Call to Order The Mayor called the meeting to order at 9:09 a.m. 2. Approval of Agenda a. September 10, 2021 Resolution #: 386-21 Moved By: Seconded By: Be It Resolved That Council approves the Amended Agenda for the Regular Meeting of Council dated September 10, 2021, as circulated. Carried Councillor Fowler Councillor Hermer 3. Disclosure of Pecuniary Interest and General Nature Thereof Deputy Mayor Martin declared a Pecuniary Interest in Communications Item B2 (see attached form). 4. Business Introductions a. Jennifer Hunter - Creative Grapes Resolution #: 387-21 Moved By: Seconded By: Councillor Hermer Councillor Fowler Regular Meeting of Council Minutes September 10, 2021 Page 2 of 11 Be It Resolved That Council receives for information the Sharbot Lake Business Group Profile of Jennifer Hunter, owner of Creative Grapes, provided by Councillor Inglis, Chair, and Paul Thiel, Member, of the Economic Development Task Force (EDTF). Carried 5. Presentations a. Mural Presentations from Artists:  Sonja Alcock; and  Brian and Leane Bailey. Resolution # 388-21 Moved By: Seconded By: Councillor Fowler Councillor Hermer Be It Resolved That Council would like to extend their thanks for the amazing contributions of Sonja Alcock and Brian and Leane Bailey who have provided murals to be installed at the Barrie Hall Grounds and the Clarendon Miller Hall Playground area. Carried 6. Delegations a. Rural Frontenac Community Services - Frontenac Transportation Resolution # 389-21 Moved By: Seconded By: Councillor Hermer Councillor Fowler Be It Resolved That Council receives the Delegation from Louise Moody, Executive Director, and Nicky Gowdy, Transportation Manager, Rural Frontenac Community Services, regarding Frontenac Transportation; and thanks them for their time spent today. Carried 7. Adoption of Minutes a. Minutes of Meeting(s) to be Adopted by Council Resolution # 390-21 Moved By: Seconded By: Councillor Fowler Councillor Hermer Be It Resolved That Council adopts the Minutes of: a. A Public Meeting (in-person) of Council regarding Re-division of Wards and Changes to Council Composition dated August 14, 2021; b. A Public Meeting (electronic) of Council regarding Re-division of Wards and Changes to Council Composition dated August 14, 2021; c. A Regular Meeting of Council dated August 20, 2021. Carried 8. Business Arising from the Minutes a. Resolution #327-21: Waste Electrical and Electronic Equipment Transition Update Resolution # 391-21 Moved By: Seconded By: Councillor Hermer Councillor Fowler Regular Meeting of Council Minutes September 10, 2021 Page 3 of 11 Whereas Council passed Resolution #327-21 at their meeting on July 16, 2021, receiving for information the Public Works Manager’s Administrative Report entitled “Waste Electrical and Electronic Equipment Transition Update”; and that Council approved adding a bin at the 506 Waste Site and transporting WEEE material to the Plevna site using existing Township equipment and staff; and that Council instructed the PWM to notify the Association of Municipalities of Ontario (AMO) and Resource Productivity & Recovery Authority (RPRA) that the WEEE program offered by the PRO is considered a reduction in service and the Municipality objects to any such reduction in the level of service during the pending transition of the Blue Box Program; Therefore Be It Resolved That Council receives for information an email dated August 18, 2021 from the PWM advising there has been further negotiating with the PRO and now in addition to the bin/pickup at the Plevna Site, they will also pick up at the 506 Waste Site; and that the only difference is they will provided super-sacs instead of a bin; and that the sacs will have to be loaded using the Township’s loader at the time of pickup; And That as the Township does not have to provide a bin and transport the WEEE materials to the Plevna Site; and as the public will continue to have two Waste Sites accepting E-Waste, the PWM has signed the Agreement and notice regarding a reduction in the level of service is not required. Clerk’s Administrative Report - Communications ‘A’ Section Resolution # 392-21 Moved By: Seconded By: Councillor Fowler Councillor Hermer Be It Resolved That Council receives for information Section ‘A’ Items of the Clerk’s Administrative Report entitled “Communications of Interest.” Carried b. Communications ‘B’ Section - Action Items B1. Association of Municipalities of Ontario (AMO) re: Policy Update - Draft