Summary of Recommendation: The recommendation is that Council consider passage of a zoning by-law amendment that would rezone land that was the subject of consent applications to create three new waterfront residential lots. The rezoning is a condition of Consent Applications S-48-15-B, S-49-15-B and S-50-15-B.
Purpose of the report: The purpose of this report is to bring to Council an application for a zoning bylaw amendment and to hold a public meeting on the application as required under section 34 of the Planning Act. The report includes a location attachment, a depiction of the proposed lots, agency comments and an amending by-law.
Background An application has been submitted to amend the Township of South Frontenac Comprehensive Zoning By-law to rezone three proposed new residential lots on James Wilson Road at Canoe Lake from Rural to residential. The rezoning is a condition of consent applications S-48-15-B, S-49-15-B and S-50-15-B which were given conditional approval by the Committee of Adjustment on December 10, 2015. Two of the proposed new lots and the retained lot would have frontage on a new lane that would be constructed off James Wilson Road while one new lot would fully front on James Wilson Road. The subject land is shown on Attachment #1 to this report and the configuration of the new lots is depicted on Attachment #2.
Analysis The subject land is physically challenging to some degree located mostly on a granite outcrop that rises steeply from the lake forming a cliff along the eastern edge of proposed Lot #1. The land becomes slightly more gentle moving west towards the retained land however, generally, building envelopes for the new lots are constrained as a result of the topography. An access right-of-way exists through the area of proposed Lot #1 giving access to a parcel to the north from James Wilson Road. It should also be noted that a small cabin and a trailer presently exist on Lot #1 which are to be removed. The portion to be retained is fully developed with a dwelling and accessory buildings. The land is designated Rural in the Official Plan which permits residential development on a body of water where the primary means of access is from either a public road, a private lane or a navigable waterway subject to meeting minimum standards set out in the Plan. In this regard, the new lots would range in size from 3.36 acres to 4.48 acres and they exceed the minimum standards in terms of lot size, waterfrontage and frontage on the new lane and the road. The retained portion would also still be large at 5.02 acres. Canoe Lake is classified in the Official Plan as moderately sensitive for lake trout. As required by the Plan for development on such lakes, a preliminary environmental report was undertaken by Ontario Lake Assessments (OLA) to support the applications (discussed below).
Page 5 of 112 Attachment #2 illustrates that proposed Lot #1 would maintain full frontage on the public road (James Wilson) and the two other new lots as well as the retained portion would have frontage on, and be accessed by, a new private lane to be constructed from the public road. The land is presently zoned Special Limited Service Residential (RLS-2) in the Comprehensive Zoning By-law. This zone was placed on the land in acknowledgement that James Wilson Road, until recently, was only seasonally maintained by the Township. The RLS-2 zoning recognized this fact and was meant to specify and advise any property-owner that the Township has no responsibility to fully maintain the road. Also, only seasonal dwellings are permitted. However, as noted, the Township has now assumed full maintenance of the road. Thus, considering all of the above information, the zoning by-law must be now be changed from RLS-2 to Waterfront Residential (RW) for Lot #1 to recognize that the parcel is for residential use fronting on a Townshipmaintained road while the zoning on Lots #2 and #3 and the retained parcel would be changed to Limited Service Residential-Waterfront (RLSW) recognizing that they would be for residential use with waterfrontage and accessed by a private lane. Also, Proposed Lot #3 would require a special RLSW zone as described below.
Discussion Council members will recall that the matter of parkland dedication on this land was considered by Council last September. A member of the Committee of Adjustment had suggested that, since the area residents make good recreational use of the natural beach area on the property, perhaps part of the subject land should be dedicated as parkland as a condition of approval of the severances. However, after much discussion and public input Council ultimately decided against accepting this parkland dedication for the reasons that there may be a traffic and parking hazard created at this curve in James Wilson Road and because of the presence of an underground/underwater hydro power line located at the site which poses a danger to swimmers.
Agency Comments All agencies commented favourably to the proposed lot creation at the consent stage. At time of preparation of this rezoning report no comments had been received from the public. It should be noted that the Cataraqui Region Conservation Authority, although supporting the lot creations, suggests that the minimum setback for development from the highwater mark of the lake should be 60 metres for all the new lots. However, Mr. Reg Genge of Ontario Lake Assessments, who conducted the original preliminary environmental report in support of the proposed development, followed up on CRCA’s suggested setbacks with another report. In it, he describes the lay of the land for each proposed lot and determines that a minimum 30 metre setback from the lake is appropriate for proposed Lots #1 and #2 but that a minimum 45 metre setback should be required for proposed Lot #3. Attachment #3 is copies of the CRCA letter, dated September 1, 2015 and the OLA report, dated November 3, 2015.
Conclusion From a planning perspective, the proposed new waterfront lots appear to meet the intent of the Official Plan in terms their use, minimum size, waterfrontage, location and frontage on a private lane (and on a public road). The new lane to provide access will be constructed to meet Township standards and the Planning Department agrees with the conclusions of the report from OLA that recommends appropriate minimum setbacks from the moderately sensitive lake for each of the lots - these setbacks are specified in the attached zoning by-law amendment. Therefore, the rezoning application is supported.

Staff of the Cataraqui Region Conservation Authority (CRCA) have reviewed the above-noted applications for consent to sever and offer the following comments for the Land Division Corrunittee’s consideration. A site inspection was conducted by staff on August 28, 2015. Summary of Proposal
The applicant has requested three severances of 1.62 hectares (Lot 1), 1.82 hectares (Lot 2), and 1.4 hectares (Lot 3) respectively of land from the property known as 1125 James Wilson Road. It is
proposed ’that the Lot 1 will have road frontage onto James Wilson Road and the other two lots to be severed will be accessed via right-of-way. The lot to be retained would be approximately 1.68 hectares in area.
Site Description
The property is located on the west side of James Wilson Road. The severed and retained parcels have water frontage onto Canoe Lake. One of the lots to be severed (Lot 1) contains a small structure <in it
and the oth;rs are presently vacant. The three new lots are proposed to be used for residential development in the future. The lot to be retained contains a cottage and associated development.
The property is currently designated ‘Rural’ in the Official Plan and ‘Waterfront Residential" (RW) in the implementing Zoning By-law for South Frontenac Township. Canoe Lake itself is identified as a moderately sensitive Lake Trout lake in the Official Plan and is zoned ‘Environmental Protection’ (EP) in the Zoning By-law.

Discussion
The main interests of the CRCA with respect to this application are the avoidance of natural hazards
(e.g. flooding and erosion) associated with Canoe Lake and the protection of the water quality of the lake. Natural Hazards
Flooding: The maximum recorded water level for Canoe Lake is 142.15 metres geodetic. For Canoe Lake, the maximum recorded water level is used in lieu of an engineered flood plain. The CRCA’s Guidelines for I[rnplementing Ontario Regulation 148/06 (see description below) requires that all development be set back a minimum of 6 metres from the regulatory floodplain of a waterbody. Based upon elevation mapping data and site observations, there is considerable area for development to occur beyond the required setback from the flood plain. Therefore, staff have no eoncerns with the applications from a flooding perspective. Erosion: Section 5.8.2(2) of the Zoning By-law specifies that no buiMing or structure or septic tank installation shall be located witbin a minimum of 15 metres horizontal of the top of bank of any embankment, the slope of which is greater than 30o/o from horizontal. The CRCA defines the extent of potential erosion hazards to include an allowance for toe erosion, a stable slope allowance for rock of
1 (h):7(v), plus an erosion access allowance of 6 metres. Based upon observations made during the site visit, staff have concluded that the lots to be severed contain suitable building envelopes outside of the erosion hazard setbacks described above. Therefore, staff have no concerns with the applications from an erosion perspective. Water Quality
Section 2.2 of the Provincial Policy Statement (PPS) suggests that planning authorities should seek to protect, improve or restore the quality and quantity of water. Accordingly, the Official Plan and Zoning By-law for the Township of South Frontenac provide guidance with respect to how development should occur in consideration of protecting, improving and restoring water quality within the municipality. Similarly, the CRCA’s Planning Policy (April, 2015) contains provisions that seek to support these . objectives. The Official Plan recognizes the need to minimize impacts to water quality by reducing phosphorous
inputs, preventing erosion and maintaining natural appearances. Accordingly, policies have been’ included that can vary the setback from the highwater mark from 30 to 90 metres depending on the site characteristics such as steepness of slope, vegetation cover, soil depth and soil phosphorus retention. Policy 6.1.6 of the CRCA’s Planning Policy suggests that development setbacks should be based on the findings of lake management plans and site evaluation guidelines if available. For Precambrian shield lakes such as this one, Appendix G of the Planning Policy is used to establisb an appropriate setback for future development. Appendix G was developed in consideration of the findings of a report entitled ?Assessment of Municipal Site Evaluatioii Guidelines for Waterfront Development in Eastem Ontario’s Lake Country? -completed by Hutchinson Enviromnental Sciences Ltd. (April, 2014). These guidelines define a horizontal water setback distance based upon site characteristics such as soil texture and depth, slope and vegetation along the shoreline. Based upon observations made during the site visit, the

