Recommendation It is recommended that South Frontenac Council receive comments from the public and, pending comments received, direct staff to prepare a by-law to bring back to Council after the identified title issues are resolved to rezone the subject lands from Limited Service Residential (RLS) to Rural (RU) in order to enable development on a property that is accessed by a public road.

Proposal An application has been submitted to amend Zoning By-law No. 2003-75 to rezone a portion of the subject property from Limited Service Residential (RLS) to Rural (RU).

Background The subject property has frontage on Hitchcock Drive, but is accessed by Cardinal Lane, which runs through the property. The property abuts Stone Point Road, an assumed public road in a plan of subdivision. The lands are developed with a single detached dwelling. The subject property is subject to consent application S-52-20-S to create one new residential lot with frontage on Stone Point Road. Provisional approval of this application was granted subject to conditions on April 9, 2021. Condition 13 requires the severed parcel to be rezoned to Rural (RU) to recognize that this new lot is accessed from a public road. The severed parcel is located on the North West portion of the subject property between Stone Point Road and Cardinal Lane. Attachment 1 to this report shows the location of the lands that are subject to the rezoning application. A Zoning By-law amendment to change the zone on the severed parcel from RLS to RU is required to bring the new residential lot into conformity with the Zoning By-law. Specifically, the severed parcel must be zoned Rural to recognize that the property has frontage on a public road, and so that building permits can be issued for buildings and structures. Staff identified a 0.3 metre reserve along Stone Point Road as part of the review of the consent application. A 0.3 metre reserve means that the subject property does not have frontage on Stone Point Road. Staff sought direction from Council on this matter. On March 9, 2021, Council, sitting as the Committee of the Whole, directed staff to prepare a by-law dedicating and assuming a portion of the 0.3 metre reserve along Stone Point Road to provide the proposed lot frontage onto this public road. This bylaw would provide the subject property frontage on Stone Point Road, thereby facilitating the creation of a new residential lot through the consent application. In preparing to fulfill the conditions of consent approval, the applicant’s lawyer identified that there are title issues that had not been identified as part of the original consent application. These title issues further impact access of the severed parcel to Stone Point Road. The applicant and their lawyer are working to resolve these issues. The bylaw for the release of the 0.3 metre reserve will be brought back to Council for passing together with the by-law for this rezoning only after the title issues impacting the severed parcel have been resolved.

Department, Agency and Public Comments Comments from departments, agencies and the public are summarized in this section of this report. Public Services and the Building Department (Sewage System Review) were not circulated the rezoning application. These departments had no objection to the approval of Consent Application S-52-20-S and to the release of the 0.3 metre reserve of Stone Point Road. Public Comments At the time of writing, no comments on the rezoning application have been received from the public. The intent of the public meeting is to receive comments from the public. Under the Planning Act, a public meeting is required to be held to receive comments from citizens on the proposed rezoning. The province has provided direction that public meetings are able to be held virtually using technology such as Zoom to obtain public input on planning applications. The public meeting for application Z-20-16 will be a virtual public meeting.

Planning Analysis Provincial Policy Statement, 2020 The Provincial Policy Statement, 2020 (PPS) provides policy direction on matters of provincial interest related to land use planning and development. Section 3 of the Planning Act requires that Council decisions be “consistent with” the PPS. The PPS allows growth and development to be directed to rural lands, including residential lot creation and development that is compatible with the rural landscape Natural, Vibrant and Growing – a Progressive Rural Leader 2

(section 1.1.5). The new residential lot would be compatible with the surrounding rural plan of subdivision. The proposed development is consistent with these directions of the PPS. County of Frontenac Official Plan, 2016 The County of Frontenac Official Plan sets out the general direction for planning and development by defining strategic goals, broad objectives and policies. Section 3 – Growth Management sets outs policies intended to help guide new development across the County as well as manage change at a regional level. The Rural Lands policies are meant to recognize the importance of rural areas for future growth and create guidelines for development that is sensitive to the surroundings. The new residential lot would be compatible with the surrounding rural plan of subdivision. The proposed development is consistent with the direction of the County Official Plan. Township of South Frontenac Official Plan, 2003 The subject lands are designated Rural in the Official Plan on Schedule A. The type and amount of development on Rural lands must maintain the rural character, natural heritage, and cultural landscape in the Township. As indicated above, there is a 0.3 metre reserve between Stone Point Road and the subject property. There were also title issues identified that further impact access for the severed parcel to obtain access to Stone Point Road. A by-law dedicating and assuming a portion of the 0.3 metre reserve is needed, and the title issues need to be resolved, to provide the subject property with road frontage. Once these matters are addressed, the new zoning would bring the new residential lot into conformity with the Official Plan and Zoning By-law. Specifically, the lot must be zoned Rural so that building permits can be issued for buildings and structures.