Resolution for Municipal Recognition of September 30th as National Day for Truth and Reconciliation Resolution #: 393-21 Moved By: Seconded By: Councillor Hermer Councillor Fowler Whereas the Truth and Reconciliation Commission released its final report on June 2, 2015, which included 94 Calls to Action to redress the legacy of residential schools and advance the process of Canadian reconciliation; And Whereas the recent discoveries of remains and unmarked graves across Canada have led to increased calls for all levels of government to address the recommendations in the TRC’s Calls to Action; And Whereas all Canadians and all orders of government have a role to play in reconciliation; And Whereas Recommendation #80 of the Truth and Reconciliation Commission called upon the federal government, in collaboration with Aboriginal peoples, to establish, as a statutory holiday, a National Day for Truth and Reconciliation to ensure that public Regular Meeting of Council Minutes September 10, 2021 Page 4 of 11 commemoration of the history and legacy of residential schools remains a vital component of the reconciliation process; And Whereas the Federal Government has announced September 30, 2021, is the first National Day for Truth and Reconciliation (National Orange Shirt Day) and a statutory holiday for federal employees; Therefore Be It Resolved That the Council of the Township of North Frontenac does hereby commit to recognizing September 30, 2021, as the National Day for Truth and Reconciliation (National Orange Shirt Day); And That Council approves the Mayor working with Chief Davis on an event for September 30, 2021; And That Council approves the orange flag being flown. Carried Resolution # 394-21 Moved By: Seconded By: Councillor Inglis Deputy Mayor Martin Congratulations Letter to Chief Davis regarding Successful Re-election Be It Resolved That Council approves the Mayor writing a letter to Chief Doreen Davis regarding the re-election. Carried B2. Martin, Resident: Noise Exemption Request Resolution # 395-21 Moved By: Seconded By: Councillor Fowler Councillor Hermer Be It Resolved That Council receives for information an email dated September 1, 2021 from Gerry Martin, Resident, advising there will be a wedding reception on October 2, 2021 at 1108 Martin Road; and requesting an exemption from the Township’s Noise By-law #27-21, Section 3.3 (g) which provides that no loud parties are permitted between the hours of 11:00 p.m. and 7:00 a.m. that is clearly audible at neighbouring premises or residential properties; And That Council approves the exemption to the Noise By-law to permit the wedding reception to continue until 1:00 am on October 3, 2021; And That Council instructs the Clerk to provide a copy of this Resolution to the Township’s By-Law Enforcement Officer; the Ontario Provincial Police and to Gerry Martin. Carried 10. Council, CAO, and Managers’ Administrative Reports a. Director of Emergency Services / Fire Chief: Fire Prevention Week, October 3 - 9, 2021 Resolution # 396-21 Moved By: Seconded By: Councillor Fowler Councillor Hermer Be It Resolved That Council receives for information the Director of Emergency Service, Fire Chief’s Administrative Report entitled “Fire Prevention Week – October 3 – 9, 2021”; And That the North Frontenac Fire Department (NFFD) is joining forces with the Not for Profit National Fire Protection Association to remind and educate local residents about Regular Meeting of Council Minutes September 10, 2021 Page 5 of 11 the importance of “Learn the Sounds of Fire Safety” and smoke and carbon monoxide (CO) alarms, their necessity, and how the sounds they make help save lives; And That Council declares October 3 - 9, 2021 as Fire Prevention Week; And That Council approves of the NFFD’s planned events, and demonstrations based on the recommendations at the Federal, Provincial and Local Health Unit recommendations, relative to COVID– 19 Pandemic; And That Council instructs the Director of Emergency Services/Fire Chief to place a copy of the Mayoral Declaration and an advertisement outlining the events associated with Fire Prevention Week and emphasizing the importance “Learn the Sounds of Fire Safety” in the Frontenac News and on the Township’s Social Media and Website. Carried b. Director of Emergency Services / Fire Chief: Core Service Review Resolution # 397-21 Moved By: Seconded By: Councillor Hermer Councillor Fowler Be It Resolved That Council receives for information the