recornrnended minimum depth of shoreline buffer for development for each of these proposed lots should be 60 metres to protect the water quality of Canoe Lake. In order to ensure that future residential development is consistent witb the 60 metre setback noted above, staff recormnend that additional controls be placed on the proposed lots. Specifically, it is recommended that the proposed lots be rezoned to a site specific waterfront residential zone that requires a 60 metre setback provision for new development (including the septic system). It is also recommended that the proposed lots be subject to site plan approval to control the location of buildings, stmctures and site alteration on the subject lots. Staff note that there appears to be suitable development envelopes outside of the recommended 60 t’netre setback from Canoe Lake on the lots to be severed. Recommendation
Staff have no objection to the approval of applications S-48-15-B, S-49-15-B and S-50-15-B based on our consideration for natural hazards, natural heritage, and water quality and quantity protection policies
provided that development be set back a minimum of 60 metres.from the high water mark O?2 each qf the severed lots to protect the water qualiffl qf Canoe Lake. To achieve this, staff recommend rezoning the lots to a site specgfic waterfront residential zone requiring a 60 metre setback for development and that the lots be subject to site plan control.
The CRCA, under Ontario Regulation 148/06: Development, Interference with Wetlands, and Alterations to Shorelines and Watercourses, regulates development within 15 metres of a flood plain or erosion hazard, and within 15 metres of the top of valley. Therefore, a permit may be required for proposed development on the severed and retained lots. The applicant or future owners of the lands will be required to contact the undersigned at the building permit stage for more information regarding permitting requirements under Ontario Regulation 148/06.

Mr. Campbell has requested of me to revisit the above sites with a view to reassess the proposed locations of the building envelopes for the new lots. This request stems from the building envelope set-back recommendations made to the municipality by Andrew Schrnidt (CRCA) in his September 1, 20l51etter to the municipality. I conducted a site visit to the property along with Mr. Catnpbell on August first, prior to him submitting his application. I prepared a letter to Mr.
Campbell on August 3rd indicating my opinion with respect to tlte location of building envelopes and shoreline access points. A copy of that letter is attached.
As a result of Mr. Campbell’s request, you and I discussed at length on October 23rd, the connotation of the moderately sensitive classification of Canoe Lake, how it came to be and what
the planning implications and development impacts might be. During our discussion, I covered some of the history of water quality management on lake trout lakes in Eastern Ontario and how the lakes were modelled using the Ontario Lakeshore Capacity Study methodology. This aspect of the discussion was mostly generic in nature; additionally we discussed the specifics of how Canoe Lake became classified as moderately sensitive. We also discussed some of the cultural and topographical constraints that exist on Canoe Lake that protect it from being adversely impacted by shoreline development.
In order to encapsulate the points of our discussion within the context of the above applications and to re-new my familiarity with the site now that the applications have been made, I revisited the site on October 30ffi. This site visit included the GPS recordings of the high water marks
(HWM) for each lot and the locations of proposed building envelopes as well as notes regarding slopes, perpendicular distances to the HWM; vegetation cover, GPS locations of the trailer and building and the distances to the beach area on proposed lot S-48-15B. A photographic record was also completed.

What follows is a discussion around all of the above. The sensitivity classification of the lakes in eastern Ontario began iii the mid-1 970s; the concern at the time was the potential for uncontrolled lakeshore development to cause increased phosphoms loadings to the lakes with cold-water fisheries to the point where the lakes could not sustain the fishery, in this case lake trout. Increased phosphorus causes increased phytoplankton growth and subsequently a decline in deep water oxygen concentrations. The only ’tool’ available at the time to evaluate lake sensitivities was the Ontario Lakeshore Capacity Model (OLCM); it was used despite it not being formally released to the public at that time. Virtually every lake in eastern Ontario was evaluated using this methodology and then the predictions made were compared with measured data attained from the lakes,
All the lake trout lakes svere evaluated and classified, ranging from having a low sensitivity to a high sensitivity to increased phosphorus loadings. There was a continuum in gradient from a lake predicted to be unresponsive to a 100 kg increase in phosphoms supply, to lakes that were predicted to have a great change in algal growth as a result. All of this was reported in a publication Ontario Ministry of the Environmem Report on Water Qualiffl Management of the Lake Trout Waters of Southeastern Ontario 1977. To put that into perspective, a 100 kg increase in phosphoms supply is equivalent to adding 162 seasonal cottages to the lakeshore and then assuming that l OOo/o of the phosphorus from the septic systems actually reaches the lake. It is now known that in fact phosphoms migration away from septic systems in Precambrian Shield settings is very limited; phosphorus adheres to iron and aluminum in the soils and also becomes seqriestered in vegetation.
At the time of release of the above report lake front residences could be constmcted at the shoreline with the septic systems located at 15 m from the shoreline. Due to the unknowns at the time and also to error on the side of caution, the report recommended that for au lake trout Qa%eq the setback for septic systems should be a minimum of 30 metres; residences could still be Iocated at a closer distance. The setbacks for septic systems on the warm water lakes remained the same, 15 metres. Since that era, the 30 metre setback standard for r@sidqnce and septic syst?em has become the
norm for all lakes. Support for this setback stems not as much from hard core science as it is from common sense and the ‘Ribbon of Life’ philosophy of protecting riparian zones around lakeshores. It not only provtdes wildlife habitat but promotes shoreline stabilization and water quality protection through sequestering nutrients in the soils and in the vegetation biomass within the 30 metre buffer.
In the above report Canoe Lake was classified as having a low sensitivity to nutrient loadings. The sensitivity of a lake to changes in nutrient supply is quite simple, Lakes that have a large volume provide dilution and therefore concentrations of nutrients are less than for lakes with small volumes; lakes that are deep have large volumes below the thermocline and therefore have greater
amounts of oxygen and do-not suffer from the effects of nutrient loadings; these well oxygenated deep lak@s also retqin nutrients in their sediments and do not release them back into the water column and finally lakes that have high flushing rates (the ability to exchange its volume) are not sensitive. 3