Conclusion This application is consistent with the Provincial Policy Statement 2020, the County of Frontenac Official Plan and the South Frontenac Official Plan, and it represents appropriate planning for the subject lands. However, there were title issues identified that impact access of the severed parcel to Stone Point Road. Staff propose that it is appropriate at this time to hold the public meeting to obtain comments from the public on this rezoning application, but staff would not bring the bylaw back before Council until such time as the title issues impacting the creation of the severed lot are addressed. Staff will bring the by-law addressing the assumption of the 0.3 metre reserve forward for Council’s consideration at the same time as the zoning by-law amendment will be brought back. TOWNSHIP OF SOUTH FRONTENAC BY-LAW 2021 - XX Being a by-law to amend By-law 2003-75, as amended, to rezone land from Limited Service Residential (RLS) to Rural (RU) on lands described as Part Lot 17, Part Block 56, Concession 8, District of Storrington: (Zimolag) WHEREAS pursuant to the provisions of Section 34 of the Planning Act, RSO 1990 as amended, the Council of a Municipality may enact by-laws regulating the use of land and the erection, location and use of buildings and structures thereon; AND WHEREAS By-law 2003-75 being the Zoning By-law regulates the use of land and the erection, location and use of buildings and structures within the Township of South Frontenac; AND WHEREAS the Council of the Corporation of the Township of South Frontenac considered all written and oral submissions received on this application, the effect of which helped Council make an informed decision; NOW THEREFORE, the Council of the Corporation of the Township of South Frontenac, hereby enacts as follows: 1.

THAT Schedule “C”, to Zoning By-law Number 2003-75 as amended, is hereby further amended by changing the zoning from Limited Service Residential (RLS) to Rural (RU) for the lands shown on Schedule “1”.

THIS BY-LAW shall come into force in accordance with Section 34 of the Planning Act, 1990, as amended, either upon the date of passage or as otherwise provided by said Section 34. Recommendation It is recommended that South Frontenac Council receive comments from the public, and pending comments received, direct staff to prepare a by-law to rezone a portion of the subject property from Limited Service Residential – Waterfront (RLSW) to Limited Service Residential – Waterfront – Special Provision (RLSW-59) and from Limited Service Residential to Residential Waterfront (RW) so that the severed parcel of consent application S-03-21-L will have the same zone as the parcel receiving the subject lands and that the retained parcel will have zoning that reflects access from a Township road.

Proposal An application has been submitted to amend Zoning By-law No. 2003-75 to rezone the subject lands from Limited Service Residential - Waterfront (RLSW) to Limited Service Residential - Waterfront - Special Provision (RLSW-59) and Residential Waterfront (RW).

Background The subject property has frontage on North Shore Road and Loughborough Lake. The upland areas of the property are separated by the Loughborough Lake provincially significant wetland. The lands are developed with a single detached dwelling near North Shore Road. The subject property is subject to consent application S-03-21-L for a lot addition to a property municipally known as 1036 Brittara Lane. Provisional approval of this application was granted subject to conditions on April 9, 2021. Condition 9 requires the severed parcel to be rezoned so that the lands will have the same zone as the parcel receiving the subject lands. The severed parcel is a peninsula located on the south side of the wetland, and beside 1036 Brittara Lane. Attachment 1 (Location Map) to this report shows the location of the lands that are subject to the rezoning application. The RLSW zone is applicable to residential properties that have frontage on a private lane, or are accessed via a private lane, and have frontage on a navigable waterway. In the case of a lot addition severance, it is good planning practice to ensure the enlarged

parcel has one consistent zone that applies to the whole property. The RLSW-59 zone applies to the lot that is being enlarged. The lands that are being added through the lot addition severance are also proposed to be zoned RLSW-59 to have one consistent zone on the enlarged parcel once the severance is finalized. Attachment 2 to this report is a draft by-law. Through the review of the consent application, staff determined that the retained parcel should also be rezoned. The retained parcel is zoned RLSW. However, it should be zoned Waterfront Residential (RW) since the property has frontage on, and is accessed from, a public road. This rezoning proposes to change the zoning on both the severed and retained parcels relating to consent application S-03-21-L.