Director of Emergency Services, Fire Chief’s Administrative Report entitled “Core Service Review”; And That Council instructs the Director of Emergency Services/Fire Chief to continue to provide Council with an annual review of the Core Services as a component of the Annual Fire Department Review. Carried c. Manager of Community Development: Community Building Fund - Capital Stream Resolution # 398-21 Moved By: Seconded By: Councillor Fowler Councillor Hermer Be It Resolved That Council receives for information the Manager of Community Development’s (MCD) Administrative Report entitled “2021 Community Building Fund – Capital Stream”; And That Council directs the Manager of Community Development to submit an Application for 100% Funding to the Community Building Fund – Capital Stream for the re-surfacing of the Cloyne Tennis Courts (either repairing and upgrading the existing surface or removing and replacing the existing surface, whichever is more feasible and sustainable based on recommendations from the experts), the replacement of the nets and posts and the re-lining the courts (if appropriate price quotations can be received in time for a competitive Application); And That Council authorizes the Manager of Community Development to sign the Application for Funding and the Agreement for Funding on behalf of the Township if the Application for Funding is successful. Clerk/Planning Manager: Public Comments - Re-division of Wards and Changes to Council Composition Resolution # 399-21 Moved By: Seconded By: Councillor Hermer Councillor Fowler Regular Meeting of Council Minutes September 10, 2021 Page 6 of 11 Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Public Comments - Re-division of Wards and Changes to Council Composition”; And That, based on public comments received, Council chooses Option 1 being to leave the Ward boundaries and Council composition the same. Carried e. Clerk/Planning Manager: Three (3) Shore Road Allowance Applications for Approval in Principle – Volpe, Polak and Bell-Stone Resolution # 400-21 Moved By: Seconded By: Councillor Fowler Councillor Hermer Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Three (3) Shore Road Allowance Applications for Approval in Principle – Volpe, Polak and Bell-Stone”; And That Council approves in principle the Application to close, stop up and sell the Shore Road Allowances as describes below:  Part of the Shore Road Allowance lying adjacent to Lot 9, Plan 1323, geographic Township of Miller (Brule Lake);  Part of the Shore Road Allowance lying adjacent to Part of Lot 9, Concession 9, geographic Township of Barrie (Mississagagon Lake);  Part of the Shore Road Allowance, lying adjacent to Lot 18, Plan 1557, geographic Township of Barrie (Big Gull Lake). Clerk/Planning Manager: Shore Road Allowance Closures and Sale By-law – Tokley and Mcilveen-Papineau Resolution # 401-21 Moved By: Seconded By: Councillor Hermer Councillor Fowler Be It Resolved That Council receives for information the Clerk/Planning Manager’s Administrative Report entitled “Shore Road Allowance Closures and Sale By-law – Tokley and Mcilveen-Papineau”; And That, as required by By-law #22-15,  All That Part of the Road Allowance in front of Lot 7, Concession 12, geographic Township of Barrie, Township of North Frontenac, County of Frontenac being Part 2 on Registered Plan 13R-22481 (Shawenegog Lake);  All That Part of the Road Allowance lying in front of Lot 11, Registered Plan 1232, geographic Township of Clarendon, Township of North Frontenac, County of Frontenac being Part 11 on Registered Plan 13R-5670 (Big Gull Lake). be declared as surplus and sold to the adjoining owners. Appraisals of these properties are not necessary as these are Shore Road Allowances; And That Council will consider a By-law later in the meeting to Stop-up, Close and Sell a Portion of these Shore Road Allowances. Manager of Community Planning, County of Frontenac: Site Plan Control - S1/21 - Smart’s Marina Ltd. Councillor Inglis Councillor Fowler Be It Resolved That Council receives for information the Planning Report prepared by Sonya Bolton, Manager of Community Planning, County of Frontenac entitled “Site Plan Control – S1/21 – Smart’s Marina Ltd.;” And That Council approves the Site Plan Control Application for 804 Skootamatta Lake Road to permit the development of a commercial boat storage site; And That Council will consider a By-law later in the meeting to execute the Site Plan Control Agreement.