Canoe Lake has all of these beneficial characteristics: volume = 66.69 x 106 m3 ;
depth = 47m; flushing rate O.12 x /yr; retention coefficient O.82%
Canoe Lake has the added benefit in that 23% of the shoreline is held by the Crown and is not
subject to development. In addition, the topography of the entire western shoreline is so extreme that it is unlikely to be developed due to access constraints and the setback requirements from the top of bank as well as the top of ridge; for much of this shoreline the top of the ridge is 50 metres above the water.
The above report was replaced in 1993 by the report inlap@ Lake Trout M,anagempn,t, in, Southeas,tern Ontario. At the time of the writing this report there was an agreement between the MOE and MNR that there would be no low sensitivit3i classification for any lake trout lake despite the hydrological characteristics and the model predictions for a set of lakes that showed no or very little predicted impact from shoreline development. These low sensitivity lakes became classified as moderately sensitive by default and are subject to all the development recommendations commensurate with the classification. These development recommendations are in place to protect the water quality of the lake for the sustained management of the lake trout population. Essentially these lakes, while not needing the added protection of the moderately sensitive group, are subject to the same development recommendations.
It is the recommendations in this report that form the foundation of discussion in the Official Plan for South Frontenac Township. As a result, Section 5.2.8 Lake Trout lakes, correctly identifies Canoe Lake in the moderately sensitive category.
For the discussion below all unobstructed straight line distances were recorded with a laser range finder (lrf); all other distances and elevations were recorded using GPS coordinates. The term building envelope used below refers to the building and the septie bed. Application S-48-?SB:
This proposed new lot of 1.62 ha is to have an entrance off of the James Wilson Road. An access right-ofway exists across this parcel to the peninsula to the north. This right-of-way poses a constraint to locating
a building envelope in-addition to the difficult teirain conditions. A narrow ATV trail crosses this parcel to
the peninsula; the distance between the east and west bays of Canoe Lake at this point is approximately 53m.
An entrance exists now that provides access to a trailer and a small cabin on the proposed parcel. A sand beach exists for a portion of the waterfront; the firontage norther?y on the lot is granite outcrop. A smaJl iiisignificant wet area exists between the beach area and the entrance. The distance between the entrance
and-the high water mark (HWM) at the beach is 47 to 49m (lrf). The Canoe Lake reservoir has been drawn down for ‘me fall, as a result a larger dry beach area is exposed than occurs in the summer months; the drawdown appears to be about 2 metres. 4

The cabin on this lot is located about 39m (lrf) from the east bay in front of the hard granite outcrop portion of the shoreline. The cabin floor is at an elevation of s-6 metres above the HWM. This cabin is in the
downslope area to the lake and should not be considered for the bui}ding enve]ope for the residence for this proposed lot.
Located behind the cabin is a clearing with the trailer; two areas are cleared, one with the trailer and also an area west of the trailer. Due to the di’&ult terrain this area is the only suitable building envelope location where a sewage system and residence could be located. The distance between these clearings and the beach HWM is approximately 77m with an eJevation of 8m above the HWM; the average slope being l 0%. This slope would allow for a 30 metre setback from the HWM however due to the topographical constraints of the lot this setback distance is neither practical nor recommended.
Approval of this Iot should be conditional upon the building envelope being located in the vieinity of the existing trailer. Application S-49-15B:
Tliis proposed new lot fronts on the bay to the west of the peninsula. This is a more gently sloping lot than either of the other two lots; wtth shallow soils and some rock outcrop; the interior of the lot has had the hardwood logged off recently. A building envelope was setected and marked during the August 1"’ site visit; the findings on the October 30"’ site visit support this location. The site is approximately 50 metres from the HWM down gradient; a change of elevation of 3m to the waterfront (a 6oA slope) and also 39 metres perpendicular distance to the shoreline to the west; the terrain to the west is up-gradient from the proposed
bui]lding envelope. The easterly portion on this lot is a valley area tlxat receives local runoff particularly during ;he spring melt period: this area of the proposed lot should not be considered for the building envelope.
Approval of this lot should be conditional on the building envelope being loeated in the vicinity of the 50 metre setback location indicated above but not strictly limited to this site. There is some flexibility
for this building envelope to be located closer to the water but no closer than 30 metres to the HWM. Application S-50-15B:
This proposed new lot has water frontage on the west side of the lot. This lot has a steep shoreline down-to the water at most locations but also has a reasonable gently sloped water access location available.
Tlie lot has a shoreline buffer of cedar, hemlock and white pine with a few hardwoods mixed in; the interior
of the lot has had the hardwood logged off recently. A building envelope was selected and marked during the August l" site visit; the findings on the October 30’ site visit continue to support this location, While the shoreline rises steeply from the HWM, the proposed building envelope is in relatively flat terrain. The site is 66rn from the HWM and is elevated 9m above the HWM (a slope of 14%). The near-shore
topography of this proposed lot necessitates a greater setback than the minimum 30 metre distance in order to-m;et-setback from top of bank requirements (15m) and also to protect the vegetation in the 30 metre 5uffer.

Approval of this lot should be conditional on the building envelope being located in the vicinity of the 66 metre setbaek loeation indieated above but with enough flexibility to accommodate a building, septic and driveway. There is some flexibility for this building envelope to be located closer to the water but no closer than 45 metres perpendieular distance to the HWM.
We also discussed the proposal that the beach area be considered to be set aside for a public beach as a condition of the approval. In my view this would create a sufficient constraint to development of proposed lot S-48-15B that it may prevent creation of the lot altogether or greatly devalue the lot if the beach area is approved as a municipal beach property, Commensurate with adopting this area as a municipal beach for public use will be the requirement for off-road parking and as a minimum vault privies and perhaps a change house; the parking lot could be located south of the entrance to proposed lot 48 but would likely require a small storm water management pond to treat runoff and prevent erosion into the beach area. The OP would require that the parking lot, privies and change house all be located beyond the 30m setback from the HWM. I trust that the above clarifies some of the discussion around the moderately sensitive lake classification for Canoe Lake and also the details around the selection of building envelopes for

John McEwen, re: Radon and the Ontario Building Code Mr. McEwen presented his research on the effects of radon gas existing in homes where damp proofing and waterproofing permits are not required by the municipal Building Department. He requested Council’s support to require permits to repair or materially alter a foundation in anyway, shape or form and lay charges when violations occur. Mayor Vandewal thanked Mr. McEwen for his presentation and advised him that this matter will be referred to the Corporate Services Committee for their review and comment.

Council also requested a more accurate number of units for AVL. The Public Works Manager noted that L & A are experiencing issues with the system that Council has requested he provide more information on.

ANALYSIS: At the June 14, 2016 Committee of the Whole meeting Council reviewed the staff report regarding the second intake of the Canada 150 Community Infrastructure Program (CIP 150) as part of the celebration for Canada’s 150th anniversary. It is a national program providing $150 million in funding which began in 2015. The program will provide up to 50 per cent of funding, to a maximum of $1,000,000, to provincial, territorial, municipal and regional governments, Aboriginal organizations and non-profit organizations. The funding is to renovate, expand (to a maximum of 50% in square footage) or rehabilitate community and cultural infrastructure. Projects costs must be incurred between April 1, 2016 and March 31, 2018. Eligible projects include community centres, cultural centres and museums, parks, recreational trails, libraries, recreational facilities, tourism facilities, docks, cenotaphs and other existing community infrastructure that have a local community impact such as local roads, drinking water systems, connectivity and broadband and solid waste management infrastructure. There are limited projects that fit into the criteria and intended objectives of this funding. Our previous submission was for the Storrington Centre and requested an amount of $200,000 for the project. The same facility is being chosen for this submission. However, the scope of the application will focus on, with the incremental components being highlighted: • • • • • • •
Upgrade of septic to meet building occupancy parking lot improvements including the provision of accessible parking siteworks and landscaping around facility installing accessible washrooms retrofitting of lighting with energy efficient fixtures updating the kitchen replacing articulating room divider and reconfiguring the space
The 2016 capital budget had $20,000 which was put on hold pending a follow up report and approval. Based on the scope presented, project costs are estimated at $500,000 with the application requesting funding for 33.3% of the project or $166,500. This would leave the Township costs at $334,500 or an additional $314,500 from what was originally budgeted.