Department, Agency and Public Comments Comments from departments, agencies and the public are summarized in this section of this report. Public Services, the Building Department (Septic System Review), and Cataraqui Conservation were not circulated the rezoning application as the proposal did not meet the criteria for circulation. Public Comments At the time of writing, no formal comments have been received from the public. The intent of the public meeting is to receive comments from the public. Under the Planning Act, a public meeting is required to be held to receive comments from citizens on the proposed rezoning. The province has provided direction that public meetings are able to be held virtually using technology such as Zoom to obtain public input on planning applications. The public meeting for application Z-21-03 will be a virtual public meeting.

The enlarged parcel would continue to satisfy the RLSW-59 zone. No further lot creation is facilitated as a result of this rezoning. Through the review of the consent application, staff determined that the retained parcel should also be rezoned. The retained parcel is zoned RLSW. However, it should be zoned Waterfront Residential (RW) since the property has frontage on, and is accessed from, a public road.

Conclusion This application is consistent with the Provincial Policy Statement 2020, the County of Frontenac Official Plan and the South Frontenac Official Plan, and it represents appropriate planning for the subject lands. Road Closing Application – RC-21-04, Cook, Lelah (Agent: Timothy Cook) Closure and transfer of a portion of an Unopened Road Allowance between Lots 5 & 6, Concession 13, Bedford between Devil Lake and Perth Road (Road 10).



RECOMMENDATION That Council receive public comments on a proposal to consider the closing and transfer of ownership of a portion of unopened road allowance that abuts the property addressed as 38 Coronation Lane.

PURPOSE The purpose of this report is to bring forward an application for a road closure and to hold a public meeting on the application as required under the Municipal Act.

BACKGROUND The road allowance is aligned east to west, running from Perth Road (Across from MacComish Lane), to Devil Lake. The road allowance begins as a steep embankment at Perth Road, runs across the wetlands before it ends at Devil Lake. Attachment #1 illustrates the property fabric for the adjacent parcels as well as the road allowance. The owner of the lands municipally known as 38 Coronation Lane, Lelah Cook and her son, Timothy Cook acting as her agent, have filed a road closing application requesting Council stop up, close and transfer approximately 20 metres by 270 metres of unopened road allowance being part of the unopened road allowance between Lots 5 & 6, Concession 13, District of Bedford. 38 Coronation Lane is a waterfront parcel of land located southwest of the unopened road allowance. The lands are developed with a cottage and outbuildings, including a boat house. The parcel to be enlarged is approximately 0.25 acres in size, being an undersized, legal noncomplying parcel. By adding the road allowance to this property, the parcel would be closer to conforming to the current Comprehensive Zoning By-Law 2003-75 provisions and will enable the applicants to restore the boathouse that is currently located on the unopened road allowance. Planning staff and public services staff visited the site on October 28, 2020. Public Services staff advised that they have no issues with selling the road allowance as it runs through a wetland that would be negatively impacted if a road or public access of any nature were to be constructed over the road allowance. There is also a steep embankment where the road allowance meets Perth Road that would pose challenges for access and sightlines.

NOTICE Consistent with the requirements of the Municipal Act, a Notice of Road Closing was posted on the Township website on May 3, 2021 and advertised in the Frontenac News for 4 weeks

