TOWNSHIP OF SOUTH FRONTENAC BY-LAW 2022-20 A BY-LAW TO CONFIRM GENERALLYALL ACTIONS AND PROCEEDINGS OF THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC ON FEBRUARY 15, 2022 Whereas Section 8 of the Municipal Act, S. O. 2001 c. 25 and amendments thereto
provides that a municipality hasthe capacity, rights powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act of any other Act; and;
Whereas Subsection 2 of Section 11 of the Municipal Act S. O. 2001, c. 25 and
amendments thereto provides that a lower-tier municipality and an upper-tier municipality may pass by-laws respecting matters within the spheres of the jurisdiction described in the Table to Subsection 2, subject to certain provisions, and; Whereas Section 5 of the Municipal Act, S.O 2001 c. 25 and amendments thereto
provides that a municipal power, including a municipality’s capacity, rights, powers and privileges under Section 8 shall be exercised by its council and by by-law unless the municipality is specifically authorized to do otherwise, and
Whereasthe Council ofthe Township of South Frontenac deems it expedientto confirm its actions and proceedings;
NOWTHEREFORE BE IT RESOLVEDTHAT THE COUNCIL CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC, HEREBY ENACTS AS FOLLOWS:
The all actions and proceedings ofthe Council ofthe Corporation of the Township of South Frontenac taken at its regular meeting held on February 15, 2022 be
confirmed as actions forwhichthe municipality hasthe capacity, rights, powers and privileges of a natural person.
That all actions and proceedings ofthe Council ofthe Corporation ofthe
Township of South Frontenac held February 15, 2022 be confirmed as being
matters within the spheres ofjurisdiction described in Subsection 2 of Section 11 of the Municipal Act, S.O. 2001, c.25 and amendments thereto.
That all actions and proceedings ofthe Council ofthe Corporation of the
Township of South Frontenac taken at its regular meeting held on February 15,
2022exceptthosetaken byby-lawandthose required bybylawto bedoneby
resolution are hereby sanctioned, ratified and confirmed as though set outwithin
and forming part of this by-law.
Execution bythe Mayor and the Clerk of all Deeds, Instruments and other Documents necessary to give effect to any such Resolution, Motion or other action and the affixing ofthe Corporate Seal to any such Deed, Instruments or other Documents is hereby authorized and confirmed.
- This By-lawshall come intoforce andtake effectonthe dateofits passage. Read a first and second time this 15 day of February, 2022.
