Delegations

a)

County of Frontenac - In-Field Communications Terry Gervais spoke to his presentation that provided an update on what has been done to date with respect to the County wide in field communication strategy. The next steps will be to initiate a process that would include an Expression of Interest and a Request for Proposal to include upgrading the existing analog system and user gear, costing of a new digital system and user gear, leasing options for the simulcast infrastructure both analog and digital and to explore the possible partnerships with neighboring municipalities/counties.

b)

Overview of County Economic Development - Successes and Future Direction Richard Allen and Alison Vandervelde provided an update on economic development in Frontenac County. Their presentation included outlining the ecosystem of partnerships with various agencies, the economic development charter that includes Trips and Trails, Local Food and Beverages and Recreation Lifestyle and the Brand Ambassador program success. A review of the operating budget for economic development for Frontenac County and other counties revealed that other than Renfrew County, Frontenac has the lowest per capita investment.

Resolution Resolution No. 2017-19-02 Moved by Councillor Sleeth Seconded by Councillor Barbeau THAT Council suspend the procedural rules limiting delegations to Committee of the Whole meetings and received delegations at the Council meeting of June 6, 2017. Carried

Allan and Associates Auditors - 2016 Financial Statements Howard Allan reviewed the financial statements as presented. Mayor Vandewal questioned the 2% target of Council and how it compares to the .88 rate of taxation outlined in the statement. He commended staff and Council for their efforts in the audit and sound financial direction. Councillor Sutherland noted that keeping the tax rate at 2% allows for the increase in other costs associated with new development . Councillor Sleeth referred to the prudent financial management that South Frontenac has demonstrated over the years yet have been unable to obtain any funding. He asked Mr. Allan if there is anything the township can be doing differently. Howard Allan indicated that the townships getting funding are not in the same good financial position as South Frontenac.

Resolution Resolution No. 2017-19-04 Moved by Councillor Sleeth Seconded by Councillor Barbeau THAT a public meeting be held to discuss planning matters related to: • Road Closure and Transfer to Scouts Canada - Concessions XII and XIII, Party of Lot 11, Loughborough District • Proposed New Road Name - Robinson Road, Part Lot 7, Concession IV, Portland District Carried

Road Closure and Transfer: Scouts Canada - Concessions XII and XIII, Part of Lot 11, Loughborough Mr. Symon explained that Scouts Canada had requested that the road allowance be closed and indicated their interest in purchasing the potion that runs east and west through their land near Frontenac Park as they wish to develop their camp property and build a four season facility that would allow Scouts Canada to offer winter programming for youth. One of the proposed structures would be located on the Township-owned road allowance. There was discussion about the per square foot fee as part of the property lies within 300 feet of the lake with the remainder being bushland and it was agreed that the cost of the entire piece would be $12,266.00. There were no comments from Council or the public.

c)

Proposed New Road Name: Robinson Road Mr. Symon explained that the new road is a portion of the intersection reconfiguration in the village of Harrowsmith. The new road will be a public road approximately 150 metres to the west of the present intersection. The Public Services Committee proposed the new road be named “Robinson Road” in honour of former long serving Councillor for Portland District - Bill Robinson. Nancy Vandewal provided a written suggestion of 150th Way in honour of Canada’s 150th Birthday this year. Councillor Barbeau appreciated the suggestion of 150th Way and requested clarification on whether it would be a “road” or a “street”. Councillor McDougall supported “Robinson Road’ as Mr. Robinson had been a Korean war vet not recognized for his many years of service. The opportunity to name the parkette being created in honour of Canada’s 150th was suggested. There were no comments from the public.

Mark Segsworth, Public Works Manager, re: Planned Hydro Outage Battersea Area - Verbal Report Mark Segsworth explained that he has been contacted by Hydro One about an upcoming planned power outage in the Battersea/Inverary/Sunbury areas from 4:00 am to 12:00 noon, however the date has not been confirmed. Hydro One needs to advise users ten days in advance. The proposed date is June 25 for upgrades to their transmission lines. Further updates will be circulated to Council.

Councillor Barr notified Council of the Rideau Valley Conservation Authority’s Annual Watershed Tour to be held on June 22, 2017 starting at 8:30 am.

Councillor McDougall referred to an email he received from the Bob’s and Crow Lake Association regarding financial assistance for septic tank maintenance. He will forward a copy of the email to staff and Council for review.

c)

Councillor Sleeth asked about the status of the private lane assistance program. Mark Segsworth indicated that the deadline for applying is June 9 and that a report to Council is not anticipated until late fall as invoices are usually not submitted until November.

d)

Mayor Vandewal reminded Council of the grand opening at the park in Inverary and the playground fundraiser for Battersea Park this Saturday.

Sommer Casgrain-Robertson, General Manager, RVCA, re: 2016 Accomplishments Sommer Casgrain-Robertson provided an update on the accomplishments of the Rideau Valley Conservation Authority in 2016. The annual report and supplementary specific to South Frontenac was previously circulated to Council. She noted various programs and highlights including the watershed monitoring and reporting, protecting people and property from natural hazards, sustainable development watershed restoration and enhancement and conservation lands and education. Looking ahead in 2017, the RVCA Strategic Plan will include developing and sharing watershed knowledge that advances decision making and leads to on-the-ground action, protecting, restoring and enhancing watershed health and increasing watershed awareness and appreciation. Mayor Vandewal thanked her for the presentation.

b)

Heidi Conarroe, re: Building Permit Relief Ms. Conarroe was not in attendance.

c)

Philippe Archambault, re: Traffic Calming Request - Silverwood Drive Mr. Archambault voiced his concerns about the traffic coming and going to the lake and travelling fast through a residential neighbourhood while children are riding their bikes. He referred to the petition presented to Council last year for a speed bump and assumed that since it was installed last year and had made a difference, that a speed bump would be reinstalled this year. Mr. Archambault noted that the township owned speed bumps are rotated around the municipality and noted that members of the community are willing to do fundraising for additional speed bumps. He asked that Council reconsider the speed limit on Silverwood Drive as well.

Jevon Austin, re; Traffic Calming Request - Silverwood Drive

Committee of the Whole June 13, 2017 Mr. Austin noted that his concerns are the same as Mr. Archambault and suggested other traffic calming measures such as signage - “Children at Play” or “Community Safe Zone”. He noted that Silverwood Drive is narrow and has no shoulders. He also suggested extra police surveillance. Councillor Sutherland asked about the noise resulting from the speed bump being utilized and Mr. Austin stated that generally there wasn’t any. Councillor McDougall asked if traffic counts had been done before or after the speed bump was installed last year. He felt the township should reconsider this request given that the residents are willing to fundraise to cover expenses. Mayor Vandewal noted that reducing the speed limit doesn’t work, but agreed that the matter of the speed bump would be reconsidered. e)

Chris Wilcock, re: Traffic Calming Request - Silverwood Drive Chris Wilcock has been a resident of the area for almost a year and recognizes the tendencies of drivers and that children should be encouraged to stay on their own property. He stated that he has three small kids and felt the speed bump made a big difference . Councillor Sutherland felt it was extremely generous for the residents to offer fundraising however since South Frontenac has allowed linear residential development he feels the township should be paying for additional speed bumps and that photo radar doesn’t always work.

f)

Kent Labbett, re: Traffic Calming Opposition - Silverwood Drive Mr. Labbett was not in favour of the speed bump, he agreed that no one wants an accident however he has talked to residents along the water that are being accused of speeding on Silverwood Drive. He submitted a petition with 46 signatures indicating they are not in favour of the speed bump. He felt the speed bumps are as hard on vehicles as a pot hole which residents blame the township for if damage is done. He felt that cautionary signs would be more effective and that the “offenders” should be dealt with directly. Councillor Sleeth felt the township should be requesting the OPP to provide surveillance. He noted that he has travelled this road recently four times and found children playing in the middle of the road and suggested parents should be monitoring this. Mr. Labbett felt there are three issues, children on the road, people not obeying traffic laws and residents allowing their pets to wander onto the road. School bus drivers endure long waits for children to get safely onto buses as well. Mayor Vandewal noted that speed bumps shouldn’t slow vehicles down below the posted speed limit. Council agreed to have this matter reconsidered at Public Services.