Page 40 of 87 beginning May 3, 2021. Notice was also sent by mail to all other land owners abutting the relevant portion of the road allowance. Planning Staff have received two replies to the Public Notice from adjacent land owners. Both adjacent land owners advised that they were concerned that the portion of road allowance that encompassed the wetlands may be sold to individual property owners because there may be potential for buildings within the wetlands. Planning staff have advised that a minimum 30 metre setback for any new structures would be required in accordance with Zoning By-Law 2003-75. If any structure were proposed at a reduced distance, permission through a minor variance would be required and it would be up to the Committee of Adjustment to make a decision on any applications. The Committee would take into consideration Planning Staff and Conservation Authority staff reports and comments before making a decision. The abutting property owners were satisfied that the wetlands would be sufficiently protected in this regard. The southerly adjacent land owner was also concerned about the boathouse and the demolition and re-construction in a safe and environmentally friendly manner. Planning staff advised that any demolition and reconstruction of the boathouse will require demolition permits and building permits to be obtained through the building department, permits will also be required through the Cataraqui Conservation Authority for the re-construction. This property owner advised that they were pleased to hear this and that they may consider purchasing a portion of the southeasterly side of the road allowance that abuts their property. No application has been made for any portion of the road allowance to date. Concerns in relation to the property fabric shown in the Frontenac Maps illustration as well in the historical surveys were also discussed with both adjacent neighbours. Planning staff advised that while Frontenac Maps is a great tool utilized by Township Staff and members of the public, it is not a formal survey and only a qualified Ontario Land Surveyor is able to produce exact measurements and lot line placement. A formal survey will be required to be completed and registered prior to the by-law being drafted and Council approving the transfer of the lands.

SUMMARY Council should hear anyone who wishes to speak at this public meeting on the closing of the road allowance. If Council is still favourable to the proposal, a road closing by-law will be considered at such time as the reference plan is deposited and submitted to the Township.

Deputy Mayor Leonard commended the Public Services staff on work recently done to Clair and Leveque Roads. He felt these roads are in the best shape they have been in in years. Brian Kirk assured the Deputy Mayor he would pass on this note of appreciation and noted that the use of clean aggregate is more effective for these types of roads.

BACKGROUND Council’s Procedural By-law 2017-76 establishes the process for Notice of Motion. At the Committee of the Whole Meeting on May 18, 2021 Councillor Sutherland served a notice of motion that South Frontenac Council supports the resolution passed by the Town of Fort Erie regarding source water protection and the consideration of legislation that would permit expansion of source water protection to aquifers and private services. A notice of motion requires a seconder at the next regular Council meeting. If seconded, the motion is debated and voted on.

Please be advised the Municipal Council of the Town of Fort Erie at its meeting of April 26, 2021 passed the following resolution: Whereas the Municipal Council of the Town of Fort Erie passed a resolution on October 21st, 2019 identifying that 1,100 private water wells were in operation in the Town of Fort Erie, of which 75% were used for domestic purposes including human and livestock consumption, and Whereas the Municipal Council of the Town of Fort Erie further identified in that resolution that Council requires the protection of water in the aquifer supplying water to those wells from contamination as the result of any remediation of Pit One owned by the Port Colborne Quarries in the City of Port Colborne, and further Whereas Report No. PDS-23-2021, approved by Council on March 22, 2021, identified that while the Niagara Peninsula Conservation Authority, The Regional Municipality of Niagara and Local Area Municipalities work together to protect source water, these plans do not generally apply to private servicing, and Whereas Report No. PDS-23-2021 further identified efforts undertaken by the Town of Fort Erie through available provincial planning policy, regulation and legislation to protect source water within the Town of Fort Erie without any explicit ability to designate source water protection for private services, and Whereas on July 28, 2010, through Resolution 64/292, the United Nations General Assembly explicitly recognized the human right to water and sanitation and acknowledged that clean drinking water and sanitation are essential to the realization of all human rights, and

Updated OPP Detachment Board Composition

RECOMMENDATION: That South Frontenac Council supports the updated recommendation from the Chief Administrative Officers of the Frontenac townships regarding the structure of a new Detachment Board for the Frontenac OPP, involving a nine (9) voting-member board as outlined in the report dated June 1, 2021. BACKGROUND: On May 4, 2021, Council endorsed a recommendation from the Chief Administrative Officers of South, Central and North Frontenac regarding an eight (8) member composition for a new Detachment Board for the Frontenac OPP, as required under the new Community Safety and Policing Act, 2019 (CSPA). Following that meeting, Central Frontenac Council expressed an interest in reaching out to the Shabot Obaadjiwan First Nation regarding their interest in participating on the new Detachment Board. ANALYSIS/DISCUSSION: While not a requirement under the Act for the catchment area of the Frontenac OPP, the Solicitor General’s office strongly recommended outreach to First Nations communities within the region and the CAO’s support this approach. The Shabot Obaadjiwan First Nation is based out of Central Frontenac with band membership throughout the region including North and South Frontenac. When contacted, Chief Doreen Davis of the Shabot Obaadjiwan First Nation expressed strong interest in participating. As a result, the recommended structure and membership of the new Frontenac OPP Detachment Board is as follows: •