SUBJECT: Vendor of record listing RECOMMENDATION: That Council approve the attached Vendor of record listing. BACKGROUND: A vendor of record is a vendor with which the Township already has an acceptable business relationship which pre-qualifies the vendor to provide goods/services to the Township. A vendor of record listing provides the full listing of pre-qualified vendors. Our procurement policy provides for the use of a vendor of record when a purchase is between $150 and $25,000 and the services requested are within budget. Further, our procurement policy provides that a vendor of record listing shall be compiled by staff and recommended to Council for approval on a bi-annual basis. ANALYSIS: At the May 24th Committee of the Whole, an initial listing for a vendor of record listing was provided along with a background on our existing process and next steps. The initial listing was distributed to managers for their review of vendor listing and removal of any vendors no longer used i.e due to performance or no longer in business. As new vendors are solicited through quotes, tenders or RFP’s, they will be assessed by the manager and added to the vendor of record list. The listing will be reviewed yearly with managers to keep listing current and the list will be presented to Council every two years for approval. SUBJECT: Capital Budget Amendments RECOMMENDATION: That Council approve the amended 2016 Linear Asset Capital Budget as presented on June 14, 2016. BACKGROUND: Council reviewed the report at the Committee of the Whole meeting on June 14, 2016 and endorsed the amended budget. This was also presented to the Public Services Committee on May 19, 2016. ANALYSIS: The amended budget included the capital budget reductions presented to Council on March 15, 2016 as well as changes to some of the proposed 2016 projects. The original approved budget and the amended budget are an attachment to this report. FINANCIAL/STAFFING IMPLICATIONS: The approved 2016 Linear Asset Capital Budget was reduced by $223,174 to account for a portion of the 2015 Budget overruns at the Council meeting of March 15, 2016.

BACKGROUND: Council’s Procedural By-Law 2015-56 as amended, establishes the process for the reconsideration of a previous decision of Council. At the Committee of the Whole meeting on June 14, 2016, Councillor Sleeth served Notice of Motion to bring the June 7, 2016 CAO’s report back and to amend the one recommendation to not move the Public Works Manager to the Sydenham Office. In accordance with the Procedural By-law, the request for reconsideration requires a seconder. If seconded then the motion for reconsideration shall be open for debate and voted upon. A two thirds majority is required for adoption. With 8 active members of Council at this time this means that 6 votes are needed for reconsideration. If adopted, the motion to reconsider temporarily nullifies the previous decisions. The 4 recommendations #2 -5 originally voted on are again pending. Any of the 4 motions may now be amended, referred or deferred or considered as moved and voted upon. If Council approves the motion to reconsider, the item up for reconsideration will become the next order of business. Debate shall proceed as though it had not been previously voted upon. The debate must be confined to reasons for or against reconsideration only. BACKGROUND: On May 24 Council received a summary of the steps taken in the organizational review process, a summary of the recommendations from the consultants, the feedback from Council during the May 4 session, an overview of the continuum for delivering planning services and the following recommendations from the CAO, which incorporated the addition of 3 staff over 2 ½ years. 2016 Plan:
- Reassign the Arena Recreation Supervisor to report to the Public Works Manager
- Reassign the HR/Legislative Compliance Coordinator to report to the Treasurer.
- Create and hire a Development Services Manager with the Planner/Deputy Clerk and CBO reporting to this new role. Focus on streamlining the development process and enhancing customer service. In addition take on the role of coordinating current and future economic development resources as well as contracted bylaw enforcement services.
- Establish a Senior Management team comprised of the CAO, Public Works Manager, Treasurer and Development Services Manager assisted by the Executive Assistant to develop an implementation plan for the strategic plan as well as required policy and long term needs. See Draft Organizational Chart attached.
- Given the opportunity with a pending retirement update and redefine the role of Accounting Clerk
- Relocate staff to accommodate the new positon and to facilitate the formation of a cohesive senior team focused and resourced for success. • Public Works Manager moves to George St. (current HR office) • Fire Chief moves to Sunbury hall until Perth Road Station is built

- Allocate additional budget dollars to support Economic Develop initiatives The recommended plan responds to the challenges identified, aligns with the consultant’s recommendations, fits within a reasonable cost, and will enhance the organization’s efforts to move forward. The formation of the senior team located at the George St office, and the inherent move of the Public Works Manager was supported by the Public Works Manager as being the “right time” to move forward with this previously discussed concept. As an initial step, Council provided clear direction that they envisioned South Frontenac eventually seeking delegated authority for the approval of subdivisions and plans of condominiums. This definitive expectation, if granted, will require processes and resources to be put in place in order for South Frontenac to be prepared to assume this responsibility. Staff recommend that this change be targeted for an effective date in 2019. Following discussion on the Township’s role in planning, the CAO’s recommendations were debated. There was general support for the proposals, however it appeared there was an interest in dealing with approvals in yearly increments. On May 27 in a meeting with Warden Smith, CAO’s Pender and Orr, Councillor McDougall and Mayor Vandewal, staff shared the direction that Council was considering with regard to planning. This was seen as a positive step in the eyes of County representatives. The likelihood of achieving this change is not clearly predictable as it will require Provincial approval as well. FINANCIAL / STAFFING IMPLICATIONS: The costs and funding for the CAO’s recommendations that were presented on May 24 are outlined below:

Council Agenda Date: June 21, 2016 Date of Report; June 15, 2016 Subject: Review of Request to Remove Holding Symbol in Part of Part Lot 8, Concession V, Loughborough District, Township of South Frontenac: Soucie
Summary of Recommendation: The recommendation is that Council consider passage of a by-law that would remove the holding “h” symbol on a vacant waterfront lot to allow development to proceed.
Purpose of Report: The purpose of this report is to provide the background information necessary for Council to consider the removal of the holding symbol on a waterfront lot.
Background: In 2007 the Committee of Adjustment approved the creation of three waterfront residential lots on Sydenham Lake, which are now accessible via the new Georgia Lane. At the time, a resident on the opposite side of the lake objected to the consents for the reason that creation of the lots would negatively affect her views. Attachment #1 shows the location of the three lots. The issue was appealed to the Ontario Municipal Board (OMB), who ultimately approved the creation of the lots with conditions. These included that strict controls be placed on the lots to ensure that the mature tree growth on the steep embankment within 30 metres of the lake be maintained to help sustain the natural aesthetic and stabilize the embankment. As per the terms of the OMB, a Development Agreement was registered on the title of each lot which included provisions requiring that any staircase or path to the water be designed and constructed without the use of heavy equipment, taking advantage of natural openings in the forest and with the Township’s approval. As well, the area from the shoreline to fifteen metres beyond the top of bank was to be designated as a natural buffer in which no development could occur. Contrary to the terms of the agreement, the owner of one of the lots (the westerly lot) did in fact use heavy machinery to cut into the bank to construct a road from the top of bank to the lake. The work also included a cut into the bank for a picnic/sitting area. Attachment #2 illustrates the illegal work that was done. Following some correspondence between the property owner and the Township, an environmentalist was called upon by the Planning Department to prepare a report (paid for by the property owner) outlining remediation work to be undertaken to stabilize the slope and restore its vegetation. The owner then undertook some of the remedial work recommended. However, more remediation work was required and, accordingly, on December 17, 2013, Council passed a by-law to apply a holding “h” symbol to the lot’s zone to ensure that this work is carried out. Under section 36 of the Planning Act, a holding symbol may be placed on the zoning of a property when the use of the

land is known but where there are specific studies or work that must be completed in order for the development to proceed. In this case, the “h” was placed on the existing zoning to require that the owner undertake remedial work to the shoreline where he had cut into the slope and begun construction of a road/path. The slope was to be rehabilitated to rectify the damage.
Discussion: The land is designated Rural in the Official Plan. Within this designation, the Plan permits residential use so long as the lot is of an appropriate size as outlined in the Plan. In addition, the Plan specifies that a rurally designated lot “shall be consistent with maintaining its rural, natural heritage and cultural heritage”. The parcel is zoned Limited Service Residential-Waterfront (RLSW) recognizing that it is a waterfront lot for residential use accessed by a private lane. As noted above, the property is one of two others resulting from three severances on the larger lot. The subject property is 3.5 acres in size, consisting of a flat area fronting onto Georgia Lane, and a treed area at Sydenham Lake. It is this area where the owner cut into the slope in order to create an access way to the water and a picnic/sitting area. The slope is extremely steep, and conditions placed on the initial severance included the maintenance of the natural vegetation and mature forest for erosion and water quality concerns. The property-owner has now undertaken remediation work since construction of the road/path in an effort to satisfy Council’s concerns. The road/path is now overgrown naturally with some plantings of native species added. Also, the gouge in the embankment for the sitting area has been filled, restored and renaturalized. In consideration of this, the owner now wishes to have the holding symbol removed to allow development of the property as a residence.
Agency Comments: Notice of this meeting was sent to all neighbouring property-owners as required by the Planning Act. No comments have been received to date. By letter dated May 30, 2016, the Cataraqui Region Conservation Authority advised the Township that they are satisfied with the works that have been completed and that they have no further concerns. Attachment #3 is a copy of their letter.
Conclusion: Remediation work appears to have been completed on the property as much as can be expected. The accessway that was constructed to the water now constitutes only a narrow pathway that is overgrown naturally and which has been further stabilized by the owner with plantings. Also, the gouged out portion of the land (which may have been the most offensive action in relation to the efforts to keep the embankment natural) has been fully restored. Also, the concerns of the CRCA have been satisfied. On this basis, the Planning Department supports the removal of the “h” symbol to allow development to proceed.
Recommendation: On the basis of the above review, it is recommended that the attached By-law No. 2016-39 to lift the “h” from the subject land in Part of Lot 8, Concession V, District of Loughborough to allow development to occur, be considered for passage. Submitted/approved by: Lindsay Mills