Reports Requiring Action

a)

Mark Segsworth, Public Works Manager, re: Process for Assumption of NonSubdivision Roads Council was generally receptive of the process, however there were concerns

Committee of the Whole June 13, 2017 expressed about “More than 50% of abutting property owners must be in favour of assumption by the Township”. This should be clarified to read “benefiting” property owners or similar wording. Staff were directed to refine the process and bring back to Council. Councillor Sutherland thought that 50% is not enough people in favour to go forward. Mayor Vandewal replied that 50% is pretty good for any request of this type and added that perhaps these roads should be condominiumized. b)

Forbes Symon, Manager of Development Services, re: Encroachment Agreement-Holiday Manor, Battersea Forbes Symon noted that they have looked extensively at road surveys and are unable to locate the steel pegs that indicate the lot line. This concern can be addressed prior to any capital improvements. Council was supportive of bringing this forward for approval on June 20, 2017.

c)

Forbes Symon, Manager of Development Services, re: Request for Licence Agreement for Access to West Part of Lot 13, Concession 9, Bedford District Doug Amey Council was supportive of maintaining the direction they gave in September 2012 and that permission will not be granted to cut trees on the municipal unopened road allowance and that they do not support improving the unopened road allowance.

d)

Forbes Symon, Manager of Development Services, re: Outdoor Solid Fuel Burning Appliance By-law Council had concerns about clauses 6 and 8 in the draft by-law. Specifically should there be a provision in clause 6 to request extensions to the chimney and in clause 8 are we “sterilizing” the property if they are not allowed to replace an old furnace with a new one. Lindsay Mills had received an email from Councillor Barbeau who was unable to attend the meeting but had some concerns. Mr. Mills read the email to the Committee. Councillor Barbeau suggested that the township talk to an expert on wood heating to address some of the concerns and Councillor Barr noted that she agreed with this idea. Forbes Symon cautioned Council on going above and beyond the Building Code and the unit requirements. There needs to be very solid reasons to require more than those guidelines. Councillor Schjerning was concerned with #8 and #10 and asked about hot water heating in the summer months. Councillor Sutherland questioned the general clauses about nuisances and adverse effects. He felt that adverse effects should be included in the by-law. Mr. Symon clarified that adverse effects are different that nuisance in case laws. He noted that the wording comes directly from case law and gives more strength however he agreed to look at the wording again. The general consensus of Council was to defer the report back to Development

Forbes Symon, Manager of Development Services, re: Cranberry Cove Condominium Agreement & Release of Municipal Conditions Council commended staff for the clarity of the report. Forbes Symon indicated that changes have already been made since the report was submitted for the agenda. BACKGROUND At the Committee of the Whole meeting on June 13, 2017, the draft by-law and related encroachment agreement was presented to Council. The owners of the Holiday Country Manor at 5208 Battersea Road wish to operate an outdoor licenced patio that encroaches on the municipal road allowance. Staff were directed to move this forward. Previously the Development Services Committee at its May 31st meeting found the by-law and agreement to be generally acceptable and recommended the matter be forwarded to Committee of Whole for further consideration

AGENDA DATE: June 20, 2017 DATE REPORT PREPARED: June 15, 2017 SUBJECT: Condominium Agreement & Release of Municipal Conditions of Draft Approval: Cranberry Cove Condominium RECOMMENDATION The recommendation is that Council authorize the Mayor and CAO to enter into the subdivision agreement and that staff notify the County that conditions 1 to 14 of draft plan approval for the Cranberry Cove Condominium has been addressed to the satisfaction of the Township of South Frontenac.

BACKGROUND As Council is aware, the Cranberry Cove Plan of Vacant Land Condominium, former Township of Storrington, received draft plan approval from the County of Frontenac on July 16, 2014 (County Decision Attachment #1). The County decision identified 14 conditions which required clearance from the Township of South Frontenac prior to the County considering Final Condominium Approval. The proposal was for a 13 unit residential Plan of Vacant Land Condominium on lands described as Part of Lot 26, Concession 10, Geographic Township of Storrington. The development covers 25.49 hectares of land to be accessed by private lanes off of Carrying Place Road. The property has frontage on Cranberry Lake. (Attachment 2) The developer has been working with the Health Unit, Cataraqui Region Conservation Authority and the Township of South Frontenac to satisfy the conditions of Draft Approval. It now appears that the conditions have been satisfied. The primary document through which the conditions are satisfied is a Condominium Agreement between the Township and the developer. This agreement identifies the detail reports, engineering plans, covenants and conditions through which the development may proceed. The Draft Condominium Agreement is now close to being finalized. Accordingly, it is appropriate for Committee to consider forwarding the matter to Council to authorize the Mayor and Clerk to enter into the Condominium Agreement and send notice to the County on the clearance of municipal conditions. The following is staffs report on how the conditions have been satisfied. Highlighted conditions are still outstanding and requiring further clarification. It is anticipated that outstanding issues will be addressed in short order and that the draft subdivision agreement can be finalized. The draft conditions are indented. Staff`s assessment of how the condition is being satisfied is in bold text. Satisfying the Conditions of Draft Approval

  1. Approved Draft Plan: That this conditional approval applies to the Draft Plan of Vacant Land Condominium, dated 01/04/12, revised May 30, 2014 prepared and certified by Clancy and Hopkins Surveying Limited, OLS, which shows the following:  13 units for single detached dwellings (Units 1-13);

Satisfied. The final draft plan surveyed April 3, 2017 and signed May 25, 2017 and Reference Plan 13R-21517 includes all of the items identified in Condition #1 and is referenced in Schedule C of the Agreement. 2. Condominium Agreement: That the owners of the subject land enter into a plan of vacant land condominium agreement with the municipality, prepared to the satisfaction of the municipality, to be registered on title of the subject land. Satisfied. The draft vacant land condominium agreement has been prepared to the satisfaction of municipal staff and upon Council`s approval shall be registered on the title of the subject lands as per clause #22 of the agreement. 3. Financial Requirements: A. That the owner agree in writing to satisfy all the requirements, financial and otherwise of the municipality concerning the provision/upgrading of roads, installation of services and drainage, in accordance with the municipality’s standards and procedures. Satisfied. The draft vacant land condominium agreement clauses 2, 17 to 22, Schedule B and Schedule C address these matters. B. That the Owner shall reimburse the Township of South Frontenac and County of Frontenac for all legal, engineering, planning, administrative expenses and permit fees including the cost of any peer review that the Township of South Frontenac or County of Frontenac may require in relation to the condominium. Satisfied. The draft vacant land condominium agreement clauses 2 and 19 address these matters. All accounts shall be paid in full prior to execution of this agreement. 4. Access A. That the road allowances included in this draft plan identified as Block 16 Common Element’, ‘Block 17 Common Element’ and ‘Block 18 Common Element’ shall be shown and constructed to Township standards for new private lanes. Satisfied. The draft vacant land condominium agreement clauses 1 and 2 and Schedule B 18 address these matters. B. That a portion of Carrying Place Road from the existing fire hall on the road to the entranceway to the development (approximately 712 metres) be surface treated to the satisfaction of the Township. Satisfied. The draft vacant land condominium agreement Schedule B and E 19 address these matters.