In addition to their participation on the Frontenac Detachment Board, the Township will soon be involving regional First Nations as part of the Official Plan review process. Both initiatives will provide opportunities to develop valuable relationships and foster more regular communications between Township Council and staff and First Nations communities in this area. FINANCIAL IMPLICATIONS: Under the CPSA, members of Detachment Boards will be required to obtain training at the expense of the Board and its member municipalities. While training requirements and their costs are unknown at this time, the number of seats on the Board would likely result in a negligible cost for such training which would be shared equitably between the Townships. 2021 Community Grant Recommendations

RECOMMENDATION: That Council receive and approve the listing of staff recommended Community Grants included as Attachment 2 to the report prepared and dated June 1, 2021 from Louise Fragnito, Director of Corporate Services and Treasurer; and, That any remaining funds be allocated to a second intake to be issued in the summer of 2021. BACKGROUND: 2021 is the eighth year that the Township has accepted applications to its Community Project Grant program. Website and newspaper ads were placed soliciting applications. The 2021 budget included an amount of $35,000 in new funding for the program in addition to a carryover from 2020 of $11,828. A copy of the Community Grants Policy is attached. Although the policy makes reference to a submission deadline of the last business day of March with decisions being announced by May 15th of every year, these deadlines were extended to April 30th this year due to COVID-19. Further, the policy speaks to the Corporate Services Committee reviewing the summary of applications and providing a decision on grants. Rather than calling a committee meeting for only this purpose, the approval is being brought forward directly to Council. ANALYSIS/DISCUSSION: Seven (7) applications were received in response to the Township’s advertisements. The CAO and Treasurer reviewed and evaluated the applications against the Community Project Grant Policy. Of the seven (7) applications received, three (3) were directed to the COVID-19 grant program and three (3) that were submitted under the COVID-19 grant program were directed to the regular community grant program, keeping the total number at seven (7). Of the seven (7) applications, one (1) did not meet the requirements of the grant program and is not recommended for any funding. Further, one application, from the Dog and Cranberry Lakes Association, was deemed to be better suited for the Lake Ecosystem grant program but due to the timing of the 2021 application intake for that new program and the anticipated project timeline, this application is being recommended for approval as an exception under the community grant program. The applications are summarized along with recommendations in the attached document. The number of submissions received this year is lower than usual which may be in part because of current COVID-19 uncertainty and provincial restrictions. For this reason, it is staff’s recommendation that a second intake be issued later this summer to allocate the remaining funds of $28,838.34. ATTACHMENTS: • •

COMMUNITY GRANTS POLICY

  1. Purpose: This policy is to establish a grant process that supports and encourages community organizations and events that enrich the quality of life within the Township. 2 . Policy: The Township on a yearly basis will solicit applications from community organizations for projects or events supporting community initiatives. The total amount available within a calendar year will be based on what has been set within the year’s operating budget. Individual allocations to organizations will be based on a pre-determined structure. Being approved in one year does not guarantee funding in the following year. Definitions & Guidelines: Community organizations: Not for profit including unincorporated groups or registered charitable organizations who: o operate a business, provide a service or event within the geographic boundaries of the Township of South Frontenac o have the ability to show the stability or sustainability of the organization/group o in the previous calendar year, received less than 75% of its operating budget from government grants. o Submitted financial statements from the previous calendar year with your Letter of Intent along with a list of current officers. Criteria for All Grant Recipients:
  2. Submissions must have a well-defined purpose and take place / be completed within the calendar year of receiving the grant.
  3. Submissions must meet the requirements of the application process.
  4. The Grant request may be for: • a new, improved or expanded community service (including necessary supplies), • a community event. • an acquisition, improvement or expansion of a facility or its related equipment • the acquisition and installation of community assets
  5. Final reports from any previous year’s funding must have been received in order to be considered for the current year.
  6. Unspent funds must be returned to the Township following completion of the project.
  7. Applicants cannot be in receipt of other program specific Township funding Grant Streams:

A pre-determined scoring system will be used by the Township prior to beginning the review process. Should multiple applicants meet the application requirements and goals of the funding, a fixed amount will be granted to each organization with any remaining funding allocated based on the percentage applied for and the total funding available. Submissions beyond the scope of this grant process may be presented for separate consideration to council in advance of the next operating budget review. If you are selected for a grant, you will be asked to sign a grant agreement. Upon completion of your project or event, you are required to complete a Final report. The final report is intended to help you evaluate the initiative and help us evaluate the effectiveness of our grants in supporting and improving the quality of life in our community.

