requests for validation of title and does not have a fee to cover the staff time involved with processing this request. 4. Source Water Protection – Risk Assessment Review The Township has a small budget dedicated to risk assessment review of development projects when they are located within the source water protection zone of the water treatment plant. Establishing a review fee to be borne by the applicant would assist with cost recovery. The Township currently has a three-year contract with Cambium Inc. to complete risk assessment reviews. 5. Red line revisions to plans of subdivision/condominium Staff has indicated that a common practice in municipalities across the province is to include a red line revisions fee for plans of subdivision/condominium. It is not uncommon for a land developer to request this type of adjustment to the plan during the approval process. Red line revisions was added to the change of condition section and the fee increased. 6. Request for Municipal Support Resolution for energy grid programs (FIT) or similar programs Staff anticipate increased requests for Municipal Support Resolutions for energy grid programs (FIT) or similar programs in the future. a planning fee is recommended in order to account for staff time reviewing and commenting on these development proposals. Page 27 of 47 Township of South Frontenac By-Law Number 2024-62 Page 1 of 3 By-Law Number 2024-62 A By-Law to Amend the Planning Fees Schedule Whereas section 69.1(1) of the Planning Act, R.S.O. 1990, provides that the council of a municipality, by by-law, may establish a tariff of fees for the processing of applications made in respect of planning matters, which tariff shall be designed to meet only the anticipated costs to the municipality or to a Committee of Adjustment constituted by the council of the municipality in respect of the processing of each type of application provided for in the application; Whereas the Council of the Corporation of the Township of South Frontenac deems it expedient to ensure that staff time involved in reviewing and processing development applications is properly accounted for in the tariff of fees associated with the processing of planning applications; Therefore Be It Resolved That the Council of the Corporation of the Township of South Frontenac hereby enacts as follows:
- That Schedule “C”, attached hereto, and by this reference, shall form part of By-law 2024-59.
- That all other by-laws establishing fees for the processing of planning applications are hereby repealed.
- This by-law shall come into force in accordance with section 69.1 of the Planning Act, R.S.O. 1990, either upon the date of passage or as otherwise provided by said section 69.1. Cataraqui Conservation Councillor Sleeth advised that an appealed application regarding a property on Devil Lake that was reviewed by the Board. He noted that the Board agreed that the decision of Conservation Authority staff to deny the application was appropriate.

Frontenac Community Arena Board Councillor Roberts advised that the staff has put the ice in for the upcoming season. He noted that the first booking was scheduled for September 3, 2024. He stated that the Frontenac teams and Loyalist teams will be using the ice and mentioned that September 13, 2024 from 6:00-8:00 is opening night at the arena.

Summary This report seeks Council approval for the contract award Recommendation That Council approve the award of the grave excavation and cemeteries maintenance contract to D.G. Younge Cemetery Services for a period of 2 years with an option for a one additional year. Background The Township owns 12 cemeteries that required regular maintenance and grave excavation services. The current contract for grave excavation and cemeteries maintenance expired earlier this year. Based on the dollar threshold, a request for quotation (RFQ) was issued on July 24, 2024 and closed August 14, 2024. Discussion/Analysis Two submissions were received in response to the issued RFQ. Both submissions were reviewed and met all requirements. Below is a summary of prices received:

Younge Burial Vaults created reliable and responsive services. For this reason, along with the quoted prices, staff are recommending the award of the contract to D.G. Younge Cremation Services. Summary This report seeks Council approval for the declaration of surplus land for roll # 102904002030450, PT LT 10 CON 13 LOUGHBOROUGH AS IN FR156156; SOUTH FRONTENAC Recommendation That Council support declaring roll # 102904002030450 as surplus land. Background A request has been received in regards to a property owned by the Township which is approximately 100 acres and land locked. There is interest in the property for nature reserve purposes. It is only accessible through private lands. There is what appears to be a unopened road allowance abutting the property at the north which extends East-West from Canoe Lake Rd to Frontenac Park but would still not provide access due to watercourses through the road allowance. The property abuts to Frontenac Provincial Park and is an opportunity to establish a conservation corridor between the Park and the Kingston Field Naturalist’s Helen Quilliam Sanctuary and the Gould Lake Conservation Area to the southwest. Discussion/Analysis In order to move forward with the process to authorize the transfer of land, the property must first be declared surplus by Council under by-law 1999-0025. By-law 1999-0025, establishes procedures governing the sale of real property by the Township. Prior to the sale of any property, Council must: a) pass a public resolution to declare the property surplus; b) Obtain an estimate of the fair market value; and, c) Give notice to the public of the proposed sale www.southfrontenac.net South Frontenac is a welcoming and thriving rural community.