C. That the new lanes identified as ‘Block 17 Common Element’ and Block 18 Common Element’ shall be named to the satisfaction of the municipality. Satisfied. The draft vacant land condominium agreement clause 12 address this matter. Developer has selected Winterberry Lane and Fern Lane for the two new lanes. Cranberry Cove Lane is the name of the existing land and shall be retained. D. That 0.3 metre reserves be identified by survey along the road allowance of Carrying Place Road where it abuts proposed units 6, 9, and 10 to be conveyed to and held in trust by the municipality for the purpose of denying additional access onto Carrying Place Road.

Satisfied. The draft vacant land condominium agreement clause 10 and Schedule A and D address this matter. E. That, prior to final approval, street signage shall be installed according to Township standards and to the satisfaction of the municipality.

Satisfied. The draft vacant land condominium agreement clause 12 address this matter. 5. Declaration, Easements and Joint Use Agreement A. That the easements referred to in the August 13, 2013 letter from Soloway Wright to the County of Frontenac be created within the declaration of a condominium, with the proposed additional access from the island located at Part 2, Plan 13R-8978 being subject to confirmation that the proposed easement is to the Township’s satisfaction

Satisfied. Developer has provided Condominium Declaration document. The draft vacant land condominium agreement preamble and Schedule D address this matter. B. That Cranberry Cove Lane be subject to a joint use agreement (or other similar legal agreement), to be registered on title, between the condominium corporation/declarant and the properties listed in the August 13, 2013 letter from Soloway Wright to the County of Frontenac to the satisfaction of the Township.

Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E and Township has been presented with the draft agreement (signatures pending). 6. On-Site Sewage Disposal and Water Systems: A. That the recommendations outlined in the letter dated January 10, 2014 from KFL&A Public Health to the County of Frontenac, be addressed to the satisfaction of the municipality and KFL&A Public Health

Satisfied. KFL&A has provided clearance of their conditions and that the draft vacant land condominium agreement acknowledges this requirement in Schedule E 4, 5, 6, 7 and 24. B. That all requirements and recommendations specified in the Hydrogeology, Terrain Analysis and Nitrate Impact Assessment Report, revised dated April 9, 2013, from Lissom Soil and Water Inc., and ‘Cranberry Cove Nitrate Attenuation Calculations’ from Greer Galloway Group Inc., dated

November 12, 2013, and project letter dated March 15, 2014 and all associated drawings and peer review recommendations be complied with. Satisfied. The draft vacant land condominium agreement acknowledges these requirements in Schedule E 3(b)(ii) and (iii). C. That any existing wells and or septic systems that may be present on the site and are not to be used as part of the plan of condominium be decommissioned as per applicable regulations. Satisfied. The draft vacant land condominium agreement acknowledges these requirements in Schedule E 3(e) and 25. 7. Environment A. That the recommendations of the Environmental Impact Statement (EIS) dated January 12, 2012 prepared by Ecological Services, be implemented including the requirement that all development be set back a minimum of 35 metres from the high water mark of Cranberry Lake and inland ponds. Satisfied. The draft vacant land condominium agreement acknowledges these requirements in Schedule E 3(d) and 28 and in zoning by-law amendment #2015-09. B. That all conditions and issues outlined in the letters dated November 26, 2012, December 12, 2013, and July 14, 2014 from the Cataraqui Region Conservation Authority/Rideau Waterway Development Review Team to the County of Frontenac, be addressed to the satisfaction of the municipality and Rideau Waterway Development Review Team. Satisfied. The draft vacant land condominium agreement acknowledges these requirements in Schedule E 3(b)(i) and (vi), (f), (g) and E18. C. That a practical building envelope in compliance with the Zoning By-law and EIS be identified to the Township’s satisfaction on Unit 2 Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E 26. D. That the area on ‘Block 19 Common Element’ near Unit 14 at the narrowest point between the lane and the water’s edge be vegetated with natural species of shrubs and trees as identified in the Township’s Site Plan Guidelines and to the satisfaction of the Township. Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E 27. E. That the Condominium Agreement include text to the satisfaction of the Township and the CRCA notifying the Owner that permission will be required under Ontario Regulation 148/06: Development, Interference with Wetlands, and Alterations to Shorelines and Watercourses prior to commencing rough grading, stockpiling, road construction, etc. within 30 metres of the wetland, within 30 m of all watercourses and ponds and within 15 m of the 98.86 m GSC flood elevation on the subject property. That the Condominium Agreement include text to the satisfaction of the Township and the CRCA to provide notice to purchasers of Units 1 to 5 and 10 to 13 inclusive and Block 18 (based on May 30, 2014 Draft Plan revision) that site alteration and construction (including but not limited to buildings, structures, filling and grading) on these lots may require permission under Ontario Regulation 148/06: Development, Interference with Wetlands, and Alterations to Shorelines and Watercourses prior to commencing these activities. Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E 3(g). G. That notice be provided to future purchasers advising them of any other applicable CRCA and Parks Canada regulations, and any other particular environmental restrictions on individual lots, in wording and in a manner to the satisfaction of the Rideau Waterway Development Team and the Township. Satisfied. The draft vacant land condominium agreement acknowledges this requirement is Schedule E 3(g). H. That an agreement be registered on the subject land applying to all of the proposed units to deal with setting out the municipality’s limited service policies to recognize that there is no commitment or requirement by the municipality to assume responsibility for ownership or maintenance of the private lanes within the plan. In addition, the agreement applying to Units 1-5 shall set out the municipality’s standard environmental protection policies requiring that the area within 35 metres of the highwater mark of the lake be maintained in a natural state for soil and vegetation. Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E 28. 8. Stormwater A. That a lot grading and drainage plan and a sediment and erosion control plan be completed and approved to the satisfaction of the Township of South Frontenac and the Cataraqui Region Conservation Authority (‘CRCA’), and be included in the Condominium Agreement between the Owner and the Township. Waiting final approval of Stormwater Management Brief from CRCA. The draft vacant land condominium agreement acknowledges this requirement in Schedule C. Blanks have been included in reference to documents for final revision data to be added in. The following note was also added. “Note: Additional drawings related to stormwater management and CRCA approval may be identified following the signing of this agreement and prior to final approval by the County of Frontenac. By consent of all parties who sign this agreement, the additional drawings approved by CRCA are hereby identified as being part of Schedule C of this agreement as an addendum.” B. That a stormwater management plan be prepared by a qualified Professional Engineer and approved to the satisfaction of the Township and the CRCA, and that appropriate text to implement its findings be included in the Condominium Agreement.

Waiting final approval of Stormwater Management Brief from CRCA. The draft vacant land condominium agreement acknowledges this requirement in Schedule C and in Schedule E 3(v). C. That, prior to final approval, the Township shall be satisfied that all servicing issues are resolved such as lane construction; stormwater drainage, design, and maintenance; and the construction and design of ditches and culverts. Satisfied. The draft vacant land condominium agreement acknowledges this requirement in clauses 1 and 2(g) and in Schedule B and C. 9. Parkland Dedication: That the owner convey up to five percent of the value of the land in the form of cash-in-lieu of parkland. Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule C and Schedule E 29. Valuation prepared in accordance with Council approved policy by a qualified Appraiser - $500,000 as of July 15, 2014 (day prior to draft approval), representing cash-in-lieu value of $25,000. 10. Human Remains: The condominium agreement shall contain a clause providing that any Owner(s) be advised, and also that a notice be placed in the purchase and sale agreement alerting any prospective purchasers that in the event that human remains are discovered during construction or site development of a lot, that the property owner shall immediately contact the OPP, the Ministry of Tourism, Culture and Sport and the Registrar or Deputy Registrar of the Cemeteries Unit of the Ministry of Consumer Services (or the applicable agencies at the time of final approval). Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E 3(h). 11. Archaeological Resources: A. That all recommendations of the Archaeological Assessment (Stage 1-2 & Stage 3) Report, dated June 4, 2010 by Adams Heritage and further revised May 2013 be implemented to the satisfaction of the Township. B. That a garbage pick-up area be included on the plan at a location near Carrying Place Road and to the satisfaction of the Township.

Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E 10. B. That an easement be included and a dry fire hydrant shall be constructed at a location to be determined to provide for a Dry Hydrant - this hydrant and the access to it shall be left unobstructed and accessed by the Township for inspection anytime year round and shall be maintained 100 percent, twelve months per year by the Corporation which requirement shall be incorporated into the final condominium agreement. Construction of the hydrant and all maintenance costs shall be borne by the developer/condominium corporation and shall be to the satisfaction of the Township Will not be satisfied. Letter on file from Fire Chief that no suitable location was found but it will not negatively impact delivery of fire services. C. That, subject to the requirements of Canada Post, any mail boxes shall be placed at a location near the entrance to the development near Carrying Place Road and to the satisfaction of the Township. Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E 30. D. That prior to final approval, the Owner satisfy the Township that public utilities, including without limitation Bell Canada, Hydro One, etc., are adequate to service the proposed development. Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E 13. E. That, prior to final approval, street lighting shall be installed at the entrance to the development at Carrying Place Road such lighting to also illuminate any garbage pick-up area and mail box location. Satisfied. The draft vacant land condominium agreement acknowledges this requirement in Schedule E 26. 13. Revisions to Draft Plan: A. That Prior to Final Condominium Approval, the Owner shall submit a revised Block Plan, if required, to reflect any significant alterations caused from this Draft Plan Approval. Satisfied. CONDOMINIUM AGREEMENT Cranberry Cove THIS AGREEMENT made in triplicate this __ day of __________, 2017. BETWEEN: MAGENTA WATERFRONT DEVELOPMENT CORPORATION hereinafter referred to as the “OWNER” OF THE FIRST PART

WHEREAS the Municipality recommended approval of a Draft Plan of Condominium for lands more particularly described on Schedule “A” attached hereto (the “Owner’s Lands”); AND WHEREAS the Council of The Corporation of the County of Frontenac approved the Draft Plan of Condominium for the Owner’s Lands and imposed draft plan conditions, pursuant to the Planning Act, as amended; AND WHEREAS the Plan of Condominium creates thirteen (13) Units for single detached dwellings, one (1) storage garage designated as Unit 14 on the draft plan of condominium, one (1) parking area designated as Unit 15 on the draft plan of condominium, three (3) road blocks, one (1) open space block, and one (1) easement block within Unit 4, with the common elements owned by the Condominium Corporation (as such term is defined below) and governed by the Condominium Act, 1998 (the “Act”) the Declaration and the By-laws of the Condominium Corporation, each Unit owner being an owner of the Condominium Corporation; AND WHEREAS it is a condition to draft plan approval that the Owner enter into a Condominium Agreement with the Municipality and register this Agreement on title to the Owner’s Lands in accordance with section 51(26) of the Planning Act; AND WHEREAS the Owner shall register a Declaration and Description under the Act in order to create a Vacant Land Condominium Corporation upon the Lands described in Schedule “A” attached hereto, and upon creation of the Vacant Land Condominium Corporation (the “Condominium Corporation”), the Condominium Corporation shall assume all of the obligations of the Owner pursuant to this Agreement; NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the approval of the Plan of Condominium and other good and valuable consideration, the Owner hereby agrees with the Municipality as follows:

  1. The Owner shall, at its sole risk and expense and to the satisfaction of the Municipality, construct, use, operate and maintain those facilities and works set out in the Plan of Condominium Drawings in accordance with the terms of this Agreement. The Plan of Condominium Drawings listed in Schedule “C” are hereby incorporated by reference into this Agreement. Without limiting the generality of the foregoing, the Owner agrees that it shall build all private lanes to the Municipal standard for private lanes. The originals of the Plan of Condominium Drawings are on file in the offices of the Municipality and shall govern in the event of any dispute.

2 2. As a condition of this agreement and without which this agreement shall have no effect, the Owner shall: a. execute and deliver this Agreement to the Municipality; b. obtain a consent to registration of this Agreement in a form satisfactory to the Municipality from the holder of any mortgage or other encumbrance of the Owner’s Lands that will be outstanding on the date of registration of the Plan; c. pay in full all outstanding taxes, drainage and unamortized local improvement charges on the Owner’s Lands; d. pay in full all outstanding invoices issued by the Municipality with respect to the Plan; e. deliver to the Municipality an original copy and an 8½” X 14" reduced copy of the final Plan forwarded to the County for registration; f. deliver: i. to the County of Frontenac, eight (8) mylars and four (4) paper prints of the completed Plan; ii. to the Township of South Frontenac, four (4) copies of all reference plans and four (4) copies of all conveyance documents for all easements and lands being conveyed to the Municipality, if any; iii. to the Township of South Frontenac, a surveyor’s Certificate to confirm that the units and blocks on the Plan conform to the permitted minimum area requirements for each unit and the maximum density requirements in the Zoning By-law of the Municipality; and iv. to the Township of South Frontenac and the County of Frontenac, a digital file in AutoCAD format of all required drawings; g. provide certification from the Owner’s Professional Engineer that the facilities and services have been installed and are sufficient to ensure the independent operation of the Condominium Corporation. Alternatively, if any facilities or services have not been installed such that the Condominium Corporation can operate independently, then the Owner will be required to engage the services of a qualified quantity surveyor or professional engineer to provide a calculated amount of the required security for one hundred percent (100%) of the required works. The security shall be provided in a form satisfactory to the Municipality in its sole discretion and shall be in compliance with the Act. 3. If required by the Municipality, the Owner shall employ an engineer licensed and in good standing with the Association of Professional Engineers of Ontario to supervise all engineering functions including but not limited to: a. the preparation of calculations, contours, designs, plans and specifications; b. the preparation and furnishing of all required drawings; c. the preparation of the necessary contracts; d. the obtaining of all required federal, provincial and municipal approvals; e. the provision of the field layout, contract administration and construction supervision; f. the maintenance of all records of construction and upon completion to advise the Municipality of all construction changes and to prepare all final and “as constructed” plans and drawings as may be required by the Municipality; and g. acting as the Owner’s representative in all matters pertaining to the construction. 8. The Owner shall furnish all plans, specifications, designs, calculations, contours, or other information pertaining to the Owner’s Lands as the Municipality may require. No contract shall be awarded and no work shall commence or be continued without the prior written approval of the design and inspection of the work by the Municipality. 9. All required inspections shall be performed by the Municipality whose determination of whether any work has been constructed to its satisfaction shall be final. 10. The Owner shall not transfer title to any Unit within the Plan until after this agreement, all deeds, grants of easement and 0.3 metre reserves in favour of the Municipality and related reference plans of survey have been registered, as required. 11. All civic addresses and 911 numbers for use within the Plan shall be allocated by the Municipality. The Owner shall advise each purchaser of a Unit of its correct number. 12. The Owner shall submit proposed lane names to the Municipality for approval. The naming and installation of civic addresses and lane signs shall be in accordance with the Municipal Standards for 911 and Emergency Preparedness and at the Owner’s expense. The location of all entrances to all Units, including the location of culverts and 911 civic address signage shall be shown on a plan approved by the Municipality prior to issuing a building permit for development within the lands. 13. The Owner covenants and agrees that nothing in this Agreement releases the Owner from the obligation to comply with the provisions of all other by-laws of the Municipality that may now or in future be in effect. 14. All construction within the Owner’s Lands shall be carried out in accordance with any noise by-law of the Municipality which may be in effect from time to time. 15. Time shall be of the essence of this Agreement and of any extension of time that may be 4841-6569-5045, v. 2