2021 COVID-19 Community Grants Recommendations

RECOMMENDATION: That Council receive and approve the listing of staff recommended COVID-19 Community Grants included as Attachment 2 to this report; and, That any remaining funds be allocated to a second intake to be issued in the summer of 2021 BACKGROUND: In the 2021 budget, Council allocated funding in the amount of $250,000 to a targeted financial relief and support program for those affected by the COVID-19 pandemic. At the March 2nd Council meeting, Council approved the details of that program including the allocation of the $250,000. Program Allocation Three overarching program streams were created:

  1. Small Business Supports – Allocation of $60,000 managed by Frontenac Business Services
  2. Support for Not-For-Profits and Community Groups – Allocation of $170,000
  3. Program Funding – Allocation of $20,000 Under the 2nd stream, to be administered by the Township, two types of eligibility were identified: a) Social Recovery – seed funding for new events aimed at rebuilding community, health & wellness through activities and programs or to offset the increased costs of offering existing programs due to pandemic restriction and related distancing or material requirements – maximum of $5,000 per group b) Support for Operating/Fundraising Losses or deficits in order to maintain important community groups – maximum of $5,000 per organization The funding for community groups was to be administered through separate streams of the Township’s existing Community Grants Program. The degree to which the organization operates/benefits South Frontenac was to be an important criteria, as was proof of financial impact due to COVID-19. Financial statements were requested and applicants had to identify if they had accessed other funding sources. A copy of the COVID-19 Community Grants Policy is included under attachment 1. ANALYSIS/DISCUSSION: 13 applications were received in response to advertisement in the local newspaper and on social media. The CAO and Treasurer reviewed and evaluated the applications against the COVID-19 Community Project Grant Policy. Of the 13 applications received, three (3) were directed to the regular community grant program while another three (3) that had been submitted under the regular community grant program were directed to the COVID-19 program.

The applications are summarized along with recommendations in the attached document. After a review of financials from 2018 to 2021, three (3) of the applications are recommended to receive an amount in excess of $5,000. Their financial operating/fundraising deficits from COVID-19 surpassed the $5,000 threshold and an upset limit of $15,000 was used to preserve funding for additional applications under a second intake, if approved by Council. The number of submissions received is lower than was anticipated. This may be in part because of current COVID-19 restrictions and uncertainty about the ability to deliver programs.   1. Purpose: This program is to establish a grant process that supports community groups who have been impacted by COVID-19 and provide important services in the community. 2 . Policy: The Township will solicit applications from community groups including non-for-profits under two main streams, social recovery and support for operating/fundraising deficits. A total allocation of $170,000 is available for the two streams and is a one-time funding opportunity approved by Council in 2021. Definitions & Guidelines: Community organizations: Not for profit including unincorporated groups or registered charitable organizations that operate a business, provide a service or event within the geographic boundaries of the Township of South Frontenac. Social Recovery Stream  Grant up to $5,000 per group  Grants are to provide: o Seed funding for new events aimed at rebuilding community, health & wellness through activities or programs. o Support existing programs or events through the offset of increased costs of offering the programs/events due to pandemic restrictions and related distancing or materials requirements.  Township sponsorship must be clearly acknowledged and promoted at the event and in all materials  The event must be open to the community and must be free to attend, or as an alternative the proceeds are provided to a local charity  The event must take place in 2021.  Any unspent funds must be returned to the Township following completion of the project.
  5. Operating/Fundraising Deficits  Grant up to $5,000 per group.  The request must demonstrate and provide details about the financial impact of the COVID-19 pandemic on the organization, such as reduced registration revenues or limited fundraising abilities.  Submissions must show the stability or sustainability of the organization/group prior to the impact from COVID-19.  Where a specific program is identified, both the loss of revenue or fundraising and the related expenses for that program must be identified.  Submissions related to fundraising losses must identify the purpose of the funds and related expenses and community donations, if applicable.  Requests for funds where proceeds would normally be donated to another organization will be assessed on the basis of that organization’s purpose, eligibility and receipt or application for alternative funding. Funds must be related to community-wide purposes; in the case of faith-based institutions, funding cannot support religious activities or promotion. Submissions must include financial statements from 2019, 2020 as well as 2021, where applicable. Statements must provide sufficient level of detail by program to review the organization as a whole as well as each program it offers separately. Grants are to support incurred impacts to organizations from the pandemic in 2020 and 2021.