Summary of Recommendation: The recommendation is that Council authorize an exemption from By-law No. 2015-41 (the Noise By-law) to permit an outdoor wedding celebration to take place on June 25, 2016 on property described as Part of Lot 25, Concession V, Storrington District, municipally known as 4587 Kauffman Lane.
Purpose of the Report: The purpose of this report is to bring to Council a request to hold a special event open air wedding on the above noted property. Attached to this report is a request letter from the property-owner, location maps and an By-law # 2015-41 (the noise by-law).
Analysis By letter dated April 26, 2016, the owner of the above-noted property has requested to know whether he would be permitted to hold a special event openair wedding celebration on the land – to be held on June 25, 2016. The property is approximately 191 acres in size, fronts on Loughborough Lake and Round Lake and is accessed by Kauffman Lane. The lot is shown highlighted on Attachment #1. Attachment #2 is an air photo of the subject land showing the area to be used for the wedding event. And Attachment #3 is a copy of the owner’s letter of request for the event including a drawing of the planned venue. The owner advises that the event would take place in a large canvass structure and a barn on the property and he will make use of temporary bathroom facilities during the event. The anticipated attendance is 165 guests and it will take place between the hours of 3:00 PM and 2:00 AM. The property is very large and the portion of land away from the lake, which is the venue, is flat and open and seems able to facilitate any required parking. Although there are some waterfront residential lots in the vicinity of the subject lot to the north, they are located a great distance from the location of the event and are screened visually by mature stands of trees and other vegetation which would also be expected to mitigate excessive noise. Overall, the site appears to be able to accommodate the proposed event. By-law No. 2015-41 is the Township of South Frontenac’s by-law to prohibit and regulate noise. The by-law states that no person shall emit, cause or permit the emission of noise resulting from an act. Included in the list of potential noise producing uses is

A BY-LAW TO PROHIBIT AND REGULATE NOISE WITHIN THE TOWNSHIP OF SOUTH FRONTENAC
WHEREAS Council deems it necessary to prohibit or regulate, within the municipality or within any defined area or areas thereof, the ririging of bells, the blowing of horns, shouting and unusual noises, or noises likely to disturb the inhabitants:
NOW THEREFORE THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC, BY lT8 COUNCIL, HEREBY ENACTS AS FOLLOW8: DEFINITIONS:
1 . For the purpose of this by-Iaw,
a) “construction” includes erection, alteration, repair, dismantling, demolition, structural maintenance, painting, moving, land clearing, earth moving, grading, excavating, the Iayirig of pipe and conduit whether above or below ground Ievel, street and highway building, concreting, equipment installation and alteration and the structural installation of construction
comporients and materials in any form or for any purpose, and includes any work in connection herewith:
b) “construction equipment” means any equipment or device designed and interided for use in construction, or material handling, including but not Iimited to air compressors, pile drivers, pneumatic or hydraulic tolls, bulldozers, tractors, excavators, trenchers, cranes, derricks, Ioaders,
scrapers, pavers, gerierators, off-highway haulers, trucks, ditches,
compactors and rollers, pumps, concrete mixers, graders or other material handling equipment; c)
“clearly audible” shall mean a noise level that a reasonable person would, in all of the circumstances, consider to be excessive or unnecessary, or intrusive, or disturbing or unacceptable;
d)
“council” means the Council of the Corporation of the Township of South Frontenac

“consumer firework” means an outdoor, low,hazard, recreational firework that is classed as a subdivision 1 of Division 2 of Class 7 Fireworks under the Act and includes fireworks showers, fountains, golden rain, lawn Iights, pin wheels, Roman candles and volcanoes, but does not include Christmas crackers arid caps for toy guns containaing not in excess of twenty-five one-hundredths of a grain of explosive used per cap: “discharge” means to fire, igntte, explode or set off or cause to be fire, ignited, exploded or set off and the words “discharged” and “discharging” have a similar meaning;
g)
“display firework” means an outdoor, high hazard, recreational firework that is classed as a subdivision 2 of Division 2 of Class 7 Fireworks under
the Act, arid includes rockets, serpents, shells, bombshells, tourbillions,

maroons, Iarge wheels, bouquets, bombardos, waterfalls, fountains, batteries, illumination, set pieces and pigeons but does not include firecrackers;
“firecracker” means a pyrotechnic device that explodes when ignited and does not make any subsequent display or visible effect after the explosion,

and iricludes those devices commonly known as Chinese firecrackers
“fireworks” means display fireworks, consumer fireworks and firecrackers “Iivestock” includes, but is not Iimited to chickens, turkeys or other fowl,

“motor vehicle” shall mean a vehicle or any other device employed to transport a person or persons or goods from place to place propelled, driven or drawn by any means other than by muscular, gravitational or wind power, including but not limited to motor vehicle, motorcycle, motorized snow vehicle, motor assisted bicycle, trailer, farm tractor, road

building machine; i)
“municipality” means the Corporation of the Township of South Frontenac;
m)
“noise” means unwanted sound
n)
“other areas” means any area other than a residential area as defined in the municipality’s zoriing by-Iaw;
o)
“point of reception” means any point on a premises where noise from other than those premises is received;
p)
“residential area” means any area of the Municipality that is zoned residential in the Zoning By-Iaw of the Municipality.
GENERAL PROHIB?T?ONS
No person shall emit, cause or permit the emission of noise resulting from an act listed herein, and which noise is clearly audible at a point of receptiori; a) Racing a motor vehicle other than in a racing event regulated by by-law; b) The operation of a motor vehicle in such a way that the tires squeal: c) The operation of a combustion engine, pneumatic device or construction equipment without an effective exhaust or intake muffling device in good working order and in constant operation;
d) The operation of a motor vehicle resulting in banging, clanking, squealing or other like sounds;
e) The operation of an engine or motor tri, or on, any motor vehicle or item of attached auxiliary equipment for a oontinuous period exceeding five minutes, while such vehicle is stationary in a Residential Area unless:
(i) The original equipment manufacturer specifically recommends a stronger idling period for normal and efficient operation of the motor vehicle in which case such recommended period shall not be exceeded;