4 agreed upon by the parties. 16. The Owner hereby grants to the Municipality, its servants and contractors, a licence to enter the Owner’s Lands during normal operating hours for the purpose of inspecting the real property within the Plan of Condominium and to perform any work arising from or the result of any default by the Owner under this Agreement. 17. It is the intent of this Agreement that the Municipality shall not incur any expense for the development of the Owner’s Lands and every obligation of the Owner under this Agreement shall be deemed to include the words “at the expense of the Owner”, unless specifically stated otherwise. 18. In the event the Owner is in default in the performance of any obligation under this Agreement and such default continues more than fifteen (15) days after the Municipality delivers written notice to the Owner requiring the Owner to remedy the default, the Municipality may, without further notice to the Owner, do such thing at the Municipality’s expense as it may reasonably require necessary to remedy the default, and the Municipality may recover the expense incurred in doing such thing by action or the same may be recovered in like manner as municipal taxes in accordance with the provisions of Section 446 of the Municipal Act, 2001, S.O., 2001, C. 25, as amended. 19. The Owner agrees to reimburse the Municipality and the County of Frontenac for all legal, engineering, planning, administrative expenses and permit fees including the cost of any peer review that the Municipality or County of Frontenac may require in relation to the condominium. 20. All invoices, costs and expenses received or incurred by the Municipality and payable by the Owner shall be paid within thirty (30) days of the Municipality’s invoice or demand for payment to the Owner, failing which the Owner shall be in default under this Agreement and shall continue in default until payment plus all accrued interest is made in full. 21. Interest shall be paid by the Owner on all overdue amounts at the same rate per annum and calculated in the same manner as the Municipality charges on overdue municipal taxes and any payments received shall be applied first on account of accumulated interest and then on the outstanding amount. 22. The Municipality shall undertake the registration, at the Owner’s expense, of this Agreement against the title to the Owner’s Lands and, in accordance with s. 51(26) of the Planning Act, all of the terms and conditions of this Agreement may be enforced against the Owner and any and all subsequent owners of the Owner’s Lands. 23. The Owner shall ensure that the requirements of this Agreement are brought to the attention of its contractors, employees and workers prior to the start of any construction. 24. All covenants in this Agreement shall be construed as being joint and several and that, when the context so requires or permits, the singular number shall be read as if the plural were expressed, and the masculine gender as if the feminine or neuter gender, as the case may be, were expressed. 25. Pursuant to s. 51(32) of the Planning Act, the Draft Plan of Condominium Approval shall lapse on July 16, 2017 if the final approval has not been given, notwithstanding the entering into of this Agreement, unless an extension is requested by the Owner and, subject to review, granted by the approval authority. Pursuant to s. 51(33) of the Planning Act, the owner may submit a request to the approval authority for an extension of the Draft Plan of Condominium Approval. The extension period shall be for a maximum period of three (3) years and must be submitted prior to the lapsing of Draft Plan Condominium Approval. Further extensions may be considered at the discretion of the Municipality and the County of Frontenac. 4841-6569-5045, v. 2

5 26. Any dispute between the parties with respect to this Agreement shall, at the request of a party, be submitted to arbitration pursuant to the Arbitrations Act 1991 and the decision of the arbitrator or, if more than one, the decision of a majority shall be final and binding on the parties. 27. Each party shall pay its own costs of the arbitration and shall share equally the costs of the arbitrator(s). 28. Any notice required to be given by the parties to this Agreement shall be given by registered mail at the last known address for service of the parties, or at such other addresses as the parties may specify from time to time, (provided that in the event of a postal disruption, notice shall only be given by hand) and shall be deemed to have been delivered on the third day after the date of deposit in the post office. 29. The Owner agrees that if any section, clause or provision of this Agreement is for any reason declared by a Court of competent jurisdiction to be invalid the same shall not affect the validity of the Agreement as a whole or any part thereof, other than the section, clause, or provision so declared to be invalid and it is hereby declared to be the intention that all the remaining sections, clauses or provisions of this Agreement shall remain in full force and effect, notwithstanding that one or more provisions thereof shall be declared to be invalid. 30. The parties shall, upon reasonable request of the other, execute any further documents as may be required for the more perfect and absolute performance of the terms and conditions. 31. In addition, the Owner and each and every subsequent owner of the Lands or a part thereof acknowledges notice of and agrees to be bound by all of the provisions of this agreement and, in particular, those provisions set out in Schedule “E”. 32. This Agreement shall enure to and be binding upon the parties hereto, and their respective successors and assigns. 10 SCHEDULE “E” MUNICIPAL CONDITIONS The Owner further covenants and agrees as follows: 1.

In this Schedule “Plan” shall mean the Plan of Condominium, as finally approved.

The drainage of surface water within the Plan is the sole responsibility of the Owner and all subsequent purchasers of Units, who shall provide and maintain adequate drainage of surface water in accordance with the Approved Plan of Condominium Drawings.

The Owner shall include in each agreement for the purchase and sale of any Unit, notice that the Purchaser will be bound by the following provisions which shall, without limiting the generality of the foregoing, also form part of this Agreement, binding on the Owner: (a) That every purchaser of a Unit shall be responsible for ensuring that all wastes are disposed of in compliance with the Municipality’s waste management by-laws and all other applicable laws. Further, that any other applicable CRCA and Parks Canada regulations may apply to the development of the individual lots. (g) The purchasers of Units 1 to 5 and 10 to 13 inclusive acknowledge and agree that site alteration and construction (including but not limited to buildings, structures, filling, and grading) on these lots may require permission under Ontario Regulation 148/06: Development, Interference with Wetlands, and Alterations to Shorelines and Watercourses prior to commencing these activities. (h) All purchasers acknowledge and agree that should deeply buried archaeological remains be found on the property during its development, that the Ministry of Tourism and Culture shall be notified immediately. The purchasers further agree that any discovery of an aboriginal or archaeological artefact or resource is subject to controls under the Ontario Heritage Act and those archaeological resources shall not be removed without the approval of the Ministry of Tourism and Culture. In the event that any human remains are discovered, the purchasers agree to immediately contact the Ontario Provincial Police, the Ministry of Tourism and Culture, the Registrar or Deputy Registrar of the Cemeteries Regulation Unit of the Ministry of Consumer and Commercial Relations ((416) 326-8404) and the Municipality. The Owner shall provide to every purchaser of any Unit a site servicing plan showing the location of the house, well, and primary and alternate sewage locations for the Unit.

The identified primary and alternate sewage system locations shall be reserved and maintained solely for that purpose. No construction of wells, homes, driveways, pools, garages or any other structure is to take place in the primary or alternate sewage system location.

The primary and alternate sewage disposal locations were selected due to the suitability of those areas to provide an ideal area to treat sewage. No deviation will be permitted in the sewage disposal system locations unless, if it becomes necessary to deviate from the approved location, an engineering report and system design as well as a terrain analysis is provided to the satisfaction of the approval authority. The alternative location must also include an impact assessment on adjoining properties.

Sewage disposal systems which produce a higher quality of effluent will be considered and encouraged by the approval authority in situations where protection of human health or the quality of surface water or groundwater is an issue.

The Owner acknowledges and agrees that the Municipality will not be assuming or maintaining the roads within the Plan and will have no obligation to undertake any works to improve, widen or upgrade the aforesaid roads at public expense at any time. The operation and maintenance of all roads and driveways within the Plan are the sole cost and responsibility of the Owner.

The Owner acknowledges and agrees that the Municipality shall not be responsible for providing fire, ambulance and other emergency services to any Unit if the operator of the emergency vehicle, having made reasonable efforts in the circumstances, determines that the condition of the roads or driveways as constructed or maintained at the time, prevents the vehicle from being operated properly or safely in order to access or exit any given Unit.

The Owner acknowledges and agrees that the Municipality shall not provide curbside waste disposal services to any unit within the Plan. Waste pickup will be available at the garbage pick-up area included in the Plan at a location near Carrying Place Road, in accordance with the Municipal waste management policies.