  1. The Township will advertise on their website and in the local paper to announce the application process. Applications will be received until the last business day of April.

  4. All letters of Intent will be reviewed by staff and grant approval and funding disbursements will be announced by May 31st. A pre-determined scoring system will be used by the Township prior to beginning the review process. Should multiple applicants meet the application requirements and goals of the funding, a fixed amount will be granted to each organization with any remaining funding allocated based on the percentage applied for and the total funding available. If your organization is approved for a grant, you will be asked to sign a grant agreement with the Township. Upon completion of your project or event, your organization would have to submit a Final report. The final report is intended to help us evaluate the effectiveness of our grants in supporting and improving the quality of life in our community. RECOMMENDATION That Council pass By-law 2021-29 to stop up, close and transfer ownership of Part 2 on Plan 13R22405 being a portion of an unopened road allowance adjacent to the property located at 30 Rideau Crescent Lane. AND That Council pass By-Law 2021-30 to stop up, close and transfer ownership of Part 1 on Plan 13R22405 being a portion of an unopened road allowance adjacent to the property located at 5508 Rideau Road.

BACKGROUND An application was submitted to the Development Services Department to stop up and close a portion of unopened road allowance in Plan of Subdivision 1316. The road allowance subject to this application was never assumed or opened by the Township. The road allowance runs across the back of 5 properties in the plan of subdivision. The properties are located on a large peninsula accessed by Rideau Crescent Lane off of Rideau Road, located on Little Cranberry Lake. A portion of the road allowance has already been stopped up, closed and transferred in 1998. Development Services staff received a reply from the Public Notice for application RC-20-03 made by Jordan Cunningham and Madeline King. Abutting land owners, Stanly and Muriel Prunster advised Township staff they would like to purchase half of the road allowance related to the proposal in application RC-20-03. The Prunster’s submitted an application RC-21-02 to stop up, close and transfer a portion of the portion of road allowance that had been applied to be stopped up, closed and transferred by Jordan Cunningham and Madeline King. The parties came to a mutual agreement prior to the Public Meeting held on March 16, 2021. Attachment “2” to this report illustrates Part 1 and Part 2. Part 1 on Plan 13R22405 is proposed to be stopped up closed and transferred to the Prunster property municipally known as 5508 Rideau Road. Part 2 on Plan 13R22405 is proposed to be stopped up, closed and transferred to the Cunningham and King property, municipally known as 30 Rideau Crescent Lane. The proposal came before Council for consideration at the December 15, 2020 Council Meeting and to a public Council Meeting on March 16, 2021. “Natural, Vibrant and Growing – a Progressive Rural Leader” 1

The transfer of the unopened road allowance will enable the Cunningham and King property to expand the structure on the property and still comply with the rear yard setbacks, it will also provide parking that is currently a challenge and sometimes takes place on the road allowance. The undersized parcel will be closer to conforming to the current waterfront lot size standards by receiving this portion of road allowance. The transfer of the unopened road allowance will enable the Prunster property to have their driveway widened for safe access, improved drainage and to provide for more parking and safer snow removal on their own property. Based on discussions with the property owners, it was determined that the first 18.48 feet of the road allowance (being a portion of Part 2 on the attached plan) is within 300 feet of the waterbody having a purchase price of $2.41 per square foot. The remaining 14.75 feet of Part 2 and all of Part 1 is beyond 300 feet of the waterbody, a purchase price of $0.80 per square foot will be applied to this portion based on “Residential Lot on Water” purchase prices. Part 2 (Cunningham King): 266.8 square metres (2,871.7 square feet) Portion within 300 feet of the water: 1,597.04 sq ft @ 2.41 per sq ft = $3,848.87 + HST Portion beyond 300 feet of the water: 1,274.70 sq ft @ 0.80 per sq ft = $1,019.76 + HST Cunningham / King Total Purchase Price: $4,868.63 + HST ($632.92) = $5,501.55 Part 1 (Prunster): 266.8 square metres (2,871.7 square feet) Portion beyond 300 feet of the water: 2,871.7 sq ft @ $0.80 per square feet = $2,297.36 + HST Prunster Total Purchase Price: $2,297.36 + HST (298.66) = $2,596.02 Two separate bylaws have been drafted to facilitate the transfer to the Cunningham / King property and to the Prunster property consistent with the direction of Council Prior to the transfer of the portion of the unopened road allowance the Applicants, Jordan Cunningham and Madeline King are required to pay to The Township of South Frontenac $5,501.55 consistent with the Township policy. Prior to the transfer of the portion of the unopened road allowance the Applicants, Stanly and Muriel Prunster are required to pay to The Township of South Frontenac $2,596.06 consistent with the Township policy. Jordan Cunningham, Madeline King, Stanly Prunster and Muriel Prunster have had the survey 13R22405 prepared. The survey was deposited with the Land Registry Office on April 21, 2021.