(ii) The operation of such engine or motor is essential to a basic function of the vehicle or equipment, including but not limited to operation of a ready-mix concrete truck, Iift platforms, or refuse compactors and heat exchange systems normal operation;
(iii) Weather conditions justify the use of heating or refrigerating systems powered by the motor or engine for the safety and vvelTare of the operator, passengers or animals, or the preservation of perishable cargo;
(iv) Prevailing Iow temperatures make Ionger idling periods necessary immediately after startirig the motor or engine;
(v) The idling is for the purpose of cleaning and flushing the radiator arid associated circulation system for seasonal charige of antifreeze, cleaning of the fuel system, carburetor or the like, when such work is peformed other than for profit;
f) The operation of any electronic device or group of connected electronic devices incorporating one or more loudspeakers or other electromechanical transducers, and intended for the production, reproduction or amplification of sound in such a manner as to disturb the pea> and comfort of a person or persons at the point of reception;
g) The sounding of any bell, steam or air whistle, horn, siren or signal device on or off a vehicle;
h) The selling or advertising by shouting, or Ioud speaking; i) The keeping of any animal or bird LIMITATIONS BY TIME AND PLACE
No person shall emit, cause or permit the emission of noise resulting from arry act Iisted in Schedule 1 - Prohibitions by Time and Place if clearly audible at a point of reception Iocated in an area of the Municipality specified tri Schedule 1 within a prohibited time show for such an area. EXEMPTION
Notwithstanding any other provisions of this by-law to the contrary, this by-law does not apply to a person who emits or causes or permits the emission of noise in connectiori with:
a) Emergency vehicles;
b) The immediate health, safety or welfare of the inhabitants c) Races, authorized by the Municipality; d) Regimental salutes;
e) Parades authorized by the Municipality;
f) Fireworks displays authorized by the Municipality; g) Community public events authorized by the Municipality;
h) Sporting, recreational and entertainment events in or on public parks or buildings:

i) Musical and other performances in public parks or buildings authorized by the Municipality;
j) Municipal mainteriance vehicles, including but not Iimited to snow clearing, street cleaning arid garbage collection vehicles; k) The raising or herding of livestock
l) Blasting authorized by the Municipality; PENALTIES
s. Eveiy person who contravenes any of the provisions of this by-Iaw is guilty of an offIce and shall, upon conviction, be Iiable to a fine pursuant to the Provincial Offences Act.
ENFORCEMENT
- This by-law shall be enforced by the by-Iaw enforcement officers of the Municipality.
- Schedule 1 to this By-law forms part and parcel of this By-law.
VAL?DITY
- If any section, clause or provision of this by-law, is for any reason declared by a court of competent jurisdiction, found to be invalid, the same shall not affect the validity of this by-law as a whole or any part thereof, other than the section, clause or provision so declared to be invalid and it is hereby declared to be the intention that all the remainirig section, clause or provision of the by-Iaw remairi in effect until repealed.
REPEAL
- By-Iaw 2001-67 is repealed. EFFECTIVE DATE
This by-law shall come into effect on the date of passing thereof.

There was a noticeable increase in baseball registration this year. Chair Mike Howe requested registration numbers be provided to give the committee an idea of how many children in the area are involved in baseball. There was a discussion regarding the reasons behind replacing the playground equipment as it was not requested.
e. Wilmer Park
- Terra Gower emailed Tim Laprade about the fence along the road being repaired or replaced. He indicated that it is not a capital item for 2016 but he will look into what, if anything, can be done this year.
- There was a discussion about capital and maintenance items not being incorporated into the budget and that alternate plans are made without consulting the district committees. Councillor Ross Sutherland explained that there will be a time in November during budget deliberations where the public can come to Council and give their comments and or concerns about the budget.
- The Loughborough District Recreation Committee recommends that, prior to submitting the 2017 Capital Budget, staff meets with the South Frontenac Recreation Committee and the local district committees for discussion and review. f.
The Point Park
- Chair Mike Howe met with Jamie Brash and Mark Segsworth to discuss the fencing the football field. Traditional fencing will need to be installed in order to properly protect the field from vandalism. A public meeting will be held to discuss the decision to install this type of fencing around the field.
- The committee discussed moving the temporary fencing in order for the public to have room to watch the fireworks at The Point on Canada Day.
- The shoreline restoration project should be completed by the Victoria Day weekend.
- New netting is needed for the baseball diamond.
g. Capital Budget for Loughborough 2016

Public Works Updates: Jamie Brash & Mark Segsworth i. Point Field fencing options
- Either standard black chain link fencing or a mixture of standard chain link fencing and ornamental fencing will be installed around the football field and track to protect it from vandalism. There was a discussion regarding whether ornamental fencing is necessary, although it is more esthetically pleasing as well as how high the chain link fencing needs to be. The RFP will ask for quotes on varying heights of fencing and will be decided upon at a later time.

ii. Point Shoreline
- The project is nearing completion with landscaping being the only remaining portion that is incomplete. The germination of the hydro seeding has not yet taken place because of the cool weather that the area has been experiencing.
- The committee discussed whether the fencing should be taken down for the upcoming long weekend or left up in hopes of protecting the grass. Committee members agreed that it is best to leave the fencing intact and to set June 4th as a tentative date for the opening ceremony. c. Summer Camp Program update
- All summer camp staff has been hired. Jenna Veldman will be the summer camp coordinator.
- The McMullen summer camp will be specifically geared towards sports.
- Online registration is now available. The software can provide instant receipts and is very helpful in terms of it offering a database in real time. Councillor Mark Schjerning suggested being able to copy information for registrations within the same family such as; address, emergency contacts, phone numbers, etc. Facilities within the township with be able to be booked through the same software eventually.

- Councillor Schjerning inquired if staff had found out anything with regards to residents moving their civic number signs after initial installation. Staff are to review and develop a Policy, if necessary.
- It was noted that the paragraph under Harrowsmith EA should be worded Council “supported” not “approved” the intersection design.
Sydenham Parking Mark presented the Committee with a diagram from the Proposed Parking Bylaw for the Village of Sydenham outlining the capacity of parking stalls. David Holliday informed the Committee that the parking signs had arrived and that once the micro surfacing was completed in the village, the parking stalls would be painted. The date of painting would take place 3 to 4 weeks after the initial date of May 2. Mark made mention that once the stalls were painted, the parking signs would be erected at which time the parking bylaw would be enforced.
Commuter Parking Lots Mark informed the Committee that the parking signs for the commuter lots would be erected in sync with the parking signs in Sydenham Village. The Committee felt a bylaw should be established and that the parking lots should be upgraded to reflect their purpose.
Harrowsmith Intersection Mark presented the Committee with a handout showing the requirements for property acquisition. Council would need to endorse the property acquisitions prior to a formal letter for property acquisition going to the County. The Committee discussed future work that would be required; locating of tile and sidewalks. Mark informed the Committee that CRCA had been on site and were up to date with plans. Mark will provide Steve Knechtal with a copy of the proposed property acquisitions. The life expectancy of the existing storm structure was questioned. An overall Plan for the Hamlet of Harrowsmith will be prepared.

Perth Road Corridor Study Mark informed the Committee that the report had been completed summarizing identified potential developments along the corridor. The Report provided a guide in terms of upgrades to existing roads. There was discussion of a roadway coming off Division Street instead of Holmes/Lakefield roads for the Collins Lake Subdivision. The Committee felt that a copy of the Report should be received by Council for information purposes at the COW meeting on May 24.
Fleet Automated Vehicle Locating David Holliday attended the meeting and informed the Committee that Telus had made a presentation to staff. There would be no installation, hardware and maintenance costs with Telus. The monthly fee would be $40.00 per month per vehicle. David explained that when the hardware was removed from a contractor’s truck or an obsolete fleet vehicle, it would be placed in “vacation” and cost would be stopped until reactivated. The Committee felt that a report should be brought forward to the COW for the May 24th meeting recommending the Fleet Complete System by Telus. Right Sizing Fleet David informed the Committee that there were several pieces of equipment that required costly work that were not utilized on a year round basis, one being the loader at the Storrington garage. CAT confirmed that the condition/age of the loader made putting any money into it useless. Discussion ensued around renting a piece of equipment during active months versus buying new. Mayor Vandewal suggested that a RFQ go out to local companies/contractors for loaders instead of manufacturers. A cost/benefit analysis of lease versus own will be undertaken.
Spring Roads Assessment Hard Surface Mark informed the Committee that York Road, Buck Bay Rd and Randy Clark Rd required repair this year even though York and Buck Bay Rd were originally slated for work in 2017 and the Randy Clark Rd in 2018. He explained that staff would like to pulverize the bad sections of the road and then maintain the section as a pulverized road. He explained the roads did not hold patch anymore and that cost effective wise, pulverizing would make the road easier to maintain then currently with continuous patching. The Committee supported the idea and suggested it be brought forward to Council. There was brief discussion on the upgrading of the Sunbury Road EDR. The Committee felt that staff should exhaust all possibilities of acquiring funding and that a letter go to the MPP’s.
Solid Waste Management Waste Free Ontario Act An update on the status of the Waste Free Ontario Act was provided. A copy of the City of Kingston’s comments on this Act were provided (copy attached). The Committee will be kept apprised of any developments. Styrofoam Recycling Jamie informed the Committee that the City of Kingston will no longer be accepting coloured Styrofoam. The Committee suggested putting the information on the Township Website banner for resident awareness and placing an information ad in the local papers.