The Owner acknowledges and agrees that any development or redevelopment is subject to land use planning controls and Ontario Building Code permits and approvals, intended to, among other things, conserve shorelines and woodland areas in their natural state.

The Owner acknowledges and agrees that every owner of a Unit shall be responsible for operation and maintenance of their water system in accordance with all applicable laws.

It is the responsibility of the Owner and each subsequent owner of a Unit within the Plan of Condominium to make whatever arrangements with Hydro One and such other utility provider as are necessary for the installation of hydro-electric, telephone and other utility services for the Unit.

The Owner shall confirm that sufficient wire-line communication/ telecommunication service to the proposed development exists. In the event that such infrastructure is not available, the Owner is hereby advised that the Owner may be required to pay for the connection to and/or extension of the existing communication/telecommunication infrastructure. If the Owner is required to demonstrate to the Municipality that sufficient alternative communication/ telecommunication facilities are available within the proposed development, such facilities must be sufficient to enable, at a minimum, the effective delivery of communication/telecommunication services for emergency management services (i.e. 911 Emergency Services).

The Owner shall endeavour to maintain all existing grades along the edge of the boundary of the Plan.

The Owner hereby agrees to indemnify and save harmless the Municipality against all actions, causes of action, suits, claims, demands and costs whatsoever arising by reason of any matter under this Agreement, including without limitation any actions, causes of action, suits, claims, demands or costs directly or indirectly related to the construction, use, operation or maintenance of the roads within the Plan, including the inability to operate an emergency vehicle properly or safely in order to access or exit any given Unit due in whole or in part to the condition of the roads or driveways within the Plan at the time.

The Owner shall agree in writing to satisfy all requirements, financial and otherwise of the Municipality for the provision/upgrading of roads, installation of services and drainage including ditches and culverts, according to the Municipality’s minimum standards.

The Owner acknowledges and agrees that the proper maintenance and inspection of the stormwater management infrastructure shall be the responsibility of the Condominium Corporation and shall be undertaken in accordance with the recommendations identified in Section 9 of the Ainley Group, Servicing and Stormwater Management Brief, Cranberry

13 Cove Lane Condominium, Project Number 16847-1, dated February 2017, Revised__________________, page ___________. 19.

The road allowances included in the Plan identified as “Block 16 Common Element”, “Block 17 Common Element”, and “Block 18 Common Element” shall be constructed to the Municipality’s standards for new private lanes.

The portion of Carrying Place Road from the existing fire hall on the road to the entranceway to the development (approximately 712 metres) shall be surface treated to the satisfaction of the Municipality.

The new lanes identified as “Block 17 Common Element” and “Block 18 Common Element” shall be named Winterberry Lane and Fern Lane respectively.

An easement shall be created within the Declaration for the condominium in favour of the island located at Part of Lot 26, Concession 10, Storrington, being Part 2 on Plan 13R-8978, South Frontenac (PIN 36288-0301) (the “Island”) providing additional access to the Island, such easement being subject to confirmation that the proposed easement is to the Municipality’s satisfaction.

Cranberry Cove Lane shall be subject to a joint use agreement (or other similar legal agreement) to be registered on title, between the condominium corporation/ declarant and the adjoining properties using Cranberry Cove Lane with respect to the joint use, maintenance, repair and cost sharing obligations for the lane, to the satisfaction of the Municipality.

Access to Units 1 and 2 shall only occur on an easement registered as FC139453 and FC139454. The Declaration shall contain provisions to establish the legal access for Units 1 and 2, to the satisfaction of the Municipality.

The Owner acknowledges the letter dated January 10, 2014 from KFL & A Public Health to the County of Frontenac and agrees that the recommendations contained therein shall be implemented to the satisfaction of the Municipality and KFL & A Public Health.

The Owner agrees that any existing wells and/or septic systems that are present on the site and are not to be used as part of the plan of condominium shall be decommissioned as per applicable regulations.

The Owner agrees that a practical building envelope in compliance with the Zoning By-law and Environmental Impact Statement dated January 12, 2012 shall be identified to the Township’s satisfaction on Unit 2 prior to applying for any building permit for this Unit, and that no construction outside of the approved building envelope shall be permitted.

The area on “Block 19 Common Element” near Unit 15 at the narrowest point between the lane and the water’s edge shall be vegetated with natural species of shrubs and trees as identified in the Municipality’s Site Plan Guidelines and to the satisfaction of the Municipality.

The Declaration shall contain the Municipality’s limited service policies to recognize that there is no commitment or requirement by the Municipality to assume responsibility for ownership or maintenance of the private lanes within the Plan. The Declaration shall also set out, with respect to Units 1-5, the Municipality’s standard environmental protection policies requiring that the area within 35 metres of the highwater mark of the lake be maintained in a natural state for soil and vegetation.

The Owner agrees to convey up to five percent of the value of the Lands in the form of cash-in-lieu of parkland at the time of execution of this Agreement.

The Owner agrees that, subject to the requirements of Canada Post, any mail boxes shall be

14 placed at a location near the entrance to the development near Carrying Place Road and to the satisfaction of the Municipality. 32.

Units 14 and 15 shall be reserved exclusively for the use of Part of Lot 26, Concession 10, Storrington, being Part 4 on Plan 13R-8978, South Frontenac (PIN 36288-0303) (“Part 4, 13R-8978”) in the Declaration. Units 14 and 15 shall have the benefit of an easement over part of Unit 4 in the condominium plan, being Part 12 on Plan 13R-21517 for access to the lake, and such Units shall be conveyed to the owner of Part 4 13R-8978 upon registration of the Declaration and Description. A Restrictive Covenant shall be registered on title restrictive covenants shall be registered on title to Unit 14 and Unit 15 and Part 4, 13R8978 in favour of the Condominium such that neither Units nor Part 4, 13R-8978 may be sold without the other Unit and that at all times, the Units cannot be sold without the concurrent sale of Part 4, 13R-8978. Such restrictive covenants are intended to run with the lands benefited and burdened thereby, and shall be binding on and enure for the benefit of the Condominium and the Units and its respective successors in title thereto, all to the satisfaction of the Municipality.

BACKGROUND Under the Municipal Act, 2001, a person who has an interest in land which has a Tax Arrears Certificate registered against it has up to one year from the date of registration of the Tax Arrears Certificate to pay the Cancellation Price before the municipality is in a position to advertise the property for sale. As a result of outstanding taxes being owed in excess of three years, a Tax Arrears Certificate was registered July 4, 2017 for the property located at 6140 Perth Road, Perth Road. The registered owner of the property is Thavarajah Masillamany. In accordance with section 378 of the Municipal Act, 2001, a municipality may pass a by-law authorizing an Extension Agreement with the owner of the land, the spouse of the owner, a mortgagee or a tenant in occupation of the land, extending the period of time in which the Cancellation Price is to be paid. In accordance to the payment schedule attached to the by-law, a payment of $7,243.67 has been received on June 14, 2017. Further payments will be applied to this account as detailed in the payment schedule.

RECOMMENDATION That Council support the Eastern Ontario Regional Network submission of a business case to support improvement and expansion of cellular networks and mobile broadband services across Easter Ontario as outlined in the correspondence dated May 25, 2017.

BACKGROUND At the Special Council meeting on May 31, 2017 hosted by South Frontenac that included the Townships of North, Central and Frontenac Islands council and staff as well as County staff, Terry Gervais presented his report on In-Field Communications. The next steps from his presentation included an Expression of Interest and a Request for Proposal as well as upgrades to existing analog systems and user gear and the costing of a new digital system and user gear as well as leasing options etc. An update was given regarding the development of a business case by the Eastern Ontario Regional Network to address both cell and broadband gaps. The County now requires the support from each township to move this forward.

RECOMMENDATION That Council authorize the CAO to execute an agreement with Percy Snider to extend the lease for 4264 Stage Coach Road for an additional month, under the same terms but with an expiry date of July 31, 2017.