NOTICE & PUBLIC COMMENTS Consistent with the requirements of the Municipal Act, a Notice of Road Closing was posted on the Township website on February 4, 2021 and advertised in the Frontenac News for 4 weeks beginning February 4, 2021. Notice was also sent by mail to all other land owners abutting the relevant portion of the road allowance. A public meeting was held on March 9, 2021.

It is recommended Council pass By-law 2021-29 to stop up, close and transfer ownership of the unopened road allowance identified as Part 2 on Registered Plan 13R22405 to Jordan Cunningham and Madeline King, and approve the purchase price of $5,501.55 plus HST. And, it is recommended Council pass By-law 2021-30 to stop up, close and transfer ownership of the unopened road allowance identified as Part 1 on Registered Plan 13R22405 to Stanly and Muriel Prunster, and approve the purchase price of $2,297.40 plus HST.

Open Farms 2021

RECOMMENDATION: This report is for information only. BACKGROUND: Since it’s inauguration in 2018, Open Farms has seen continual growth that has positioned the event as a flagship attraction drawing thousands of visitors to the region. In 2020, Open Farms effectively adapted their delivery model in response to the COVID-19 pandemic. Through the resourcefulness of the event coordinators, the four-week virtual event was able to meet the event mandate to increase education about local agriculture and to connect consumers to local producers. Many of the participating farms are located in South Frontenac, and the municipality has supported this event as an important economic development initiative. The connections made at Open Farms provides an opportunity for relationship building between consumers and producers, and promoting customer loyalty and growth in one of South Frontenac’s leading industries. With coordination support from South Frontenac Township staff, Open Farms 2021 is well positioned to continue the success of the event and provide an opportunity to reconnect residents to their communities. The event directly aligns with South Frontenac’s 2019 – 2022 Strategic Plan, specifically the priority to “be a catalyst for the creation of vibrant, complete communities”. DISCUSSION/ANALYSIS: Lead by Alison Vandervelde, Community Development Officer, Frontenac County is adapting the 2021 Open Farms event once again to meet public health measures in place due to COVID-19. Along with a strengthened partnership with South Frontenac’s Public Services Department, Open Farms has also established new partnerships with Tourism Kingston, regional farmers markets, and other community stakeholders. This strengthened partnership will ensure South Frontenac businesses are central to the event and provide an opportunity for economic development. The event will be supported internally by the Program, Events and Education Coordinator. Event planners are coordinating a hybrid event taking place from September 10th – 12th that will feature the following in-person and virtual components: •

TOWNSHIP OF SOUTH FRONTENAC BY-LAW 2021-31 A BY-LAW TO CONFIRM GENERALLY PREVIOUS ACTIONS OF THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC. THEREFORE THE CORPORATION OF THE TOWNSHIP OF SOUTH FRONTENAC, BY ITS COUNCIL, HEREBY ENACTS AS FOLLOWS: 1.

The actions of the Council of the Corporation of the Township of South Frontenac at its special Council Meeting of June 1, 2021 be confirmed.

Execution by the Mayor and the Clerk of all Deeds, Instruments and other Documents necessary to give effect to any such Resolution, Motion or other action and the affixing of the Corporate Seal to any such Deed, Instruments or other Documents is hereby authorized and confirmed.

This By-law shall come into force and take effect on the date of its passage.

Dated at the Township of South Frontenac this 1 day of June, 2021. Read a first and second time this 1 day of June, 2021. Read a third time and finally passed this 1 day of June, 2021.