- AVL – the Committee inquired as to the status of the AVL installation. Mark informed them that the proposal from Telus had not yet arrived and that the process of installation was a relatively quick one.
Parking Lots and Sydenham Parking Mark informed the Committee that once the micro-surfacing was completed in Sydenham Village the line painting would then be done and the Parking signs would then be erected. David Holliday was in the process of preparing Public Notices to residents and would be delivering them door to door. The Committee discussed various solutions for the parking issue at the Sydenham High School. Mark will have a site meeting with the Principal to go over the parking challenges.
Harrowsmith Intersection Mark informed the Committee the Harrowsmith Intersection work will be tendered in August and that the design has not yet been finalized; and that a letter had been sent to the County of Frontenac in regards to land sale negotiations.
Contractor Invoices Mark presented the Committee a report with regards to outstanding invoices recently received by a Contractor for services rendered in 2014 and 2015. The committee made the following recommendation to the COW; “THAT 50% of the total amount of combined invoices be paid in 2 installments; the 1st installment in 2016 and the 2nd installment be paid in 2017. Carried” Mark informed the Committee that the services that were invoiced for were going to be tendered out in the future. The Committee felt that there should be specific wording in the tender that the Contractor is to submit invoices in a timely manner; for example, within 30 days of services rendered.

Linear Asset Construction Budget Mark presented the Committee with a revised 2016 Capital Budget showing the reduction of almost $300,000 to help cover the 2015 Budget overrun. This amended Capital Budget also reflects some project reallocations. The Committee suggested that the amended 2016 Capital Budget be brought before the COW in an Information Report.
Maintenance and Capital Project Update Mark presented the Committee members with a spreadsheet outlining maintenance and capital projects and the dates with which the various work was slated for. A report would be provided to Council with the project spreadsheet in June. (Attached)
Municipal Funding Status Mark presented the Committee a chart showing who is receiving grants in Eastern Ontario (Attached). The Committee discussed looking at ways of debenture financing for larger projects such as Westport Road and Road 38 and passed the following motion: “THAT Public Works be directed to work with the Treasurer and CAO to investigate debenture financing for repairs of major roads and for larger projects. Carried” Direction was given to look at bundling of several projects as opposed to financing them separately.
Solid Waste Management Waste Free Ontario Act A copy of the City of Kingston’s comments on the Waste Free Ontario Act was circulated (copy attached). Communal Garbage Bin/Recycle Station Assistance Program Mark informed the Committee that due to purchase cost increases the Communal bin cost would be going up $100. He also mentioned that this change would be placed on the Township Website.

(RLS-2) TO WATERFRONT RESIDENTIAL ZONE (RW), LIMITED SERVICE RESIDENTIAL-WATERFRONT ZONE (RLSW) AND SPECIAL LIMITED SERVICE RESIDENTIAL-WATERFRONT ZONE (RLSW-111) ; PART LOT 6, CONCESSION V, DISTRICT OF BEDFORD: JAMES CAMPBELL WHEREAS, the Municipal Council of the Township of South Frontenac deems it expedient to amend By-law Number 2003-75 as amended, as it relates to a parcel of land located in Part of Lot 6, Concession V, in the District of Bedford, NOW THEREFORE THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC BY ITS COIINC?? HEREBY ENACTS AS FOLLOWS:

- THAT Zoning By-law Number 2003-75 as amended is hereby further amended by adding a new section RLSW-1 11 (Part Lot 6 Concession V, Bedford District) immediately after section RLSW-110 (Part Lot 15, Concession IX, Storrington District ), to read as follows: RLSW-1 11 (Part Lot 6, Concession V, Bedford District - James Campbell Notwithstanding the provisions of section 10.3.1 or any other provision of this By-law to the contrary, on the lands zoned Special Limited Service Residential-Waterfront (RLSW-111), the following provisions shall apply: Front Yard (Minimum)………………………..45 metres (147 fi.) Setback from highwater mark or floodline of a body of water (Minimum)…….45 metres (147 ff.) All other provisions of this by-law shall apply.

SUBJECT: Ontario Waste Management Association RECOMMENDATION: For Information only BACKGROUND: The Township of South Frontenac’s Public Works Manager has been proposed and accepted as a member of the Board of Directors of the Ontario Waste Management Association. ANALYSIS: The OWMA is a unique industry organization in that it represents both the Public and the Private sector. Attached is a listing of the current Board of Directors. It should be noted that the OWMA has had a significant role in the development of the new Waste Free Ontario Act and will continue to have an influential role in the development of the regulations pertaining to this Act. The Public Services Committee has discussed this opportunity and is supportive of the appointment. The time commitment for this role includes ten days away from the office for ten board meetings per year and a three day annual strategy session. FINANCIAL/STAFFING IMPLICATIONS: There will be an expense of approximately $2,000.00 for the annual Out of Province Planning and Strategy Session.

SUBJECT: Environmental Cleanup in Hartington BACKGROUND: The environmental remediation of the Township owned property at 5598 Road 38 was initiated in 2015. The intention of this report is to provide an update on the status of this cleanup. ANALYSIS: As part of our ongoing monitoring, wells were installed on the property lines of this property. In addition domestic wells were sampled in the immediate vicinity. (drawing attached) The initial results show exceedances in 4 of the onsite wells of applicable MOECC groundwater standards for petroleum hydrocarbon (PHC) parameters in monitoring wells at site property boundaries to the north, east and west. The 6 domestic well sampled indicated no PHC impacts in these wells. (see attached letter from SOS Inc.) There are still some areas of contamination on site that will be more cost effectively removed as part of future road construction at this intersection. As discussed with the MOECC, 2 additional monitoring wells will be installed as part of this on-going monitoring program. FINANCIAL/STAFFING IMPLICATIONS: The cost to install 2 wells is approximately $2,500.00.