BACKGROUND In May 2015 staff were directed to formalize the lease with Mr Snider for the property at 4264 Stage Coach Road with an expiry of April 30, 2017. Mr. Snider was granted an extension to the lease agreement to June 30, 2017 deadline due to challenges in getting hydro installed at the site. Mr. Snider, when approached has now indicated a need for a further one month extension to July 31, in order to complete the move to his new facility.

FINANCIAL and STAFFING CONSIDERATIONS The current rent for the facility is $1211 per month plus an additional sum of $1,000 per month as additional rent that is applied and reconciled against property taxes and utilities.

  1. The Business Plan as prepared by SHS Consulting on behalf of the County while useful, it did not reflect the degree of consultation required. Assumptions about the partners were made and incorporated that have not been fully discussed let alone endorsed by the respective agency/boards.
  2. Southern Frontenac Community Services Corporation as a Board has not committed to the use of the land, nor has there been discussion about governance or management. The Board will consider how this project fits in the plans of the Grace center over the next 20 years. Questions remain about if there is enough land and whether the seniors housing should be part of the proposed expansion of the centre. SFCSC is keen on supporting seniors housing and working together to find solutions that fit within their mandate. The board is in the early stages of any discussions. Loughborough Housing Corporation has a shared mandate and objectives and the goals of this project are aligned with the Board’s. While the project is achievable the role of the Board is still to be defined. It was questioned why a 3rd floor option of for the existing facility was not considered I the plan when it was raised as an option. From a Township perspective no decisions have been made with regard to waiving fees or who will fund the “equity portion”
  3. The City has issued an RFI for funding that closes on May 17, 2017. This is a one shot opportunity to potentially gain access to $900,000 of funding for this project. Despite all the issues not being addressed, we need to pull together a submission. SHS has been engaged to pull this together, however the first draft still perpetuates the concerns previously expressed. The groups agreed to a rewrite with the following incorporated: • the partners want to be part of the solution that addresses and responds to senior housing needs • they believe that if the city is flexible, they would like to consider other viable options if they can meet the same monetary commitments • they would like to explore other funding models for some of the 6 market units through Community Hub funding possibly for transition housing for homelessness and one unit for respite care

the whole proposal needs to be edited to capture the vagueness that each board has, i.e. no definitive commitments

The Consultant will be asked to revise the proposal for Friday so that the proposal can go out and be reviewed over the weekend. Final comments can be received and the submission finalized. 5. Meeting Schedule Township staff will survey for the next meeting date. 6. Adjournment

Communication will need to be coordinated to relay information to the public through social media in the event of any scheduling changes. Flyers/Advertisements/Website

Posters and large signs are now up in the community. The website is incorrect on the large signs. Chair Mike Howe has arranged to have Marv add a patch to the sign with the new website on it. Darlene LaBarre will forward the Women’s Institute logo to Chair Mike Howe to add to the posters and website next year.

Volunteers

Samantha and Noah have arranged for 24 Sydenham High School students to volunteer for set-up and children’s games. Joanne will be ordering light blue volunteer t-shirts.

Fundraising/Finances

Chair Mike Howe has not yet confirmed the vendors but will call them all this week.

Parade

Chair Mike Howe met with OPP Staff Sgt. Sharon Brown and other district representatives to discuss the attendance of officers at each parade and the issue of traffic flow, particularly on highway 38. There were many complaints

about the highway being closed off for the parade last year. It is a heavily travelled road that needs to be closed off for a shorter period of time. Harrowsmith will change the direction of the parade this year as it should decrease the closure of highway 38. Activities

The fishing derby will be held from 8 a.m. – 10 a.m. Jamie Deline will be there as early as 7 if the children start showing up early. He would like to have a sign-up sheet so that he knows approximately how many kids to expect. Jamie has arranged for 6 volunteers to help run the derby as well as many prizes for the kids to win. The parents must stay with their children and provide their own fishing rods. Jamie will forward the specifics of the derby to the recording secretary for submission to Jason Silver for the website. Janet Knights will be arranging for a cookie decorating table for the children. It will be held in the gazebo with the cake. John Trousdale has not indicated whether he has confirmed the wagon rides after the parade. The petting zoo will be set up between the new play structure and the face painting station. Bill and Kerry Arthurs provided a report by email that the dog show is completely organized.

Food

Laura Hackett will pick up the cake from Costco and leave it in the fridge in the library overnight. Chair Mike Howe will speak with Councillor Mark Schjerning about the status of the canteen’s organization. The fridge in the canteen will need to be cleaned out prior to the event. Chair Mike Howe will confirm who will be performing this task.

SOUTH FRONTENAC TOWNSHIP BY-LAW 2017-35 BEING A BY-LAW TO AUTHORIZE THE ENCROACHMENT OF A PATIO ON THE ROAD ALLOWANCE THAT IS BATTERSEA ROAD ABUTTING 5208 BATTERSEA ROAD, DISTRICT OF STORRINGTON. WHEREAS Section 11(2) of the Municipal Act 2003, c. 25 authorizes a municipality to pass by-laws respecting highways; and, AND WHEREAS such jurisdiction includes allow any person owning or occupying a structure that is wholly or partially erected or constructed on any highway to maintain and use such structure thereon and to fix such annual charges that the Council considered reasonable for such an owner or occupant to pay for such a privilege; AND WHEREAS the patio located on lands with the civic address of 5208 Battersea Road, District of Storrington, is located wholly or in part on the road allowance of Battersea Road; NOW THEREFORE THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC, BY ITS COUNCIL, HEREBY ENACTS AS FOLLOWS:

  1. The patio feature which is proposed on 5208 Battersea Road may encroach into the road allowance of Battersea Road, but in no case shall it encroach further into the road allowance than the retaining wall existing at the date of the passage of this By-law;
  2. An annual fee for this privilege is $1.00;
  3. A permit agreement shall be entered into between the property owner and the Township and attached to this By-law as Schedule “A”;
  4. If any structure which encroaches into the road allowance as of the date of this By-law taking effect are removed, they cannot be replaced within the road allowance, and no additional structures shall occur within the road allowance; and,

To pay to the Licensor on demand all moneys paid by it in pursuance of any such settlement and also such sums as shall represent the reasonable costs of the Licensor or it Solicitor in defending or settling any such action, suit, claim or demand, and this agreement shall not be alleged as a defense by the Licensee in any action by any person for actual damage suffered by reason of the permission hereby granted to maintain the above-mentioned encroachment;
  3. That if in the opinion of the Licensor, there is a need for development or use of the road allowance by the Licensor, and if the existing encroachment is deemed to interfere with such development or use, the owner shall remove the encroaching patio from the road allowance, subject to a 120 day notice period; and,
  4. That if any structures which encroaches into the road allowance as of the date of this By-law taking effect are removed, they cannot be replaced within the road allowance, and no additional structures shall occur within the road allowance.
  5. That this agreement is non-transferable and is only assigned to the owners of the property at the date of the execution of the agreement.

WHEREAS a Tax Arrears Certificate was registered on July 4, 2017 as Instrument No.FC222202 against lands described as PT LT 19 CON 10 LOUGHBOROUGH AS IN FR647882, in the township of South Frontenac, County of Frontenac; (the “Property”).

AND WHEREAS Thavarajah Masillamany IS the registered owner of the Property;

AND WHEREAS Thavarajah Masillamany has expressed the desire to enter into an agreement with the Corporation of the Township of South Frontenac in connection with the repayment of tax arrears and all related costs for the Property prior to the sale of the Property by way of public tender;

AND WHEREAS Section 378 of the Municipal Act, 2001, permits the municipality to pass a by-law authorizing an extension agreement with the owners of land against which a Tax Arrears Certificate has been registered, in order to extend the allowable time for the repayment of the cancellation price;

AND WHEREAS Council has determined that it is in the best interest of the municipality to enter into an extension agreement in connection with the tax arrears and related costs for the Property.