The property has been reviewed by the Director of Development Services who has confirmed that there is no future use of the property for the Township. The property is land locked and is surrounded by unopened road allowances and provides a challenging terrain for access. This report seeks Council support to declare the property surplus. Once approved, a public notice will be issued to seek feedback on the surplus lands for a period of one month as prescribed under by-law 2002-92. Once the public feedback period closes, staff will bring back the request received, valuation information and any public comments received along with next steps. Page 42 of 47 Township of South Frontenac By-Law Number 2024-62 Page 1 of 3 By-Law Number 2024-62 A By-Law to Amend the Planning Fees Schedule Whereas section 69.1(1) of the Planning Act, R.S.O. 1990, provides that the council of a municipality, by by-law, may establish a tariff of fees for the processing of applications made in respect of planning matters, which tariff shall be designed to meet only the anticipated costs to the municipality or to a Committee of Adjustment constituted by the council of the municipality in respect of the processing of each type of application provided for in the application; Whereas the Council of the Corporation of the Township of South Frontenac deems it expedient to ensure that staff time involved in reviewing and processing development applications is properly accounted for in the tariff of fees associated with the processing of planning applications; Therefore Be It Resolved That the Council of the Corporation of the Township of South Frontenac hereby enacts as follows:
- That Schedule “C”, attached hereto, and by this reference, shall form part of By-law 2024-59.
- That all other by-laws establishing fees for the processing of planning applications are hereby repealed.

- That Schedule “C” to Zoning By-law Number 2003-75 as amended, is hereby further amended by adding a holding symbol (-H3) to the RU zone on the lands shown on Schedule “1”.
- That the following holding symbol provision be added to Section 33: Holding Symbol H3 The holding symbol (-H3) applying to lands zoned Rural (RU) may be removed to permit development only after an Environmental Impact Assessment is prepared to the satisfaction of the Township.
- This By-law shall come into force in accordance with Sections 34 and 36 of the Planning Act, 1990, as amended, and take effect either upon the date of passage or as otherwise provided by said Sections 34 and 36. Page 47 of 47 Township of South Frontenac By-Law Number 2024-64 Page 1 of 1 By-Law Number 2024-64 A By-Law to Confirm generally all actions and proceedings of the Council meeting of the corporation of the Township of South Frontenac on September 10, 2024 Whereas Section 8 of the Municipal Act, S.O. 2001 c. 25 and amendments thereto provides that a municipality has the capacity, rights powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act of any other Act and; Whereas Subsection 2 of Section 11 of the Municipal Act S.O. 2001, c. 25 and amendments thereto provides that a lower-tier municipality and an upper-tier municipality may pass by-laws respecting matters within the spheres of the jurisdiction described in the Table to Subsection 2, subject to certain provisions, and; Whereas Section 5 of the Municipal Act, S.O 2001 c. 25 and amendments thereto provides that a municipal power, including a municipality’s capacity, rights, powers and privileges under Section 8 shall be exercised by its council and by by-law unless the municipality is specifically authorized to do otherwise, and; Whereas the Council of the Township of South Frontenac deems it expedient to confirm its actions and proceedings; Therefore, be it resolved that the Council of the Corporation of the Township of South Frontenac hereby enacts as follows:
- The all actions and proceedings of the Council of the Corporation of the Township of South Frontenac taken at its regular meeting held on September 10, 2024, be confirmed as actions for which the municipality has the capacity, rights, powers and privileges of a natural person.
- That all actions and proceedings of the Council of the Corporation of the Township of South Frontenac held September 10, 2024, be confirmed as being matters within the spheres of jurisdiction described in Subsection 2 of Section 11 of the Municipal Act, S.O. 2001, c.25 and amendments thereto.
- That all actions and proceedings of the Council of the Corporation of the Township of South Frontenac taken at its regular meeting held on September 10, 2024, except those taken by by-law and those required by bylaw to be done by resolution are hereby sanctioned, ratified and confirmed as though set out within and forming part of this bylaw.