First, I would like to confirm that the “she” referenced in Mr. Mills June 8, 2016 report, was in fact myself. Second, I would like to clarify that the questions I posed at the June 7, 2016, Council meeting included “why was Mr. Ruland’s report not provided to Mr. Rancourt when there appeared to have been ample opportunity to do so?”, “why was so much pertinent information missing from the materials provided to Mr. Rancourt, including some 46 pieces of correspondence from the community?” and “what steps has the Township taken with respect to the findings in Mr. Ruland’s report?”. Whether the Township provides any additional materials to Mr. Rancourt is up to Council, however it would certainly appear the community has a significantly greater amount of materials concerning this matter than that retained by the Township planner. Despite numerous requests by the community for a detailed listing of the materials the Township has concerning this matter, none has been provided. The closest we have come to same is the google drive site set up by the County of Frontenac, which unfortunately has not been updated in some time. The community remains sceptical as to the benefit of an updated report from Mr. Rancourt, if he fails to receive all the materials the community provided to Mr. Ruland. In any event, the most important question I raised at the June 7, 2016, Council meeting, which appears to have resulted in no further action, was the last question set out above “what steps has the Township taken with respect to the findings in Mr. Ruland’s report?”. I confirm once again that Mr. Ruland made it perfectly clear to staff and councillors’ present during the meeting at the Town Hall on May 19, 2016, that a well testing program for the residents of Hartington is advised. It is disappointing that the only action item on the June 14, 2016, Committee of the Whole agenda with respect to this matter does not entail steps to protect the health and safety of the residents of Hartington. Will Council please commit to setting up a well testing program for the residents of Hartington with respect to hydrocarbon and nitrate contamination? Fifty years of conservation in the Rideau Valley May/June 2016
Middle Rideau Subwatershed & Catchment Reports Available! The Middle Rideau Subwatershed Report 2015 and its accompanying catchment sheets are now available. Each year RVCA publishes a report covering a different subwatershed in the Rideau system, six in total over a six year cycle. The Middle Rideau is the first one to repeat its cycle; the first one was published in 2009. The report highlights key indicators such as forests, shorelines, wetlands and water quality. RVCA’s baseline water quality, land classification and watershed watch program provided the data. Along with the report there are catchment sheets for the 10 catchments in the Middle Rideau Subwatershed. These technical reports contain much more detailed information on each catchment. They can be viewed online at the new Subwatershed Reporting webpage — watersheds.rvca.ca. The catchment reports are instrumental in targeting stewardship projects and guide land-use planning and development decisionmaking, as well as assisting water resource management decisions on policy and programs. Cash payment is no longer required — as long as you have a phone or computer, you are covered. By using this PayByPhone service, visitors can pay online through their phone or from their home computer, making it exceptionally convenient and reliable. The service will be available at all user pay conservation areas, which include Baxter, Foley Mountain, Rideau Ferry, W.A. Taylor and Perth Wildlife Reserve. RVCA staff surveyed the installed spawning beds and brush bundles this spring. In 2016, 55 percent of the installed spawning nests were considered active as they were guarded by a male smallmouth bass, compared to 43 percent in 2015 and 41 percent in 2014. Several species of fish were observed around the installed brush bundles including largemouth bass, yellow perch, pumpkinseed, bluegill, rock bass and various minnows. 2016’s very early freshet peak on the Rideau River was 280 cubic metres per second (cms) recorded at Carleton University on March 15. In 2015 RVCA recorded the seventh lowest peak since 1937! Water levels continue to follow this trend from last year and have been low. There was no flooding or property damage.
RVCA is part of the Rideau Valley Low Water Response Team (LWRT), along with other key members including: Ontario Ministry of Natural Resources and Forestry, Ministry of the Environment and Climate Change, Parks Canada Rideau Canal, City of Ottawa and the townships of Athens, Augusta, Beckwith, Central Frontenac, Clarence-Rockland, Drummond/North Elmsley, Elizabethtown-Kitley, Merrickville-Wolford, Montague, North Dundas, North Grenville, Perth, Rideau Lakes, Smiths Falls, South Frontenac, Tay Valley and Westport. RVCA monitors conditions and reports low water issues when they occur. RVCA collects precipitation, stream flow and water level data to estimate the severity of drought conditions in our area.

Steve Simmering Fund
Spring has been a busy time for the Carbon Neutral Program with many partners renewing their carbon neutral pledge for another year and new partners joining in. The program enables businesses, events and individuals to offset their carbon footprint from day-to-day operations by planting healthy, vigorous native trees in the Rideau Valley. Here’s this spring’s honour roll:
The Steve Simmering Fund plays a vital role by providing funds to take care of the properties as they become active public parks. The fund helps pay for public safety features such as guardrails, mapping, basic signs, trail maintenance, fencing, monitoring and parking lots for visitors.
• Belvedere Vodka —A hard working group from Belvedere Vodka came out on May 25 to plant trees to make the Belvedere Vodka Relearn Natural Program launch in Canada Carbon Neutral. • Little Ray’s Reptile Zoo is continuing with its Carbon Neutral pledge. The Foundation is very happy that Little Ray’s continues to be an important partner in our Carbon Neutral family. • LiVE 88.5 — Canada’s first and only carbon neutral radio station has planted another 5,700 trees this spring. Their collective forest has grown to 34,200 trees! Congratulations to the team at LiVE 88.5. • Vélofix mobile bike shop in Ottawa has made its operations Carbon Neutral for 2016. The Foundation is thrilled to welcome them to the program. • Queens’s University Tea Room and their Chapter of Engineers Without Borders have combined efforts to plant 725 trees in 2016. We appreciate the commitment to being carbon neutral while completing your studies. Keep up the great work!

City Streams to Get TLC The City Stream Watch Program is always looking for volunteer “scientists” to help monitor and clean up Ottawa streams — everyone is welcome. The City Stream Watch program is driven by volunteer participation and gives the community a chance to contribute to the health of their local streams.This year the program will concentrate on Brassils (Burritts Rapids), Graham (Ottawa West), Greens (Gloucester) and McEwan Creek (Hunt Club East). This sampling will assess habitat, water and shoreline conditions of the streams and include fish sampling. There are also additional opportunities for cleanups, shoreline planting and invasive species removals. City of Ottawa’s Water Environment Strategy Released The City of Ottawa’s Water Environment Strategy Phase 2 Report and accompanying 2016–2018 work plan was presented to City of Ottawa Council on June 8. The goals and objectives outlined in the report complement what Conservation Authorities do. The City is looking to work closely with the CAs to implement many of the goals they’ve outlined especially for stream restoration and erosion protection works. Procurement (LRP) I contract offers recently announced by the Independent Electricity System Operator (IESO). I welcome the opportunity to respond. I would like to begin by saying I appreciate that your municipality has shown leadership by supporting solar energy proposals under the LRP I process. As you are aware, on March 10, 2016, the IESO released a list of 16 contracts that were offered under LRP I, representing nearly 455 megawatts (MW) of clean renewable
energy capacity. This capacity contributes to the achievement of the province’s renewable energy targets.
I am pleased to say that 12 of the 16 successful LRP I projects received support from local municipalities, and more than 60 per cent had support from abutting landowners. also acknowledge that some successful LRP I projects are located in communities that did not have the formal support of the municipality. Regardless of whether
municipalities indicated their willingness or unwillingness to host projects, LRP project proponents were required to engage with municipalities and take into account local needs and considerations before proposals were submitted. The results from LRP I are an important component of Ontario’s ongoing commitment to
building a cleaner and more sustainable energy system. The LRP is administered by the I ESQ and therefore I am not in a position to speak to
the first phase evaluation results. I understand that the IESO designed the LRP process so that proposals would be evaluated using three key elements: community support, Aboriginal participation and price. While municipal and community support was a significant factor in the evaluation of project proposals, it was not a mandatory requirement. The objective was to strike a balance between community engagement and achieving value for all electricity ratepayers. …/cont’d

The IESO has indicated that a number of factors, outside of community support,
factored into the success of LRP I proposals, including competition between projects seeking to connect at the same point on the grid, the proposed project size and how well it fit within the procurement target versus its competitors, and the proposed pricing of a project versus its competitors.
On April 5, 2016 I directed the IESO to launch a second phase of the LRP process (LRP II) to secure up to 930 MW of additional renewable energy capacity. The province will continue to ensure renewable energy procurement encourages the selection of projects with local support and competitive prices, as well as projects with Indigenous community participation. The I ESQ is seeking feedback from stakeholders, municipalities, and Indigenous communities to ensure that any learning and opportunities for improvement from LRP I are taken into account for LRP II. Updates and timetables associated with this

Re: Federal government reviewing our public postal service - Have your say! I am writing to let you know that the federal government is conducting areview of Canada Post. It
says that everything but postal privatization is on the table. This means daily mail delivery, restoring
home delivery, postage rates, the moratorium on post office closures and more.
The review will have two phases. The government has appointed an independent task force to collect input fi-om Canadians, do research, gather facts and identify options for the future of our postal service by September 2016. Following this, a parliamentary committee will consult with Canadians on the options identified by the task force and make recommendationsto the government by year’s end. The government expects to announce its decisions about Canada Post in the spring of 2017. The review’s first phase - the part that determines the options
that will be examined - is being held over the summer. As well, there has been very little information and advertising about the review, except in social media. We are concerned people will not learn about the review until it’s too late.
CUPW would like to ensure that the views of municipalities are considered. Therefore, we would like
you, if at all possible, to provide input to the Canada Post Review. We have attached a resolution for your consideration, information on providing input and some fact sheets on key issues.
Thank you very much for considering our request. There’s a lot at stake and we appreciate anything
you can do to help. We would also like to take this opportunity to express our gratihide to the many municipalities that supported our campaign to stop the cuts that Canada Post announced m December 2013, including the end of home mail delivery. We had a major victory when Canada Post announced a temporary hold on its plan to eliminate door-to-door delivery. CUPW is confident that we can build on this success and convince the Canada Post Review to recommend against further cuts in favour of