NOW THEREFORE BE IT ENACTED AS FOLLOWS:

The municipality is hereby authorized to enter into the Extension Agreement dated June 20, 2017, with Thavarajah Masillamany in the form of Agreement attached as Schedule 1 to this bylaw and forming a part hereof.

That Mayor and Clerk are hereby authorized to execute the Extension Agreement on behalf of the municipality under corporate seal and to deliver it to the parties.

This By–law shall come into force and take effect on the date it is passed.

EXTENSION AGREEMENT THIS AGREEMENT made this 20 day of June__, 2017.

BETWEEN: Thavarajah Masillamany (Hereinafter called the “Owners”) OF THE FIRST PART;

and –

THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC (Hereinafter called the “Township”) OF THE SECOND PART;

WHEREAS the Owners are the registered owners of those lands located in the Township of South Frontenac and more particularly described in Schedule “A” to this agreement (the “Owners’ lands”); AND WHEREAS as a result of tax arrears owing in respect of the Owner’s Lands as at December 31, 2015, the Township registered a Tax Arrears Certificate against the title to the Owners’ Lands on July 4, 2016 as Instrument No. FC222202 in accordance with the provisions of the Municipal Act, 2001, S.O. 2001, c.25,s.373(1) (the “Tax Arrears Certificate”);

AND WHEREAS at the request of the Owners, the Township has agreed to extend the period of time in which the cancellation price is to be paid in accordance with the terms of this agreement and the Municipal Act, 2001;

NOW THEREFORE WITNESSETH that in consideration of the mutual covenants and agreements contained herein, the parties agree each with the other as follows:

  1. The period of time in which the cancellation price is to be paid is extended to July 3, 2019, on the condition that the Owners pay to the Township on account thereof: (a) An initial lump sum payment of $7,243.67 to be paid by certified funds on June 20, 2017. (b) The sum of $170.00 paid on a monthly basis via pre-approved payment plan with the first payment being made on Monday July 3, 2017. (c) The balance of the cancellation price and outstanding penalty fees via cheque by July 3,

  2. The cancellation price shall be calculated in accordance with the Municipal Act, 2001, but without limiting its generality, shall include all tax arrears and all current real property taxes owing in respect to the Owners’ Lands to the date of payment, all interest and penalties thereon, and all costs incurred by the Township in connection with proceedings taken or contemplated under the Act, including all legal fees and disbursements and all costs incurred in connection with the preparation of the extension agreement.

  3. If the Owners fail or refuse to make a payment to the Township in accordance with the terms of this agreement, the Township may, on seven (7) days written notice to the Owners, terminate this agreement after which it shall cease to be considered a subsisting agreement.

4. If the Owners fail or refuse to pay any current real property taxes owing in respect of the Owners’ Lands on or before the due date for such taxes, the Township may, on seven (7) days written notice to the Owners, terminate this agreement after which it shall cease to be considered a subsisting agreement.

  1. If the Township terminates this agreement before payment of the cancellation price, it shall be entitled to continue with proceedings under the Act, but the period during which this agreement is subsisting shall not be counted in calculating the time periods prescribed by the Act.

  2. Upon payment of the cancellation price in accordance with this agreement, the Township shall cause its Treasurer to forthwith register a Tax Arrears Cancellation Certificate in the prescribed form, and this agreement shall be at an end.

  3. Nothing in this agreement shall be construed or deemed to mean that the amount of the cancellation price to be paid in accordance with the Act is reduced or that any person is prohibited from paying the cancellation price in full at any time.

  4. Time shall be of the essence.

  5. No amendment to this agreement shall be permitted, except by the written mutual consent of the Owners and the Township, and any amendments shall be in writing.

  6. This agreement shall ensure to the benefit of the Owners, their respective heirs, administrators, successors and assigns, and the Township, its successors and assigns.

ENVIRONMENTAL INFORMATION FOR MUNICIPALITIES IN THE RIDEAU VALLEY

May/June 2017

Spring Water Levels in Review This spring saw prolonged and significant flooding in parts of the Rideau and Ottawa River watersheds. The mid-March snow levels were slightly above normal and combined with the large amount of precipitation received, it prompted the first flood outlook to be released early in April. This statement advised that low and flood-prone areas of the Long Reach and waterfront streets in Ottawa South may be affected. Within days the message was upgraded to a flood watch and in quick succession a flood warning. Early May saw another large rain event hit the area prompting flood outlook messages to be issued and quickly upgraded to a flood warning targeting Long Reach and the reservoir lakes of the Rideau Canal. By this time the reservoir lakes were above the full supply limit. Flood waters receded by May 15 and the flood warning was ended for the Rideau but was still in effect for the Tay system, which was affected by the high water levels in Bobs and Christie Lakes. The Ottawa River always peaks later than the Rideau River and the first flood message for the Ottawa River, in the area that the RVCA monitors, was issued in mid-April. Over the next week several flood warning messages were triggered by the large amount of rain and runoff from up north. By May 1 the messaging was upgraded to a flood warning. The river peaked on May 7 with flows reaching a record of 5,769 cubic metres per second (cms) making this spring’s freshet a significant 1:50 year flood event. Hazard Mapping in Ottawa

One responsibility of Conservation Authorities is to identify hazard lands. During the last five years, RVCA has been conducting several hazard mapping studies on watercourses within the City of Ottawa and the RVCA area of jurisdiction. For some watercourses, old mapping will be updated; and for others, hazard maps will be created for the first time. The ongoing studies identify two main types of hazards — flood risk and slope stability risk. Through various types of analysis flood risk maps identify areas that may be flood-vulnerable and restrict or prohibit development in accordance with Provincial Planning Policies. Slope stability studies make use of highly detailed topographic data to identify potentially unstable slope areas. The new and updated maps will be used by the City of Ottawa to update their Official Plan and Zoning Schedules and also used for review of development applications under the Planning Act. CAs will use the maps in administration and enforcement of regulations under the Conservation Authorities Act.

Currently, the RVCA is focusing its efforts on the following watercourses: • Flowing Creek (Flewellyn Road to Jock River) • Hobbs Drain (Fallowfield Road to Jock River) • Kings Creek (Brunton Side Road to Jock River) • Nichols Creek (Montague Boundary Road to Jock River) • Becketts Creek (Sarsfield Road to Ottawa River) • Bilberry Creek (Innes Road to Ottawa River) • Rideau River (Hogs Back to Kars) • Rideau River (Kars to Burritts Rapids) Once the technical work for individual study areas is complete and hazard mapping has been prepared, a public information session will be held to collect feedback. The fact sheet explores steps to repair houses, how to dispose of garbage, debris and what to do with sand bags. It also talks about how your septic system may be affected and what to do to safely handle the strain floods put on septic systems. City Stream Watch Recognized!

RVCA’s City Stream Watch Program was awarded the Ontario Association of Landscape Architects Certificate of Merit for Service to the Environment on March 31, 2017. Program Co-ordinator Justin Robert and Program Manager Jennifer Lamoureux were on hand to receive the award. The certificate is given to individuals or groups in Ontario to recognize and encourage a special or unusual contribution to the sensitive, sustainable design for human use of the environment. For over 15 years City Stream Watch has obtained, recorded and managed valuable information on the physical and biological characteristics of creeks and streams in the City of Ottawa. Family Programs @ Foley Mountain and Baxter Baxter and Foley Mountain Conservation Areas are offering family programming this summer. Families can experience nature handson in our exciting educational programs. At  Foley Mountain, we have three FREE morning programs (July 6, 27 and August 17) with a valid day pass ($6/vehicle). Children must be accompanied by an adult. At Baxter, the cost of family programs is $5 per person per program with a maximum of $20 per family per program, children under five are free and you must pre-register!
